After my dad died and my mom had a little Money. I told her mom go out and buy yourself some new furniture . Buy a nice washer and dryer. Go to bingo everyday if you want to. My mom scrimped and saved all her life because we were poor. When it was my birthday I honored my mother because she carried me for 9 months and gave me life. When she died I was devastated. She left a couple thousand dollars to me and I couldn't even spend it. I kept thinking about the time she could have used it when I was a little kid. But she did go out and treat herself to New furniture and did spend most of it. She had a stroke and I was there every day. I didn't even think about my job. I thought how many times she sacrificed for us. Please be good to your parents. They gave you life.
I know how you feel. My mom lived with us the last 17 years of her life. When she got sick i didn’t hesitate to care for her. I was honored to see the woman brought me into the world out of this world. My brother who did nothing in the last 17 years for her. When she needed new tires i informed him she didn’t have the money….crickets. My husband I cover 60% (all we could afford). Over the years i provided for her as she provided for me growing up and a few times as an adult. Do you know he took 1/2 her insurance after burial expenses, but he did let me keep all funds from the sale of her car ($3000 after my expenses waiting for probate). Wasn’t super nice of him? Forgot to mention her insurance was only $25,000 after expenses. I’m feel greedy, but if the roles were reversed I wouldn’t taken half, if any at all.
I am an only child and my parents have been advised by their lawyer to make sure they have a living trust and not just a will. My mom literally said to me: “we don’t want to put you through the nightmare of the courts”. Their lawyer is a knowledgeable person and Toby thanks for explaining everything.
Yup. Don’t get a will. I’m going through this with my now deceased father. I just pulled out because I’m pretty fiancial stable and my dad had all this debt. That the probate lawyer told me it’s not really worth paying all this money for very little return. I respectfully dropped her services and my narcissistic brother can have the few thousand that will be left over from our father’s estate. To me it’s not worth it. It was a horrible basic will.
My mother-in-law had a trust and when she died, it was really hard but she had a living trust and all we had to do is open up the book and follow the instructions. It was so easy. I want to thank her for making it easy for my wife in this trying time, it was so easy I believe in living trust everything worked out properly. It was just perfect.
My Dad and Mom had a Trust that cost us 50% in Litigation because they didn't use an Administration Lawyer to fund, record, monitor, validate, certify, and a dozen more steps to avoid the Estate Planners mistakes.
Ha Ha very funny there are dozens of complex steps in an Inheritance Administration you need a NICER approved Forgery Proof Inheritance Administration Lawyer to perform to avoid the dozens of mistakes the estate planners are adding up.
My dad passed away last December. He mentioned he wanted to go get a living trust done, but unfortunately he got sick and passed away before he had a chance. We are still in probate court and it's been a nightmare, not to mention expensive! We have been paying on his house for almost a year and just received the right to sell it from the courts. Get it done sooner than later folks, my dad thought he had time but you never know!
@@TobyMathis I have a similar situation, my father had been prompting me to set up a special account; the last 5 years saying that I have an inheritance, & so it doesn't affect my Social Security disability and Retirement income. I looked & only thing I found was to put it in an educational savings account for a time & amount dispersement; Is there anything better to secure my inheritance without pay taxes, or affecting, lose my SSDI INCOME!? ALSO my sister's KEPT ME in the dark, not inform me of anything till after. NOW there trying to lead me to believe there is no WILL; that DAD WAS BROKE, & THEY HAD TO SELL EVERYTHING TO PAY HIS BILLS and I was MIA (missing in action for so long, & not keeping in touch) they my two younger & one older sisters "didn't want to be responsible for ME. Tried to find some Legal advice FOR HELP. All Attorney said "to find out if Will was in Probate" couldn't find anything,
