Because of people continually and willingly giving up their rights police think they can do this. Charges were dropped and she received a settlement because the cop was wrong. Edit no settlement received because when you investigate yourselves you always come out on top.

I had a similar situation to this where I went through a self checkout line with about 5 items. One of them was a cooler that was too big for a bag so I put the other items in the cooler and then dragged it out. Im guessing an employee just saw the last second when I was pulling the cooler and told a cop that I might have been stealing. A cop approached me in the parking lot and asked if I had a receipt. Instead of arguing and yelling, I showed him the receipt and the other paid for items in a bag inside the cooler. He apologized and we both laughed about it and then I left. That entire interaction lasted about 20 seconds. I then went home and watched Netflix. It was a peaceful day.
In her case, no one saw her steal and no one saw facts giving reasonable suspicion that she stole. I hope she enjoys the money that she receives from Publix.

This exact thing happened to me last year, I was mistaken for a guy wearing similar clothes, I showed my receipt and after 30 seconds I was on my way, untazed and unhandcuffed.

I was accused of walking out on a tab at IHOP. The manager told cops inside of IHOP that me and three friends skipped out without paying. The cops ran outside and detained us very aggressively. The waitress came out screaming at the cops telling them that she told us to leave payment on the table. We also tipped very generously. After all of that the manager was fired I was given a $100 dollar voucher. The police department pulled me over 3 days later and apologized to me face to face.
You live in a wild country. In Russia, in this case, they would not aggressively detain you. They would just talk to you if you didn't pay. If you refuse to pay, you will be taken to the police to issue you a fine. Nobody would draw a gun. He would have been in a closed holster. In Russia, police officers kill about 10 people a year during arrest. Most of these killings take place in the Caucasus. There are terrorists there, it is difficult to negotiate with them.

It doesn't need to. The officer was committing crimes against this woman. His personal opinion of her doesn't matter, only the legal one does and he had no lawful reason to detain her in the first place.

@@secondary5913 1) She can refuse to give id because he is questioning her about a misdemeanor (5th amendment). 2) she does not need to show a receipt, there is zero legal standing for her to have to provide one. 3) he saw kids in the backseat and claimed she left them in the car, but he is assuming that, he cannot prove it. 4) he admitted he did not see any video. Finally, there is no state where a police officer can make an arrest for a misdemeanor they did not witness, with a few exceptions. Theft is not one of those misdemeanor exceptions. There is a reason the charges got dismissed. This was a bad arrest.

If she was accused and on the property she DID have to show proof of purchase. They arent just gonna let someone accused of stealing who was on the property items were stolen from walk free. On private property all you need to be accused of stealing is word from the store manager, failure to comply with proof of purchase or waiting until the store can provide proof you didnt purchase the items is grounds for detainment until said proof is provided. She then resisted arrest which, no matter the circumstances, is illegal.

Case law has held that witness testimony isn’t grounds for a detainment, and this video exemplifies why perfectly. Humans are unreliable, and often get things wrong or mistaken things to be something they’re not. You know, if tomorrow everyone just gave in to liberals and started to stop fighting gun restrictions then we’d just lose those rights….. That's fine. If you ever get pulled over and the police ask you to get out of the car, be sure to stay in your car. Then if they ask you to put your hands out the window, be sure not too. If they just ask to see your license and insurance, be sure to refuse to do that. Then if they approach your car, be sure to drive away because you feared for you life with the police just asking you to do some SIMPLE thing(s). Then be SURE to say you didn't do anything wrong as the judge watches the video. :) I would LOVE to see what you do when you go out of a Walmart and they ask to see your receipt. They didn't call 911, the officer was working as security for Publix.

She settled outside of court. Meaning: that she was not in the wrong and they were. How could she have known she was going to be followed and detained unlawfully? I respect our officers, but they need to fully know what laws they are trying to enforce. And not try to strip our rights. Those were not her children, but she showed them how to stand up for their rights. The officer was in the wrong. So the lawsuit she settled for an undisclosed amount says. And before a reply says it was publix, yes indeed. This particular officer was working for publix that day.

