The fact that he donated the bare minimum 600k estimation, combined with the fact that the *reported* proceeds went up AFTER the scandal, cements him as a scammer. His events were popping off during the pandemic and he was only reporting a little over 100k for those years. Then he gets busted as a scammer, and the following year he reports over 155k, after a massive decline in support and viewership. This combined with him "holding" the money for 10 years, and then donating the bare minimum that was estimated should be enough for him to do jail time. I hate that these white collar crimes result in slaps on the wrist. This is way more evil than someone shoplifting, or being drunk in public, but he'll get less of a punishment or no punishment at all for using his deceased mother's name to scam charity bucks from his own fans....

The guy literally had it all. Doing something he loves as a job. Part of a passionate community of gamers. Has connections to gaming companies such as Nintendo, which must be a dream come true. And I'm sure he was making a good deal of money from his content. But just had to throw it all away by either being incredibly stupid or greedy.

If you read the pleadings, TOVE didn't just lose at summary judgment. It surrendered. TOVE failed to file a response to the summary judgment motion, and then CONSENTED to having judgment entered against them. I can't possibly figure out why. If you fail to respond (and you have a defense), the first thing you're going to want to ask for is more time to respond. If you can't get that, you want to ask the other party to consent to you dismissing the lawsuit before judgement is entered. (In federal court you can't dismiss without the defendants or the courts permission once the case is underway). That way you avoid having the judge issue a written opinion describing the ways you fucked up. If the other party won't do that, you might file a motion to ask the court to just dismiss it. If you can't get that, you might at least ask the other party to withdraw (or cap) its attorney fee request in exchange for you dying quietly. Here, TOVE agreed to lose the lawsuit in exchange for NOTHING. The judge is still going to write a full opinion about why TOVE loses (and now it'll certainly contain a big pile of references to the fact that they didn't even file a response). They still lose the case. And the defendant is pursuing its attorney's fees with guns blazing. Their fees motion clearly did not pull any punches. This is TOVE running away from this lawsuit as fast as it can without much if any thought to the consequences. It smells of panic and not much else.
Here’s a good reason: Lawyers are officers of the court. A lawyer knowingly lying to a judge or in court can get them disbarred or fined. The only defense TOVE’s lawyers had at this point would require their lawyers to knowingly lie or fabricate evidence. It saved them professionally to throw in the towel and they get paid win or lose.

I wonder whether TOVE said they wouldn't pay for any further legal work & their lawyers said fine, we're not lodging anything further so it's on the brothers to respond (which they didn't do). Given the way they used the immigration lawyer's name to imply their visa scam was legit, I wouldn't be surprised if Chucklehead #2 thinks he's smart enough to dodge legal issues while avoiding additional legal costs... the consummate scammer.

The failure to respond is a huge error (I'd hate to be their lawyers right now), but it was a frivolous claim from the start and it wasn't going to go well. TOVE and the programmer had a deal. The programmer and the defendant (clearly I don't remember their names) had a deal. The defendant didn't know anything about TOVE's involvement until after everything went down. That's mostly undisputed. The disputes are mostly legal, and TOVE had a hand to play. For example: the terms of the programmer's license with the defendant (giving defendant a licensed to use the programmers work) were a part of his agreement as a USER, not a programmer. The defendant has argued that the same terms should apply, and I tend to think they're right, but there's certainly a colorable case to be made that they're two different things. The case is a loser, but not such a loser that a competent lawyer can't put up a response without breaking the rules.
I'm also no lawyer, but I have a feeling ICE might want to have a word with Mr. Khalil next, because that employment contract does not sound like a typical H1B arrangement.

