Been a motorcyclist for six decades. My current ADV bike makes around 110 hp. It weighs 230kg. Roughly 450hp/tonne. Way in excess of the supercar licence requirements. I ride this bike on dirt, just as I have done my entire life. It's the first bike I've ever owned with traction control, which is always switched off. I wonder when the cops will tell me this is illegal. Particularly when ALL my body parts are outside of the vehicle. Oh.....I live in South Australia!

If your motorbike is within the Australian Design Rules(ADR's) for motorcycles/motor vehicles , you will never have an issue!
This is so basic. If you modify any vehicle that takes it outside the scope of the ADR's, you will land yourself in hot water..
The greatest issue for Australia, is each state enterprits the ADR's a little differently. So what's legal in NSW, might be illegal in QLD and VIC..
I've been driving for nearly 35 years and have never been pulled up once by police for anything more than an RBT.. This is because I have never modified a car and taken it outside the ADR's.
No the specs. No the rules.... and you will never have an issue.
Remember one important fact. Just because you can buy a lowering kit, doesn't make it legal.
If anyone has wondered why modern cars have the same height wheel arch front and rear, this is to make measuring vehicle height simpler. It's also an easy way for police to see if the vehicle has been excessively lowered.

    • @M3rVsT4H
      @M3rVsT4H วันที่ผ่านมา +1

@ Congratulations on your exceptional compliance.. I love how you took the time to explain it as if it weren't simple common sense lol.
On a serious note however. It saddens me that people don't see our ADR's for what they are. They are not infallable, and they've never been about safety. They are so dated in any given year, that they could only limit new safety features if they were. The fact that most cars now sold in this country have a bonnet height that we know to be dangerous is further evidence of the transactional nature of compliance in this country.
The fact is, and easy proven with any year model of commodore. You could just go around the ADR compliance laws with more money. And I know this because I have experience in getting cars complied in Australia, and I've seen the other side of the scam. What can you say about a system of strict rules that "specifies" the safe tire size differently on 2 different cars with exactly the same chassis. Like what we see with Holden and HSV.. A system that was adamant that composite body panels were not safe.. Until mercedes spent the money to get compliance and suddenly now we're fine with plastic cars glued together lol. Totally fine.. Same plastic and glue that was unsafe 30 years ago.
I guess I struggle with people placing so much faith in a system that isn't performing for them and never really has. I've been fortunate to know people with the strength of character to stand up and change things. Like the guy who took on the system to make them stop forcing all motorcycles headlights to be on all the time. (Thanks Tom)
And on a personal note, I can't actually imagine what it's like to be a person who has only ever eaten off the menu for their whole adult life. I don't know if that's something to be proud of.

Everyone should know the council cannot legally enforce the bs about what you do with your own property. Cars are items of your personal property/material. They're not vehicles unless currently registered as such. Its similar to them stealing your property when they refuse to acknowledge that what they call an unregistered vehicle is still property which a person owns and has authority over, not the petty extortionists in the local council gangs

    • @excalibur2038
      @excalibur2038 5 วันที่ผ่านมา +2

Exactly, unless classified by them from registering it as a vehicle it could be anything, yard art, a hunk of metal. Where do they draw the line, if i cut up a car into 10 peices to where its unrecognisable is it still legally a car, or only when i weld it back together, its extremely arbitrary

    • @Blackbeardxx9

When I obtained my NSW licence, in 1969, there was a move afoot to offer motor vehicle insurance discounts to people who undertook a high performance driving course. What a great idea, I hear you say, teach people how to drive and control a car properly and you reduce the risk of accidents. The thought police then came up with the idea that it could encourage people to drive like hoons, so it got knocked on the head. The real problem is, there are too many people granted driving licences who should not have them.
This will be vehemently denied by the authorities but I'm going to say it anyway, because I got it straight from the horse's mouth Well, actually, from someone who fed the horses but we'll leave it at that. In the late 1990's, NSW Motor Registry managers were told, at private meetings, they needed to pass at least 50% of "non-Caucasian" driving licence applicants because the RTA were being accused of racial discrimination. There was never anything put in writing, for obvious reasons, but it happened.

For what it's worth, the last one is not a federal or state law. The Council of Casey issue is a "local" law and only enforceable by the local council. Most "local" laws are not actually enforceable in court, the police have no jurisdiction around them, only council rangers, but the council can make your life a living hell if you don't pay their fines.

In the city of Casey there are a lot of car dealers who’s workshops are missing out on retail work and spare parts sales because of their exorbitant workshop prices of $120+GST per hour and in some cases more. To combat for this loss of revenue I would suggest that the dealers have a principle on the council or an individual councillor that the dealers are lobbying. The Casey council is a quite large and wealthy council their rates are some of the highest in the state especially for those who live in the Harkaway area. I think this grab for cash has sinister under tones as a way to force owners back to the dealers.