Excellent information, our family is fractured now because of a will that was changed days before dad died. Resentment, envie, and greed motivated a couple siblings to prey on his despair and get him to change his will. My wife and I will set up a trust for ourselves so our heirs don't end up going through what we experienced. It is beyond my comprehension why siblings plot to hurt one another, but the love of money does funny things to people.
Amen it is sad people fight over things that can be replaced but the loved one dying no matter what their past is like you cant replace a loved one simple and to fight over it is sad belonging dont replace them the love they gave you and memories are the key to healing your heart and keep a loved ones memory alive
Hi Mark! Sorry, you experienced such heartache and broken relationships. I pray one day your family will realize the foolishness of their ways and seek reconciliation. PRAY! God's word does not leave any room for excuses, "The love of money is the root of all evil!. Your heirs will thank you. Blessings, Karen
I know the feeling, im on my 2nd dealing with thievery in my family. 100s of thousands were stolen and last wishs not fulfilled. Its so important to have your affairs in order.
@@4wchitstands Sorry to hear that John. Don't get too caught up in it. It took me down a dark path for months. I am doing better for it, when I accepted it as a blessing and a lesson. Unbelievable how much abundance we have been blessed with since we had been taken advantage of, but God answers prayers when you show gratitude. Try to be thankful for all life's blessings, even the negative ones. Let go and move on, or it will consume you.
I just went thru this nightmare, my father had a lot of assets. My brother and sister thought it was going to be a free for all and were shocked to find out he had a living trust in place. Great video
We love this station and looking forward to information about Notary Index Crime Enforcment Regulatory and Sheriffs on-call to arrest Estate Plan forgers, Trust counterfeiters, and Power of Attorney financial elder abusers.
Thank you for explaining Living trust versus Will in a very clear way. I have never heard explained as simple and as you'd done. This is going to be a game changer for a lot of people listening to this.
Don't do it. It only benefits the attorneys. Almost 70 percent of living trusts are never funded. Meaning the trust is like a shopping cart and your assets are like the products you put in a cart. Everytime you buy an asset, or sell an asset, guess what..the estate planning attorney or CPA will charge you to update the trust and it is not cheap. Furthermore, if you try to say get a mortgage but your securities at a brokerage are held in the trust you will have to get a notarized ($$$) copy of the trust not just show them your statement from your brokerage.
@@ksmith2852 Thank you for voicing your opinion. I disagree, but get where you are coming from. Lawyers make billions (with a "B") from probate fees. According to studies, including AARP, the average costs of transferring assets via probate are in the 15-20% range. There are also things like financial & health matters during your lifetime - both of which are also addressed in a living trust. Even unfunded, a living trust is better than a will as there is still a pour-over will included in a living trust that dumps everything into the trust. What it eliminates is public disclosure of what is going to whom as well as the litigation between beneficiaries. Too much here for a simple response, but suffice it to say, I disagree.
I am a young accountant (just graduated college and am working towards my CPA) I just want to say that your content is wonderful and that your breathe of knowledge is something I am going to strive for in my career.

