Just a little add up on the situation. In legal mindset's live from yesterday where he looked into japanese law, he found out that Nijisanji is probably breaking multiple of them.
Nijisanji is so screwed. Not only does Doki have a case, but their reputation is in shambles. I hope Doki takes Nijisanji to court and scores big. She deserves to have the last laugh. I also hope that the Livers were blackmailed into doing that PR stunt and they can mend their relationship with Doki so that they can at least have their friendship and they can bounce back from their tarnished reputation. The yacht is sinking and it is a beautiful thing. I would ask that you continue covering this, but this is way too juicy for you not to.
The way Nijisanji is talking about Doki Bird they literally just opened themselves up to a Japanese defamation lawsuit. If you look up cdawgva clips he talks about how he can't discuss this since he is afraid that they will come after him.
But remember these Japanese companies are super scummy using law to advantage. Even if you prove it 100% true very high chance the court will side with the company even then they can drag the lawsuit for years to bleed you dry.
Biggest difference between Holo and Niji is that Holo seems to understand that fans follow the TALENTS first, not the company. And they have come to understand that the best way to strengthen the company is to provide stability and support for the Talents. They aren't perfect by any stretch of the imagination, and they have made significant mistakes in the past - but they are adapting. Hell, Holo put out some people from Management (A-Chan, Yagoo, Jenma, etc.) into the public sphere to humanize them, and show a good relationship (working and personal) between Talents and Management to solidify the image that Management works for the benefit of the Talents. Even if this isn't true behind the scenes (just being cynical here, not making any specific claims), the public image of Holo is of a company who supports their public talent. Western fans LOVE this idea. Niji... seems to be of the opinion that Fans support NIJISANJI first and foremost, and the talents are just the way that fans show their support. Even removing as much cynicism as I can, it really does seem that Niji believes the Talents are interchangeable - oh, you liked Mika, and she's gone now? Why are you upset, we have... 15? 20? other female Livers, just pick one and buy merch. Mika was cute funny black hair spoke English had an accent aaannnnddd... Even de-emphasize superchats if Niji gets too much of the split, but spin it as being out there for the fans, keeping their best interest in mind. "Voice packs are a better support than Supers - you pay less, yet I keep more. A 20$ Supa, I get $5, a $10 voice pack, I get $5." kind of deal, but being careful not to break any clauses in your contract. When there are delays due to management, go HARD on those - "Permissions take time, man, gotta jump through all the right Management hoops. This will get done when Management wants them done.- don't worry, I'll keep you updated. (then update weekly with "Still no permissions guys, sorry, these things take time." etc)" and the like. you'll enrage your audience, you'll push them to demand you leave... and then negotiate a way out of Niji while the rage is simmering - then when you leave, your fan base will come with you because they support YOU, not Niji.)
It is important to note that Legal Mindset ultimately has advised that Doki's best choice is to NOT sue. And in fact that the best thing they can do is play Defensive because Nijisanji is the one screwing up everywhere. Furthermore, to the people who dismiss Legal Mindset because they disagree with his polistics, which he has never brought up in regards to his objective analysis of the law, was also supported by a pro bono Canadian lawyer who ultimately agrees with all the same key points, being that Doki shouldn't sue and that she's doing everything correctly right now. As for how good or bad a case she has, both of them also agree that there is no guarantee of victory either way, there are too many random elements. Who is the judge, who is the lawyer, how well they voice their argument, how much money they have, whether NIjisanji will or won't screw up, or play legal games, or if someone has a bad slip-up or writes something wrong or makes an argument badly in paper or in writing. And also that the result of it will put Doki's personal information at risk. Just a head's up, because there's a bunch of idiots going But the Lawyer's a grifter or I don't like his politics so don't believe what he says or the stupidest one being He's anti-Disney and therefore has no legal knowledge despite the fact that he was on the money about Disney unceremoniously losing their federal case, which did happen. Legal Mindsets first stream on it was 7hrs long followed by another 7hrs the next follwed by a hr stream the next day with Fakse EyeD followed by a 3hr stream the next day where he broke down the Japanese business culture followed another2-3 hr stream breaking down Japanese law and how it applies. mans on fire oh and he has a regular Law job at the same time. gotta resoect the hustle

