  • New surveillance video shown to CBS News reveals the final moments before an 18-month-old girl fell to her death off a Royal Caribbean cruise ship. Chloe Wiegand was being held by her grandfather Salvatore Anello while the ship was docked in Puerto Rico in July. Prosecutors have charged him with negligent homicide. David Begnaud reports on what the video shows.

    "There was no sign or warning about not sitting on the railing." It's called common sense. The railing is the warning. That's what railings are for. To prevent people from going where they are not supposed to go and falling off edges and out of windows.

      The USA does not have a common sense law on the books hence why tragedies happen and the people that caused the tragedy or that are involved claim it’s not their fault cause they want a big fat check. Since when is it socially acceptable to receive money for the death of a person. Everyone in this case should be ashamed. No amount of money will bring her back. Clearly the parents are looking for someone to blame and extort for money.

      They said the grandfather looked first then picked up the baby and put the baby on the railing. He looked first. No way he didn't know...NO WAY.

      It didn't have a sign, because little toddlers can't reach up that high. That baby would of had the same view looking out the bottom windows. That DON'T open.

    My husband was on a jury where a family had a twin bed shoved up next to a bedroom wall in an apartment under the 2nd story window. They had kids jumping on the bed and one fell out the open window that had a lightweight aluminum screen on it and the child fell to the ground and was killed. The family sued the apartment owner and they claimed that the screens should have prevented the fall. The jury and my husband felt bad for the family but they determined that screens are designed to keep bugs out not children in. The family should have not placed the bed next to the window and shouldn’t let the kids jump on the bed. People have to protect their own kids, it’s the job of the parents.

      Randy That McDonalds incident it was reported she put it between her legs to hold it. Who is that stupid? Yes it may have been very hot but the same woman probably would have sued if it was cold. We are responsible for our own actions except the times when it is truly not our fault like my daughter was driving her red car doing the speed limit down the right lane. A Semitruck hauling beer came up behind her he was in the left lane he decided he wanted over in the right lane he hit her left tail rear panel and it flipped her car sideways in front of him he hit her again on the whole side of her car and hooked her onto his big chrome grill and bumper. He said he thought he had a blowout of a tire and he hit his brakes but he was shoving her car sideways down the road for the entire distance it took the truck to stop. He still didn’t know he had hit a car and he told the police that his brakes were bad which is against the law for a truck to drive with bad breaks. Finally after he got his rig stopped and got out he saw he had a car stuck to the front of his truck he admitted total fault. She has had 4 surgeries and she is in constant pain and she is losing control of her hands and she has brain damage. This was not her fault just very bad luck.

      Men absolutely think of danger. We just aren’t as scared and aren’t maternal but we are mentally wired and grow up wanting risks and not as afraid and like to challenge ourselves against fear, against obstacles and strength. What this man went through with his grandchild was an error and pure innocence and ignorance. I would have never placed the child up there but I understand some people would put children on there so they can be wowed by the view. We have to understand that the old man also wears glasses and is older, there’s chances he may be more oblivious to danger and a kissing glass and someone younger and more aware of surroundings. He probably noticed the care incasement of large glass panes in room and figured one pane will have missing glass’s however I’m trying to understand why you would let go of the toddler once on railing? Did he think a glass would support her body against it? And why? Wouldn’t the average person that does consider putting a child on railing for the views still hold the child throughout the moment?

    I think he actually knew that the window was open. Just like many parents would throw their toddlers up in the air, sit them on the balconies etc. He just didn't count on him dropping her. He probably thought he could hold her up and bring her back inside safely. That's what I think happened.

      So What happens when a child that just happens to stray and heads straight for that window , say a 2 or three year old , and you’re hot on there heels to catch them , cause it happens in the blink of an eye , and they trip and fall out that section of window that has no glass , should you be charged with Negligent homicide as well ? It was an Accident! That would have never taken place had there been Glass there , he was just trying to show his Granddaughter the view that’s all

      It's not common sense. Many folks do that, especially to give their arms a rest after holding the child 12 hrs a day. It's little excuse what happened, but it seems like the grandfather wanted the child to have a better view of the port. Bad decision with a bad outcome.

    The step-grandfather was clearly lying. He leaned over for 8 seconds before lifting the child over the railing and dangling outside the railing for 34 seconds. And he had the guts to say that he did notice it was open? Give me a break!

