I literally just had a C&P and examiner did not have any measurement tool to gauge my ability to lean forward. I was kinda taken back by that based on your previous videos on back injuries. Also brought my personal statement, he didn’t even look at it.
My last exam was in March 2024. The first thing the examiner asked was. "Were these not in your records? It's remanded." I had to explain to her the judge remand it back to the VA to get a rating. My records of my back injury were lost on active duty in 2009. It's always been noted that I had scoliosis going in prior 2005. The VA lost my records along with my buddy statements somewhere between 2015-2022. I was able to get new statements and now should be getting a decision here soon. I have 6 claims all dating back to 2012. My whole case was grandfathered into the new system.
Just had my exam for my back (ankylosis) on the 22nd. My examiner didn't use the tool to measure my back. She also tried to trip me up by asking me, how did I know I had ankylosis if I never had X-rays? My response "because the military diagnosed me 😏☺️" My exam was pretty quick. Although she didn't use the tool, when she told me to bend I barely moved. I'll come back with an update.
@@frankieredd156 I have a few more appointments scheduled today actually. I'm just as curious myself. I will provide an update as soon as I get one, my case is still pending.
Great video. Way to break it down. I'd go as far as to leave the examiner your statement and evidence just in case they have any lingering questions. I didn't and the examiner got some things wrong. Keep up the great work. Thank you Sir
I went to the C&P exam for my back about two weeks ago. The dude used a goniometer...however, the jackass went from measuring one ROM to another and wasnt writing each one down after measuring. I saw the dbq a few days ago and that piece of schit essentially indicated that I had full ROM, even when I basically just peeked at my toes and said that's as far as I can go without feeling pain.
I got a small 10 percent for My back issues , even having been diagnosed while in a combat zone for the first time for said back issue. I had no clue why i was going to the doctor they sent me to ( a private one since i was outside VA mile range). Anyhow, this was my c&p exam for my back claim i later learned. SO, I walked in and the first thing he says to me, well I watched you walk in so your gait is ok " they were starting that exam before i even met the examiner. SO be aware that everything you do will be watched and noted. Nevermind that 75 percent of the time i walk like an old man, on that particular day I was being mindful of my posture....I am certain it cost me in some form. He was overall a good examiner, the low rating was my own fault for having one of those personalities to never admit pain or goto the doc.
My MH examiner never asked about history prior to Iraq deployment, talked about stressor statements, how I’ve been dealing with stuff daily and dreams I have. Was very pleasant, talked a little over an hour tele-exam, I didn’t really care if I got a rating or not basically. My VA records noted multiple times about stuff (non MH docs). VA and my VFW VSO (another veteran) actually talked me into just filing and just talk to examiner and see.
During my back exam, I could not bend during the ROM test because I was in so much pain. My back literally feels frozen (really stiff and tight with pain), so she was not able to use the tool to test my rom. I signed a waiver for not using the tool. On the paperwork she had me state my reason why I couldn't do the ROM test.
That having medical documents is a big one. I went for a Migraine C&P They told me the VA put in for tension headaches. They also didn't send her any of my records. I was able to grab a blue button of my recent exams I validated at least the basic info was there before sending them to VES. Currently waiting for someone to update so I know w hats going on. But yeah va is for sure not sending documents over.
Yep, I just did an exam last Friday. I uploaded every piece of evidence needed for claims when I filed. When I arrived VBA had not sent her one piece of the evidence uploaded. I brought it all with me, she looked at it all and was very happy I had brought it. She used it all. My last claims, over a year ago, same thing. I brought everything. She also was very happy to have it. That exam netted me 9 claim approvals out of 11. Bring your evidence with you and KNOW THE RATING SCHEDULE for each condition and where you fall in the schedule.
I stopped moving my knee at the real point of pain. This seemed to "disappoint" my examiner, a VA C&P examiner, who then rearranged my position such that my body weight collapsed my knee WELL PAST any point of pain It hurt!! And, I DON'T WANT to do it again!!
Great informative video Jordan! I understand for PTSD claim, you should have a diagnosis first. Is a diagnosis required for general mental health disorder (i.e. anxiety, depressive, etc.)? Thanks in advance!
