It depends on where you live, but even Judge Benitez's ruling won't make your charges go away. This State is F'd. They will appeal it and have his ruling Stayed.

I am a retired social worker, child protection for LA county. I would have given a bundle to have had a judge like judge Benitez. Sometimes tough love is very helpful, like this case. What was the outcome. Did the girl learn from the experience. After my own daughter was arrested ir was a turning point for her.

They overturned prop 187 w which encouraged the invasion from our southern border.Californias now just northern mexico.If it goes to them they will rule against Benitiez and us.
I have no problem at all with what Judge Benitez did with the teenage girl. If it were my girl, I would have deeply appreciated it. I note to Judge Benitez, if you ever read this, I am so thankful for what you have been doing for the second amendment here in California. You have helped us to see light at the end of the tunnel. Didn't the 9th put an emergency stay on Miller because Benitez said it was so blatantly unconstitutional he wouldn't even entertain the idea of issuing a stay on his order?
not quite, if I recall he put a stay on his own order because he said while it doesn't comport with the Constitution or Heller, but that the 9ths' interest balancing test wouldn't let his ruling stand.
Bruen's KEY decision is the elimination of the 2 step interest balancing test. The Text History Tradition test is already factored into Heller, and the determination for 'commonly possessed for lawful purposes' is dealt with in the Caetano case.
The interesting thing about Heller is it actually makes the laws requiring gun locks / safe storage unconstitutional, because the case was about having a handgun readily available in your home.
They are intimidating a federal judge. This is illegal, send people to jail.
The federal judge shouldn't have violated the young teen girls rights. He made that mistake.

A friend of my looked up a chart of the amount judges who have been reprimanded by the state judicial council. It’s laughable. Zero removal or consequences. If something happens to this judge, it’ll be a huge outlier.

I applaud Judge Benitez for doing what he did with the young lady. It’s a proven fact that scared straight tactics can and do work to help young people make better decisions in their lives. I’ve used similar actions with my own kids when they were young and one of my daughters used the same approach with her daughter.

Texas is laying the groundwork for that in the 5th Circuit Court. Once that's done on a Federal level in that district court, it will be very easy to bring that jurisprudence over to CA and the 9th Circus Court.
it's always been legal to manufacture your own firearm for personal use, you just can't transfer it or transport it across state lines

@@kingmasterlord The whole idea of "not transfer across state lines" is based on Democrats using the Commerce clause to justify the 1934 NFA. Democrats in 1933 Senate hearings are on record saying that they thought that they could tax guns under the commerce clause, to get around the unconstitutionality of banning them under the 2nd amendment. Since we have had SCOTUS rulings in past 20 years saying that the government can not tax a civil right, taxing across state lines is blatantly unconstitutional under the Bruen standard. Banning them outright, from average citizens, violates the Heller standard.
Serializing of guns was not required until 1934 and serializing of shotguns and .22 rimfire rifles was not required until 1968. Yet most manufacturers serialized their guns for manufacturing purposes and keeping records of changes.