You can apply to the government in your state for an exemption, but unless you have a compelling argument, it will be pointless. Having a CAMS racing licence and an extensive history in motorsport as a youngster would be your best bet. Many years ago Bernard Tomic applied (and was granted) permission to drive a M3 on his P-plates in QLD, but I doubt it would be so easy these days.
The issue is always the same, young guys think they can drive far better than they can, doing stupid shit and end up either killing themselves (which I am fine with, play stupid games, win stupid prizes) or usually someone else and since the government knows young guys are always going to do stupid shit, they have to protect them from themselves because of the outcry from families that little Johnny was really a good boy and should not have died and that the government has to protect people from themselves.
Everyone forgets that the only reason there are these kinds of laws is that generations of young guys continue to do stupid shit on the roads.
We all did when we were young and I know that Im only here by shear luck after some of the close calls I had.

This guy clearly don't know what he's talking about. For example an arm protruding out of a vehicle has been a fineable offense along with loss of demerit points, in Victoria for nearly 40 odd years now. And as someone points out elsewhere in the comments, he clearly doesn't know anything about the PRIVATE LAND USE PERMIT which has nothing to do with whether you can 'repair your unregistered vehicle on your own property and more to do with what you can use your private property for ie doing certain activities on your property from which you might derive an income from, or engaging in activities which might impact on neighbors or that might be detrimental to the enviroment.

I'm not so sure it's quite as clear as you are implying. Have a look at Section 28 of the Casey local laws (www.casey.vic.gov.au/sites/default/files/user-files/City%20%26%20Council/Publicly%20Available%20Documents/Casey%20Community%20Local%20Law%202023%20Final%20Adopted%20Enacted%20Version.pdf).
      It says:
A person must not, except with a permit, use private land to: (a) dismantle; (b) repair; or (c) service vehicles or machinery in circumstances where the activity or use is detrimental to the amenity of the area in which the private land is located.
It then goes on to talk about unregistered vehicles too. There is no implication in the laws about conducting income-generating activities involving dismantling, repairing or servicing a vehicle. This law is incredibly poorly worded, leaving it to a council worker to judge whether these activities are 'detrimental to amenity'.

We live in a country that has used road safety as a stick to beat us with for decades, all whilst casually ignoring it when it doesn't make anyone money. We used taxes and our compliance systems to allow our local car industry to sell 2nd rate cars for premium prices for 40 years. And the car companies milked it for all it was worth before leaving. We're obsessed enough about safety to make a billion dollars a year in speeding fines. But not enough to tell car companies that drum brakes are unacceptable in 2025, or that optional better brakes are a safety, not performance item. If a robot can't see your seatbelt over a black Tshirt. Massive fine.. But if you actually want to be safe with harnesses and a rollcage.. That's another fine.
It's a bad joke that we drive around in cars from the future, with speed limits from 1974. And somehow our roads are less safe than ever, and insurance premiums prove it. I'm honestly sick of safety being the excuse for laws are only about compliance and revenue.

The drive driver of the Lamborghini that killed the young girl basically walked away because he was inexperienced driving that car. Agree that the licence upgrade requirement in SA is ridiculous. But having seen people jump into these cars with no experience at all of the power take them for a joy ride there needs something like a weekend driving test in the car with a sign off from a qualified high speed during instructor to make people realise they’re in something that can catch you out. Police drivers have graded licenses that allow them to drive faster pursuit vehicles, something like that.

  • @Mad4400

The Government knows it needs to be seen to be taking action on these matters. It also knows most people don't read anything past the headline. So when the news article reports "New Licence Class For Ultra High Powered Vehicles", those people think "Good", the few that read further into the article think "Why?", the car community thinks "How is that a solution?", while the police think "Great, now we can pull them over even when no laws have been broken".
The law about having any part of your body outside the vehicle's cabin should not be enforced for stationary vehicles. Police need to use discretion when issuing this fine, and failing that we need to contest it until a precedent is established. I recall in the late eighties my father receiving this fine, or more specifically "The owner of the vehicle" because it wasn't issued upon a traffic stop, rather left under the wiper on the windscreen! We were in Melbourne to visit my Grandfather, who was dying. Dad was bringing us kids (my cousins and I) to the hospital to say goodbye. My older cousin was in the passenger seat and was the one with his hand outside the window. Dad had even mentioned how it was illegal to do so, but my cousin just brushed his comment off. On the way back to our grandparent's house, I noticed the ticket of the windscreen. At first, Dad thought it was a parking fine, until my cousin reached out the window to grab it (oh the irony) and read the description of the infringement. Dad's only words were, "Right, put the windows up now!" and the rest of the drive was awkwardly silent.
The City of Casey case is the pinnacle of bureaucracy madness. However, with enough push back from residents and support from communities and business's across the greater Melbourne area, the right outcome is possible. Corruption was rife within that council, all decisions made during that time should be open to critical review and any regulations that borne from those decisions should be removed if it can be shown the residents do not support them. If the City of Casey is allowed to get away with this rot uncontested, you can guarantee it will spread to other LGA's in time.
    TL;DR
▪Question the purpose and effectiveness of any new laws
▪Challenge infringements if they don't represent the law they are issued for
▪Show support for your neighbour's plight, don't wait until it becomes your problem. Otherwise, be prepared to raise the height of your property fences.