I am a VA rater. You need a current diagnosis for any issue you claim. No diagnosis or treatment, very rarely an exam is ordered unless it falls under PACT.
My husband is 100% p and t...recently anputee and lung cancer. Why do they want him to do and exam for cardio. Vascular issues from diabetes, from 3 years of agent orange caused all this. I think he doesn't have to go..is that right?
Hi Valarie, the fist thing to confirm is if it is a VA treatment exam or a Compensation & Pension exam (for Va ratings). If it’s a C&P exam, there is essentially no world in which NOT going would be of benefit. If he isn’t service connected for the cardio already, it could still be of benefit to do so even at 100% P&T, due to the fact that God forbid if he passed away and it was due to that heart condition, you as the surviving spouse would get his transferred benefits. Not showing up to a C&P exam is the same as having a bad C&P exam, which again is never a good thing really
During my exam dude didn’t even look at me. He sat there looking at his paper. He didn’t say anything about pain. He just said go as far as you can go. I can barely bend over before pain kicks in. But I can touch the floor but I’m in excruciating pain.
wouldn't have done that im not going past my level of pain for an examiner. oh well they don't live in my body. they also can write in the file I made my client push past the point of pain. so when I inflame my back he can own that one.
Had the same examiner twice for my orthopedic and sinus rhinitis issues. The best guy ever. Mental health are the worst got 100 % and my mental health issues got deffered and the 3rd different examiner accused me of filing claims for more money. Did HLR and still got denied I really think there decision is based I’m already 100%
I just had 2 exams and VA set me up with the same contractor for my 2 supplemental appeals. I requested the same examiner they said no problem. She did an outstanding job. What helps is having all your Sh*t together (evidence). They love that, it saves them so much time and frustration.
Thank you for your tips. These insightful tips have assisted me by a huge measure. I am now at 70% combined, but have my shoulder on active duty, PTSD and my back (I flew Apaches with the 82nd and was airborne qualified in my late 30's). Thank you! Very good advice! By the way, the military lost my medicial records after retiring with 38 years...I had a printout after my last deployment of my injuries and flight physicals, though. How many vets lose out because of this? Thanks again!!!!
Glad to hear you got approved. Iv been out for 17 years. As an afghan combat Marine I’m finally going to make a claim. Which I was encouraged by my marine peers. Pride was always my excuse now to.
It's because of the questions the VA is asking on the medical opinion. If VA is asking a specific question then we have to answer it truthfully. This is a legal exam.
Something to note, I brought my records with me as they didn't have them all even though I loaded them. the examiner noted she could look at them but couldn't use them as a valid evaluation as when shhe submitted the results the "back office" QA department wouldnt have them to review and would kick it back. This was Optum Serve. As an FYI.
I did a sleep study through optim serve and although they determined I had Sleep Apnea, the VA denied my claim because it wasn't in my VA medical record. Now I have to redo the entire process
3 C&P this year. None had any of the evidence I uploaded to VA when I filed. I had my entire file for each claim and all three were excited and input all evidence into the system. It paid off on all three claim/ C&P for me. The VA gives little to no information, from my experience.
Bring your records. Bring your personal statement. If you sent in buddy statements from service or family members bring those. If your personal statement does not talk about how your condition affects your life, write it down and read or use it for notes to tell the examiner. Make sure you talk about how it has affected your current or past jobs (missing work, disciplined for missing work, being fired or laid off etc.) If not currently employed talk about how it will make it difficult to get and hold a job in the future.
My audio and ibs c&p was so quick. They didnt ask super detailed questions to which i am not sure i was able to provide all necessary info. I got out this past march.
But how do I know WHAT records are relevant? I am not a Doctor. Several of my injuries are related so I am totally unqualifed to determine what documents are needed. This is why it has taken over 15 years for me to try and file.
I filed a claim that is related to a GYN condition which happened in 1995. I did not know that I could file a claim until recently discussing with my VSO. I have no medical records for receiving my diagnosis from that time as records are disposed of after 10 years, therefore all I have is my statement, buddy letters and medication that I have on my medical records. What else can I do?
the issues I encounter with C & P exams, is that the examiner don't get the accurate records and so, they just answer what the VA asking and that alone they denied me a few times for the same condition.
