If tomorrow thay come to your house and arrest you or your family (god forbid) in the name of law and order, would you still argue on the same lines? The law is there for a reason. Upholding it doesnt make us weak or lets gangsters escape. On the contrary, one could argue, that the USA is such a power because it observes the law.

    I appreciate the boldness of the lady in defending her actions through her arguments. Her choice of the Defense Counsel is pathetic (he is totally unprepared). The Judge is doing the right thing to understand the urgency. Defense Counsel is a lame duck.

      He is not a defence counsel. He is the state counsel and he is not lame. The questions of the court were addressed directly to the cop who appeared personally on being ordered to do so and there is nothing exceptional in what she said. If you had ever been to a court you would have known that senior police officials when summoned to the court, always defend the actions of their juniors. First understand the court proceedings and then start running your fingers on the keypad.

      There is no practicality in the court of law in India .. Either it's illegal or legal .. not right or wrong... Courts in India are Bound by the procedure established by law unlike the Courts in the USA which follows the Due Process of Law . So the Objectivity of the written laws are to be followed regardless of its consequences.

      @@pantomathlonda6746 The reasons for this backlog are complex and involve multiple reasons, lack of judicial infrastructure, lack of judges are one of those reasons, government is often the largest litigant which leads to slow process and backlogs . A lot more facts , i can discuss with you. Judges are not only a functional body in the judiciary it's you and me also . With deu respect sir , in that particular part of the court proceedings I felt it was negligence and instinctive decision making of the sp was somewhere wrong .

    If there is a murder or robbery at the judge's house, anyone can be called to the police station to catch the culprit, but poice must secure Accused within 24 hours. If police do that in the common man case, the judge immediately becomes a saint and acts like Gandhi 😂😂😂

    If it had been the judge's daughter's wedding jewels then he would have been questioning the police woman whether she was sleeping during duty hours at night and why wasn't action taken to detain people who are aware of the theft. Policing is a thankless job. How will these judges who take long vacations undrrstand the plight of the policewoman. She has to hunt and arrest the criminals and their collaborators at night when judges will be peacefully sleeping and then produce them in court before such kind of insensitive judges

      The woman who was picked up at midnight was not the criminal for your information.Her husband was accused of a crime and the wife and the children were picked up by the police which is against the law. You must remember that Police is not the law, they are the enforcer of law. So they too come under the purview of Judiciary. As a former employee of Hon'ble Court, I have seen numerous case where police have intimidated innocent people and the only thing they fear is the Judiciary.

    Now this is height, when police act then court suspend police. But the important point of murder is completely neglected. The law should also consider the circumstance and given that the wife will be completely aware some support to police is required. All respect to lordship, but he should also consider the place if police have waited for another 2 hours the wife may also escape. I stand with police in this case

      This is an extremely negative analogy. First of all women is not the accused, u didnt hear things clearly. This is what negative thoughts and judgements do to us. Realistic condition is, if such things would have been the case the cops would have raised an alarm when they were there at the venue itself and documented them and presented it in court, which the cops never had. They didn't even have a justified reason to Bring her to court. Buddy 95% of the people in the world are not criminals so we have to realistically look into a situation as per Law. Bcoz of 5% criminals 95% genuine citizens should not have a traumatic life experience especially when there are children involved. There has to be an evidental threat observed and verified instead of a cops random judgment.

    Wow, it was a matter of just 2 hours. And when you expect police to do their work righteously, why you again blame them in case of their inability of catching a culprit? Law is law, but circumstances are more crucial.
    If a wife is fully aware about the misdeeds of her husband and still supporting him, what makes her less criminal then him? And if the society is seeking equality between men and women, how women can't be arrested in the night by the lady police?
    And last thing, criminal has no time duration for committing a crime against another human, doesn't it again oppose the notion of civil law?

      Wife of the accused is arrested without any warrant and magistrate order and you're on the side of the police.? Police works under the law not above. Innocent until proven guilty is usually followed not guilty established before arrest. Accessory after the fact is supposed to be the reason for her arrest but after 5 days the order is issued. What incompetence is the police doing. Guilty party will walk free because of their incompetence.

    As a Bangladeshi, I am very impressed to see such practice where a judge is standing for civil rights, even for notorious criminal's wife. A citizen is citizen, right? No matter who they are. Actually, under Awalami league/Sheikh Hasina's era we didn't have any human rights. The country was like a jungle. Total system was corrupted by her (Hasina). The police, army, judicial systems and everything were under her control. That's why when we see such good practices like this, it feels starnge to us.     Judges like these make it impossible for police to do any investigation In Criminal cases. The judge knows very well that the criminal is a history sheeter, involved in multiple cases, his wife is refusing to divulge any information about the accused, and the judge here is more concerned about the time of police action.
    In this case the entire police station is put on suspension, so effectively the judge is saying to the police, regardless of the case, we expect you to walk on a tight rope and will punish you for every procedural lapse, and we don't care if you solve the case or not, but don't impinge on civil rights of the criminals. This is authoritarianism on the judges part.

    Inshort court wants to say, keep copy of low book all sections and code of conduct with you. And don't do any thing out of that even if there is a need to for presence of mind.

    Judges should give this lecture to wife and children of those who were murdered by the accussed. Who will forever become widowed and be fatherless. Ask them what is judiciary and law enforcement was doing when despite the accused previous murder records, why was he granted bail by the court. I am pretty sure the judges who granted him bail would surely be like the judge passing comments. Hearing everything and previous murders committeed by the accussed, it is pretty clear that this is not one off incident but it's the accussed full time business.
    Regarding picking them up in morning, Dhubri is in Assam that is Northereast of India where government schools start at 5 to 5:30 AM as the sun rises very eary there. So, it can be forgiven when the SP apologized for it.
    It is because of woke judges like this that crime in our society is gonna increase. I know from the matter of fact, that what these type of judges have done to US and made it into a safe haven for criminals. A anti corruption inquiry should be initiated against the judge to examine his wealth and earnings.
    This woke judge system meeds to go. If a person has one off incident, you can treat him with hiw you are treating this case but if he/she is a repeat offender, such roghts cannot be extended to such psychopaths.

      They only follow what law and order say's,,, if you need to work and night by your own then go to that lady collect information from her residential that's what law and order say,, you not call her to police station for your day and night rush running