I think it's important to define the differences between revocable and irrevocable trusts... specifically the ability to shield assets from consideration regarding Medicare and nursing home costs.. please consider including this in future videos
How is content like this just sitting free here on the internet? This was AMAZING!! Life changing even. I've never heard anyone articulate how to nuts & bolts build a legacy. The thought has always been desirable but intangible. You made it plain. THANK YOU!!! This was the answer I was looking for.
Don't forget this is the first step to mentor grantors, referee grantees, fund, amend, validate to avoid Estate Plan forgers, certify to avoid counterfeiters, transfer titles, defend grantee beneficiaries, distribute forgery proof pink slips to title deeds and about 15 steps to settle a NICER Latin Law Crime Interdiction Administration So Drew Barrymore and Sher's heir gets their shares.
I live in Florida and see end of life greed from kids who swoop in like vultures after never helping with their parents in their elder years. Their greed is disgraceful
You're correct. I recall my children attending fifth grade in an Affluent school. It was very common for the children in the school who all seem to fit a certain image, to brag and declare how they couldn't wait for their parents to die so that they could have everything. Absolutely disgusting. But I wonder they were likely a reflection of their own parents
@@HeartLatic sounds like boarding school mentality for teens. Never heard of this in 5th grade before but they are corrupting children at younger and younger ages with their agenda.. sick and sad
Well done. I have one and forced my mom to set one up. She was on the receiving end of my grandmother’s estate - no will. Her sisters fought over tea cups. At the end of the day they never spoke to each other again. Easy Peasy estate settlement if you have a properly st up trust.
The Living Trust will do nothing about tea cup battles. Whoever gets into the house after the person dies will take the tea cups, photo albums, hard drives, safes and all technology. That's how it works in real life.
@@ksmith2852 True. Relationships ruined. On the other side my kids- minimalists- don’t want anything. My wife is an only child and has heirlooms back to her grandparents.
@@ksmith2852 Maybe its best to just give stuff away begor you die? I took 2 weeks and copied Every picture from 25 years and put them on several flash drives for my kids. So no fighting over albums. Got any suggestions? I dont want my kids fighting.
Trusts do not stop fights, people can and do contest the trust. If it is a second marriage so you leave your assets to your spouse thinking they will leave your kids what the trust says, and the surviving spouse changes the trust there is nothing you can do.
I had to watch this a few times to make sure that I wasn’t missing anything. Thank you for breaking this down so that anyone can understand how to protect their family. Great video!
I’m a paralegal probate law you are so right! Living Trust is the way to go. Lawyers push Wills but the cost before & after is $$$$$$$$$ and the effectiveness of a Will is almost nonexistent.
I have a question for you my grandfather passed away a couple months ago. He was living with his girlfriend for 25 years they’re not married he left two homes a couple of properties, some Ira account and a couple of vehicles. His girlfriend is living with him, sell any of his vehicles under his name Without having a will or a living trust ?
I knew some of the information about Living Trust but not all, it was mind blowing to find out what you can do with a living trust and I really don’t think my dad knew that too because he left it to my sister and my niece and my sister (niece mom) took everything & still complained. There was provision for all his grandchildren but my sister turned around sold all the property and put it under her name because she was the executor. Now everything is gone, no one has anything and she even convinced her siblings to give her money because of property taxes which she pocketed. Greed beyond imagination! Thank you for this information, I will definitely look into this!
She could have gotten in legal trouble as executor for not following the will. The executor is responsible to fulfill the wishes of the person whose will it is.
Thank you very much… This information came right in time!!! My mother passed away without a will or a living trust!!! And I’m sad to say that my brother is a practicing attorney of over 30 years! This should have never happened!!!! Im a nurse of over 35 years and when I constantly spoke with her in reference to her affairs she always said “she had a will”… Thank you for your service!
I live in NJ. A few years ago, my dad set up a revocable trust. We went to a local estate lawyer. His will got updated & everything-his home, stocks, etc.- were put in the trust. It wasn't hard to do & overall, it didn't cost that much, under $2k. Our family has peace of mind. When my dad passes, it will be a very emotional time for us. His estate will be be settled quickly. All the work was done while setting up the trust while dad was alive.