I went to Walmart yesterday and bought maybe 10 grocery items. I never bag my items. As I was leaving the greeter asked me for my receipt for the first time in many years. Because I have not stolen anything since I was 6 years old, I was briefly offended, but showed it to him. I asked him if he was asking everyone for receipts. He stalled but then told me it was because I had not bagged my items. Like I said, I never do and never get stopped. But, I am not going to make a scene or harass some older guy who has to check people.
You’re actually under 0 obligation to show the Wal-mart greeter your receipt since you did not agree to that prior to entering the store. Only places like Sams club, Costco, etc are allowed to do so because you agree to it in order to be a member. However, if a cop walks up to you and asks to see the receipt because there is suspicion of you not paying for an item, you have to provide it because theft is a crime. Now if she were just minding her own business and wasn’t suspected of theft, she wouldn’t have to provide anything to the cop.

The cop had alternative choices. One choice, was to have Publix provide evidence of their allegation. The choice of the cop was to not expect the accused person to prove their innocense .. because in America we are presumed innocent until proven guilty. If Publix was refusing to allow the officers to review video inside the store, then it was in fact Publix who was not cooperating with the investigation, in which they bore the burden of providing evidence to support the allegation they were making. This woman actually went to a register with a cashier present , so another choice the officer could have made , was to go inside and speak with the cashier's. He and no other officer made what should have been the most reasonable choice ... INVESTIGATE. A mininmum wage worker making an accusation does not constitute probable cause. Without probable cause, there should be no expectation of an officer to perform a search of person or their vehicle without their consent. That is another right afforded to us , as American citizens. Fourth Amendment to the United States Constitution prohibits searches of persons and their properties without a warrant executed by a judge, the motor vehicle exception still demands probable cause exist for the search to be considered LEGAL. This woman stood on her rights, right's this officer was very well aware of as he entered into this engagement. He understood the limitations the law provided him , and CHOSE to exceed those limitations. Ultimately she was innocent, and acted within reason to her rights as an American.

But, I think it's fairly obvious that she was bothered by the fact that she was asked for a receipt, and then tried to escalate that into a lawsuit. There are clues all over the place. She slipped up and said she didn't have the receipt, when she actually did have it, and she stopped mid-sentence, as if she realized it was a bad idea to outright lie, and wanted to take her words back. She also repeatedly asked to be Tased... who would do that? And, despite how many times she was warned that she needs to provide identification (mainly in the longer version of this video, not this one that clips out the first half), she refused to provide ID. It's definitely as if she wanted to get herself Taser'd and arrested.
@@jeremyhodges7956 What they do is scan something and put it back in the cart like they didn't already scan it, then when they get ready to leave they put on an act like a typical shoplifter does and puts the item from the cart into the bag skipping the scanner. This is why they ask for reciepts and not just hold them in the security office waiting for police pickup.
My gym is in the same shopping center. It's the only Publix I've ever been to that has a police officer parked in front and standing in the lobby from open to close 7 days a week. The nearby Walmart has such massive shoplifting problems, they also have security in the parking lot and the lobby at all times. It's also the only Walmart left that doesn't have ANY self-checkouts. I used to joke with my friends that I moved to a side of town that you need a bullet proof vest to do your errands, and it's not because of the cops. I've had to duck and run for cover in our Walmart a few times over the years due to gang activity, as well as loss prevention tackling people trying to run out after getting caught shoplifting.

To me it is a decision of what will be less of an intrusion into my life. I can stand my ground and get into a conflict with an officer where I go to jail...or I can show the receipt. Maybe I have the right not to show it...but what action do I choose to end the situation with the least intrusion into my life...I show the receipt.