Another thing that makes no sense is how L platers are allowed to drive "high performance" cars but with red and green p platers it's strictly forbidden. Also the car system in Australia is generally flawed as all police forces suit to their own entitled opinion, they all vary and contradict each other. For example, a p plater could get written up for using an ipod to play music in the car when it actually is not against Australian law. Some officers will argue that it could be used as a phone when in fact it's a media player. You also aren't even allowed to use hands-free bluetooth synced via your phone, which also sucks since the whole point of hands-free in the first place is to control what you are playing via the steering wheel; which therefore offers no distraction. Yet this alone can cost your license.
I probably speak for all of Australia when I think that the majority of laws recently implemented are introduced by intellectually lazy politicians who have done little to no research in the philosophy of driving and other topics that are entirely out of their specialty. That social media ban introduced recently quite literally proves this, and has contradicted Australia's own privacy laws.

And yet in the SA learners handbook page 61, they describe how to use hand signals, which involves putting your hand out of the car. Is this a contradiction??

Having a aftermarket muffler on a lams approved motorcycle makes the bike non lams approved which means 8 point fine and roughly $900. Can be for as little as modified indicators if you got a bad enough cop.

Arms out has always been findable in NSW. Your argument for Special Licence is ‘it’s too easy’ so the answer is let’s make it more skill based (a point I absolutely agree with) so the upgrade should at least be part of an advanced driving course to be completed at drivers expense through certified companies, similar to motorcycle courses here in NSW. on your third point it is my understanding that the Casey case is a local council directive and has nothing to do at state level. I am happy to be directed to the state legislature if I’m wrong but if it’s a local council then they will enforce NOT police or other bodies I would reckon.

5:15 saying that someone just off their 'P's can handle a high powered car is laughable. The thing that makes you able to handle a high powered car is 1) actual brains between your ears and 2) plenty of time behind the wheel of a high powered car progressively learning where the boundaries are. In support of this assertion is countless videos of idiots with full licenses crashing their high powered cars.

Australian government is a private corporation and are required to abide by contract law. Don't register your car and you won't have any problems plus fill out appropriate u.c.c paperwork. Know your rights people.

@PerformanceNic, if you've been researching "laws" to make this video, maybe consider having a look at the series of videos by yours truly about what these so-called law-makers have been doing with the statute books while we slept.
If said makers have no legitimacy, then neither do their mutterings and scribblings.

We're completely fucked here in Aus.
You want to take the risk and put your arm out the window, that's on you.
whats that you modified your car and it passed an engineers report? nah defect and now you have to prove it wrong.
People complain about the noise of race tracks that the Government allowed people to build homes around, then propose to close them then complain about hoons :S
Pulled over for going 4kph over the speed limit is a real valuable use of police resources guys, trust me it keeps us all safe......

how do you fix your own car on your own property?
You park it in your "Car Fixing Space" ... and don't open the damn door.
restoring a car? Long term project? Hire a storage shed. Stick a sign up on the door that says "Joe Bloggs Car Fixin' Business"
There. Now you have a commercial space to fix your car. You don't need to register a business to trade as it :) So long as "No trading is actually going on"
    hahaha.

It seems a lot of people (disingenuously?) miss the point of the UHP license - it's obviously got nothing to do with driver skill, and it seems pretty obvious to me that that's not the idea. It's to make sure there is a targeted consequence for people who drive irresponsibly on the road in their UHP vehicles. Obviously you can already lose your license for your driving, but in the current system, once you get your license back, you're back in business. I imagine that with this scheme in place, you run the risk of being refused the privelege of being granted another UHP license after a loss of license, meaning you will not legally be able to drive your UHP vehicle.
The logic around not being allowed to use a button in a car you own is also pretty silly. Just because the button is there doesn't mean it's intended for road use by the manufacturer. It makes sense that the higher power the vehicle, the more potentially dangerous it is to be disabling things like TCS/ESC.
The benefit of not touching your TCS/ECS mode buttons on the street for someone like yourself is that you'll no longer have to worry about spinning your wheels in the wet and possibly getting in trouble with the police, which you mentioned in a previous video as as a reason Australia apparently sucks if you're a car enthusiast. 😅

2:34 that makes zero sense. So someone who has an old supercar without electronic assists, like a ford GT or f40 are not allowed to drive on the road? This is completely ridiculous. So someone with a lower powered car can disable their ESC, but someone with an "ultra high performance vehicle" cannot do it, even though the 'test" they had was supposedly meant to equip them with the skills to handle their car. So logically, the actual purpose of the license is to get people to understand that their car is fast and the manufactures engineers developed driving aids which ( obviously) makes the car safer. Why would there be an option, from factory, to turn the assist off? That's the definition of a nanny state.
3:10 how are they going to police that though? It's absolute lunacy.