I just don't understand. It wasn't even like he was blowing that money on gambling or drugs or sports cars or whatever people do with money that doesn't belong to them. He wasn't even earning any interest on it. He was just letting it collect dust and devalue with inflation. What was the point? Why couldn't he just donate it? He kinda was doing all that, passing all his expenses of who knows what kind to the charity, while claiming he doesnt touch anything. Even his own stuff wasnt adding up to the numbers being in the tax forms, he was making way more than what was reported in the form, and the expenses are suppose to be taken out and disclosed AFTER not BEFORE you deposit them, and the golf tournament money were nowhere to be found. The money in the account were there to keep appearances i guess, with who knows what plans for them down the line, they could do what most of these charities do, pay most of the proceeds as salaries to the executives, and the executives are him and his family members.
People were speculating at the time that the Jirard and his family were waiting until a certain amount of years so they could withdraw it and hopefully get away with it. Getting caught early mostly ruined that plan though.
Jirard SAID they never touched it, but he never verified that by posting a statement of that account. My theory is that they were using that account as their personal slush fund to fund whatever. The reason I think that is the fact that it took them 2 months after being exposed to donate to the foundation they already had listed as one they were working with. All the talk of taking time to find the right place to donate was horseshit, they already had it. So why did it take them 2 months? They had to get the money together because it wasn't actually just sitting in that account...doing that shit takes time.
To give a little insight on the H1B visas vs Canada's version of Work Visa(Called Work Permits here): There's almost no differences, but the key takeaway here is that the work visa/permit can/has/should be done in person/brick & mortar. Not remote nor work-at-home. The visa THEY SHOULD HAVE applied for for this individual would be called "Digital Nomad Visa", which encompasses basically any work that can be done virtually from anywhere & cooperated via the internet. IE: Art Designers, Programmers, Remote Customer Support Agents, etc. as long as they are not a citizen or permanent residents of that country. Technically they are just treated as a visitor that can work in that country for the amount of time that the visitor is allowed to stay in that given country before having to submit an extension request either electronically means or in writing. Yes, they are in big trouble vs US immigration now. lol

Just an FYI about all the objections at the 36ish minute mark, that's just a thing from depositions. They ask the questions, the lawyers object, the people answer them anyway, and then they move on. The objections are basically placeholders - if they don't object to questions during the deposition, they can't later file to have it stricken later if it is actually bad-bad.
Not an immigration lawyer, but I’ve worked in tech HR for 10 years and have worked with hundreds of H1B holders. It’s pretty common for H1 holders to be hired by contracting agencies and placed on projects with different corporate clients working under a C2C managed services contract. That said, the economics of that model only really scale properly when you’re dealing with large third party agencies that can afford to employ teams of tens or even hundreds of H1B holders at a time, so maybe this was a situation where they were trying to spin up a new line of business, or something? If so, though, they failed spectacularly.
Also, RE: it being an O visa… it’s typically EXCEPTIONALLY difficult to secure an O-type visa. You basically have to be a leader in your chosen field with niche technical knowledge that is probably difficult to find elsewhere. I’ve spent most of my career working with Meta and Google, and even companies with those resources hesitate to pursue O-type visas given the low approval rates.
Okay, so here’s my overall take: It sounds like there is some kind of system in streaming/YT where companies will sponsor H1 visas for streamers to come to the states and make content. Now when this kind of sponsorship relationship exists, the visa holder (DW) in this case, cannot work for any other employers… all work that they do has to be funneled through their sponsor (for example, the managed services contracts that I mentioned in my first comment). So from that standpoint, I can see why the Khalils might think they have a right to income that DW received… That said, it sounds like there was no pre-existing business relationship between the Khalils and OnePixel, meaning that any work that DW did was done illegally, and almost certainly violated the terms of his H1B. That said, this does not give the Khalils a right to that income, and trying to claim as much is suuuuuper shady. There are a lot of protections in place for both H1 holders and H1 sponsors, and those protections are there for a reason, because, otherwise, you could really easily see the H1 system quickly devolve into effectively being a modern form of indentured servitude. DW and OnePixel are not blameless here. DW almost certainly violated the terms of their visa and will probably end up being deported as a result. Someone in OnePixel’s HR department f**ked up royally in allowing him to gain employment without properly verifying his visa status. But none of that changes the fact that the Khalils are not entitled to the income of the employees whose visas they sponsor. DW is an employee of the Khalils, and any work he does for the company (whether directly or by way of a managed services contract with another company) he must be compensated for by the Khalils… but if he’s getting paid directly by someone else, even if that payment is done illegally, that doesn’t mean shit for the Khalils. They aren’t involved. They get nothing.
Okay, last addendum: Re the immigration fraud stuff… I don’t think they knowingly engaged in fraud from the beginning, but that they may have perjured themselves into sounding like they had. This sounds to me like they hired DW as a streamer, and found out that he was doing work on the side and are trying to claim their slice of the pie, while having 0 idea about how H1Bs (or employment law) actually works. H1 visas are super restrictive, and you typically cannot work in an area outside of the field listed on your original application (and the definitions for “field” are suuuuuuper specific… like, I’ve worked with people who we couldn’t secure visas for to work as a Data Scientist because their degree is in Computer Science). Given how restrictive the system is, there is 0 chance that software development work would be allowable for someone hired on a visa that listed streaming or video content production as the field. In order for the Khalils to have committed immigration fraud they would have had to have hired DW with the intent to loan him out as a dev, but doing so without mentioning that in the documentation would have been a breathtakingly stupid risk that whatever law firm they were contracting to process all of the paperwork would have shut down the moment they heard about it. Sure, the Khalils could have just ignored that feedback and lied to the immigration attorneys they were working with, but doing so would have been a HUGE risk to them with little upside… we’re talking like potential jail time in exchange for (maybe) a percentage of the income that DW’s under the table illegal work might generate. It just doesn’t make sense for them to have had this plan from the get go, even under the most nefarious interpretation of their motivations. All of the detailed references to streaming content and revenue make me think that (1) DW was originally hired as a content creator, and NOT as a software engineer, (2) that he ended up illegally taking on development work on the side, in violation of the terms of his visa (FYI, for anyone wondering why this would be illegal if the client was in Australia, from the government standpoint, it doesn’t matter where the client is, it only matters where the work was physically done), (3) that the Khalils found out about this work and decided that they were entitled to that money, and (4) because their procedures and documentation were already such a mess, they intentionally or unintentionally lied (read: perjured) during depositions for the lawsuit to make it seem like they hired DW for something that his H1B application ultimately proves that they did not, and finally (5) that in committing this perjury they have put themselves into a catch-22 where they either have to admit that they lied in official court documents, which is super illegal, or that they intentionally committed immigration fraud, which is also super illegal. TBH, I have no idea how their counsel in the lawsuit allowed them to move forward with filing the suit in the first place… everything about this stinks of utter incompetence from top to bottom