Legal Mindset also thinks that a lawsuit is unlikely, and a court case even less so. When discussing the choice of venue, among other things, he is simply discussing possibilities. Legal Mindset actually talked about this Nijisanji Dokibird stuff for well over 20 HOURs across various streams. He even had False EyeD and Rima Evenstart on one of them to talk them about it and get the Vtuber perspective since he is not all to familiar with vtubers in general. This drama has actually been his intro to vtubers for the most part. Was a pretty cool stream, what I caught of it anyway. On another note, there is something that no one is really talking about. The long term damage to Niji. Let's say we get past all the Dokibird drama, it all get settled and dealt with. Even if that happens, this case has blown up on a level that has not really been seen before. And Niji, no matter what happens at this point, their reputation is SHOT. How many people are going to be willing to sign on with them, at least on the EN side, after this? This could completely destroy the EN side of things. And if they DO bring a case against Dokibird about the contract violations, and even if they win it it will only make things worse. This stuff may fly in Japan, different culture and different laws, but in the west it doesn't. If they bring Doki to court over this, even if they win the contract stuff, most people on the EN side will see it as another attack. Another attempt to to smear and damage Doki and drag her through the mud. Because they MAY be technically right about the contract violations under Japanese law, but they are dead wrong about the morals and ethics of it under western culture. To say nothing of western law where expectations and what is allowed by the corpos is VERY different. Nijisanji needs to shell out the money for actual experienced PR experts that are either western or familiar with western culture. And they need to shell out for GOOD lawyers for the same reasons. I can't say if their Japanese lawyers are good or not. But it is clear that they don't have anyone who is overly familiar with laws in places like the USA or Canada. And finally, if any prospective vtuber out there is looking to sign on with these big corpos, hire a lawyer. Preferably one that is good at or specialized in contract law. It may cost you, but it is for your own protection. And will possibly save you a lot of grief down the line. A lot of these contracts are incredibly unfair, and its not just Niji that does this. And a lot of that unfairness can be hidden in corporate and legal jargon thar the average person isn't going to understand. And anyone signing a contract should ABSOLUTELY understand it before doing so. Otherwise a violation is almost inevitable. To say nothing of how they use these contracts to screw you over.

Before Ruth (King David's great-grandmother) could marry Boaz he had to work out a legally binding deal with Naomi's closest relative (Naomi was Ruth's mother-in-law from her marriage with one of Naomi's sons who had died). Boaz had a claim to be able to marry Ruth because he was related to Naomi too, just not as closely related as the other guy. The deal involved purchasing land that Naomi owned; however, Ruth had to be part of the deal and the relative had to marry her. However, since the relative was already married (and he probably didn't want the headaches of having two wives) Ruth could marry Boaz after he purchased the land from Naomi. The whole deal was a bit more complicated than the way I'm explaining it, but you get the gist of it here. There is a lot of wheeling and dealing with legal consequences in the Old Testament, both involving individuals to treaties involving whole nations. People who dismiss the Bible as "fairytales" miss out on a lot of IRL stuff by doing so.
Much of the Bible is a fictional story with sprinkles of history in it. One has to take a deep dive to separate the BS from the truth, and usually its just better to spend that time going with a secular source. There really isn't a loss to ignore the Bible, outside of understanding Christian culture. The first two books, Genesis and Exodus make a lot of statements that is at best extremely flimsy and at worst, provable false. Such as the Creation Story, The Ark, and the Exodus from Egypt.

Another Lawtuber, Runkle of The Bailey, who is a Canadian lawyer clarified some stuff about PIPEDA and I think he concluded that even if Dokibird brought a claim against Niji under PIPEDA and it made it past motion to dismiss, they can't actually compel Niji to appear in Canadian court so it likely wouldn't go anywhere. And the maximum reward she could get from that would be $20,000(CA), so not really worth it to take it to court anyway.