Every time I buy something or use self-checkout, I hold the receipt so it's clearly in view as I'm walking out. I've only been asked for the receipt once by an older lady who couldn't see. It's not hard to avoid confrontation, but some people actively seek it out

Once you and a business exchange goods for currency the transaction is OVER. You have legally satisfied your obligation to avoid a shoplifting offense. If you walk out of the door it's over and DONE. A business cannot summon police because the store failed in THEIR obligation to ensure that they observe the process. You do not work for the store nor are they paying you to complete additional actions after a sale has been finalized. If store policy was that every customer show a receipt and you refused then you are violating their rules and could in theory be escorted off the premises. But this lady had already walked out the door. She was free to leave. The law doesn't require that you prove your innocence in the parking lot of a store. And even conducting that investigation requires that you be detained, which is only permitted if a crime had occurred. The store didn't have a witness to a crime, they didn't have evidence of theft, nor did they even state with any certainty that they were aggrieved for their to be a foundation for probable cause.

I've been a police officer in a major metropolitan police department for 23 years now. I have experience. I am now going to tell you how the law works in this instance. You can agree or disagree, but the law is the law. Any crime that is categorized as a misdemeanor and was NOT committed in the presence of an officer (in other words the officer did not witness the crime), that crime needs to have a victim who wants to press charges. In that instance, the officer is basically facilitating a citizen's arrest on behalf of that victim. That is exactly what is occurring in this video. The officer is conducting an investigation into a possible crime, in which the victim (the store with the employee acting on behalf of the store) wants to place the individual under arrest for the theft they believe she committed. An officer faced with this situation basically has three options; Option #1- Investigate to find proof of guilt (or innocence). Option #2- Don't investigate and cite and release or arrest solely based on the statement of the victim (in that case, the victim/store assume all legal responsibilities). Option #3- The victim decides they want nothing done and the officer let's the person go, whether they are guilty or not (the option all cops prefer) In this video, the officer was doing his best to achieve the #1 option and help the woman prove her innocence. The officer is wrong in that the woman's decision to not show a receipt is absolutely her right. Her decision to not identify herself is also her right. But those decisions leave the officer with no choice but to go with option #2 (keeping in mind that the victim is wanting to press charges). In this case, the officer is acting on behalf of the victim and facilitating THEIR arrest. Once the officer has told you that you are under arrest (which this officer did a multiple of times), it is of course still your legal right to not say anything or hand over the receipt, but you certainly do not have the right to physically resist the officer, or not comply with his/her verbal commands (you actually never have that right, which I can explain further if someone wants). The officer has not only the legal right to take you into custody, but a duty to do so on behalf of the victim who is requesting the arrest/cite. Now, on top of the theft charge, you will receive an additional misdemeanor charge of resisting an officer. If the officer gets injured during the resisting, it becomes a felony resisting charge. Now to the tasing part..........While I would not have tased this woman, that doesn't mean the officer was not lawful in doing so. In order to tase someone, an officer must have a present threat of physical danger. In other words, you can't tase someone who is running away from you or someone who is just verbally uncooperative. But someone who is squaring up with you like a boxer or wrestler, or in this case, someone who has already proven they are going to fight you if you go hands on (like this lady did at 3:48), is able to be legally tased. Again, while I would not have tased this woman, she was still legally "taserable". I know getting tased looks bad, but let's not forget that she put herself AND THOSE KIDS in that situation. Bottom line is officer was 100% legal in what he did. Could he have handled it different and not tased her? Sure...But then the officer is actually going hands on and fighting with her. I guess you have to "pick your poison". I hope this helps people understand from an officer/legal point of view. I welcome all questions, but please don't come at me with rude comments. thnx
So what about when the woman offers to go to the store to confirm she paid and the officer says no? He does not allow her to prove her innocence the way she wanted. He wanted done his way imo and he infact did taser an innocent person.
Finally an intelligent cop who understands that law. Her mistake was resisting. I would have remained silent or told cop if I don't show you the receipt am I under threat of arrest? If he says yes, I would compy under threat of arrest and take it up with a lawyer. Interesting how many make false reports, 911 calls and cops never harass or arrest them. When will they arrest those who make false reports, complaints or 911 calls?
He had no lawful commands to issue. None. Therefore he had no right to use force. She does not have to comply with unlawful commands. He was investigating an alleged crime and she’s not required to aid in that investigation. There was no legal grounds for him to issue any commands until he had PC. This encounter was consensual because he was investigating hearsay. She did not have to comply. He just cost the city a couple hundred grand, and I’m sure Publix will get sued as well.

