A lot of times to achieve a specific color, they need a specific base coat. I have to wonder if the painter applied a generic primer, or no primer, followed by the color. Think of painting your kitchen wall. If the primer is white, the color will be X, but if the primer is a dark gray, the color will by Y even though the color came from the same can.
The Defendant keeps saying that he didn't have the plane, or any other pieces of it, to match the color to, but Plaintiff brought the cowling that was painted the ORIGINAL color... so if the Defendant had that color matched, it shouldn't be a different color... it's really not that hard... IMO...
the only way to perfectly match paint is to use the exact paint brand and color labeled on the paint container last used , but trying to color match paint using computers or eyeballing it is not a exact science and not a guarantee of a perfect match . i have been a painter for the last 20 years . and also there was nothing stated in their agreement that the painter had to use paint that would perfectly match other existing paint on parts that would not be painted .
He picked the color twice and admitted he didn’t look at it because he had other things going on. It’s not the painter’s fault. Final call and the pain color is always with the customer. No different than when you go to Home Depot and pick out a color and you don’t like it later it’s not Home Depot‘s fault you chose wrong. Really, after multiple emergency landings and a crash… the paint color is the least of his worries.
Plaintiff seems like an interesting guy. Hang gliding for 40 years and 30 years flying around in an ultralight? Has a 'life wish' indeed, has to be totally free flying around doing his own thing.
I think he was just trying to warn him he was right there behind him but simultaneously keep his arm from hitting the camera. Was a little unprofessional though lol
it sounds like he had the thing done, assumed it was fine and then didn't look at it assmebled until much much later at which point he discovered the problem. I kinda empathize with him since I'm the guy who orders a buncha stuff online and then doesn't look at it until the day before I would need to return it.

I bet the friend the Plaintiff brought was the person buying the plane. The Plaintiff liked it but his buyer didn't like the 2 tones of purple so the Plaintiff was trying to get a new paint job for free. Regardless, the Plaintiff had numerous chances to reject the color so, not the Defendant's fault.
Color matching is an art on a car you have a code that tells you which colors to mix to match the cars paint it never matches and the painter has to play with it. without a code your just guessing which tints to mix, Dark or light primer underneath, the more coats you apply the darker the color will be. I've never heard of some magic scanner that can do what takes painters years of experience to do and clearly the scanner is worthless
He said he was only painting it to sell it, I would say, if it hinders a sale he should be reimbursed, but if he's selling it, and it sells, what does he care what color it is???

The contract was not breached. They completed the contract. You believe the color doesn't match because that is the plaintiff's word today. He has a duty as a customer within the contract to say he was dissatisfied with the color at the time. He admitted in court that he was negligent. (07:38) She ruled that way because he never spoke up in the time to speak up. JM said the Plaintiff had 3 times to speak up. So, the plaintiff not noticing quick enough is actually the sole reason the contract wasn't breached.
Not my plane but I would have noticed the different colors without having all the pieces together. And plaintiff said he took him the piece sanded and prepped. So how the hell you supposed match colors when a piece has been sanded??