The thing with legal documents is, at least in the States, that vague contracts can be thrown out. It's why contracts are so long and complicated - because they have to pretty much specify things very black and white. The other thing is, I don't think you can go after someone for 3rd Party copyright without being the copyright owner whose been violated. For example. If they say, 'well she said Poke'mon in her stream' and it's not specified that she cannot talk about Nintendo / Poke'mon Company specifically, I feel like the judge is going to ask if that company has asked for discipline/threatened legal action/asked them to keep their name out of it and if so - why it's not documented clearly.
Runkle of the Bailey who is a Canadian lawyer and knows the Canadian laws that apply, has also covered and would he said cover more legal stuff if there is more legal to cover so he would probably also analyze a nijisanji contract if he got one.
What I've never understood is, if the contract is terminated then that means all clauses of said contract are now null and void. So why can't people speak out? I get NDAs, but an NDA does not apply if there has been literal illegal activity or abuse. If the company themselves have mistreated the person in question, an NDA doesn't stop someone being able to speak up.
Certain clauses still are in effect. It’s why certain types of jobs include non compete clauses for a specific amount of time after you leave the company.
This guy is definitely a better fit than Legal Eagle. Legal Mindset is familiar with anime culture already, and he has background in corporate legal counsel.
I'm glad you've seen LM. He's been sucked into the Vtuber world after covering the termination of Selen Tatsuki. Ian Runkle, a Canadian Lawyer on TH-cam (Runkle of the Baily), put a pretty sharp pin in any Canadian Privacy actions. Basically, like all things Canadian, we're all Bark, and unless Niji actually comes here and stands still, we're no Bite. (And there's no way for us to compel Niji to come here for this) He didn't speak to very much else in the case overall, as he doesn't have experience in Japan or in cases like this, he was focused mostly on elaborating on Canadian Law... and kinda sorta politely telling other lawyers "Thank you for your service, please let me take it from here." and less politely telling the 39 non-Lawyer ...s... that maybe someone should commission a companion piece to a recent fan-art, but replacing "Nijisanji" with a representation of themselves. Not to diminish Andrew Esquire's take on this, only to elaborate on a section of law Andrew himself stated he was not versed in.
Frankly, and I am on selen side, court battle would be pointless. Large corps have the resources to drag this out for years and with her being under nda it will be hard handle her case. From what we seen niji is looking at some fines and a wrist slap if doki wins vs the 1 million plus in court cost being in two countries with different languages. Yea, I'm a little annoyed with how Mindet just blows off this criticsm saying that it doesn't matter because he never recommended Doki try a lawsuit, but he clearly thought that Canadian law was a hell of a lot more rubust then it actually is. I don't think Mindset was wrong to think that, because the summery of the law suggests it would be pretty strong, but he still just read the summery, and didn't do a deep dive into the laws regarding this. He really should be thanking Runkle for the work, but he just glosses over it. Also, Mindset seems to be wrong about Selen being an employee, according to Canadian law. Runkle feels she counts as an independent contractor. Not that it matters, because the laws are toothless either way. She probably does count as an emplyee under Japanese law but suing under Japanese law is a no go either way (could be important if Niji is the one suing though). One thing I didn't think Runkle expanded upon properly is why Doki's lawyer isn't a moron for releasing the full documents to Niji. There are no laws protecting the infomration, appererntly, so why Trust Niji would keep them private?

IF niji were dumb enough to try to drag this out (further lowering their reputation in the west), and draw her into a contract breach lawsuit in Japan she has protections. How can you say suing under Japanese law is a no go? If niji decided to initiate a legal case, it would either be breach of contract, or defamation. For both of those, Japan is where they would happen. Runkle makes good points about Canadian stuff but he clearly doesnt deal with international issues which Legal Mindset does, all the time. Ultimately the 2 of them agree on the important stuff anyways, it is not worth it for Doki to initiate and it seems her lawyer has advised her to let it go and just stay on defense if niji attacks.
@@logikx1325 The whole thing about suing in Japan is the cost, plus Mindset talked about how foreigners are at a massive disadvantage over there. She'd spend a ton of money, up to 500k and would likely lose anyway, so suing in Japan would be a bad move. It would be better if she could sue under canadian law, but Canada is toothless. So, it's best not to sue.