Toby, been watching you for years and learned a lot. But this is probably one of the best videos so thanks for some of the suggestions! My mom's one asset was a house that was purchased in 1977 for $40k but sold for $1.1m (California) when she passed last year with the proceeds sitting in a specialized account until distributions are made. She had Alzheimers but she passed peacefully in her home as outlined in her AHCD which was part of the set of legal documents she had set up in her living trust. As the trustee of her estate, I am witnessing firsthand the grief and greed that you so aptly described. The beneficiaries are pulling out the stops. One beneficiary asked for their distribution immediately after mom passed, another contested the trust, and the last has filed a petition to have me removed claiming I had undue influence over her when she named me the trustee. But the trust was set up in 1979 (updated every 10 years with me named as the successor trustee every single time) when she was of sound mind so the net effect is that legal fees can still drain the trust by belligerent beneficiaries. Yes, those legal fees will eventually be recouped at their expense. It's stupid though. My mom would be mortified if she knew what was happening.
Very sorry for your loss of your Mother. I am and was a trustee for several people & family members, the greed I see is beyond belief! And yes, it is so very stupid. And yes I got accused of influencing, but the funny thing was when we had asked the greedy beneficiaries to help me as trustee to take care of the person so they had an idea of what was going on and could be paid a wage from the estate (and end up getting more money in the end than the others because they were being paid out of the same pot), not a one would step up. They wanted the money without the work. LOL...greedy, lazy and stupid...just unbelievable. Take care of yourself.
The best ... stumbled here while switching bewtween 360 videos. I always wanted to do this. Been giving away $1,000s to family, strangers and organizations for years "just because..." This can help with my legacy versus giving 5 figures to my "beneficiaries."
The problem is people are not educated in living trusts. I was familiar with them. I talked to my sister who is the executor of my dad's will & then we both talked to our 91 year old dad about setting up a trust. We explained it would make everything flow easier in the future. Everything would be organized & easy. When our mom passed, it was a lot of paperwork, phone calls, transferring everything everything to our dad, etc.....He saw what a hassle that was & that is why he agreed to do the trust.
My dad always said he had a trust, (even mentioned it the month or so before he died but I dismissed it as confusion.) He even mentioned how glad he was that he left everything to me (just hours before he died.) I really thought he was just sharing a nice sentiment and I was grateful for his fond thoughts, thinking they were memories of an old man of a time that was long gone in his life. I mean, I knew he was living off of his savings for the last 20 years and there was no paperwork. The only thing I found was something that let me know my father became an angel investor of sorts when he first moved to Arizona over 15 years ago. I found nothing at his bank and I am certain my brother is searching and hiring lawyers due to his attempts at causing the family nightmare. My dad always mentioned since the 80s that everything should be in a trust. Thing is, he never told anyone where, how, under what name and there is no documentation to be found. Still I am very grateful to find this video and read the comments. I look forward to planning my own living will and will seek appropriate life insurance. Great video!! Again, thank you for the safe place to share these thoughts.
Sir, you are a BLESSING!!! My wife and I have been praying, and we have a Prayer Circle on our Ranch that we go to 2 to 7 times a day. I went there this early morning to beat this intense extreme hot(106°) weather. I watered, planted, arranged, and walked the circle praying for answers...I GOT IT, THROUGH YOU!! I came inside to shower and nap, then I pulled up my TH-cam, and your/this video popped up and stood out to me...at 1st, I was like, hmmmm, no likes, but tons of positive feedback and comments. I played it loud as I sat to eat lunch, so my wife could hear it too. We were at PEACE and CALMNESS came over us. Your genuine servitude, professionalism, transparency, and love for TRUTH is very evident, sir, and for that, I thank you, man to man. We have a 18 acres Ranch in the Texas Hill Country, built a 2 story Barndominium, and have a 2 acres stocked pond, plus 4 German Shepherds, 120 chickens and roosters, 17 ducks, and multiple raised Vegetable Beds. My mom and her brother STOLE my INHERITANCE that my dad left for my sister and I when we were 5yrs and 4yrs old, he was a 2 time Purple Heart medal recipient, and he loved us, I REMEMBER!! Long story short, he left everything to us in his WILL, but somehow, my mom assumed the role to dole out my sister and my FORTUNE, and USE it on herself and her new husband who physically abused and beat me naked on drugs listening to demonic music. Then my grandfather who took me under his wings, left me his fortune too, because I was 1st born, and I helped him clean up his rental properties and small lots around town, as my sisters and cousins MOCKED and LAUGHED at me because they saw HARD WORK and NO PLAY on the weekends A LOT. Fast Forward, my grandfather came down with Alzheimers, but before he lost his senses, he PROMISED me that he was leaving it ALL to me. Once he died, they buried him immediately, and TOTALLY SHUT me OUT, and Never Answered the phone and said that I wasn't allowed to come to their Mc Mansions. I was confused, angry, lost, and CRUSHED, because didn't know what was happening....NOW I DO!!!lol THANK YOU!!! What can we do to work with you on our LIVING WILL?