      He’s the baby’s mother’s step-father. He’s younger than his wife, about 15 years older than her daughter. The baby’s mother has said publicly she does not blame “Sam” though. She blames the cruise line. She felt cruise ships shouldn’t have windows that open for air circulation and that they should get fans instead. Here’s the thing: I’m no fan of the cruise industry. The pandemic brought to light a lot of negative issues. I doubt I’d ever go on a cruise again. However, this particular incident wasn’t on them. Anello committed a horribly idiotic and irresponsible thing. I don’t think he killed the baby deliberately. I didn’t necessarily want him to go to prison. (And now he’s made a plea, he won’t.) But the refusal to take responsibility with the claim he thought there was glass really disturbs me. I recognize family does not need to be related genetically; but ... I don’t know ...when people say he’s the grandfather, I wonder if he ever had the maturity the title implies to most people. Did he ever raise a child, assume any sort of responsibility for a child or was he just a goofball playmate? If the baby’s parents are able to forgive him, that’s their choice; but them blaming the cruise line really bothers me. It just seems like a lot of denial.

      @@Daybreaq thanks, couldn’t agree more. I’m a father and I’m usually thinking of the worse case scenario. It may be a bit paranoid but also safe. I know someone who made their grand kid a vegetable by tossing her up in the air in a playful manner and not being able to catch the baby on the way down. Things like this make me hyper vigilant.

      No small child could EVER climb up there and over the window on there own, that man knew the window was open, he thought it would be cool to feel the breeze and look out an open window, he might not have meant to have his granddaughter fall but he definitely knew it was open, he can’t be that stupid. And after she fell he claimed he didn’t know it was open to take any sort of blame off of him. He might not have meant to have her fall but he was a stupid man to place her by the one and only window open.

    Been on 10 cruises. Its very easy to tell the window is open. Just the sheer volume of wind/sound/visual coming through is undeniable.

      Cinn city I saw the video a few months ago. I don’t think he was drinking but worn out from watching the kid. When he walked up to the window and leaned against the railing and had his head out the window - in other words the window was open and he knew it. About 30 seconds later he picked her up and lifted her out the window. He lied twice and was responsible. Again he may have been worn out from watching her.

      @@shF1- LMAO, not true. I want my child safe first and foremost. The ship hadn’t left port yet yet, there was nothing to see except the cement she was going to hit. That child was ina brand new world. Everything was new, he had to put her on a railing, not even just hold her? It took me awhile to let my husband have our child alone, I think when my child is around my father or father in law I’d be more vigilant also. The safety thing never stops!

      xXWinningTheFightXx absolutely none. Everything literally has to be spelled out.
      Kind of like driving in America where there are traffic jams. The only sign on the road is a Speed Limit sign. It’s supposed to be the maximum speed you can go, but what’s the minimum? There’s no sign, so people LEGALLY drive as slow as they want, in any lane that they want so long as they don’t exceed that speed. Some states have signs that say “slower traffic keep right” but they’re posted separately from the speed limit sign. Not only that, if someone is going the speed limit in the far left lane, they have every legal right to maintain that speed even if someone behind them is traveling faster.
      Even worse, in parts where drivers are expected to Merge into another lane, drivers are never taught in any school or any driving manual who is supposed to merge 1st. So a merging car that’s already ahead of a car will almost come to a complete stop to let the car to their left pass them VS finding a comparable speed and safely merging. Not to mention people who stop their cars trying to enter a freeway via an on-ramp.
      It’s all the same. People need step-by-step instructions spelled out understandable enough for a 9 year old to comprehend. I don’t know how it got that way, but that’s just how it is.

    I can’t believe this family actually tried to sue Royal Caribbean after this man’s negligence. In the security footage, you can see him sticking his head out the window before he stupidly put his granddaughter on the rail. Obviously, he knew the window was open. But they tried to act like he thought the window was closed, which was a lie. Absolutely horrible this little girl had to fall to her death because of this man’s lack of common sense.

Was she handicapped or had medical conditions that were expensive to treat ? Were the adults in serious debt and needed a way out (They sued the Cruise Ship). A life Insurance Policy was taken out on my 8 old year sister and she was in a "accident" months later. They got $30,000.

The sadistic Female taking care of us cut her beautiful long curls into a boy's short haircut. She was asked if she still wanted Barettes. Tears pouring down her face ....she defiantly said yes. She was killed the next day in an "accident". She was buried on her Birthday....with the Barettes she wanted placed on her shaved head. They were Blue Barettes. The Woman seemed to have no control over her anger, jealousy, spitefulness and addictions. Some people are just Evil and you need to stay away from them.....especially Stalkers. There is something of value to them that they want from you or they wouldn't be stalking . The howling Wolf doesn't stalk the Lamb because he wants to be friends with it.

