    Fali Nariman, who is widely considered India’s greatest living expert on the constitution, says: “The Opposition is the most important part of the Parliament” and it is its duty to “attack the government and individual ministers” but, he adds, “the Opposition has no right to obstruct in the sense of making parliament barren or unproductive”. Mr. Nariman has also said that the situation today is like the emergency of 1975 except behind a veil. However, he agreed that one critical difference between the situation today and during the Emergency of Indira Gandhi’s time is that today there’s an anti-muslim, anti-minority mood prevailing, if not increasing, in the country. Mr. Nariman said this “does not gel with India’s prominence in world affairs”.

      Thanks to Covid vaccination developed within a year by the Modi government. It is always a pleasure to receive a criticism from a former Supreme Court judge knowing fully well his life was extended thanks to domestic vaccine!

      ​@@chander3338yes thanks, Government did very unexpected things , extra ordinary, but I think it's the scientists and Bharat biotech they deserve the praise. They could have sold the vaccines For higher profits to the world but they called government to literally give it as almost a charity. The CEO of Bharat biotech could have become one of the Richest person ever lived. Government provided machinary of logistics and distribution not development. Scientists went through all the possible conditions and combinations of mRNA that can destabilize the SARS COVID viruses in a cell. All were private scientists. Bharat biotech is the unsung, forgotten worth appreciation company for development . Government had almost no job in lock down , they provided logistics and distribution. Thank you. When we can praise the Government when it does small goodness then why can't we criticise it in cases of undisciplined behaviours and unfulfilled promises.

      Soli Sorabjee & Fali Nariman were neutral only when congress was in power but when bjp came to power Sorabjee caved in to the lure of the office of Solicitor general and this time it was Fali whose son got appointed as judge to the Supreme Court…One just can’t recall Fali arguing against this present dispensation in any case although there were many instances particularly of abuse of human rights and freedom of speech wherein Fali could have taken on this government…..

      Are you unable to see how much of time and tax payers money is being wasted in conducting elections throughout the year when the time of the elected representatives and the money can be put to better use for the benefit of the people. What is the disadvantage of holding both state and national elections. The advantages of holding both state and national elections at the same time far outweighs holding them separately. Think about it.

    Ranjan Gogoi is not eminent judge but an agent of BJP which we came to know after his retirement. When many eminent judges talk about Basic Structure of the Constitution, Ex CJI Ranjan Gogoi is against the Basic Structure of the Constitution. Very alarming for Indian Constitution and democracy.

    If they had spine then they wouldn't have been appointed. Look at justice chandrachud he is giving judgements/comments or hearings only on those cases which more theoretical or doesn't go drastically against the government. Most of important cases are not even heard in court.

      The most notable case in this context is that of Tlthe former CJI Justice Ranganath Mishra, who was appointed chairman of the National Human Rights Commission after his retirement in 1992. He became a member of the Rajya Sabha in 1998 as a Congress member; he had earlier headed the commission of inquiry into the riots in the capital following Indira Gandhi’s assassination. The commission exonerated the Congress party in the 1984 carnage against Sikhs.

      In the contemporary scene it is Mr Ranjan Gogoi who claimed his reward of a Rajya Sabha seat for judgements favourable to this government, climaxing with the Ayodhya case wherein he contradicted himself.     "We" has a completely different meaning for the present rulers. We had taught about Gandhiji, Nehru and many prominent leaders of yesteryear respectfully as grandfathers to our kids. But can the most "so called" powerful Indian PM today be taught to kids as such. Highly questionable!!! Here lies the real meaning for "We".

      'We' is indeed different for Modi when compared to Gandhi and Nehru. Gandhi's last fast was for putting pressure to release 55 Crore rupees funds to Pakistan. Nehru didn't adhere to the Nehru-Liaquat Pact and see that the population exchange happens to the full like Dr Ambedkar strongly advocated for. Crores of Hindus have suffered unspeakable atrocities in Pakistan, and Modi brought about CAA to address that.
      "We" is different now indeed.

      The original Constitution had illustrations of Lord Rama, Krishna and Buddha. These illustrations were by famed artist Shri Nandalal Bose. Subsequently someone tampered with the Constitution and deliberately reprinted the Constitution without these illustrations. Had the illustrations retained nobody would have questioned the rebuilding of Ram Temple in Ayodhya.

    Thanks for the interview. The observation during the course of the interview that the “coalition” governments will better protect the constitution rather than the “majoritarian “ governments. is iindeed true. But it will be so at the cost of stability which is also equally important for the progress of the country.

    Mr. Nariman, I appeal to you to take up the cause of a common man. I, as a citizen, am not entertained by the bureaucracy to redress my grievance. The bureaucracy doesn't reply or take action on my grievance. There is no "Citizen Charter" even after 75 years of independence. Great people like you and Karan are silent all these years. You sit on judgement on issues that don't affect me directly. I agree it may affect me indirectly and in the long run.

    I fully agree with Fali Nariman and agree with his one specific view. If the Constitution were to function rightly without pro Govt Judges then JUDGES themselves have to ensure that nothing is done against the Constitution by the Govt, and they must act fearlessly and independently. Judges must also stand up for their own rights which is not practiced at present.

    Autocracy versus democracy ..its only when we loose freedom we will begin to value what we lost .being under the control of one leader for every thing starting from schooling to marriage to life in general is unimaginable. corruption is economic in nature while autocracy will take away our basic nature of human being to be free ..we need to appreciate democracy we cant leave our future generation without freedom to grow and prosper.unfortunate
