The law about lates not being allowed on your credit reports is found in the UCC. I have used it for years. Furnishers/alleged creditors operate in commerce and are required to abide by the UCC. Basically what this code says, is that if you are late, you are in dishonor. Once they accept a future payment, they MUST treat it as never having been late - "never being in dishonor." I’m glad I saw this video because I know a late payment shouldn’t be reported if it’s past 30 days but they did so anyways and I was literally 1 week late from due, i stg. I’m still fighting it as we speak but I will do this method if current one doesn’t work.
Well they have 30 days to respond to you not to complete their investigation. So they will often send a letter saying they are investigating and that will comply with the 30 day requirement.
You can dispute all late payments in one letter but it's most important to dispute the most recent ones and you can just do those over and over until hopefully those come off. Then you go after the older ones. Either way is okay.
If they correct the error then hopefully that tradeline is in a positive status and it helps your credit score and the way future lenders look at your profile and credit eligibility.

As a co-signer, you are responsible. So, you're going to have to dispute the lates on your own report. Hopefully they will remove them off your credit reports because they can keep them on the reports of the person you cosigned for. You may have to really go hard after the pretender lender as to how it was funded in the first place because the truth is, it's against the law for banks to lend their money from their assets or their depositor's assets and it's against the law for them to lend their credit. What they do is lend you YOUR CREDIT from your signature on a negotiable instrument, exchange it through the Fed Reserve and fund your account that way. So, they failed to disclose that via the contract and the contract is void because they failed to provide full disclosure, failed to provide consideration and fail the element of Equal Risk, required for a valid contract.
For those in this situation, you will need to dispute to have the account removed from your credit reports. If you get it removed, it doesn't get rid of the account, just the reporting of it. The best way to do this is to challenge the bureaus on the errors and demand they conduct a reasonable investigation and provide the documentation acquired through their supposed investigation. They won't give it to you. Their claim will be hearsay and according to case law, hearsay is incompetent and inadmissible. Keep disputing different things and demanding proof of the verification and documentation. You need to change each dispute but also call them out for not providing the documentation of the investigation. After that, take them to small claims court. You aren't suing them for whether or not the lates are accurate, you're suing them for their failure to remove unverified information, failure to conduct a reasonable physical investigation, falsely claiming that the dispute is resolved when if you are still disputing it, it is not resolved. They are REQUIRED to remove inaccurate, incomplete, or unverifiable information. These bureaus and creditors refuse to follow the law in most cases these days and no one or any agency enforces the law agents these bad actors. You have to take it to court for your remedy.
I cosigned for a vehicle for my brother. He quit making payments and my credit tanked. I tried to repossess his truck and the finance company said I had no legal right to do so. Yes , you can repossess the truck because you are the co-signer meaning If he can’t make the payments you are liable for the that truck they’re lien to you . If that was me I would report them
My brother has traded the truck for another vehicle. The tow truck company that has the truck has removed the vin. I tried getting the cops out there and was told it's a civil matter. The prosecutor also said I can't report it stolen because my brother traded the vehicle. Basically, if you co-sign in Arkansas you're screwed
@@wormjad1973 I'm so sorry for this situation. Now you may have a repo come on your credit report unless he actually sold it and whatever he had received for it went to the "lender." They will at least put a charge off on there most likely if they didn't get full payment. You'll have to dispute this like a charge off and require full documentation proving the accounting or if a repo, dispute the accounting and proof they followed all the laws regarding repos for your state, which require specific notifications by certain deadlines. They usually don't follow everything correctly and also, if they did a repo, then they failed due process because its a civil disagreement that has to be settled in civil court. You can't just take something for non-payment. They have a burden of proof required and a judgment and order from a court. They don't follow the law because people don't understand their rights and they get away with it. Oh, and a tow company has no right without consent from the registered owners to take a vehicle. Just FYI.

You will need to review that tradeline and find any and all mistakes on it and dispute each one with the credit bureaus. Don't dispute all the errors at one time. Dispute one error, ask for a reasonable investigation and for them to provide you with the documentation proving they did the investigation and a statement of verification from the furnisher or them, signed under penalty of perjury in compliance with federal law. When you get the response, it will be lacking the proof and the verification. Then, take copies of all your disputes and all their responses, all your credit reports and sue them. You want the judgment against them to require removal of the unverified account. I had a three-year car lease with Kia, it closed in 2018, for some reason one agency has: - 100% payments made, all green checks but say 1/0/0 for 30 days late. second has: - 2 red X for late 60-90 days 98% payments 3.) 1 red X 30 days late. it’s 5+ years old, going on 6…idk why it would have ever been reported late as it was the final 2 months before I brought the car back to lease again. Yep. They make the accusation, they bear the burden of proof. You need to dispute requiring a full accounting, and when I say full accounting I mean a fully audited GAAP accounting. It's in the federal code.
To me, goodwill letters admit that you in fact did make the payment late. With that information, most companies won't remove past late payments. Consumer law typically takes care of this.@@biggthirsty2089

What kind of account is the time share reporting as ?
I would get that offer in writing because they don't always remove the lates as they claim. Seen it many times.

You can still attempt to dispute, but chances are lower since the info may be accurate