🙏🏽 Father God Almighty, please continue to bless this humble giving gentleman who is freely giving crucial information and explanations from his BIG HEART. We pray he will experience a hundred, thousand fold increase in his business opportunities and clients, in Christ Jesus name, amen🙏🏽🤴🏼🙌🏽
In California if your estate is over a certain amount they take something like 58% for probate. My best friend growing up lost Millions before they got done because his parents refused to put anything in a trust because they thought somebody would steal the trust from them and other silly rumors. They have four houses and a total of six million dollars in the estate. There was only him and his brother the brother who was causing all kinds of trouble. They had two boats but his brother wanted both boats stuff like that. Before probate was done a 6.5 million dollar estate dwindled down to 1.2 million each for the brothers. You better get a trust combined with a will.
This viedo is so beautifully done, I like the fact he called Aretha Franklin, Mrs. Franklin..showing me that he really care about legends and legacy. and taking care of your assets when you leave this world..thank you sir you are a blessings..I am running not walking to see a lawyer about a living trust for my family.thank you with all my heart😊
Thank you for the information. My parents have a will and asked me to be their caretaker. I recommended a Living Trust because we have siblings and some are not on speaking terms. The Living trust provides my parents the opportunity to provide their voice in their assets. Great inforamation.
Wow. I have struggled with thoughts of how to leave a legacy to my descendants. Your valuable advice is exactly what I needed to hear. Thank you so very much.
This is exactly what I want, I want to create generational wealth for future generations in my family, unfortunately I’m starting from scratch at the moment but have a plan and I’m running with it, and I like the fact that I can dictate and make sure that the money and assets continue to grow and continue to be handed down generation after generation without those future generations just squandering the money but making that money grow and the assets grow even after I’m gone, to create generational wealth so that my grandkids and their kids and so on aren’t starting from scratch and have a good shot in life, I am so glad I saw this video
He only presented a very basic positive side of Trusts. He is a salesman. There is a huge dark side of Living Trusts. Do your research from sources who do not make money from you opening a Living Trust, funding and changing the trust, and administering it when you die. The last cost is hidden; you are dead so you can't complain about the charges and the beneficiaries don't know any better and have no recourse other than sue.
@@ksmith2852 Hi, I have read a few of your comments and wondering who you are and what you are doing for your family at death? I like to hear all sides. Thanks for sharing. My father was in the process of creating a living trust, then went into the hospital one week before signing the documents. He then died about a month later, that was this past January. So probate has been a whole lot of fun. There is so much work involved while you should be grieving. 💔
Mind blowing. Many thanks! Will immediately check on Australian version and cross fingers it’s the same meaningful deal. Try to find an Interdiction Living Trust administration Lawyer who knows more than an estate planner who sells an easy to forge trust costing our family every cent we own.
Great content. Right after my state lowered the amount of value needed before an estate had to go through legal probate, I had a certified legal document preparer do mine. She was very knowledgeable and made the whole process very straightforward. I guessing the state lowered the amount so that they can get a bigger piece of the pie.
My concern is the fact that anything included in the trust becomes an asset to any of the persons listed in the trust and therefore becomes subject to legal actions, should any of the listed folks get in trouble (auto accident, etc) and the court rules they are responsible for payment. So in short, everything listed in the trust could be lost before you are deceased or before anyone can take ownership in the event of your death. In theory you could be kicked out of your house and loose it if one of your kids have a legal liability issue. Not a risk most people would consider if they give it any real thought….
I WILL PUT THIS VIDEO ON MY TRUST AS AN EXAMPLE OF WHAT I WANT, THANK YOU SO MUCH FOR CREATING THIS EDUCATIONAL VIDEO, I JUST REALIZED HOW MUCH OUR EDUCATIONAL SYSTEM FAILED US.