I was stationed at a PRP base and it caused a lot of issues going through the x-ray machine daily. I’m looking into trying to purchase your help and wanted to see if that might be something I could get your help to prove.
I can't go thru all that, my anxiety doesn't allow me to focus on the small details. I don't have paperwork, I got my mind. I know what happened to me without paperwork. Would it be better for me to just hire a lawyer in this field? I don't care how much it cost.
question im going to the VA for the first time served 10 active army after 20 of being out. all i have been is talk to the VA staffer to get medical for primary care. i do have ringing in my ears and is service related. but never talk to anyone about it my MOS 11M. So do i first go after my ear ringing first. once that's done and wait to get connected then go for 2nd diary conditions cant goto sleep wake up alot have to have tv on for the noise, mental health needs or appointments.
You definitely want to make sure you are officially diagnosed with tinnitus first before completing your claim submission. After that, a good personal statement explaining your high noise exposure will help get approved, a nexus letter as well will help maximize your odds at approval
@@vaclaimsacademy I hear ya but that's not necessary for tinnitus, they will test your and the machine makes a noise in the background like the ringing in your ears, say that and they diagnose you themselves
You can get diagnosed at the exam and still be denied if there was no nexus connecting your issues to service. Need to read your rating decision, it will tell you. Get a VSO or POA to help as well.
My C & P examiner didn’t even use a goniometer during the ROM part of the exam despite me asking about it. It's in HLR now. If no success on that, on to Supplemental.
Sometimes that happens but they’re actually helping you out, but sometimes they will not use it and just lowball you for whatever reason. Seems like there needs to be way more accountability. Especially since it costs the taxpayer like $5,000 per exam I hear
Physical exams have 3 different tests on the exam. 1. Your base ROM, 2. Your repeated use ROM, 3. Your ROM at the end of the exam. If you experience flare ups frequent enough they will do ROM tests for that too. They need the first 3 tests to accurately rate your physical issue.
I'm pretty new to this channel and its been great. I ETS in 40 days. I'm aware that things need to be documented to be service connected. I submitted my BDD claim through a VSO with 14 things on it. My VSO said that he couldn't pull records for sinusitis/rhinitis with nosebleeds and a few other things. Is it worth going to sick call while on terminal leave to get some other things documented? I've already gone through the majority of my medical appointments civilian side. Thanks in advance!
Have you had your SHA (Separation Health Assessment)? If not, anything you currently suffer from should be discussed during your SHA or separation exam. You can definitely go to sick call as well.
Look at your exit exam and service treatment records. Start by claiming what is already of record then as things get granted you can try to connect other things you have issues with.
I have a question, I have issues and different types of diagnosis, per x-rays with my back and neck. I’m svc connected at 50 for joint conditions-If let’s say I get 80 or 60% out of the back and neck? What would be my total rating?
If you are already at 50 percent and you get another rating at 80 percent that would be 80 percent of the 50 that is left so 80 percent of 50 that's left would be 40 percent your total would be 90 percent. If you got another rating at 60 percent that would be 30 percent giving you a total of 80 percent.
@@hereforthecomments456 ahhh got you. I just got out the military and the c&p asked me if I was “diagnosed”. Everything I was claimed is in my records, but there was a couple things I said no to since I didn’t understand. I can imagine this having a negative impact on the rating later, unless they look through the records and realize it is there for a decision.
Diagnosis is true medical evaluation and acknowledgement by a trained medical licenced person who has the education to state such things and write or document it for further use within ones medical history or records. ❤🎉
can i/ should i get diagnosed for a physical prob or mental by a outside doctor before initialting the process? for example bad knee/ ptsd? or is all done by the va? thanx
How likely is it if we obtain & submit a private DBQ, we will get sent directly (Ready to Rate) without being sent to be scheduled for the C&P Exam? How often do you see it happen in both scenarios?
As a rater I can say that it is 50/50 if it will be accepted or if you will still need to go for exams. Private DBQs are meant to be completed by your own physician but because the VA accepts them in any scenario is why there is confusion. If you use a private DBQ, use the current VA form, the doctor should be seen in person and within 100 miles of your residence, and every question on the DBQ should be addressed, even if to say no or n/a.
@@aliciaadams2764 Call the VA. Ask them for the FOIA request form to get your records. Be advised, however, that it takes months. They sent me a CD so you need a CD player too. It's a big pdf. Mine was over 1500 pages.
