    We have filed two recovery cases in Thane Registrar before three years, and hearing are completed before three months till todate we havenot getting recovery certificate .

    नमस्ते मॅम, आमची एक आर्मी सोसायटी आहे. त्यामध्ये एकूण पाच बिल्डींग आहेत. त्यापैकी दोन बिल्डींग सहा माळयाच्या असून प्रत्येकी 36 युनिट असून सर्व समान 1008 चौरस फूटाच्या आहेत. दुसऱ्या दोन पांच माळयाच्या असून प्रत्येकी 20 युनिट असून सर्व समान 1450 चौरस फुटाच्या आहेत, शिल्लक एक पाच माळयाची असून त्यामध्ये पण 20 युनिट असून सर्व समान 1755 चौरस फुटाच्या आहेत. सोसायटीमध्ये सार्वजनिक हॉल, सुरक्षा रक्षक, साफाई कर्मचारी, सुरक्षालाईट व पंप हाऊस लाईट इ. कॉमन सर्विसेस सर्वांना दिलेल्या आहेत. प्रत्येक बिल्डींगसाठी एक लिफ्ट असून प्रत्येकी बिल्डींगची पार्कींग लाईट व गॅलरीची लाईट सुविधा दिली असून प्रत्येकाचे सेपरेट लाईट बिल येत आहेत. लिफ्टीची AMC एकत्रच एका डिलर कडून करून घेत असतो.
    महत्त्वाच मुद्दा हा आहे की काही सदनिकाधारक हे मासिक मेंटेनंस हा चौरस फुटानुसार घेयला पाहीजे. हा खुप वादाचा प्रश्न निर्माण झालेला आहे. आम्ही सर्व 132 सदनिकाधारक हे आर्मी बॅकग्राउंडचे आहोत. आधिकारी लोक जे आहेत ते खालील वर्गाच्या लोकांवर दबाव आणतात. यातून एक मार्ग काढला की जे कॉमन सर्विसेस आहेत त्यांचा खर्च सर्वाना समान भागात वाटू व प्रत्येकी बिल्डींगची पार्कींग लाईट व गॅलरीची लाईट लाईट बिल, लिफ्टीची AMC त्या त्या बिल्डींग वर टाकू. त्याप्रमाणे आम्ही मागील वर्षी केले पण. त्याप्रमाणे येणारा मेंटेंनस रिकव्हर पण केला. परंतु पुन्हा एकदा ह्या मुद्दयावर भांडण निर्माण केले आहे. तरी आपणास विनंती की या वर काय मार्ग काढला पाहीजे की जेणेकरून कोणावरही अन्याय होता कामा नये.
    सदया आम्ही सर्वजण 1000/- मासिक मेंटेनंस घेतो व एक वेळेला सर्व बिल्डींगचे लाईट बील व लिफ्टचे AMC एकत्र करून येणारा खर्च काढून ज्या बिल्डींगचा खर्च जास्त झाला आहे त्याकडून वन टाईम वसूल केला जातो. पण यावर्षी ते नकार देत आहेत. यावर काही न्यायीक निर्णय असेल तर कळवा व आपल्याकडून काही मदत आसेल तर त्यांची काही न्यायलयीन ऑर्डर असेल तर कळवा, ही नम्र विनंती.

    Maine ye month me shop purchase kiya hai..uska possession and agreement copy society ko submit kiya hai aur unse maine NOC and share certificate ke liye demand kiya hai,,,but unka kehna hai ki aap pehele ye month ka maintainance paid karo fir aapko letters milega.,,and unhone maintaince bhi builder ke naam se diya hai....is it correct plz reply

    good morning sir I am santosh sharma I had problems in my society ower society secretary always he toucher like sending letters from society name with unnecessary topic like car parking outside building wall lick and when ever we go to him with our problems he always say pay your maintenance bill, after we pay our maintenance he don't solve our problem .
    I don't know what do please help me out sir.

    Our society secretary is so arrogant to talk to my family .
    Has entire power in his hands
    Groups supports secretary
    He stays on the up flat
    No accounts are ever shown to members
    Charging excessive money for religious ceremony in the name of maintenance
    And many more complaint.
    CAN A COMPLAINT AGAINST SECRETARY BE FILED ? IF YES , WHERE ? WHEN ? TO WHOM?

    Good Evening Sirji,
    Jay Prakash here, I have a flat in ghodbunder road thane, and fm the time I purchased I have given it on rent, the society managing committee has always been in boisterous behaviour with me, to cut short on the recent problem they plan to introduce moving or shifting in and out charges for tenents inspite of NOC charges paid by me, Sir that is a 2bhk flat but it has never fetched me a rent above 15000/- rupees but the society is charging noc fixed charges of rs 400/- and now they are planning to introduce for tenants only 1200/- rupees for moving in charges and 1200/- rupees moving out charges which is absurd and nowhere mentioned in bye laws of Maharashtra CHS act.
    Sir please guide me how can I takle such a problem

      No it cannot, 95% of committee the dictator behaviour is chairman secretary and rest committee members are servants for chairman for personal benefit,
      In your case it is maybe the current service provider has been giving some favours to committee to restrict competition other than this I do not see any other motive, you have to upgrade yourself by having good knowledge of chs bye law, or be silent or join the committee or be an sane voice in herd mentality

    Sir .. I am NRI / OCI living in Canada. I booked a unit in greater Noida in RAS housing cooperative society in 2012.
    Later society said builder is Rudra . I have paid 95 percent amount some in favour builder and builders.
    I have not received possession yet.
    I should file case against housing society or builder.

    Sir ..Recently SC has reiterated tha Interim Stay orders are expired after 6 months unless extended with strong supportive Documents .
    Is it applicable to Interim Injunction Also ? Situation is same in Interim Injunction and Interim Stay .?

      This is the most practical solution as,suggested by adv Vinod Sampat. A committe of persons whose erudition and legal knowleedge will advise members. this is,akin to a filtration.process.so all and sundry will not rush to Dy Reg and crowd the dept. also only rule law should be the criteria of passing a,judgement .o other extraneous considerations can be done away with.very good idea and suggestion.     Sir, no societies follows the laws, mainly because in India, there are so many laws, but implementation mechanism is not there, if implementation mechanism was there then corruption again undoes everything, hence as far as i know almost any societies no one knows the byelaws, even if someone knows it is half baked and the funny part is that even if these societies get a very efficient Society Manager too, they dont know that he is not a Secretary but a Society Manager who knows the rules thorough, they only learn when heavy fine is imposed but then also 90% dont learn

    Whether Premises and/or Industrial Co-operative are related with the Mumbai District Co-operative Housing Federation Ltd and they have to adopt the Bye-Laws printed and published by Federation and they have to carryout amendments as per 97th Amendments of 2013/2014 and also carryout the Amendments as per recent amendments in Sections 154B in the year 2019 requested enlighten on the subject

    Sir, our chsl form in jan 21, my son applied mortgage loan fm hdfc which is sanctioned, i m co- applicant, applied to shsl 4 noc as per hdfc formet in Apr 21, till today chsl not giving noc in hdfc formet , so loan dissbrsment is not done i complaint to ragestrar also, pl guide sir my family in deep trouble

      Commercial activity cannoT be allowed in residential without 1) municipal permission of change in user 2) complaint to muncipal 3) Complaint to electric company for change in residential to commercial

      Building and factory department of local muncipal, with copy to assistant commisioner, muncipal commisioner
      Now it also depends how much persuasive you are and how much heat,criticism, threats, malice you can take and how much powerful and valid are the, if majority is silent then you will be alone