Any kind of lawsuit would be completely ''not worth it'' as far as Doki is concerned. The Canadian PIPA and PIPEDA laws won't be as hard hitting as we'd like. However, he does also refute the potential of doxxing - meaning what Elira said is complete BS, doxxing was never going to have been an issue.
Yeah, I had a feeling that this was going to be an issue showing what were supposed to be confidential legal documents. It was supposed to be between DokiBird’s lawyer(s) and Nijisanji’s lawyer(s). Nijisanji’s lawyer(s) violated the confidentiality of said documents.
Except that like the lawyer pointed out in japan they don't have the same duty of confidentiality as in the west, so unless niji's lawyers confirmed in writing "we will not disclose this info with anyone" they won't really get punished for it.
Without all of the previous 'strange' cases at Nijisanji EN Selen's termination would not have stood out remotely as much, and thus the backlash would've been minimal. However due to the steady increase in popularity of Vtubers in the western market, these PR disasters which would typically be forgotten about in the span of a few weeks in Japan have now gone global. People are not going to forget this crap for a long while. If there is no 'actual' lawsuit and they attempt to go the arbitration route they would be better off settling with her and closing their collective mouths, that would include stopping talents from making snide remarks in their streams. Otherwise if Doki did have to go at them via lawfare a PIPEDA lawsuit would end up doxxing all of the talents the document was shared with, and they would be able to get discord messages and network connections as a result of discovery. Which could end up sinking the entire EN branch as I doubt they want all (or some) of their active talents IRL identities publicly known. Doki would lose her anonymity as well which would be terrible (and I hope it doesn't come to that), but I would argue Nijisanji has far more to lose as its investors would see the rapid and uncontrolled implosion of an entire branch along with the resulting nuclear detonation of backlash (from all of those talents fans) as a sign of severe incompetence (and stock insecurity). Whereas previous branch closures were done like a shifty card trick. If there is one thing Japanese corporations fear more than anything else its their own investors.
Wouldn't releasing the termination to the public before even contacting Selen/Doki about it also be a violation of PIPEDA, then, since that can be understood as a disciplinary action, which she wasn't even aware of yet and didn't agree to be released to the public?

Its been like 2 years since i last saw anything related to vtubers or vtubing in general. So when this story breaks out, it immediately got my interest, and man im thankful i wasnt a nijisanji watcher. In legal mindset's live from yesterday where he looked into japanese law, he found out that Nijisanji is probably breaking multiple of them.
Nijisanji is so screwed. Not only does Doki have a case, but their reputation is in shambles. I hope Doki takes Nijisanji to court and scores big. She deserves to have the last laugh. I also hope that the Livers were blackmailed into doing that PR stunt and they can mend their relationship with Doki so that they can at least have their friendship and they can bounce back from their tarnished reputation.