I had what should have been, a confrontation with a fast food employee, while my 12 year old nephew was in the passenger seat. I look back on that very valuable lesson I taught him: negotiate, deescalate situations. The person in the drive-thru was rude at first and then I was polite in return- I didn't blow up things because he didn't have what I initially wanted. Instead,I thanked him and the establishment for what they were able to give us. We ended up getting a good discount. My nephew was impressed and I still remember his words: you didn't make a big deal, talked to him the right way - mom would have made the biggest scene. Be careful how you conduct yourself in front of the children in your life.

Okay, I completely understand what it feels like to be accused of something you didn’t do. It’s happened to me. However, when you have evidence or proof of something, YOU hold the power because you just pull out the receipt, say absolutely nothing and go on your merry way. These situations where you’re arguing, wasting time, getting angry, frustrated etc. It just shows the other person that they’re getting under your skin. I’ve been pulled over twice in my life by police. One time for speeding as I was on the way to the hospital to see my dad who’d been taken I’ll. I quietly got in their car, explained things and I was asked to attend a speed awareness course that’s all. The second time, I had no MOT because it slipped my mind after the death of my sister. Again, I explained the circumstances and they let me go. Not saying all police and civilian interactions go well but in this case, just show the receipt and then make your complaint afterwards.
There is no requirement to prove your own innocence . Either the cop has evidence and probable cause enough to make an arrest or he does not. You are in no way legally responsible to help with the cop's investigation.
Haha, yeah these Terminatrixs' are starting to become highly resistant to conventional tasers and stun guns, they need to increase the voltage or wattage or whatever is holding the electrical charge. In most cases people tased immediately lock up and fall, she was actually resisting the charge and seemed to still have some fight in her after her collapse to the ground, though the taser did it's job, I'd say it was just barely effective.
She had no obligation to do so and the officer had no legal standing to arrest her since burden of proof is on the accusing party. She was protected by the 4th amendment from unreasonable searches or seizures. Someone simply saying they believed she stole something did not merit the officers actions. An officer educated on law they are supposed to enforce would have known this but then again there is an IQ cap as to how smart you can be to be police.

This interaction never should have happened in the first place. She paid for her items and there was no reasonable suspicion to detain her. She went to jail because of the officer's criminal actions.

I would have shown my receipt just to put an end to the encounter. I don't like talking to them. Afterwards, maybe look into what legal action could have been taken against the store and him. Not showing the receipt made her look like a thief, got her tased and traumatized the poor kids in the car.

@@ethanboyd7843 Is not enough to "accuse" someone of stealing, to accuse someone first you need to prove that this person is in possession of merchandise you believe is not been paid for. Then the burden is on this person to prove that the merchandise was in fact paid. Nobody has the right to ask you to open your coat and turn your pockets unless they have proof that you took something, that's illegal. If anything, the store can ask you to leave your coat and bags at the door before you go in, like must stores do.

@Shamika Baker I am feeling that. Had this same issue a few weeks ago. Happened with my daughter over $4 of merchandise. She didn’t get a receipt after her purchase and left. She was followed out and accused by an employee. She went back and confirmed her purchase with the employee at the register. I was livid and the store apologized. My daughter returned the merchandise and we left our cart. We were offered credit and discounts but decided to not shop there anymore considering this wasn’t the first incident according to the manager.

A lot of stores allow you to have you receipt sent by email too. Where you been? I had a similar situation to this where I went through a self checkout line with about 5 items. One of them was a cooler that was too big for a bag so I put the other items in the cooler and then dragged it out. Im guessing an employee just saw the last second when I was pulling the cooler and told a cop that I might have been stealing.
A cop approached me in the parking lot and asked if I had a receipt. Instead of arguing and yelling, I showed him the receipt and the other paid for items in a bag inside the cooler.
He apologized and we both laughed about it and then I left.
That entire interaction lasted about 20 seconds.
I then went home and watched Netflix.
It was a peaceful day.
In her case, no one saw her steal and no one saw facts giving reasonable suspicion that she stole. I hope she enjoys the money that she receives from Publix.

