  • The Atlanta Police Department in Georgia said they released bodycam footage of an incident between officers and a woman after she took to social media claiming excessive force was used during her arrest. Authorities say she was arrested after apparently refusing to sign a citation for being at a closed city park, violating a city ordinance.

      Actually it's promising to show up for court. If a person misses court, normally you file a motion to vacate conviction afterwards if you truly want to fight the ticket. The judge will usually allow the motion to and give you a new court date.
      But if you sign the ticket, then try to go through the same process, the judge will deny the motion on sight no matter what. It's because your signature is a promise to appear and comply with all stipulations. When you miss court after signing a ticket, you break that promise. You don't honor your oath. Your promise. So don't judge denies your motion because of this and you're stuck with that default judgment and fines.

    • @NotMyEmail
      @NotMyEmail 4 หลายเดือนก่อน

      @@chrissuave92only in signature required states for citations you will get arrested for not signing. Check the law in your state. There are so many non signature required states for citations. In Illinois you will not get arrested for refusing to sign because Illinois is a non signature required state for citations. Only reason they try to threaten you with arrest for not signing is for revenue. because they truly dont be wanting to go through the whole jury trial process blah blah blah.... So if they secretly intimidate you to sign by threatening to arrest you if you don't, just know that they will not do it if your state is a non signature required state. That's a lawsuit waiting to happen but most people don't know their state laws so it happens often in non signature required states and people never question it because they don't know. So the cop ends up getting away with doing it and enough time eventually passes over and the statute of limitations runs out and you miss your window period to sue. All this happens when a person doesn't know. It's false arrest that's what it is. Because in non signature required states, an officer telling you to sign a ticket is an unlawful order. Therefore, you are not obligated to do it. If he arrests you afterwards and then try to twist things around and say he arrested you for something like disorderly conduct and not refusal, you will see the truth on the bodyxam that he did in fact arrest you for refusal and he would be in trouble. It happens so so so much but people never know.. so sad.

It wasn't excessive, the only excessive thing was the 4 minutes it took to get the woman in handcuffs because she wouldn't move her arms (that were free of any grasp at multiple points) behind her. Asking the same question over and over again while not listening to said officer isn't going to get you anywhere, nor is it going to make the arrest all the more enjoyable when the only nearby floor is gravel.

      @@divinenatureonline There is nothing wrong with the officer or the law in this case. Signing the ticket isn't the same as "getting a ticket." She already got the ticket. The reason the law requires the accused to sign the ticket is so that cops can prove that the accused was physically there and was made aware that they were being ticketed. It is not an admission of guilt; it is an admission of presence.
      She didn't want to sign it just to be difficult, and due to how the law is structured, the only other way for the officer to prove that the accused was there is to take them in, book them, fingerprint them, and prove identity that way. All she had to do to avoid being taken in is sign the ticket to prove that she was indeed there.