The way Nijisanji is talking about Doki Bird they literally just opened themselves up to a Japanese defamation lawsuit. If you look up cdawgva clips he talks about how he can't discuss this since he is afraid that they will come after him.
But remember these Japanese companies are super scummy using law to advantage. Even if you prove it 100% true very high chance the court will side with the company even then they can drag the lawsuit for years to bleed you dry.
Even then the lawsuit for Defermation is usually rigged in the company's favour remember that.
Biggest difference between Holo and Niji is that Holo seems to understand that fans follow the TALENTS first, not the company. And they have come to understand that the best way to strengthen the company is to provide stability and support for the Talents. They aren't perfect by any stretch of the imagination, and they have made significant mistakes in the past - but they are adapting. Hell, Holo put out some people from Management (A-Chan, Yagoo, Jenma, etc.) into the public sphere to humanize them, and show a good relationship (working and personal) between Talents and Management to solidify the image that Management works for the benefit of the Talents. Even if this isn't true behind the scenes (just being cynical here, not making any specific claims), the public image of Holo is of a company who supports their public talent. Western fans LOVE this idea.
Niji... seems to be of the opinion that Fans support NIJISANJI first and foremost, and the talents are just the way that fans show their support. Even removing as much cynicism as I can, it really does seem that Niji believes the Talents are interchangeable - oh, you liked Mika, and she's gone now? Why are you upset, we have... 15? 20? other female Livers, just pick one and buy merch. Mika was cute funny black hair spoke English had an accent aaannnnddd... Scarle cute funny black hair speaks English has an accent GO! Like vTuber fans are like Sony fanboys, or Nintendo supporters - it says Sony, we buy, doesn't matter what. Nintendo, same deal. Link, Mario, Ash, Samus, irrelevant, it's all Nintendo. This is part of what Western fans HATE about "Capitalism", and with every passing controversy with AnyColor, it solidifies AnyColor as a perfect example of the evils of "Capitalism".
(if I were giving any advice to NijiEN Livers... I'd be advising them to do everything they can to play this up. AS LONG AS IT'S TRUE, play up all of the bad stereotypes of Niji - go HARD on shilling for the Voice Packs, making sure everyone knows that Merch is NOT the best way to support you. Even de-emphasize superchats if Niji gets too much of the split, but spin it as being out there for the fans, keeping their best interest in mind. "Voice packs are a better support than Supers - you pay less, yet I keep more. A 20$ Supa, I get $5, a $10 voice pack, I get $5." kind of deal, but being careful not to break any clauses in your contract. When there are delays due to management, go HARD on those - "Permissions take time, man, gotta jump through all the right Management hoops. This will get done when Management wants them done.- don't worry, I'll keep you updated. (then update weekly with "Still no permissions guys, sorry, these things take time." etc)" and the like. you'll enrage your audience, you'll push them to demand you leave... and then negotiate a way out of Niji while the rage is simmering - then when you leave, your fan base will come with you because they support YOU, not Niji.)
Definitely recommend checking out the VODs for this. A lot of interesting stuff both regarding Canadian and Japanese Law.
It is important to note that Legal Mindset ultimately has advised that Doki's best choice is to NOT sue. And in fact that the best thing they can do is play Defensive because Nijisanji is the one screwing up everywhere. Furthermore, to the people who dismiss Legal Mindset because they disagree with his polistics, which he has never brought up in regards to his objective analysis of the law, was also supported by a pro bono Canadian lawyer who ultimately agrees with all the same key points, being that Doki shouldn't sue and that she's doing everything correctly right now.
As for how good or bad a case she has, both of them also agree that there is no guarantee of victory either way, there are too many random elements. Who is the judge, who is the lawyer, how well they voice their argument, how much money they have, whether NIjisanji will or won't screw up, or play legal games, or if someone has a bad slip-up or writes something wrong or makes an argument badly in paper or in writing. And also that the result of it will put Doki's personal information at risk.
Just a head's up, because there's a bunch of idiots going But the Lawyer's a grifter or I don't like his politics so don't believe what he says or the stupidest one being He's anti-Disney and therefore has no legal knowledge despite the fact that he was on the money about Disney unceremoniously losing their federal case, which did happen. Disney got their federal case dismissed without even getting a chance to start going into court.
And ultimately, Legal Mindset did state he wasn't an expert of Canadian or Japanese law, just that he would be able to set a higher bar than the random commentators online.

Legal Mindset also thinks that a lawsuit is unlikely, and a court case even less so. When discussing the choice of venue, among other things, he is simply discussing possibilities.
Legal Mindset actually talked about this Nijisanji Dokibird stuff for well over 20 HOURs across various streams. He even had False EyeD and Rima Evenstart on one of them to talk them about it and get the Vtuber perspective since he is not all to familiar with vtubers in general. This drama has actually been his intro to vtubers for the most part. Was a pretty cool stream, what I caught of it anyway.
On another note, there is something that no one is really talking about. The long term damage to Niji. Let's say we get past all the Dokibird drama, it all get settled and dealt with. Even if that happens, this case has blown up on a level that has not really been seen before. And Niji, no matter what happens at this point, their reputation is SHOT. How many people are going to be willing to sign on with them, at least on the EN side, after this? This could completely destroy the EN side of things. And if they DO bring a case against Dokibird about the contract violations, and even if they win it it will only make things worse. This stuff may fly in Japan, different culture and different laws, but in the west it doesn't. If they bring Doki to court over this, even if they win the contract stuff, most people on the EN side will see it as another attack. Another attempt to to smear and damage Doki and drag her through the mud. Because they MAY be technically right about the contract violations under Japanese law, but they are dead wrong about the morals and ethics of it under western culture. To say nothing of western law where expectations and what is allowed by the corpos is VERY different.
Nijisanji needs to shell out the money for actual experienced PR experts that are either western or familiar with western culture. And they need to shell out for GOOD lawyers for the same reasons. I can't say if their Japanese lawyers are good or not. But it is clear that they don't have anyone who is overly familiar with laws in places like the USA or Canada.
And finally, if any prospective vtuber out there is looking to sign on with these big corpos, hire a lawyer. Preferably one that is good at or specialized in contract law. It may cost you, but it is for your own protection. And will possibly save you a lot of grief down the line. A lot of these contracts are incredibly unfair, and its not just Niji that does this. And a lot of that unfairness can be hidden in corporate and legal jargon thar the average person isn't going to understand. And anyone signing a contract should ABSOLUTELY understand it before doing so. Otherwise a violation is almost inevitable. To say nothing of how they use these contracts to screw you over.