I was accused of walking out on a tab at IHOP. The manager told cops inside of IHOP that me and three friends skipped out without paying. The cops ran outside and detained us very aggressively. The waitress came out screaming at the cops telling them that she told us to leave payment on the table. We also tipped very generously. After all of that the manager was fired I was given a $100 dollar voucher. The police department pulled me over 3 days later and apologized to me face to face.
When did this happen?
You live in a wild country. In Russia, in this case, they would not aggressively detain you. They would just talk to you if you didn't pay. If you refuse to pay, you will be taken to the police to issue you a fine. Nobody would draw a gun. He would have been in a closed holster. In Russia, police officers kill about 10 people a year during arrest. Most of these killings take place in the Caucasus. There are terrorists there, it is difficult to negotiate with them.

Finally, there is no state where a police officer can make an arrest for a misdemeanor they did not witness, with a few exceptions. Theft is not one of those misdemeanor exceptions. There is a reason the charges got dismissed. This was a bad arrest.

If she was accused and on the property she DID have to show proof of purchase. They arent just gonna let someone accused of stealing who was on the property items were stolen from walk free. On private property all you need to be accused of stealing is word from the store manager, failure to comply with proof of purchase or waiting until the store can provide proof you didnt purchase the items is grounds for detainment until said proof is provided. She then resisted arrest which, no matter the circumstances, is illegal.

She settled outside of court. Meaning: that she was not in the wrong and they were. How could she have known she was going to be followed and detained unlawfully? I respect our officers, but they need to fully know what laws they are trying to enforce. And not try to strip our rights. Those were not her children, but she showed them how to stand up for their rights. The officer was in the wrong. So the lawsuit she settled for an undisclosed amount says. And before a reply says it was publix, yes indeed. This particular officer was working for publix that day.

I went to Walmart yesterday and bought maybe 10 grocery items. I never bag my items. As I was leaving the greeter asked me for my receipt for the first time in many years. Because I have not stolen anything since I was 6 years old, I was briefly offended, but showed it to him.
I asked him if he was asking everyone for receipts. He stalled but then told me it was because I had not bagged my items. Like I said, I never do and never get stopped.
But, I am not going to make a scene or harass some older guy who has to check people.
You’re actually under 0 obligation to show the Wal-mart greeter your receipt since you did not agree to that prior to entering the store. Only places like Sams club, Costco, etc are allowed to do so because you agree to it in order to be a member. However, if a cop walks up to you and asks to see the receipt because there is suspicion of you not paying for an item, you have to provide it because theft is a crime. Now if she were just minding her own business and wasn’t suspected of theft, she wouldn’t have to provide anything to the cop.

The cop had alternative choices. One choice, was to have Publix provide evidence of their allegation. The choice of the cop was to not expect the accused person to prove their innocense .. because in America we are presumed innocent until proven guilty. If Publix was refusing to allow the officers to review video inside the store, then it was in fact Publix who was not cooperating with the investigation, in which they bore the burden of providing evidence to support the allegation they were making. This woman actually went to a register with a cashier present , so another choice the officer could have made , was to go inside and speak with the cashier's. He and no other officer made what should have been the most reasonable choice ... INVESTIGATE. A mininmum wage worker making an accusation does not constitute probable cause. Without probable cause, there should be no expectation of an officer to perform a search of person or their vehicle without their consent. That is another right afforded to us , as American citizens. Fourth Amendment to the United States Constitution prohibits searches of persons and their properties without a warrant executed by a judge, the motor vehicle exception still demands probable cause exist for the search to be considered LEGAL. This woman stood on her rights, right's this officer was very well aware of as he entered into this engagement. He understood the limitations the law provided him , and CHOSE to exceed those limitations. Ultimately she was innocent, and acted within reason to her rights as an American.