      I and my 17 stone weight jump up and down on a 2 inch glass floor near the top of the Blackpool Tower wherever I'm there, which is apparently unbreakable, just to scare people walking nearby.
      However even I take the precaution of making sure I'm leaning over the metal beams, just in case it does break, and I have to grab hold and stop myself falling 380ft.
      It's not cracked or broken since it was installed in 1998, but you can never be too careful with glass, no matter how safe it apparently is.

If there was a sign, I wouldn't of done it!' (which is such a dumb excuse in this case, because it's a railing; it IS the sign, besides being just common sense) Then all malls have to post signs all around; 'Do not put toddlers on/over Railings'. I mean, you don't NEED it! Signs to alert people of slippy floors, trips, hazards and other less obvious dangers fair enough.

Even the experts say that with his color blindness (sounds like he has it pretty bad) there was no way he could tell the glass was open. And all cruise ships that are newer the windows don't open like that. Probably didn't cross his mind to check for glass. I'm sure he has been cursing his colorblindness since then more then anytime in his life!

      @@Klettsedu - Colorblind people can easily distinguish dark from light. These windows were VERY dark. I've been there. They are almost as dark as some sunglasses. I'd believe the mistake if he were blind, but not colorblind. The window tint was grey.

      You're not obviously a parent. You can't watch a child every second, it took less than 3 seconds for her to fall. Birds fly into windows all the time as they can't differentiate open space and glass. Humans are the same, that's why people run into glass windows quite often.

      Ive been on a cruise ship too when I was 16 can't remember feeling air blowing inside. when I was outside on the deck yes but not inside.
      Why pick your child up and put them over railing? So they can get a better view. Kind of like when you go to the zoo kids want to stand up the glass. My daughter stood right up the glass next to a lion. If you think there is glass there then you think it's safe. You would think the glass would stop them from falling.
      What I find weird is why would the cruise ship just have one window missing glass. If all the other windows had glass then I would assume that one did too. If the cruise ship had glass in all the windows this wouldn't have happened. This was the cruise ships fault.

When we have cruised with my granddaughter we never got anywhere near a railing, never took a balcony room because the edge and the water scares us. People have even stood on those railings and fell, you can’t fix stupid. We even put a harness on our baby at Disney World I know it looks terrible but we wanted her safe and a little one can run away really fast. We are always cautious.

      @ Pam Spray common sense would have saved a life. Even if he thought there was glass, it was irresponsible and dangerous to let her play on the glass - glass is not for playing and any wise parent would consider the possibility that even if the window is shut it might not be locked, the lock might not hold, the glass could break... you never know and your child’s life is not one to gamble with by assuming that a window meant as a view has been prepped for a child to bang on.
      That said, if a person needs signs to warn them of all the common sense dangers in the world, that person should just stay in the house.

    Bull poop. I'm currently on a Royal Caribbean cruise and there is no way anyone could not know the window was open. The closed windows have a slight tint, and a breeze comes through the open ones even at port.

      This is the same thing I've been saying. You are right about being able to see the tint on the closed windows and not on the open windows. Based on the cruise I went on if the windows didn't open people would be dying from the heat under those canopies.

    The family’s defense that the little girl liked to “bang on windows” is ludicrous seeing that the wall of windows started at the floor. The child could have safely stood in front of the windows without being hoisted up by Gramps. It looks like he wanted to give her a thrill by holding her out the window. The family is making the tragedy worse by not taking responsibility for what happened.

      Damned good point. From the video I saw it looked like gramps was leaning over the rail far enough that his head was outside the window. He did something stupid and lost his grip. The family is suing to get money from the cruise line for something that was grandpa's fault. The only point they have is that if the window weren't open he couldn't have held the child out of it, but he obviously knew the window was open.

      I've been on a cruise ship never paid much attention to the windows but to be honest I didn't think they opened and to have just one window missing glass. If that was me I would think all the windows had glass in. Why would there be just one without glass? That's the bit I find weird.

    I'm on a royal Caribbean cruise ship right now as we speak. The ship is docked at CocoKay.. I'm sitting in front of a window similar to the same ship (I'm on Mariner of the Seas) I believe he was on Freedom or independence, and I can tell you there is a very strong breeze blowing through this docked ship's window, and you can hear activities outside... I saw the video and you can see that he leaned out of the window before putting her out the window.. if she was sitting on the railing, I see no way she would have feel out the window because there is too much space in between the window and the rail... This guy is just blaming everyone but the man in the mirror..... and for anyone thinking I dont know about cruise ships, go to my page. I review staterooms when I go on cruises...