I had a C&P exam for my migraines with VES and I never heard anything or received any more mail telling me of my appointment so I contacted them and after finally getting through they said they didn’t set an appointment the doctor just sent evidence in without me being seen… is that possible? What should I do because it didn’t help my claim at all.
You could file an intent to file which gives you 1 calendar year to finish filing and gather evidence and get diagnosed. But without a diagnosis and a service connection before the year is up your chances of success are near zero. If you file within 1 year of discharge most of your conditions will be presumed to be service related. But, you would still need a diagnosis.
If ever offered video call for mental health refuse it. It might be hard to do in person but I will never convey your pain via video like u will in person. I'm telling you from expirience. Goodluck vets
Not true at all. I received a 50% rating with a video MH conference. And I was able to get my wife to talk to the psychiatrist alone. They both think I have PTSD. I'll use that later...
C&P lol more like a an interagation session. Mine were are done in a little room where it was stuffy and the room temp was set at an uncomfortable temp. So glade I dont have to do that anymore.
You need a current diagnosis a nexus letter from a Dr and DBQ filled out by Dr that will get you a exam long as they say your injuries are service connected
My CP exam was bullshit .. guy was a piece of work .. he was national guard major in his own private practice doing these exams and always talking over me.. needless to say everything was denied ..
Dam I kinda push my shoulders beyond my pain/ discomfort and the examiner kinda push my arm up as well, and she didn’t seven asked me anything about being connected or not for my conditions, I’m kinda nervous now
I told my examiner that, because I am. She said move until it ratchets up to next level. It worked out for me but I wasn’t happy. Of course, I can still move, it just hurts worse. 😂
As a medical examiner... please don't fake the pain. I rather have you tell me the severity of pain when you truly have a flare than fake it. I have different tests that I can check, without you being aware...and see if the truth is not being told. Please tell us the truth. Its best that way.
E4’s fake pain all the time and they walk away with 100% with less than four years of service and no deployment or rotations. How does that happen when a 21yr retiree is denied claims deployed to Iraq and Afghanistan and get less? I’m sincerely asking this question. I’m seeing it a lot lately.
@@iamtheonlywillyand no proof of back pain for some of these young guys that never served in a war and they walk away with 100% and our war veterans still fighting for compensation. It’s so sad.
@@everhappy6312 so you aren’t filling out the DBQ’s? Or are you just answering questions on another format? The DBQ is what sets the ratings. You may not know the rating schedule percentage but those boxes being checked is the percentage level. If you aren’t why the Exam? They could just do the DBQ themselves using the non evidence or actual evidence being used.
They aren't accepting anything not PACT Act related. So don't bother. I speak from experience. I have tonnitus, diagnosed, treated, and even issued hearing aids from the VA, and they denied my tinnitus claim. The best advice you can guve a veteran is DO NOT BOTHER TO FILE. YOU WILL NOT BE APPROVED.
The VA doesn’t pay you for having a condition-- it pays you only if it impacts your life. I’m a former VA employee and coach clients to assist with their claim. Fee is $50
Did you complain about ringing in the ears during service? Do your hearing exams while in service show your hearing getting worse or staying static? I barely got my tinnitus claim granted but it took 3 opinions before they granted it. I understand the frustration but hearing and tinnitus may seem like a given but your service records, MOS and what your job is after military plays a role.
And the guy in the video never deployed. He probably just sat behind a desk his whole 4 years. He definitely doesn't deserve his 100% it is sickengow people like him get 100%, but we that actually deployed in combat areas get less rating percentages. This guy is a true fraud and should be caught.
The physician needs to be reported to the physician board because he is falsified medical and documentation and that is fraud. The physician harassed you and said you're not going to get approved. That is straight abuse towards the patient. I would pursue this matter because he is not above the law and It appears she was unethical. Just remember he is a physician for the VA but he still has to go to the board.

@strongface87 Thanks. It's been a long time coming for my family and I.
Just had my exam for my back (ankylosis) on the 22nd. My examiner didn't use the tool to measure my back. She also tried to trip me up by asking me, how did I know I had ankylosis if I never had X-rays? My response "because the military diagnosed me 😏☺️"
My exam was pretty quick. Although she didn't use the tool, when she told me to bend I barely moved. I'll come back with an update.