Well, I wouldn't go as far as saying she staged it from the start. But, I think it's fairly obvious that she was bothered by the fact that she was asked for a receipt, and then tried to escalate that into a lawsuit. There are clues all over the place. She slipped up and said she didn't have the receipt, when she actually did have it, and she stopped mid-sentence, as if she realized it was a bad idea to outright lie, and wanted to take her words back. She also repeatedly asked to be Tased... who would do that? And, despite how many times she was warned that she needs to provide identification (mainly in the longer version of this video, not this one that clips out the first half), she refused to provide ID. It's definitely as if she wanted to get herself Taser'd and arrested.
@@jeremyhodges7956 What they do is scan something and put it back in the cart like they didn't already scan it, then when they get ready to leave they put on an act like a typical shoplifter does and puts the item from the cart into the bag skipping the scanner. This is why they ask for reciepts and not just hold them in the security office waiting for police pickup.

My gym is in the same shopping center. It's the only Publix I've ever been to that has a police officer parked in front and standing in the lobby from open to close 7 days a week. The nearby Walmart has such massive shoplifting problems, they also have security in the parking lot and the lobby at all times. It's also the only Walmart left that doesn't have ANY self-checkouts. I used to joke with my friends that I moved to a side of town that you need a bullet proof vest to do your errands, and it's not because of the cops. I've had to duck and run for cover in our Walmart a few times over the years due to gang activity, as well as loss prevention tackling people trying to run out after getting caught shoplifting.

Every time I buy something or use self-checkout, I hold the receipt so it's clearly in view as I'm walking out. I've only been asked for the receipt once by an older lady who couldn't see. It's not hard to avoid confrontation, but some people actively seek it out

Once you and a business exchange goods for currency the transaction is OVER. You have legally satisfied your obligation to avoid a shoplifting offense. If you walk out of the door it's over and DONE. A business cannot summon police because the store failed in THEIR obligation to ensure that they observe the process. You do not work for the store nor are they paying you to complete additional actions after a sale has been finalized. If store policy was that every customer show a receipt and you refused then you are violating their rules and could in theory be escorted off the premises. But this lady had already walked out the door. She was free to leave. The law doesn't require that you prove your innocence in the parking lot of a store. And even conducting that investigation requires that you be detained, which is only permitted if a crime had occurred. The store didn't have a witness to a crime, they didn't have evidence of theft, nor did they even state with any certainty that they were aggrieved for their to be a foundation for probable cause.

I've been a police officer in a major metropolitan police department for 23 years now. I have experience. I am now going to tell you how the law works in this instance. You can agree or disagree, but the law is the law. Any crime that is categorized as a misdemeanor and was NOT committed in the presence of an officer (in other words the officer did not witness the crime), that crime needs to have a victim who wants to press charges. In that instance, the officer is basically facilitating a citizen's arrest on behalf of that victim. That is exactly what is occurring in this video. The officer is conducting an investigation into a possible crime, in which the victim (the store with the employee acting on behalf of the store) wants to place the individual under arrest for the theft they believe she committed. An officer faced with this situation basically has three options;
Option #1- Investigate to find proof of guilt (or innocence).
Option #2- Don't investigate and cite and release or arrest solely based on the statement of the victim (in that case, the victim/store assume all legal responsibilities).
Option #3- The victim decides they want nothing done and the officer let's the person go, whether they are guilty or not (the option all cops prefer)
In this video, the officer was doing his best to achieve the #1 option and help the woman prove her innocence. The officer is wrong in that the woman's decision to not show a receipt is absolutely her right. Her decision to not identify herself is also her right. But those decisions leave the officer with no choice but to go with option #2 (keeping in mind that the victim is wanting to press charges). In this case, the officer is acting on behalf of the victim and facilitating THEIR arrest. Once the officer has told you that you are under arrest (which this officer did a multiple of times), it is of course still your legal right to not say anything or hand over the receipt, but you certainly do not have the right to physically resist the officer, or not comply with his/her verbal commands (you actually never have that right, which I can explain further if someone wants). The officer has not only the legal right to take you into custody, but a duty to do so on behalf of the victim who is requesting the arrest/cite. Now, on top of the theft charge, you will receive an additional misdemeanor charge of resisting an officer. If the officer gets injured during the resisting, it becomes a felony resisting charge.
Now to the tasing part..........While I would not have tased this woman, that doesn't mean the officer was not lawful in doing so. In order to tase someone, an officer must have a present threat of physical danger. In other words, you can't tase someone who is running away from you or someone who is just verbally uncooperative. But someone who is squaring up with you like a boxer or wrestler, or in this case, someone who has already proven they are going to fight you if you go hands on (like this lady did at 3:48), is able to be legally tased. Again, while I would not have tased this woman, she was still legally "taserable". I know getting tased looks bad, but let's not forget that she put herself AND THOSE KIDS in that situation.
Bottom line is officer was 100% legal in what he did. Could he have handled it different and not tased her? Sure...But then the officer is actually going hands on and fighting with her. I guess you have to "pick your poison".

