- A California father's outrage is on full view as he's told his entire family is to be booted from an overbooked Delta flight. A flight attendant actually told the Orange County couple that their kids could be taken away if they didn't surrender their seats. "You'll be committing a federal offense," the attendant said in cell phone video of the incident. "You and your wife will be in jail and your kids will be put in foster care." It happened aboard a flight from Hawaii to Los Angeles last month. #InsideEdition
The “Kids in foster care” comment was totally unnecessary and inappropriate. Why would she say something like that?

No amount of apologizing or free 1st class seats to any destination would rectify the gross injustice that was handed down to this family by that single flight attendant. I do hope however they did seek Justice by suing her for the the threat of taking their children away and putting them in and Foster care and the airline themselves for harassment and abandoning them in an empty Airport with nothing open at 12am.

I remember this story. Back then, we were planning a trip to Hawaii. Our kids weren't infants, but THIS story convinced us not to fly Delta. We never flew Delta for any of our family vacations. The gall of that flight attendant to threaten the family like that. Unbelievable.
convinced you not to fly delta? it shouldn't. the airline industry in general is riddled with bad pr, you'll find similar incidents (and even worse ones) with any airline. what happened here sucks, but you can get that treatment on any airline

I imagine as the names didn't align, and common sense was chucked out the window...that was the reasoning behind the airlines decision to remove them all unfairly. It doesn't defeat the point in anyway that the family had been horrifically treated and threatened.

But the airline was not at fault. he did not pay for the seats for the toddlers and is only pretending to be concerned about safety to get a free seat. Did not care about their safety when had to fork over money to pay for their seats. Just being cheap. He does not get father of the year because he cares more about money than his kids safety.

The flight attendant? She’s just doing her job. Her boss told her to get the family to leave to make room for the extra passengers they overbooked. A single flight attendant doesn’t have the authority to kick 5 people off and arrange for replacement passengers to take their place on short notice, that is the airline.

Airlines shouldn’t be allowed to overbook flights
They have to to operate successfully. Only booking to 100% capacity then no shows could result in the plane being too empty to make it worth travelling. Large Hotels tend to do the same thing around Xmas and big local graduations, they can't risk running at anything less than virtually full capacity. It doesn't make business sense as you leave yourself open to being unprofitable. If they oversell to 120% capacity and 20% miss the flight or cancel for whatever reason, they can still fly full. Sounds odd but most big venues/travel companies all oversell. It's a very common business model.
The Wiz Kid so the airline should provide the last passenger private jet somehow if nobody miss the flight.

We covered this case in my Law and Theory class. Technically, the seat was not in the infant's name and as such, the airline used a loophole to reclaim the seat. Had the parents changed the ticket to the infant's name, the airline would have had no leg to stand on. Either way, the flight attendent and airline were 100 morally wrong, and legally on very shady ground.
It’s not technicality or loophole. Their teenager who had the seat took an earlier flight. The only way to put the seat in the infant’s name would have been to buy an additional seat because the teen’s fare was already settled. Right?
I get the technicality that the seat is not in the infant’s name but is it right to kick off family with infant kids at midnight?! At the end of the day the parent paid for the seat. It’s not like the plane lost money. This is still

Techhniquelly you did not pay for the seat unless you reserved it which cost extra. The normal flight ticket is you pay to board the plane but that's it rather it's the same flight or next. Also, the reservation of the seat is reserved under the person's name that the seat was purchased for.
They didn’t pay for the seat. They paid for a ticket for their kid who then moved to a different flight, which means that the “seat” that was paid for also was moved to that other flight. They had not paid for this seat. It was an infant in arms, which is free because they don’t take a seat. So if they wanted the seat, they would pay another fair for the seat.

I mean yes technically she's right, flight attendants have fairly broad leeway in what they can lawfully demand and failing to heed lawful demands from flight crew can be a federal crime. And yes, they have every right to take that seat, read the fine print the ticket only applies to the name on the ticket. Hence Joe Smith, Sally smith, Jerry smith individually rather then a single ticket for x seats under the familial name. Just don't fly unless you have to honestly, it's horrible for the environment and has been a crooked industry since it's inception.

They do tell em. But if that standby passenger didn't get onto their flight because of a delay or a late flight, it's not the passengers fault, so Delta would have to accommodate them. But i do agree that the issue in the video is wrong.

My guess is that its not just one company in control but many different airline companies working in one airport. This probably makes it harder for things to get done efficiently and lets mistakes happen more often.

Airlines will always overbook seats, but usually when this happens, they usually offer things for someone on the flight to give up their seats. Usually they offer cash, higher and higher until someone gives up their seat.

When the teenager didn’t check in for the flight it told the airline that the seat was open so they sold the seat again. This is commonplace among most airlines in the US. Overbooking flights will not go away.

- tickets refunded
- hotel and meals paid for (preferable a higher end hotel)

I think that's the thing they did. Payed for 4 tickets only. The teenager swapped to another plane with one ticket. So that seat is still vacant and was sold to somebody else, but the family put their kid on a seat which wasn't theirs.

As rude as the stewardess was she was technically right and the family had said that they had purchased the seat for their son their son took an earlier flight to therefore he used the seat that was paid for and was no longer available to them so the stewardess had every right to give that seat to another person the family was basically trying to get a two-for-one deal and was angry when things didn't go their way

Happens more often than you think with the threat of jail. I stayed at a Hilton hotel for 7 nights which was not cheap, I was driving home and got a call that I didn’t recognize so I let it go to voicemail, it was the receptionist threatening to call the police ln me because my card only let then pay for all of it except 23$ because it was a credit card and it got locked once so much was spent in another state. Keep in mind Over 700$ did go through and was payed, yet they had the audacity before even trying twice to contact me to threaten to call the police. Best part is when I went to complain the complaint went to that same person as they were the manager so I never heard back from them. How does such a nice hotel chain higher such a shity manger that threatens to call the police on someone who has just spent over 700$ at their establishment

It still blows my mind that an airline can sell more tickets than they have seats available on a flight. This is done in case some passengers don't show up for their flight and the airline can maximize the money they make. And it's all 100% LEGAL!

I was completely on the family’s side until the thought came to me, they paid for a seat for their teenage son who took an earlier flight, okay. So they decided to use the paid for seat for their toddler. Am I right so far? Since the seat was booked for a passenger who did not show, even though the person who paid for the seat was present, the airline is entitled to give it to a bystander. Where were the parents originally planning to put the toddler? Okay, I’m still confused.

Every airline should pay for all expenses incurred by any passenger on their overbooked flights. Hotel and food expenses, taxi, and re-booking charges as well as a fee for inconvenience.