Update?
@@frankieredd156 I have a few more appointments scheduled today actually. I'm just as curious myself. I will provide an update as soon as I get one, my case is still pending.
If you need to appeal or refile make sure you make that a part of your claim. "C&P examiner did NOT use a goniometer to measure range of motion."
@@TeilaSimon any update?

How are you able to view the DBQ’s?
80 percent of the time they don't send key evidence by the IG office - good video as usual SIR !!!
GTO the legend… Cheers and good health to you my friend
During my back exam, I could not bend during the ROM test because I was in so much pain. My back literally feels frozen (really stiff and tight with pain), so she was not able to use the tool to test my rom. I signed a waiver for not using the tool. On the paperwork she had me state my reason why I couldn't do the ROM test.
Thanks for the info. The VA will remove your gyno problem. I had a painful lump and they removed it
I’m scheduled for a C&P exam based on 5 gulf war symptoms
How should I prepare for it?
That having medical documents is a big one. I went for a Migraine C&P They told me the VA put in for tension headaches. They also didn't send her any of my records. I was able to grab a blue button of my recent exams I validated at least the basic info was there before sending them to VES. Currently waiting for someone to update so I know w hats going on. But yeah va is for sure not sending documents over.
Absolutely! Bring your paperwork reflecting your injuries. My doctor didn’t have mine, said he was provided nothing showing my fractured vertebrae.
Oh damn!
Sameeee! .. she said "thank you for bringing these so many people come so unprepared"
Had a similar experience. They didn’t have my health records and MRI but lucky for me I had everything printed out bfr I went there
Yep, I just did an exam last Friday.
So what do you do if your medical records prove you were hurt in service but the examiner said you weren’t and your claim is constantly denied
I stopped moving my knee at the real point of pain. This seemed to "disappoint" my examiner, a VA C&P examiner, who then rearranged my position such that my body weight collapsed my knee WELL PAST any point of pain
It hurt!!
Oh I understand...thankful for your reply.@vaclaimsacademy
During my exam dude didn’t even look at me. He sat there looking at his paper. He didn’t say anything about pain. He just said go as far as you can go. I can barely bend over before pain kicks in. But I can touch the floor but I’m in excruciating pain.
You stop at the first sign of pain.
@@shannoncurtis5503 yeah I wish I knew that back then. But the diaper stain of an examiner didn’t say anything about pain. Just go as far as you can.

@@danielhowell1640 yeah I didn’t know that back then.
wouldn't have done that im not going past my level of pain for an examiner. oh well they don't live in my body. they also can write in the file I made my client push past the point of pain. so when I inflame my back he can own that one.
Awesome info my brother! Keep up the good work.
If you are 100% don’t poke the bear.
Good info! Thanks for sharing!
My C&P Examiner said I am going to rate your claims as approved for Benefits but wrote the opposite on the letter to the Raters.
It's because of the questions the VA is asking on the medical opinion. If VA is asking a specific question then we have to answer it truthfully. This is a legal exam.
Crazy
Something to note, I brought my records with me as they didn't have them all even though I loaded them. the examiner noted she could look at them but couldn't use them as a valid evaluation as when shhe submitted the results the "back office" QA department wouldnt have them to review and would kick it back. This was Optum Serve. As an FYI.
I did a sleep study through optim serve and although they determined I had Sleep Apnea, the VA denied my claim because it wasn't in my VA medical record. Now I have to redo the entire process
Good video, easy to watch, lots of good info, no gloves.
3 C&P this year. None had any of the evidence I uploaded to VA when I filed. I had my entire file for each claim and all three were excited and input all evidence into the system. It paid off on all three claim/ C&P for me. The VA gives little to no information, from my experience.
If you haven’t, go to va.gov and start an account. If you have an account you can pull up your medical records and bring them to your exam.
Great information.
If you're going for TDUI (70% mental health), the same advice applies I assume?
As usual, thank you for the great info.
Can you do a video regarding SC for fibroids? Do you know much about this topic?