Very true, and these contracts were based on established laws perhaps even before the time of Moses. Before Ruth (King David's great-grandmother) could marry Boaz he had to work out a legally binding deal with Naomi's closest relative (Naomi was Ruth's mother-in-law from her marriage with one of Naomi's sons who had died). Boaz had a claim to be able to marry Ruth because he was related to Naomi too, just not as closely related as the other guy.
The deal involved purchasing land that Naomi owned; however, Ruth had to be part of the deal and the relative had to marry her. However, since the relative was already married (and he probably didn't want the headaches of having two wives) Ruth could marry Boaz after he purchased the land from Naomi. The whole deal was a bit more complicated than the way I'm explaining it, but you get the gist of it here.
There is a lot of wheeling and dealing with legal consequences in the Old Testament, both involving individuals to treaties involving whole nations. People who dismiss the Bible as "fairytales" miss out on a lot of IRL stuff by doing so.
Much of the Bible is a fictional story with sprinkles of history in it. One has to take a deep dive to separate the BS from the truth, and usually its just better to spend that time going with a secular source. There really isn't a loss to ignore the Bible, outside of understanding Christian culture.
The first two books, Genesis and Exodus make a lot of statements that is at best extremely flimsy and at worst, provable false. Such as the Creation Story, The Ark, and the Exodus from Egypt.

Another Lawtuber, Runkle of The Bailey, who is a Canadian lawyer clarified some stuff about PIPEDA and I think he concluded that even if Dokibird brought a claim against Niji under PIPEDA and it made it past motion to dismiss, they can't actually compel Niji to appear in Canadian court so it likely wouldn't go anywhere. And the maximum reward she could get from that would be $20,000(CA), so not really worth it to take it to court anyway.

The thing with legal documents is, at least in the States, that vague contracts can be thrown out. It's why contracts are so long and complicated - because they have to pretty much specify things very black and white. The other thing is, I don't think you can go after someone for 3rd Party copyright without being the copyright owner whose been violated.
For example. If they say, 'well she said Poke'mon in her stream' and it's not specified that she cannot talk about Nintendo / Poke'mon Company specifically, I feel like the judge is going to ask if that company has asked for discipline/threatened legal action/asked them to keep their name out of it and if so - why it's not documented clearly.
Runkle of the Bailey who is a Canadian lawyer and knows the Canadian laws that apply, has also covered and would he said cover more legal stuff if there is more legal to cover so he would probably also analyze a nijisanji contract if he got one.
What I've never understood is, if the contract is terminated then that means all clauses of said contract are now null and void. So why can't people speak out? I get NDAs, but an NDA does not apply if there has been literal illegal activity or abuse. If the company themselves have mistreated the person in question, an NDA doesn't stop someone being able to speak up.
Certain clauses still are in effect. It’s why certain types of jobs include non compete clauses for a specific amount of time after you leave the company.

Ian Runkle, a Canadian Lawyer on TH-cam (Runkle of the Baily), put a pretty sharp pin in any Canadian Privacy actions. Basically, like all things Canadian, we're all Bark, and unless Niji actually comes here and stands still, we're no Bite. (And there's no way for us to compel Niji to come here for this) He didn't speak to very much else in the case overall, as he doesn't have experience in Japan or in cases like this, he was focused mostly on elaborating on Canadian Law... and kinda sorta politely telling other lawyers "Thank you for your service, please let me take it from here." and less politely telling the 39 non-Lawyer ...s... that maybe someone should commission a companion piece to a recent fan-art, but replacing "Nijisanji" with a representation of themselves.