In a deposition if you don't object then you forfit your right to object to it later or to use it as a basis for appeal. The judge rules on the objections later for whats allowed in and whats not for the trial. the questions are still anwsered after the objection.

This reminds me of an event in my country, Our charity commission just released a damning report about the 'Captain Tom Foundation' The real problem with this sort of (alleged) fraud, is that it ruined things for everyone else! Good hearted people who genuinely are trying to use their platforms to raise money and do good in the world. Now there's always going to be a question. How do we know this charity live stream, or this charity event isn't just lining the pockets of the streamer themselves? I really hope the authorities start taking a closer look at online fundraising, and start bringing prosecutions.

His actions this time last year made little sense when it came to his reaction to the situation. Listening to Jirard freakout on that discord call was very telling. He knew how screwed he was more than any of us could have known back then.
The fact that he donated the bare minimum 600k estimation, combined with the fact that the *reported* proceeds went up AFTER the scandal, cements him as a scammer.
His events were popping off during the pandemic and he was only reporting a little over 100k for those years. Then he gets busted as a scammer, and the following year he reports over 155k, after a massive decline in support and viewership. This combined with him "holding" the money for 10 years, and then donating the bare minimum that was estimated should be enough for him to do jail time.
I hate that these white collar crimes result in slaps on the wrist. This is way more evil than someone shoplifting, or being drunk in public, but he'll get less of a punishment or no punishment at all for using his deceased mother's name to scam charity bucks from his own fans....