In many states when someone dies intestate, all that is necessary for the heirs to take legal procession of the decedent's real estate is to file a simple form called an affidavit of heirship. It costs about $250
Mr. Mathis, that was a great video. Very informative. I've been through that probate process a few times after the death of loved ones, and it's been painful and dramatic every time. I found this video as I was looking for some general information on estate planning. I like this gentleman's presentation. That story about the Tweedy bird is crazy and I believe it. I've seen people become irrational when death and money is involved.
I was told you need a will and a revocable trust. What gets me is why does it cost thousands of $$$ when all the lawyer does is enter a few details and prints off the boiler plate trust and will. It is all boiler plate stuff done within minutes. Granted, it does require some expertise to know what to do. Being an estate attorney has gotta be a cool gig.

All 18 grandchildren could have been sent to college and had down payments on homes and vehicles with what was lost in that the first generation...instead they got nothing...but the lawyers made 🏦 BANK! The second generation the legal representative squandered the assets of the estate, and when taken to court for what was left the lawyers again made bank leaving a mere pittance for the heirs of what was a beautiful estate.😢YES, to a Living Will! The cost of Litigation will finish off most estates..!
Our greedy trustee forged the Living Trust and ruined the family because our parents hired an easy to forge estate planner instead of a NICER approved forgery proof Administration Lawyer. We're getting the NICER crime free inheritance transfer plan with Notary Index Crime Enforcement Regulators and Sheriffs om-call to arrest anyone who tampers with an administration lawyer's permission Validated and Registry Certified Interdiction Trust.
No such thing you need to hire a NICER approved Interdiction Living Trust Administration Lawyer to mentor grantors, monitor trustees and referee grantees with a forgery proof crime interdiction administration.
No such thing when the money is on the table so hire a Trusted Advisor to inventory, appraise, mentor grantors, monitor trustees, and referee grantees, transfer, distribute, and settle your administration with a Pro Bono Trust Reading.
Thank you for being so straight forward where I am able to understand the need for a Living Trust. Right now we have nothing in place and need advice in Texas
This is by far one of the best and most informative videos I’ve ever seen on this subject! THANK YOU TH-cam Algorithm!!! This was Well taught, very thought provoking and eye opening! I just never ever understood why wills are promoted over Living Trust. It always baffled me but because of this video, now i know. I wonder does this company do Living Trust for folks in my state.
I wish I had seen this when it was first published. My Life Partner passed in March of this year without a Will or anything else. We did talk about a "Life Trust" (that's what he called it) but he never got a chance to complete one. Now I am living in a nightmare, fighting with distant cousins who want to evict me from my own home, even though I have offered to buy it from them! I'm in Oregon and we were never legally married. Fifteen years together building his legacy and I have nothing.
My family experienced the opposite. My grandpa married for the 3rd time in his 80’s. They both came to the marriage with assets and signed agreements to contribute $ for daily living, but that the rest of their assets would remain separate. When my grandfather died, his wife’s kids asked permission to take “a few household items” as she was going to live with one of her kids. My dad was the executor and he agreed. He then arranged for extended family members and grandpa’s step daughter to meet us at the house to help us sort through the household goods according to which of his wives had owned them. Also, at the funeral, I put a set of cups in with the cream/sugar collection from his previous wife. When we arrived at the house, we found his current spouse’s adult children had stripped all of the antiques and valuables (including the cups) - not “a few housekeeping items.” The antique glass, sewing machine, radio, and many more items were gone. It was sad, as the items had sentimental as well as monetary value. We don’t think his spouse even knew her kids did this, as she was also elderly and blind. My dad chose not to contact the police, but he probably should have (might not have done any good because it would have been hard to prove what was missing and/or that his spouse didn’t have the right to the items).
It seems very difficult for Attorneys to offer advice that impacts on their chosen profession without incurring explicit arguments that seek to limit what is being offered. But how do we, the public, know who to trust? Not unlike the points of view in current dialogue about the origin of Covid. I guess we all just have to say thank you to people like Toby Mathis for giving us something to consider and try to educate ourselves about. My plan is to live forever, so far, so good.
Toby : Great content. Question - If you do a legacy plan living trust, like the example you mentioned about providing money from the trust for your beneficiaries to travel, does the trust executor become a manager of the trust for years to come until all assets are fully dispersed? Let's say you have $100K in cash in your bank under the trust, and you put a clause that allows partial dispersement of that cash to your children if they travel. So let's say your son decides to travel for two weeks every year on vacation, and it takes him 10 years to spend down that money on travel expenses. That seems like a lot of work for a lot of years for the trust executor. How does a legacy trust work so it doesn't become a burden for the trust executor?
In the case of a dynasty trust usually, the individual, group, or entity that is managing the trust is paid for that service. It tends to be a small percentage amount of the trust to ensure the trust funds are handled appropriately and are able to be distributed according to your wishes as documented in the trust.
I have one for my house to divide equally between my children.can I make one for each child for my personal belongings ?can I just add on or do I need to put it into one?
My question is, person receiving a real estate as gift or inherents real estate from living trust, 1is there tax differences between the above mentioned. ( state of MD) 2. Does the trustee pays taxes from the trust?
There are no differences on the tax treatment of the real estate. The trustee would be in charge of making payments for certain taxes as well as income the trust generates unless all income is distributed.
Thank you, your video was excellent!! My mom 80, has a Trust and I had questions on it where I called the lawyer who wrote it up but even still, you were very helpful! :)
This opened .my eyes to why I need to do a living trust and the difference between a Will and a living trust. Thank you so much. The world needs more people like you.