@@Detective.John.Kimble it happened to you because of an incident that you were involved in. She wasn't being investigated for anything and was just there to support her father. As far as arrest, according to the supreme court, putting cuffs on a person and stopping their free movement is an "arrest". To arrest, detain, or question someone, they have to have RAS. To put it another way, if you were walking on a side walk and the police stopped and put you in cuffs because the cop thinks you need to be scared straight to not do something in the future, would you be ok with it. Be honest, you would want to sue them for violating your rights. The judge certainly has the ability under law, in his court room to detain someone who is breaking the law, interrupting the court, or doing something not allowed. He could certainly ask her to come up and stand there. He could ask he questions if they read her her rights that she didn't have to answer them. But he doesn't have the right to hand cuff a little girl who was not accused of doing anything and they had no reason to arrest. I understand his point, but he made a mistake. He violated her first and 4th amendment rights and probably a few others. Don't get me wrong, judges do this every day because the people they do it to are poor and don't have the ability to sue and get compensation. Recently there was an activists who was in court just to watch. The judge forced him up to the front and tried to force him to take an oath and be questioned. He refused because he was not there for doing anything wrong. They threw him in jail for contempt. Judges have way to much power in their court and you can't sue them for misdeeds. The only thing that can be done is other judges higher up can disbar them. Thin blue line, it doesn't happen very often.
Her father practically begged the judge to do it so his daughter wouldn't end up like him. I think we can let this slide.
What disturbs me is that a judge tried to show tough love that is obviously needed and he is attacked for it as if the best course of action is to do nothing and let a 13 year old girl ruin her life, maybe Newsom wants more people to be felons. You can’t coddle kids and expect them to be ok, they need that tough love. No matter what happens I hope this young girl is persuaded by this to go down the right path.
Let what slide? I was treated far more harshly the one and only time I went before a judge for pot possession when the court misfiled my original fine payment and they threw me in jail for a week after putting a warrant out for my arrest. I eventually proved I'd already paid it, but I didn't get any restitution for the false imprisonment or anything, nothing benitiz does was even objectionable, it is nothing and far more honorable than most judges act on a day to day.

Please explain, how can they appeal these cases when they don’t have “a likelihood of success on the merits”?
The State will appeal to the 9th Circus Court. This court makeup has changed thanks to Trump, but still leans to the Left by 2 judges. As such they will likely rule against our 2A Rights and uphold the State "law". They will force the issue back before the Supreme Court because of their ignorance. They will ignore and twist the Bruen decision to fit their insane narrative.
It's all about stall tactics.
Anything can be appealed.
In some ways, we want them appealed so they can be struck down countrywide.
Justice delayed is justice denied.
We see the government and those with perceived authority give the same treatment to whistleblowers. Try to make it about the whistleblower instead of what they are exposing. So scared straight isn’t a way to improve things anymore?

Let's support Judge Benitez. I remember California had a state scared straight center near Camp Robert's. The judge opened himself up to unnecessary risk by doing the "right thing".
I thought the history and tradition was supposed to happen before a legislative vote... guess not in California under the horrific government in power since the 1990s.

As a former CA Army Guardsman I remember seeing young kids being marched around formation by Army cadres at Camp San Luis Obispo. I initially thought it was a JROTC program but found out they were all trouble making kids sent to go through "boot camp" to straighten them out. I believe it's called "Grizzly program".

The question there is if they will comply with the guidelines that SCOTUS gave in Bruen or if they will need another spanking. Curious question Anthony, if for some reason the 9th circuit were to up hold their previous ruling (again) what remedies does the Supreme Court have rectify that ruling? I know they SC could kick the case back down and say do it again, which could result in the case going back to Benitez again. Could the SC overturn the 9th circuit’s ruling, or even better publicly reprimand them on top of overruling the 9th?

Is there a time limit when State or Federal agencies can appeal a decision once they lose in court OR can they wait until court membership makeup changes to more favorable to state or federal?
Regardless, these 3 cases will find their way back to SCOTUS, and then the entire country will be free.

Their are many factors why someone is placed in handcuffs for detention under investigation or security and later released with no criminal charges. In my state the agency issues a document outlining you were detained but not arrested.

As a Mom and daughter I can only say that back in the day helping a minor see where the error of their ways would likely take them greatly helped minorsmaje more advisable decisiona to course correct and have a brighter future. This is so sad. Only slimeball morally corrupt politicians would continue to push their crappy agenda of not holding people accountable for their actions. I wish there were more judges like Benitez. We need people with compassion who still hold people accountable. Rights come with responsibilities, and people need to understand that. And wrongs come with consequences. In cases to simple assault for detainment handcuffs can be used for safety in questioning, which the judge did do without objections from parent or guardians.
Her Father was in the courtroom standing by and watching this.
Tough Love is what the judge was using to hopefully get the girl to realize how things can go IF she doesn't start down the "straight and Narrow " so to speak.

This happened in 2004, why wait 18 years? I think it won't sway his decision because he was right the first time. The last time he stayed him decision because he believed that interest-balancing would prevail, not anymore.