Frankly, and I am on selen side, court battle would be pointless. Large corps have the resources to drag this out for years and with her being under nda it will be hard handle her case. From what we seen niji is looking at some fines and a wrist slap if doki wins vs the 1 million plus in court cost being in two countries with different languages. People forgot that her lawyer was more for protection
Yea, I'm a little annoyed with how Mindet just blows off this criticsm saying that it doesn't matter because he never recommended Doki try a lawsuit, but he clearly thought that Canadian law was a hell of a lot more rubust then it actually is. I don't think Mindset was wrong to think that, because the summery of the law suggests it would be pretty strong, but he still just read the summery, and didn't do a deep dive into the laws regarding this. He really should be thanking Runkle for the work, but he just glosses over it.
Also, Mindset seems to be wrong about Selen being an employee, according to Canadian law. Runkle feels she counts as an independent contractor. Not that it matters, because the laws are toothless either way. She probably does count as an emplyee under Japanese law but suing under Japanese law is a no go either way (could be important if Niji is the one suing though).
One thing I didn't think Runkle expanded upon properly is why Doki's lawyer isn't a moron for releasing the full documents to Niji. There are no laws protecting the infomration, appererntly, so why Trust Niji would keep them private?

How can you say suing under Japanese law is a no go? If niji decided to initiate a legal case, it would either be breach of contract, or defamation. For both of those, Japan is where they would happen. Runkle makes good points about Canadian stuff but he clearly doesnt deal with international issues which Legal Mindset does, all the time. Ultimately the 2 of them agree on the important stuff anyways, it is not worth it for Doki to initiate and it seems her lawyer has advised her to let it go and just stay on defense if niji attacks.
@@logikx1325 The whole thing about suing in Japan is the cost, plus Mindset talked about how foreigners are at a massive disadvantage over there. She'd spend a ton of money, up to 500k and would likely lose anyway, so suing in Japan would be a bad move. It would be better if she could sue under canadian law, but Canada is toothless. So, it's best not to sue.

Another lawyer called Runkle of the Bailey, who is a Canadian lawyer, has also reacted to this situation and his view isn't as optimistic as Legal Mindset's. Any kind of lawsuit would be completely ''not worth it'' as far as Doki is concerned. The Canadian PIPA and PIPEDA laws won't be as hard hitting as we'd like. However, he does also refute the potential of doxxing - meaning what Elira said is complete BS, doxxing was never going to have been an issue.

Yeah, I had a feeling that this was going to be an issue showing what were supposed to be confidential legal documents. It was supposed to be between DokiBird’s lawyer(s) and Nijisanji’s lawyer(s). Nijisanji’s lawyer(s) violated the confidentiality of said documents.
Except that like the lawyer pointed out in japan they don't have the same duty of confidentiality as in the west, so unless niji's lawyers confirmed in writing "we will not disclose this info with anyone" they won't really get punished for it.

Without all of the previous 'strange' cases at Nijisanji EN Selen's termination would not have stood out remotely as much, and thus the backlash would've been minimal. However due to the steady increase in popularity of Vtubers in the western market, these PR disasters which would typically be forgotten about in the span of a few weeks in Japan have now gone global. People are not going to forget this crap for a long while.
If there is no 'actual' lawsuit and they attempt to go the arbitration route they would be better off settling with her and closing their collective mouths, that would include stopping talents from making snide remarks in their streams. Otherwise if Doki did have to go at them via lawfare a PIPEDA lawsuit would end up doxxing all of the talents the document was shared with, and they would be able to get discord messages and network connections as a result of discovery. Which could end up sinking the entire EN branch as I doubt they want all (or some) of their active talents IRL identities publicly known. Doki would lose her anonymity as well which would be terrible (and I hope it doesn't come to that), but I would argue Nijisanji has far more to lose as its investors would see the rapid and uncontrolled implosion of an entire branch along with the resulting nuclear detonation of backlash (from all of those talents fans) as a sign of severe incompetence (and stock insecurity). Whereas previous branch closures were done like a shifty card trick.
If there is one thing Japanese corporations fear more than anything else its their own investors.