    I'm sorry but you would feel the wind in your face when the window is open, so I do not believe he thought their was glass there. I think he went to that portion because it was the only spot where there was no glass and you can get better view. It was clearly his fault and I believe he didn't mean to drop his grand daughter; but you can't sue the cruise line for your horrible mistake. I am so sorry for their loss...I can't imagine what any of them are going through. My heart goes out to the whole family, even the grandfather.

      thats why its called a hand rail not a sit rail , standers for a hand rail are very low , some lower then 50 lbs of stopping power so to sit on 1 is not a good way to get out of it ether

      He believed there was glass in front of him. From his point of view, the wall was all glass, top to bottom. It is something he was used to doing when taking her to hockey games.
      He allowed her to lean over, believing that she was going to touch the glass, and stop.
      Let's hope God is not as quick, and shallow when judging you, are you appear to be when judging others. And that goes to all other here passing judgement based on so little information.

      Seriously..The news anchor said the grand father looks over the railing first..then picks her up..So, he couldn't tell if the window was open or closed at that point?..Secondly if the window was closed and she is atop the railing, he should have had a firm grip on her..That baby would've been injured from falling off the railing near him...He had a lapse in judgement and her parents should've left it as such versus suing the cruise line..Now, they have opened up an investigation because of his negligence.

    “No sign” is a bs argument. When I went on a cruise a few years ago, there was a rule when we signed up saying don’t do anything on railings.
    Swear this family would probably be the same if their child fell in a lion pit at a zoo then try to sue the Zoo.

If we tried to make the world virtually impossible to have an accident with signs, we would not be able to navigate through any space due to the 1000's of signs covering every single possible scenario. Are there signs on bridge abutments on the highway stating "do not drive into this structure at XX speed, or XX speed or.....and so on?

    Those guard rails on ships are there for a reason, to protect the passengers., they are not meant to be sat upon.. they are not toys to be climbed up on or played with.
    I can’t imagine why anyone would lift their child up and place them on a guardrail. It’s a very sad situation yet one that’s preventable. I hope people learn from the grandfathers mistake
    (My heart goes out to him) but it’s never a good idea to place your child up on the guard railing. No sign should be necessary, commonsense should suffice, people should know better.

I'm pretty sure the same window is opened in the photo with the female bartender in red apron. when you are in front of the row of windows it is obvious when one is opened. There are many areas on that ship where there is a railing WITHOUT windows. What if he decided to put her over the railing there? Is the ship also at fault? Or hw about on the verandas where after the railing , it's also totally opened...The truth is that he should not have stuck his body out the window to check it and THEn put her over the railing. The open window is incidental.

      It makes you think what the family attorney told the reporter in this video or the reporter just intentionally embellishing information. The grandfather did not look at window just for a second ( it was 8 seconds) and he did not hold her for only 5 seconds (more like 34 seconds) the lawyer is either spinning information in to their favor and telling that to reporter or showing a cut version of video. Or the reporter is spinning a story for viewers to be more sympathetic to the family.

      I remember being at The Fair and here weren;t many people and my mother took my toddler son to see the horses and she looked away for a minute and someone took my son... He thought he was lost... When she told me I was panicked, but I didn;t blame her... The man had taken him to the OFFICES and they paged about the kid in the rainbow shirt... Amen... Things happen... They used to call them accidents and noone was TO BLAME and HELD ACOUNTABLE ... But this resulted in a death so of course it would be more in-depth... I hope he didn't suffer a lot going through all the legalities, and his family would go through all that with him, after losing her... Terrible

    There has been additional security footage released showing the grandfather leaning out of the same window prior to lifting the child over the railing of the same window. Hard to believe he didn't notice the window he was just leaning out of didn't have any glass.

      @Wray Rae that’s an average of 15 falls per year out of tens of millions of passengers per year. For example, in 2013 21.12 million people cruised; with an average of 15 falls, that’s a 1 in 1.4 million chance of falling and that’s not counting that at least some of those falls were the fault of the passenger (as was the case here). I don’t know everything there is to know about cruising but the stat you provided doesn’t prove your point because, as you should know, stats have to be taken in context.

    It has nothing to do with whether glass should’ve been there or not. A blind person can feel and sense there’s no glass. You feel the wind and can smell air ocean is in front of you. It was a tragic mistake of him leaning too forward.