If you read the pleadings, TOVE didn't just lose at summary judgment. It surrendered.
TOVE failed to file a response to the summary judgment motion, and then CONSENTED to having judgment entered against them.
I can't possibly figure out why. If you fail to respond (and you have a defense), the first thing you're going to want to ask for is more time to respond.
If you can't get that, you want to ask the other party to consent to you dismissing the lawsuit before judgement is entered. (In federal court you can't dismiss without the defendants or the courts permission once the case is underway). That way you avoid having the judge issue a written opinion describing the ways you fucked up. If the other party won't do that, you might file a motion to ask the court to just dismiss it.
If you can't get that, you might at least ask the other party to withdraw (or cap) its attorney fee request in exchange for you dying quietly.
Here, TOVE agreed to lose the lawsuit in exchange for NOTHING. The judge is still going to write a full opinion about why TOVE loses (and now it'll certainly contain a big pile of references to the fact that they didn't even file a response). They still lose the case. And the defendant is pursuing its attorney's fees with guns blazing. Their fees motion clearly did not pull any punches.
This is TOVE running away from this lawsuit as fast as it can without much if any thought to the consequences. It smells of panic and not much else.
Here’s a good reason: Lawyers are officers of the court. A lawyer knowingly lying to a judge or in court can get them disbarred or fined. The only defense TOVE’s lawyers had at this point would require their lawyers to knowingly lie or fabricate evidence. It saved them professionally to throw in the towel and they get paid win or lose.
How interesting... I wonder whether TOVE said they wouldn't pay for any further legal work & their lawyers said fine, we're not lodging anything further so it's on the brothers to respond (which they didn't do). Given the way they used the immigration lawyer's name to imply their visa scam was legit, I wouldn't be surprised if Chucklehead #2 thinks he's smart enough to dodge legal issues while avoiding additional legal costs... the consummate scammer.
I bet they threw in the towel when they saw Muta and Karl poke their heads around the corner and react to this farce of a lawsuit.

The relationship between these three parties, whatever it was, was recorded. TOVE and the programmer had a deal. The programmer and the defendant (clearly I don't remember their names) had a deal. The defendant didn't know anything about TOVE's involvement until after everything went down.
That's mostly undisputed. The disputes are mostly legal, and TOVE had a hand to play. For example: the terms of the programmer's license with the defendant (giving defendant a licensed to use the programmers work) were a part of his agreement as a USER, not a programmer. The defendant has argued that the same terms should apply, and I tend to think they're right, but there's certainly a colorable case to be made that they're two different things.
The case is a loser, but not such a loser that a competent lawyer can't put up a response without breaking the rules.
I'm also no lawyer, but I have a feeling ICE might want to have a word with Mr. Khalil next, because that employment contract does not sound like a typical H1B arrangement.

I just don't understand. It wasn't even like he was blowing that money on gambling or drugs or sports cars or whatever people do with money that doesn't belong to them. He wasn't even earning any interest on it. He was just letting it collect dust and devalue with inflation. What was the point? Why couldn't he just donate it? Was he hoping to just quietly walk away with the cash at the end? What's *wrong* with him?
He kinda was doing all that, passing all his expenses of who knows what kind to the charity, while claiming he doesnt touch anything. Even his own stuff wasnt adding up to the numbers being in the tax forms, he was making way more than what was reported in the form, and the expenses are suppose to be taken out and disclosed AFTER not BEFORE you deposit them, and the golf tournament money were nowhere to be found.
The money in the account were there to keep appearances i guess, with who knows what plans for them down the line, they could do what most of these charities do, pay most of the proceeds as salaries to the executives, and the executives are him and his family members.
People were speculating at the time that the Jirard and his family were waiting until a certain amount of years so they could withdraw it and hopefully get away with it. Getting caught early mostly ruined that plan though.
Jirard SAID they never touched it, but he never verified that by posting a statement of that account. My theory is that they were using that account as their personal slush fund to fund whatever. The reason I think that is the fact that it took them 2 months after being exposed to donate to the foundation they already had listed as one they were working with. All the talk of taking time to find the right place to donate was horseshit, they already had it. So why did it take them 2 months? They had to get the money together because it wasn't actually just sitting in that account...doing that shit takes time.