Refreshing to read
You are fortunate to have had such a wonderful mom!
I am an only child and my parents have been advised by their lawyer to make sure they have a living trust and not just a will. My mom literally said to me: “we don’t want to put you through the nightmare of the courts”. Their lawyer is a knowledgeable person and Toby thanks for explaining everything.
Good thing. Going into probate court takes 42%, per our living will trust attorney. I highly recommend a living will trust.
So sorry for your loss!
I have a revocable trust, is that a living trust?
@@TobyMathis I have a similar situation, my father had been prompting me to set up a special account; the last 5 years saying that I have an inheritance, & so it doesn't affect my Social Security disability and Retirement income.

I'm so glad your father did that! He was very wise. Many families fight over the 'stuff' and money. It sure gets ugly!
@@ksmith2852 Do you know approx how much the transactions you mentioned approx cost?
@@ksmith2852 So, what do you think is better??
I love your videos. They have so much important and eye opening information❤

One of the ways to shield assets from medical costs is to get a special needs trust and appoint a fiduciary to oversee it.

You're correct. I recall my children attending fifth grade in an Affluent school. Probably a pour over will.

Trusts do not stop fights, people can and do contest the trust. If it is a second marriage so you leave your assets to your spouse thinking they will leave your kids what the trust says, and the surviving spouse changes the trust there is nothing you can do.

A living trust is the way to go. No messy probate. You as a trustee are that person when that person passes away. Everything goes to you.
I’m a paralegal probate law you are so right! Living Trust is the way to go. Lawyers push Wills but the cost before & after is $$$$$$$$$ and the effectiveness of a Will is almost nonexistent.
What about contesting a living will to get a delayed Birth certificate.
You see I have been trying to get a delayed Birth certificate. And the City Clerk Said I have to go to probate court to get it.
Thank you for watching!
That is the most digestible explanation of the scenarios I've ever heard. Thank you Toby!
Glad it was helpful!
Thank you for watching us!
So sorry for the lost of your beloved Mother. Thank goodness she had a trust. 🙏🏽💜
Very good presentation

The best ... stumbled here while switching bewtween 360 videos. I always wanted to do this. Been giving away $1,000s to family, strangers and organizations for years "just because..." This can help with my legacy versus giving 5 figures to my "beneficiaries."
Just went through probate of my dad’s estate. He just had a Will and left me everything. He should of done a Living Trust. Probate was a nightmare.
Thanks, I've been interested in a living trust for some time and finally someone explained it where it makes sense!

How devastating.
Democratic states often have laws and rules so the government, state, always gets the just of the money, assets.

@@TobyMathis toby I’m trying to find the video you did explaining how to sell your home to either an LLC or an S corporation to take advantage of the $500,000 exemption if you’re married and having a new cost basis at the higher price for the LLC or S corporation. I told my lawyer about it and wanted to do it but he doesn’t think it’s possible. I’ve searched and searched videos and I can’t find it on your page or in my history.
Thank you.

Very well done sir. Thank you for this video and its useful and clear content. I've been debating between a will and a living trust and now I know the living trust is the best choice for me and my descendants. Please keep up the great work.
I don’t even know how I ended up on this video, but I’m very thankful I did! Completely makes sense and need to share this with my mother who is stubborn as a mule. Thanks again!
We are so glad that you found our video, thank you for watching!
@@TobyMathis how do you set up a living trust for ur would be clients in CA? How much do u charge for a simple trust?

I envy my dog's carefree life after watching this video.

😂 I hear you there.
I love love love the videos from Toby! They are all easy to understand and he breaks things down to where anyone can understand I will be doing a living trust. It makes so much more sense
Thanks for sharing. My father was in the process of creating a living trust, then went into the hospital one week before signing the documents. He then died about a month later, that was this past January. So probate has been a whole lot of fun. There is so much work involved while you should be grieving. 💔
Your information is very usefull
We paid $5,200 for our house and rental property. Best $$ we ever spent! Great video! Loved the red chalk!
Mind blowing. Many thanks! Will immediately check on Australian version and cross fingers it’s the same meaningful deal. Went through Probate with my beautiful mother in law and it was a four year horror show with all sorts of never heard of “Step kids” in their 50’s putting hands out. Pure distain for those types. Now we have protection thanks to your SELFLESS ADVICE. Bless you Toby!

thank you for all of this info. most you tube videos only give you a small amount of information and you need to buy their program to get the rest of the info. These are people that say they care about wheat happens to the ordinary person. How do they care if they arent willing to share their knowledge? Not everyone can afford to buy their program. So thank you!
Yes great info. We did it years ago & it helps to do a review too every so often. Over time things can change, people change & you want to be absolutely certain. 🌺Lei

A living will is very different than a revocable living trust.
Very informative. We had an expired Living Trust from California but due to moving to another State kept me on delaying to do a new, too many changes. Thank you and I will make sure my husband will watch your video presentation.
This video really helped me. OMG! I need to get started on a trust now. I'm only 57, and I had some medical issues, so I need to put this in gear.
Holy shit!! this video was so informative. My wife and I are looking into doing a will or living trust and what I’ve read and videos I’ve watched have been very confusing. I know there’s more to know about this, but this video has guided me in the right direction and explained many things. Thank you sir!
Try to find an Interdiction Living Trust administration Lawyer who knows more than an estate planner who sells an easy to forge trust costing our family every cent we own.
I love your take on things! To the point and not greedy, which is something one sees very seldom nowadays! Kudos! ❤️ 👍
Glad it was helpful!

