Good Evening Sirji, Jay Prakash here, I have a flat in ghodbunder road thane, and fm the time I purchased I have given it on rent, the society managing committee has always been in boisterous behaviour with me, to cut short on the recent problem they plan to introduce moving or shifting in and out charges for tenents inspite of NOC charges paid by me, Sir that is a 2bhk flat but it has never fetched me a rent above 15000/- rupees but the society is charging noc fixed charges of rs 400/- and now they are planning to introduce for tenants only 1200/- rupees for moving in charges and 1200/- rupees moving out charges which is absurd and nowhere mentioned in bye laws of Maharashtra CHS act. Sir please guide me how can I takle such a problem

I know I have pay maintenance charges like maintenance of bldg , watchman and sweepers salary , property taxes and and sinking fund. Besides not used by members like water and light bill?

Write to Dty. Registrar for disqualification of man. Committee for one term under section 77A.(1)(d) of mcs act, 1960 and attach a copy of this section with your complaint. If you have proof secretary has not paid maintenance bill attach copy of that page from accounts
Dear Sir, What if the societies lawyer still states that for associate membership a person has to have vested interest in the flat and hence society will not permit members husband to attend meeting or grant him associate membership ? Kindly advise
Read amendments made in bye laws, associate members can attend agm meetings and can also contest in elections if they have noc of member, question the lawyers legal understanding and check his degrees and if you have written evidence complain to advocates bar Association , I am sure the advocate has only "orally" said this, has not given it in writing, to avoid granting associate membership. Buy latest 2019 mcs act from snow White publishers or other publishers, and take them too task.
@@georgecarlinn6288 Thanks for the reply. The societies lawyer has it given it in writing thrice stating for an associate membership a person must have vested interest. In his last letter in reply to my lawyer he has stated unless I can get a competent authority to change its stand on the requirement for associate membership ,I cannot attend meetings as I do not have vested interest in the flat. I have now written to the registrar. I have even submitted a fresh NOC from the member . Ironically in 2011 I was made an associate member after filling up the forms and paying the nominal fees,my name had been entered in the share certificate as jt.Associate member.

The interest in the property remains vested in the transferee even though the right to enjoyment of the property is postponed. In other words, interest is said to be vested when it depends on happening of a certain event precedent. [i] Illustration X, the father of Y agrees to transfer an ancestral property in favour of Y after his death. The interest in the ancestral property in favour of Y is dependent on the condition of the death of his father X, which is certain. Hence on the death of X, Y will have vested interest in the ancestral property

In fact, they even don't prefer Marathi community that too in Maharashtra where maximum owners/members are from north India...how one can fight against this bias and illegal obligations without court? Sir i stay in a complex of 18.duplex bunglows.land is totally conveyed to society. Few yrs back the sec clandestinely reg a Indemnity Bond at sub reg office in favour of MCGM. By this the free hold land of the society is today mortaged encumbered and a lien created infavour of BMC.all this done without information to members or their consent. How do i proceed to cancel that reg doc and free thesociety land pl answer tks vasantasena srinivasan