To give a little insight on the H1B visas vs Canada's version of Work Visa(Called Work Permits here): There's almost no differences, but the key takeaway here is that the work visa/permit can/has/should be done in person/brick & mortar. Not remote nor work-at-home. The visa THEY SHOULD HAVE applied for for this individual would be called "Digital Nomad Visa", which encompasses basically any work that can be done virtually from anywhere & cooperated via the internet. IE: Art Designers, Programmers, Remote Customer Support Agents, etc. as long as they are not a citizen or permanent residents of that country. Technically they are just treated as a visitor that can work in that country for the amount of time that the visitor is allowed to stay in that given country before having to submit an extension request either electronically means or in writing.

I remember talking to a mate about this lawsuit a couple weeks back. He theorised that this was Jirard testing the waters of filing a lawsuit that he thought he could win before going after Karl and Mutah
Just an FYI about all the objections at the 36ish minute mark, that's just a thing from depositions. They ask the questions, the lawyers object, the people answer them anyway, and then they move on. The objections are basically placeholders - if they don't object to questions during the deposition, they can't later file to have it stricken later if it is actually bad-bad.

Not an immigration lawyer, but I’ve worked in tech HR for 10 years and have worked with hundreds of H1B holders.
It’s pretty common for H1 holders to be hired by contracting agencies and placed on projects with different corporate clients working under a C2C managed services contract. That said, the economics of that model only really scale properly when you’re dealing with large third party agencies that can afford to employ teams of tens or even hundreds of H1B holders at a time, so maybe this was a situation where they were trying to spin up a new line of business, or something? If so, though, they failed spectacularly.
Also, RE: it being an O visa… it’s typically EXCEPTIONALLY difficult to secure an O-type visa. You basically have to be a leader in your chosen field with niche technical knowledge that is probably difficult to find elsewhere. I’ve spent most of my career working with Meta and Google, and even companies with those resources hesitate to pursue O-type visas given the low approval rates.
Okay, so here’s my overall take:
It sounds like there is some kind of system in streaming/YT where companies will sponsor H1 visas for streamers to come to the states and make content. Now when this kind of sponsorship relationship exists, the visa holder (DW) in this case, cannot work for any other employers… all work that they do has to be funneled through their sponsor (for example, the managed services contracts that I mentioned in my first comment). So from that standpoint, I can see why the Khalils might think they have a right to income that DW received…
That said, it sounds like there was no pre-existing business relationship between the Khalils and OnePixel, meaning that any work that DW did was done illegally, and almost certainly violated the terms of his H1B.
That said, this does not give the Khalils a right to that income, and trying to claim as much is suuuuuper shady. There are a lot of protections in place for both H1 holders and H1 sponsors, and those protections are there for a reason, because, otherwise, you could really easily see the H1 system quickly devolve into effectively being a modern form of indentured servitude.
DW and OnePixel are not blameless here. DW almost certainly violated the terms of their visa and will probably end up being deported as a result. Someone in OnePixel’s HR department f**ked up royally in allowing him to gain employment without properly verifying his visa status. But none of that changes the fact that the Khalils are not entitled to the income of the employees whose visas they sponsor. DW is an employee of the Khalils, and any work he does for the company (whether directly or by way of a managed services contract with another company) he must be compensated for by the Khalils… but if he’s getting paid directly by someone else, even if that payment is done illegally, that doesn’t mean shit for the Khalils. They aren’t involved. They get nothing.
Okay, last addendum: Re the immigration fraud stuff… I don’t think they knowingly engaged in fraud from the beginning, but that they may have perjured themselves into sounding like they had. This sounds to me like they hired DW as a streamer, and found out that he was doing work on the side and are trying to claim their slice of the pie, while having 0 idea about how H1Bs (or employment law) actually works. H1 visas are super restrictive, and you typically cannot work in an area outside of the field listed on your original application (and the definitions for “field” are suuuuuuper specific… like, I’ve worked with people who we couldn’t secure visas for to work as a Data Scientist because their degree is in Computer Science). Given how restrictive the system is, there is 0 chance that software development work would be allowable for someone hired on a visa that listed streaming or video content production as the field. In order for the Khalils to have committed immigration fraud they would have had to have hired DW with the intent to loan him out as a dev, but doing so without mentioning that in the documentation would have been a breathtakingly stupid risk that whatever law firm they were contracting to process all of the paperwork would have shut down the moment they heard about it. Sure, the Khalils could have just ignored that feedback and lied to the immigration attorneys they were working with, but doing so would have been a HUGE risk to them with little upside… we’re talking like potential jail time in exchange for (maybe) a percentage of the income that DW’s under the table illegal work might generate. It just doesn’t make sense for them to have had this plan from the get go, even under the most nefarious interpretation of their motivations.
All of the detailed references to streaming content and revenue make me think that (1) DW was originally hired as a content creator, and NOT as a software engineer, (2) that he ended up illegally taking on development work on the side, in violation of the terms of his visa (FYI, for anyone wondering why this would be illegal if the client was in Australia, from the government standpoint, it doesn’t matter where the client is, it only matters where the work was physically done), (3) that the Khalils found out about this work and decided that they were entitled to that money, and (4) because their procedures and documentation were already such a mess, they intentionally or unintentionally lied (read: perjured) during depositions for the lawsuit to make it seem like they hired DW for something that his H1B application ultimately proves that they did not, and finally (5) that in committing this perjury they have put themselves into a catch-22 where they either have to admit that they lied in official court documents, which is super illegal, or that they intentionally committed immigration fraud, which is also super illegal.
TBH, I have no idea how their counsel in the lawsuit allowed them to move forward with filing the suit in the first place… everything about this stinks of utter incompetence from top to bottom

