      prior to the arrest he stated he had no access to the cameras.
      i totally side with the lady. the walmart rep has no grounds for demanding ID without probable cause (and, clearly, there existed no probable cause).

      It doesnt matter about the courts....you are ALWAYS innocent UNTILL proven guilty.
      The cops need to ASSUME you are innocent untill they have reasonable evidence that proves otherwise

      Majority of officers make shit money until they get years in which leads to secondary jobs, example a city of 155,000 paid 1-3 years of service $15-18 an hour, in said city I was maintenence Supervisor of 280 luxury apartments that ranged from $1200 - 4000 a month and I was making $22 an hour and free apartment with 3 years as Supervisor experience

      There are questions here, if he was working security, why didn’t he view the video first before accusing this woman of theft, and why didn’t any other employee take the time to check the footage before this huge mistake was made? If they found out after all of this that she didn’t steal the items this stupid cop would’ve arrested her anyway from secondary charges stemming from the false arrest and accusations, fruit from the poisonous tree as they say!

      Exactly... There is a reason we don't do listen and believe, cause this is why.
      Some people think when an accusation is done, police needs to arrest the person and that person needs to show they are INNOCENT.
      But that is NOT TRUE! Cause a person in jail cannot find evidence in jail of their innocence.
      Doesn't matter what accusation is done... if you have no proof of allegation, you are false allegating someone.
      The officer could only detain them to find out their side of the story and request the person to stay till they finish the investigaton.
      If they did steal.. they would be hunted down with a warrant.
      If they didn't they can move along...

      Exactly, 99% of the time, I do not take the receipt when I make a purchase. My online bank statement provides all the "proof of purchase" I have ever needed.

      Depending on the state there is a cap for how much a person can sue for. So even if you win you may get way less than what you asked for by law in that state. its unfortunate.

      Civil suits are a whole different beast. There are lower thresholds to actually win the case than criminal court (more probable than not for civil, beyond a reasonable doubt for criminal), but you first have to prove a monetary value for what’s called “actual damages” (some kind of concrete number, not just IAED) before you can seek punitive damages, which is what would be paid for gross negligence above and beyond actual damages. Legal Eagle has some pretty good videos explaining the civil process compared to criminal law.
      Edit: Yes, punitive damages can be capped by various jurisdictional guidelines for different types of cases. I forgot to mention that the first time around.

      @@sally8708 Not really true. There are many cases where the police officer simply hand-cuffs a citizen, then releases them immediately without using a taser, but the city agreed to pay $50k. In those cases, the citizen didn't have visible physical damage but their right was violated, and the punitive damage was paid for the loss the freedom, which is protected by the constitution. It is not always true that the victims have to prove physical damage.

    The fact that it only takes four to six months in the police academy is a absolute "JOKE" It takes longer than that to pass the 5th grade. Two years for a license barber , and about four years to be a journeymen electrician.

    You can bet Publix jumped at the opportunity to settle for $50k, or less. She should have started at no less than $500k. I can't recall if she's suing the police department/city. Hopefully she is. She deserves a lot more than $50k.

      How can a suit be dismissed with prejudice if it's settled amicably? Isn't dismissing with prejudice something done to warn a litigator or plaintiff that their suit is considered frivolous, and similar suits should not be brought before that court again? Just a question, because that detail seemed really odd to me.
      Other than that, these videos are great. They tend to be balanced, nuanced, and fair. Nice work.

    This guy was not working as a police officer. He was OFF DUTY working as a security guard. How is he allowed to act like he is in his official capacity as an officer? And how does he have the same protections that he would have as an officer? At that point he is nothing more than a store security guard. No cop should ever be allowed to work in this type of position.

      Righttt,😅 I was just amazed how the Officer said “I’m gunna taze you”*points gun, and she opened her chest right up, like saying “Go for it” Like whaaaaaat that was gangster. ( incredibly inhumane tho, we all know that was an unreasonable use of force and full abuse of power) That cop kinda sucks for that

      Here in America, "reasonable" people would rather show you their receipt than risk having their children taken from them. They would also rather show you the receipt rather than be arrested or tased. She did the right thing offering to go back in the store with him and talk to the checkout person who checked her items, but when the officer refused or ignored that, seriously she escalated the rest of that on her own accord.
      Cop did try to de-escalate at first, but neither of them were willing to make concessions to the other. Notice how the very first second we get of this encounter the woman is shouting, refusing to look the officer in the eyes, and seems to WANT to turn this into a spectacle. She knew what she was doing. Maybe the officer profiled her, but how do you combat profiling? Don't feed into the stereotype further... Do the unexpected and actually be pleasant, show the receipt, and get back home with your kids and groceries. If it was an overstep by the officer, file a complaint the normal way. If it gets squashed, at least YOU didn't stoop down to their level just for them to beat you with experience. I don't think I have ever had a problem with showing my receipt to an employee or security guard. Why would I unless I had something to hide?

