I am in Georgia and our grandfather died last October and the Will gave everything to his Second Wife and Step Daughter. I caveated the Will and filed to become a Temporary Administrator, because the 2nd Wife filed the Will without Probate, which I did not know was possible. So when I filed to become the Temp Administrator I listed myself along with several grandchildren that survived a decedent's child that were disinherited by the will, they sent her notice and suddenly she listed 3 more disinherited grandchildren, which brought the total to 7 Disinherited Heirs at Law. I was curious if this large number of Disinherited Heirs can be used as evidence to demonstrate undue influence and monomania or mental incapacity of the decedent to properly execute a will?
As someone that has a Sociology Degree, I hope that I am qualified to answer your question. Our Country has a vast diversity of religions, cultures, and ethnicities and I believe that it would be a huge financial burden to teach financial literacy because Christians, Muslims, Catholics, etc have different rituals around Estate Planning and burial. I remember Economics in High School, but that is about it. I also think that Lawyers make too much money in Probate Administration to freely giveaway that knowledge. Our Schools, at least Post-Secondary Education, doesn't teach Criminal Justice or Criminal Law despite thousands of people going to jail nor does it teach Entrepreneurship and how to successfully run and open a business. Honestly, I think we place an unfair burden of expectation upon Public Education to be educated by teachers to teach us things that they have not successfully mastered themselves like Finance, Credit Cards and Debt Managment and I despite me being 47yrs old and attending dozens of funerals, I have never had to plan a Funeral or Probate an Estate yet. However, my mother has already told me that she wishes for me to be the Executor of her Estate and so some people can go their whole lives without ever having to perform a Funeral or Adminstrating an Estate.