Hey mate - Can you run your audio through some kinda compressor or leveler for the whole thing, so it kinda averages out your commentary volume? I think I know how it happens if you record different bits at different times with different "energies" of your "performance" (sorry don't really know any better word =D) - If you use Davinci Resolve it has a pretty good dialogue normalising preset but whatever you use I'm sure there's something built in or an addon

In a deposition if you don't object then you forfit your right to object to it later or to use it as a basis for appeal. The judge rules on the objections later for whats allowed in and whats not for the trial. the questions are still anwsered after the objection.

The real problem with this sort of (alleged) fraud, is that it ruined things for everyone else! Good hearted people who genuinely are trying to use their platforms to raise money and do good in the world.
Now there's always going to be a question. How do we know this charity live stream, or this charity event isn't just lining the pockets of the streamer themselves?
I really hope the authorities start taking a closer look at online fundraising, and start bringing prosecutions.

Dude's always looked suspicious to me. Never been a big fan of J. Scam Artiste, or his disheveled looking beard. He's always looked like someone who'd just be waiting to pull something behind the scenes and hide it. He's never been that interesting to me really. Every time I'd see him in a video, or cameo in something, I'd always be thinking to myself: "ok, we get it, you're the funny fat dude with a beard, a wannabe Jontron, can we just move on and get back to the actual video?" And even when I checked out his videos because I felt like if someone like ProJared or PBG would recommend this dude, then I'd check it out(because I'm huge fans of those 2). But he just never had anything really interesting about him to me. He always just seemed like the kind of guy who was hiding something, didn't he? Never truly understood why people ever liked him to begin with. He just seemed to be lying about anything and every other thing he'd be saying, or saying one thing, but doing another, just to preserve his public image. That's what it had to be, a scam to save face. A wannabe who wanted to dish it out, but could never take it. And also, working for G4, was yet another sign that he's always been scummy.

I had a sneaking suspicion that there had to be more shady stuff going on with the Completionist but I just didn't know what. His actions this time last year made little sense when it came to his reaction to the situation. Every logical step he could have taken to rectify the situation and still have a bit of tact were ignored and instead he choose to dig his heels in. He knew there was a lot more going on and only a matter of time before it all came falling down.
I’m betting that falling out he had with his friend who used to be in the videos with him, which caused him to “remake” his old episodes, was caused by him learning about how big of scumbags Jirard’s whole family is
I think Greg mentioned on the internet a while back it was because he didn't feel he was being compensated fairly for his likeness in videos. Tbh there's not a lot of information on the situation, so it might be multiple things. Might even be both