He had no lawful commands to issue. None. Therefore he had no right to use force. She does not have to comply with unlawful commands. He was investigating an alleged crime and she’s not required to aid in that investigation. There was no legal grounds for him to issue any commands until he had PC. This encounter was consensual because he was investigating hearsay. She did not have to comply. He just cost the city a couple hundred grand, and I’m sure Publix will get sued as well.

I had what should have been, a confrontation with a fast food employee, while my 12 year old nephew was in the passenger seat. I look back on that very valuable lesson I taught him: negotiate, deescalate situations. The person in the drive-thru was rude at first and then I was polite in return- I didn't blow up things because he didn't have what I initially wanted. Instead,I thanked him and the establishment for what they were able to give us. We ended up getting a good discount. My nephew was impressed and I still remember his words: you didn't make a big deal, talked to him the right way - mom would have made the biggest scene. Be careful how you conduct yourself in front of the children in your life.

Okay, I completely understand what it feels like to be accused of something you didn’t do. It’s happened to me. However, when you have evidence or proof of something, YOU hold the power because you just pull out the receipt, say absolutely nothing and go on your merry way. These situations where you’re arguing, wasting time, getting angry, frustrated etc. It just shows the other person that they’re getting under your skin. I’ve been pulled over twice in my life by police. One time for speeding as I was on the way to the hospital to see my dad who’d been taken I’ll. I quietly got in their car, explained things and I was asked to attend a speed awareness course that’s all. The second time, I had no MOT because it slipped my mind after the death of my sister. Again, I explained the circumstances and they let me go. Not saying all police and civilian interactions go well but in this case, just show the receipt and then make your complaint afterwards.

There is no requirement to prove your own innocence . Either the cop has evidence and probable cause enough to make an arrest or he does not. You are in no way legally responsible to help with the cop's investigation.

Haha, yeah these Terminatrixs' are starting to become highly resistant to conventional tasers and stun guns, they need to increase the voltage or wattage or whatever is holding the electrical charge. In most cases people tased immediately lock up and fall, she was actually resisting the charge and seemed to still have some fight in her after her collapse to the ground, though the taser did it's job, I'd say it was just barely effective.

She had no obligation to do so and the officer had no legal standing to arrest her since burden of proof is on the accusing party. She was protected by the 4th amendment from unreasonable searches or seizures. Someone simply saying they believed she stole something did not merit the officers actions. An officer educated on law they are supposed to enforce would have known this but then again there is an IQ cap as to how smart you can be to be police.

Then the burden is on this person to prove that the merchandise was in fact paid. If anything, the store can ask you to leave your coat and bags at the door before you go in, like must stores do.

@Shamika Baker I am feeling that. Had this same issue a few weeks ago. Happened with my daughter over $4 of merchandise. She didn’t get a receipt after her purchase and left. She was followed out and accused by an employee. She went back and confirmed her purchase with the employee at the register. I was livid and the store apologized. My daughter returned the merchandise and we left our cart. We were offered credit and discounts but decided to not shop there anymore considering this wasn’t the first incident according to the manager.

A lot of stores allow you to have you receipt sent by email too. Where you been?
