  • NEW DELHI: Three years have passed since the central government did away with Article 370 of the Constitution that gave special status to Jammu & Kashmir and bifurcated the state into two union territories. How have things changed on the ground? Have people’s aspirations been met? What more needs to be done? In this episode of ‘Ask Nitin’, StratNews Global Editor-in-Chief Nitin A. Gokhale has the answers.

Before 5th August 2019, J&K police lacked the integration with national security and forces. Post the abrogation, the police is working in tandem with army and national security, thus bringing in the required stability.

Nithin JI. Has there been a change in the Kashmiri youth minds who were highly supportive of the 'Aazadi' from India?

Nitin, your views about the ground realities in the UTs of J&K and Ladakh don't seem to be completely in agreement with the documentary on the same. I understand that it is not possible to summarise every aspect shown in the documentary in a couple of minutes, but I do find it more balanced than your initial statements as well as your responses to the questions here.
Anyways, I have always liked your content (ever since I discovered you in SNI days) and loved the 'Simply Nitin' series. I welcome the addition of viewer queries but I would suggest you to do it as simple Q&A wherein the viewers send in their queries beforehand and you respond to them in this session, instead of the current live-video format. That would make it easier for you in terms of technical challenges and on top of that, allow you more time to give comprehensive answers.

Princely States were neither divided or distributed based on their religious composition. As per Lord Mountbatten (who was given Royal authority to implement British India Partition Act, 1947), only those Princely States which bordered Radcliffe Line were entitled to join India or Pakistan based exclusively on the sovereign will of their kings. IOA with India was signed by J&K Maharaja with Lord Mountbatten on 26th Oct, 1947 & the J&K IOA was identical verbatim with IOA signed by other bigger Princely States. However Pakistan had occupied large chunk of J&K territory through its illegal infiltration on 22nd Oct, 1947 & India had approached UN to order vacation of illegal Pakistani occupation.
UNSC Resolutions of 1948, implicated Pakistan as an aggressor putting precondition of withdrawal of all Pakistani forces out of J&K and bringing unified J&K under Indian administrative control before assessing will of J&K people to join India or Pakistan. India had been magnanimous in accepting UNSC Resolutions even though they violated partition terms of granting such sovereign right to the King’s of Princely States only.
In deference to UNSC Resolutions , India put Articles 370 & 35A into its Constitution giving Special Status to J&K. However, instead of implementing UNSC preconditions Pakistan blatantly violated them by Operation Gibraltar on 5th August, 1965 by infiltrating its soldiers disguised as Kashmiri civilians to annex more territory & the violation was confirmed by US State Department. The UNSC resolutions became null & void as per international law "Clausula rebus sic stantibus" which makes adherence to preconditions absolutely essential even for all binding international treaties. The UNSC Resolutions were merely advisory & non-binding under chapter VI of UN Charter.
India should have declared UNSC Resolutions null & void in 1965 itself restoring supremacy of IOA & removing Article 370. The articles were finally & rightly nullified on the same day ie 5th August though 54 yrs late in 2019 by the Modi-Shah team. Col. Lawrence Sellin, PhD., Writer & a Veteran of Afghanistan & Iraq wars rightly observed: “Article 370 was most useful to Pakistan : It helped Pakistan spread poisonous militancy and misery in Kashmir. Pakistan used ‘special status’ of Kashmir to claim J&K was ‘disputed territory’. With one stroke, India has ended that claim. Pakistan now faces ruin itself. It has nothing to offer Kashmir "

@majid jahangir janjua : You are living in Fool's Paradise. This Fool’s Paradise has been successfully crafted by the Punjabis. Pakistan is an abnormal country with its 62% Punjabi population having only 24% Punjabi land despite annexation of land from neighboring provinces into Punjab….Punjabi establishment knows that Punjab can not survive without massive consumption of resources of other provinces . “Kashmir, India-hatred & Islam ” were invented as important weapons by wily Punjabi army & Punjabi bureaucracy to fool and enchain other provinces & to devour their resources (From “PLAYING WITH FIRE” BY PAMELA CONSTABLE , Random House, NY 2011). According to the US Security Expert Stephen Cohen (2003), Pakistani Army directly & indirectly devours 54.7% of national resources & runs commercial empire worth $50Bn from Bakery to Banks.

@@majidjahangirjanjua9399 The so called Azad Kashmir is under Pakistan's administration and is run according to Pakistani constitution under which special provisions and clauses are there for the indigenous citizens of Azad Kashmir. I think government of India should give exactly those rights and liberty under those clauses to the people of Kashmir valley specially so that they too can enjoy their lives and live in peace like their brothers are enjoying and living accross the LoC.

Jammu should become a state of the Union in its own right - the Kashmiri's are intent on dominating Jammu and Ladakh. There are good political paths forward for Jammu and Ladakh. Kashmir has a long road ahead to political stability in India, Jammu and Ladakh must be allowed to go their own ways. Jammu must have about 7 million people today. Enough for a state.
India should build a tunnel of about 13 km under the Himalayas to link Jammu to Kargil and Leh - about 500 km to each. Jammu to Kistwar is an existing road. The road from Kistwar along the Chenab to River to Padder and then to Bhuzas needs an upgrade. From Bhuzas build a new road up a small valley to a tunnel (~13 km) under the Himalayas at about 4,000 metres to Phey on the Stod River. From Phey follow the Stod generally north east to the Zanskar and Indus Rivers and Leh. From Phey, upgrade the existing road north west till it leaves Stod River, climbs a mountain and down into the Suru Valley to Kargil.

Facts beg to differ, Kashmir gets a good chunk of India's taxes and I hope Sri Nagar would catch up with other capital cities of India by having its own thriving movie industry, rail network and metros.
Britishers looted India, just like Pakistan and China are looting Baloch and POK by building mines and dams while not even providing a decent budget to the people of POK and Baluchistan, while India is simply looking after its national interest, which is the Indus waters and a buffer between China and Pakistan while simultaneously trying to make peace with the people of Kashmir valley.
