Excellent arguments by Mr.Kapil Sibbal. And the way he explained the situation , makes it very clear that the bringing down of the govt of Maharashtra was unconstitutional and thus illegal. Now it is for the Honourable Supreme Court to right it. This will help our democracy and constitution immensely.
Mr. Sibal is simply playing with loopholes of the law. The soul of our democratic constitution is in the vote of the elected members of the legislative assembly. If the party compels it's members to vote in favour of the government evenif the members don't want to, we lose the very soul of our constitution. Eknath shinde group decided to not be with the uddhav led government. So if no confidence vote is asked and uddhav gives them whip to vote in his favour then Eknath shinde group loses their right to vote as per their will. If they vote against him, they are disqualified. So it's a loophole in the constitution in the matter of party whip.

We are not gonna talk about the constitution but let's talk about ethics here. Shivsena decided to join congress after the election. People voted for BJP and shivsena because they don't want congress or NCP in power but ultimately, they came in power. Now you tell me, what shivsena did was Ethical?
They fought an election. During rallies, they alleged congress and NCP for corruption and incompetency and suddenly formed a government with them. Why, because that was the only way to get power? Basically , stabbing voters for power. I not am saying that what the BJP did was right. They should stick to party promises that don't matter if it's written or verbal. Even they were ready to form a government with ajith pawar. All of them are power hungry and nobody cares about people who voted for them and voters are so blind that they are still taking sides.

SC should stand for the truth and truth only in respect of constitutional procedures not caring for any party whether that particular party is in power or not.. whether it's BJP, Congress or any other party.

It is a tricky situation. Had the trust vote taken place without UT resigning, the matter would have been altogether clear with respect to legal consequences. There is a good point in the argument that "defection" in the party vs "dissent" in the party, what is sought to be curbed by Anti-Defection Act? Against that, the dissent can be handled at the party level and not at legislature level. It boils down to the question Is the Party different from the Legislative group?
Trust vote happened when speaker was elected, Shivsena issued whip to vote against the speaker from BJP, but these Shinda group MLA voted in favour of BJP candidate, basically they appointed their own whip, so even if UT had not resigned outcome would have been same i.e. we don't follow Whip appointed by UT, this is all farse going on, injustice has been done.

What ever be the constitutional obligation on the part of Hon'ble SC but its an open transparent reality that Mr Udhav lost confidence of majority Shiv sena MLA's lead by Mr Shinde there by reducing the alliance no game of them with Congress n NCP. As regards Hon'ble Governor the constitutional head to oversee n administer stability of a Govt for smooth functioning in the larger interest of people of Maharashtra did ethically the right decision to admister oath to Mr Shinde who commanded majority support of MLA's at that point of time n also in the present scenario. Thus I fervently appeal to the Hon'ble SC bench to conclude the judgement to keep the faith n trust of majority people who are represented by their elected MLA's