This has helped out a lot. I think it will be easier for our properties because there will be only one beneficiary, our nephew, and then his children after him, if he has any. We do have several properties in several states, a business, and a fleet of business cars. This has been a concern of mine for a while now. Thanks for the video.
Thank you Toby, I really needed to understand and you were so clear made it so simple !
Thanks for the information we're going to wait for NICER Approved Forgery Proof Inheritance Administration Lawyers.
Where can I find them, a greedy sibling stole my inheritance, and I want to make sure my kids get theirs?
Thank you for this video. I am already working with an attorney to draft a living trust. We should be completing the trust docs shortly and then it’s all about funding the trust and taking a sigh of big relief. Thanks again.
LOL that's just the beginning there are about a hundred steps in a complete administration to protect us when we're vulnerable and our Grantees Legacies so hire a NICER approved Forgery Proof Legalese Administration Lawyer with a team of Allied Legal Professional Trust Guardians with a Latin Law Permission Ledger Arbiter Interdiction Trust complete administration.
Omg this man is a Dimond! I’ve never heard as much sense. Talked in a 20 minute video ever as this one. Everybody should be paying attention to this information.

In many states when someone dies intestate, all that is necessary for the heirs to take legal procession of the decedent's real estate is to file a simple form called an affidavit of heirship. It costs about $250
Only if their estate is small enough (think under $100k depending on state) and no real property.
@@wanderingdeer1114 In my state, Tennessee, an affadavit of heirship is for real estate, without limit of value.
Mr. Mathis, that was a great video. Very informative. I've been through that probate process a few times after the death of loved ones, and it's been painful and dramatic every time. Grief, greed, and personalities - leads to people doing crazy things. The video gave me a lot to think about for future planning to avoid those sort of scenarios. Thank you for sharing it.

God Bless You we are getting there the past 2 years I have been telling my husband we need a LIVING Trust! No we do not have a lot but house cars and a little insurance money I have seen Wills eat families money up by being in court! YOU DO NOT-KNOW how much you have helped me I called my husband in the room and got him to watch settle! I question we live in small town a small county do I need a attorney to ours up that specializes in Living Trust! We already know who our Trustee will be!
Please keep talking until Mr. Mathis advances his career to a NICER approved Forgery Proof Legalese Administration Lawyer to defend the easy to forge legal documents with a 33-year reformed Financial Elder Abuse Defense Administration Network.
THANK YOU!!!! I needed to know what you taught in this video. What’s more, even before you suggested to do so, I decided to share the video with someone who needs to know this. You might just be our hero, Toby. 💖

Thank you for this video. I have a horror story to tell if I had the space. You're right, a Will is a joke. Now I just need to find someone that I can trust to handle my Living Trust.

Ask about
1. Costs to add an asset
2. Costs to remove an asset
3. Costs to manage the trust
4. If it is you and your spouse, what happens when one dies. (I already know...and it is bad)
TY for this video...YES! THe Lawyers and the Laws are in it To Win It!
In my family we have seen 2 generations of wills, litigations and LOSS!
Thank you for sharing your story. I'm glad you enjoyed the video and sorry to hear about your family's struggles with litigation.
You need a Trustee that is trustworthy for your Trust.
I agree there is no such thing as a trustworthy trustee hire a trusted advisor to mentor grantors, monitor trustees and referee grantees.
Just found your channel. Love how you explain the difference between will and living trust. Thanks for the information.

Another phenomenal informational video. Better than a paid appearance with a lawyer.
Thank you sir for this information ! I didn't know and paid a law firm 2200 dollars for a WILL !!! I feel cheated !
Thank you very much you Have educated me too a better understanding I was going to do a will but now I don't think so
“A good man leaves an inheritance to his children's children, but the sinner's wealth is laid up for the righteous” (Proverbs 13:22).
I have thought about that often. Thank you.
Amen❤

I have one for my house to divide equally between my children.can I make one for each child for my personal belongings ?can I just add on or do I need to put it into one?
My question is, person receiving a real estate as gift or inherents real estate from living trust, 1is there tax differences between the above mentioned. ( state of MD) 2. Does the trustee pays taxes from the trust?
There are no differences on the tax treatment of the real estate. The trustee would be in charge of making payments for certain taxes as well as income the trust generates unless all income is distributed.
@@TobyMathis Thank you so much, I am grateful
Is a living trust the same thing as a living Will? And can the benificiary also be in charge of the distribution?
