I just 100% P&T today! I filed for sleep apnea exactly one month ago and got the ACE C&P exam, but they didn’t even call me. The sleep apnea was approved and rated at 50% which got me to the finish line.
I had ACE exam and got denied for sleep apnea secondary to sinusitis and migraines got denied secondary to tinnitus with a nexus letter. I don’t get what they are missing
@@coreykaar962 I just did my OSA claim as a primary. Not secondary to anything. I included a personal statement from myself and one from my wife. I also have a CPAP and mandibular mouthpiece for OSA that the VA gave me after I took a few sleep studies with them.
@@coreykaar962same here almost identical to yours. What's weird is they verify i have sleep apnea but no evidence of service connection. I'm 180lbs fit. My migraine claim was a secondary to tinnitus and I also recieve migraine medicine from the VA and still got denied

QUESTION… I will be submitting a BDD claim in a couple months before I retire. Since I’m still Active Duty… do I need to associate my injury to service? For example, I have neck pains… and it’s documented. When claiming it, do I need to explain how service caused it or should I focus just on the symptoms since it’s automatically service connected?
It'll be automatically service connected. The VA Examiner you see also has the authority to 'diagnose' you while you are there for your exam, which is what my examiner did for my knee pain. He actually gave me a diagnosis. Neck pain is genrally a low value claim, so do your research on it and move on to higher value claims like Migraines, Behavorial health, etc. Just be sure to spend your next couple months absolutely HAMMERING appointments and getting issues service connected so your claims are rock solid. Also, you will have a phone call with your respective VA examining agency (The VA contracts agencies to conduct exams), and it'll be about 90 min a few days before your physical exam (they only do it for physical exams, not mental or dental, etc). It's IMPERATIVE you say that you get 'FLARE UPS' of all conditions. It's also imperative that you read up on the CFR for each condition and understand the DBQs for each condition BEFORE YOU GO INTO THE EXAM! IF you don't understand those acronyms please google them and dig deep. You need to spend your last few months making your VA claims your full time job if you want go get 100% first shot out of the gate. Good luck.

@standelasanantone2180 Just secondary your sleep apnea to your orthopedic conditions. Your orthopedic conditions prevented you from exercising, which led to obesity and subsequent sleep apnea.
No. You keep getting the compensation you're entitled to until the new claim is approved, then they pay you back pay for the difference from the date that you filed your new claim
Jordan is it possible to claim Chronic pain as a general condition with only one service connected issue at this time? The VA changed my chronic pain claim to Chronic back pain. Literally the same day as my back and sciatica C&P exam so it was like they were trying to set me up to fail. They gave me no time to act before the exam
your looking for Symatic Symptom Disorder or SSD. Its a mental illness associated with pain. Its hard to get. I have excruciating neck pain from a cervical spine injury and years worth of psychiatric treatment records for it along with very powerful psychiatric medication to control it. They only gave me 30 percent. I wont file for an increase because they could very easily drop it down to 10 or 0 percent. Its not as easy to get psychiatric ratings anymore. To get 50 percent or higher they need to see you got fired from jobs or got divorced or got arrested a bunch or got commit to a psych facility. If your still working , which they WILL ASK in the exam, your not going to get more than 30 percent. Of course there are exceptions especially with combat vets who saw very heavy combat and have PTSD from that.
Yes! My best friend and Co-worker is sitting an 80% overall disability. He received 20% for his shoulder. Then claimed "Depressive Disorder Due to Chronic Pain Syndrome with Major Depressive Like Episode Secondary to Service-Connected Disabilities." I believe they rated him kind of low. It went to a HLR, and it was realized that the C&P examiner had said the same thing the Private Dr. said, so it was bumped up to 70%. 80% overall from a 20% shoulder rating. He didn't do it himself though. He used a company to file the Fully Developed Claim.
If your chronic pain manifests in your back region, they’re gonna rate it as back pain. But if it has mental impacts (because of course it does) they should ALSO rate chronic pain syndrome, provided you get diagnosed with that specifically (a mental condition)
If it is for Back Pain, watch Jordan's Video. It helped my Co-worker increase his rating. Worst Day, As soon as you start to bend, it starts to hurt. Sciatica, get it.

It ALL depends on who is looking at your STUFF! If you get a fair rater then you are golden, but if you get a hack rater then denial is incoming… just the way it is, sadly.

Presumptive claims are not a given to get compensation for. I was denied on a presumptive claim under the PACT Act

If you're already being paid benefits and you submit a new claim, do payments stop until the new claim is resolved?