From what I’ve read, c&p examiners can also diagnose though obviously it would be better to already have a diagnosis
Oh wait who told you medical records was disposed of after 10 years
and what do we do when the VA says they cannot obtain our service treatment records?
and st louis cannot find them
are we as vets $hit out of luck?
the issues I encounter with C & P exams, is that the examiner don't get the accurate records and so, they just answer what the VA asking and that alone they denied me a few times for the same condition.
I don't care how much it cost.
thanks for the tips and information
question im going to the VA for the first time served 10 active army after 20 of being out. all i have been is talk to the VA staffer to get medical for primary care. i do have ringing in my ears and is service related. but never talk to anyone about it my MOS 11M. So do i first go after my ear ringing first. once that's done and wait to get connected then go for 2nd diary conditions cant goto sleep wake up alot have to have tv on for the noise, mental health needs or appointments.
You need to watch more videos and you will see you might be jumping the gun. Work on the big 3 first. I’m in the very beginning stages too.
I never had a diagnosis until my c&p exam for hearing and tinnitus
@@real-h1739 Same here.
Just got denied on back, feet, ankles and knees but was diagnosed during exam…what exactly went wrong?
During c&p exams are they able to access our medical records?
Why do they ask you to move a second or third time after you told them you have pain on the first movement?
Physical exams have 3 different tests on the exam. 1. Your base ROM, 2. Your repeated use ROM, 3. Your ROM at the end of the exam. If you experience flare ups frequent enough they will do ROM tests for that too. They need the first 3 tests to accurately rate your physical issue.
Just had my C&P exam, my examiner used that goniometer for everything on me. I didn’t have to sign anything though? Could that mean anything?
I was denied on multiple claims and never had a C&P Exam.
Look at your exit exam and service treatment records. Start by claiming what is already of record then as things get granted you can try to connect other things you have issues with.
Get a current diagnosis and a nexus letter and DBQ
Does PTSD always need to be combat related?
No! There is such thing as Non Combat PTSD!
Do you think it's a good idea to do a personal statement for every claim? Just wanted some thoughts.
Definitely!
Can someone explain what a “diagnosis” is exactly. If it’s in my records in general it was diagnosed right??
Have you see a dr yet? It would be in your medical records. Check your blue button report on the Va health website
@@hereforthecomments456 ahhh got you. I just got out the military and the c&p asked me if I was “diagnosed”. Everything I was claimed is in my records, but there was a couple things I said no to since I didn’t understand. many times the c&p examiner will diagnose your condition, especially tinnitus
Chronic conditions
Diagnosis is true medical evaluation and acknowledgement by a trained medical licenced person who has the education to state such things and write or document it for further use within ones medical history or records. ❤🎉
can i/ should i get diagnosed for a physical prob or mental by a outside doctor before initialting the process? for example bad knee/ ptsd? or is all done by the va? thanx
Doesn't matter who does the diagnosis but you should have one for any chance to get an exam.
need to get a diagnosis first from a normal outside doctor or VA doctor. then you go to the exam to explain the condition.
It's the VA's game. We just have to learn how to play it.

What should I do because it didn’t help my claim at all.
If your claim is denied, file an appeal and let them know you never had a C&P exam; not in person, not by video conference, not by telephone.
uhh maybe you won't need one lol see if it got denied you dont always have to have a C and P exam some don't require it.
Can you do a video on claim 1151
Will they even give you a C & P exam without a diagnosis?
Can you file a claim if you believe you have something wrong but didn’t see a Dr yet/ do not have a record of it?
You could file an intent to file which gives you 1 calendar year to finish filing and gather evidence and get diagnosed. But without a diagnosis and a service connection before the year is up your chances of success are near zero. If you file within 1 year of discharge most of your conditions will be presumed to be service related. But, you would still need a diagnosis.
go to the normal doctor first.
If ever offered video call for mental health refuse it. It might be hard to do in person but I will never convey your pain via video like u will in person. I'm telling you from expirience. Goodluck vets

I second this... do it in person.
Results may vary. I had a video call and was rated 70% for MH, which is what I think fits my symptoms
Not true at all. I received a 50% rating with a video MH conference. And I was able to get my wife to talk to the psychiatrist alone. They both think I have PTSD. I'll use that later...

That's strange. Even after you filed claims?
Hopefully your evidence is enough, without a c&p.🤞🏼
