  • MoistCr1TiKaL Penguinz0 reacts to this often hilarious new video by Gunnar TV called ' This TH-camr Threatened Me...' is a detailed case study of how not to respond to criticism, focusing on a TH-camr named Delete Lawz, run by Chili De Castro. The video begins with Chili threatening to sue the creator Gunnar for defamation before fully watching the critique video about him. In a surprising turn of events, Chili later thanked the creator, claiming the video helped his channel grow.
    The drama escalates as Chili goes live on his channel, urging his audience to find the creator's address and report the critique video for bullying and harassment. Days later, Chili admits he won't sue because the critique video helped his channel. However, he continues to make contradictory and immature comments, even going as far as commenting on the creator's old Instagram posts.
    The video serves as a cautionary tale on how not to respond to criticism, dissecting Chili's behaviour and highlighting the importance of handling criticism maturely without resorting to threats or intimidation. The creator uses this incident to advise viewers on the importance of responding to criticism maturely and respectfully.

    Also, defamation is EXTREMELY difficult to prove in court

    • @rationalbushcraft
      @rationalbushcraft ปีที่แล้ว +74

      It is hard because one you have to prove real damages, two what the person said has to be a statement of fact, and three you had to know it was a lie. So for example I can say someone is a idiot. That is an opinion not a statement of fact. Now if I said someone is CA then I had better be able to prove that statement is true or I am just repeating what was said. That is why most people do the whole according to the New York Times so I can't be sued because I am just repeating what is reported.

    • @Astrussy
      @Astrussy ปีที่แล้ว +1

      The biggest thing is you have to prove they KNEW the statement they made was false and it had to damage you in some way. This is purposefully extremely difficult to prove because it would limit freedom of press if it was easy.
      For instance, reporters would be scared to report on Trump because he could just sue them for defamation, so no reporters would want to report on him unless the claims were 100% provable

      I mean tbf a lot of people hate it because it's worded ambiguously and has been argued to be heavily subject to systemic biases like racism (since essentially cops can find a plethora of excuses whenever they deem someone "suspicious" for whatever reason). But in this guy's case, given that he appears white af (albeit with a Latin-sounding name, if that indeed even is his actual name, can't say I've ever seen "Chili" as a first name, but I could be wrong), yeah his personal crusade might be due to something embarrassing (I'm not going to speculate on what though, as he'd probably bring a defamation suit against me for it).
      EDIT: okay upon seeing other pics of him, he does actually seem to be Latino (granted, "White Latino" is literally a thing, hence why forms for stuff that ask about race have a separate "do you ID as Latino" part, but anyway), but nonetheless, my points still overall stand

      My opinion is that someone could do this idea justice but that this insane dude that happens to have a Hispanic sounding name is not that guy. Its clear from watching Gunner's first video about him, that hes a narcissistic loser who found a way to harass people and somehow have an audience for it because some people find it ok or even good to be mean to them. So in summary: good argument but this guy isn't the dude to carry that flag since he's just a loser who enjoys bullying others and found a market that was willing to watch him do so.

If you have a restraining order against someone, you can blow them up 24/7 and try to bait them into a response, then have them arrested if they engage. I used to be partners with that lunatic Chille till last year when we split. he did the same thing tome where he doxed me, brigaged his audience to mass report me, threatened me and my family, threatened to sue me and i also had to get a restraining order on him which was granted. oh and he is also facing stalking and harassing charges too as a result of the 24 videos he made about me defaming and doxxing me. He is a real winner... NOT, lol, I can't even say that with a straight face

    That’s not how the terry thing works. We call them terry stops now, which are not allowed. A terry stop is where an officer approaches and requests ID or to search you with no reason other than “do it or be arrested”. Now with the law in his bio, the officer has to tell you exactly what reason and what law would constitute a search or seizure, in most cases of your ID. Now what his bio means is that officers will now be allowed to terry stop and no longer lawfully need the reasons

    As a lawyer, it is amusing that the guy in question says that publishing a retraction won't help, which is categorically false, and that he does it all the time and it will cost him $150,000. In legal fees, perhaps, if Gunnar were to retain an expensive attorney. However, between the threat of suit, which is generally a bad idea, and a lack of measurable damage, it won't go anywhere, even if the statements were defamatory, which they are not. Using a legal term of art in a lay sense doesn't make something immediately defamatory, e.g. "nuisance." The guy has no ascertainable damages, a necessary element of defamation, and that he has the oddly specific $150,000 figure makes me think he was successful once and one time only and thinks that is just the award if you are successful. That is incorrect.

When Bloomberg initiated it throughout the city, and it was mostly done to colored individuals, mainly African Americans and Mexican Americans in the area. It never was really done to too much. Caucasian or Asian Americans.
    It created a lot of problems where if we did not allow them to check us, we got arrested.
    It was deemed very racially motivated since then, Back when he was trying to run for President, a lot of people told him no mainly because he pushed out the stop and frisk, Since then, a lot of minorities have never trusted him.