      @@undercoveragent9889 That's a bit ridiculous and quite inflammatory my dear friend. First of all, expecting people to have some personal responsibility is not the same as justifying lethal force. Saying that someone escalated the situation is not the same as saying the officer should respond in kind. I am merely explaining that there were multiple ways this situation could have turned out differently, and you have to pick and choose your battles.
      Being asked to show your receipt when you came out of a grocery store is not the same as being asked to provide identification when you are not legally obligated to. If you choose to make a fuss over it instead of just sighing and showing the receipt, then you have to take some responsibility for the direction the rest of the encounter goes because you decided you wanted to be difficult. Maybe a normal grocery worker would say "F- it, not worth the hassle" and walk away, but if the employee of the establishment doesn't do that, you have an easy way to make them leave satisfied that they did their due diligence.

      As a resident, I would get ahold of Publix as well. The manager created the situation by making the claim without checking video. He could have asked her to stop while he does so or asked the cops to hold her briefly while they did so (she even offered to wait or go with), but him and the cop did it the hard way, assuming she was guilty and assaulting her. The manager should be fired for profiling her resulting in assault and arrest when she was never guilty. Being angry and stubborn and such are part free speech and refusing to show id or receipt - while possibly silly and throwing gasoline on the fire - is perfectly legal. Somebody should go audit the store while that manager is working, see whom else he wants to profile.

      Knowing how things work in an ER, she only had to wait so long because she was brought in being under arrest. That's commonly done if it's non life threatening. When all others are taken care of then she is attended. This is normally because officers have spewed their version and of course, the victim waits.

      The worst part is there was no regard for her children, and the officer made coercive threats to call state child endangerment...the usual threats to black women with children etc., It's clear he was racially profiling her and felt good saying how all the shoppers are black, sounded like something he says in private but much worse.

      the accusations of the store is valid. It is up to the store to provide proof of which she mentioned that he could view the camera footage. He chose not to and automatically assumed she would assist him in his investigation. This is the problem with this type of stuff..."       No clue why he said that in his report but as soon as she was passively resisting and trying to avoid being taken out the situation was entirely justified by police standards I would think.
      I know that sounds crazy but it always comes down to if you are charged or whatever you need to fight it in court. Not on the road etc.
      I don't know if it's really worth it to taser her but she had specific warnings and ignored it. This probably was the main reason why he wasn't charged. Especially if he had a representative from the union defending his interests.

    I give her an "A" for knowing her rights and having the courage to stand her ground. She even kept it up in the back seat of the police car after being tased. She did give him great alternatives to pursue whether or not a crime had been committed and was offering to stay/ not trying to flee. I wish her lawyer would have helped her file a Federal lawsuit for violating her civil rights.

    I never understood why it is necessary for the store to demand to see your receipt after you've gone through checkout. With the cameras all over the place it's just another invasion of privacy.

    I’ve always considered myself a supporter of law abiding law-enforcement. I admit, when I first saw your channel, I thought it was a witchhunt against all police officers. After watching many of your videos and extremely thorough references to the legal statutes I have done a complete 180° turn around and appreciate everyone of your videos and all your hard work. I especially appreciate how you grade the officers at the end to show that you were being extremely fair based on their interactions.

      There's a big gaping hole in our laws. Citizens have certain rights and obligations depending on the nature of the encounter. Their obligations in a casual chat are very different from cooperation in a crime investigation. But police have no duty to inform you which it is. They don't have to explain what evidence they're going on. So you think it's a friendly chat, they think it's a crime scene, and you talk past each other. You're left to guess on what's needed of you in a situation.

      Not necessarily, all a cop needs is a store representative to levy an accusation. Then the accussed needs to present proof of purchase or it can be construed as theft. if they had to be detained, they then can look at camera footage to determine the truth. Theres several factors that must ALL be met for a accusation to be levied, and only certain people can take any action

    I give her a lot of credit for not showing the receipt. Cops get away with invading our privacy so often because most of us take the path of least resistance, thereby never holding the police accountable for these breaches. It would’ve been easy for her to show the receipt and prove she hadn’t stolen anything, but she stood her ground despite the officer escalating the situation.

    Wow. This reminds me of a situation that happened to me and my friends one day and all the police had to do was watch the cameras. Long story short my car broke down at a del taco, we just needed to jump my battery so we walked around asking everyone for a jump. We finally found a construction worker that helped us out. We go inside del taco one last time to use the restroom and grab a water cup before we left. As I’m pulling out the parking lot the damn manager is like running after my car taking pictures of us. At first I kinda slowed down but I just brushed it off like whatever n kept it moving. I thought he was mad at my friend cauze he took lemonade instead of water lol. But my buddy was like bruh I just grabbed water to lol idk why he was doing that. We completely forget about that whole incident and as the day went on I was driving across a bridge that entered into a different city. We noticed a cop staring right at us as we drove by him but we didn’t really pay much attention to it. Until I come to a stop sign and a cop lets me go first when he had the right away. I nod my head with a wave saying thank you as I thought he was just being polite. Nope! He pulls right behind my car and was on my ASS. When I finally take another turn he flips the lights on to initiate a traffic stop. But before I could do anything like 7 undercover cars swarm all around us, mind you this is like mid rush hour traffic so they stop all cars in the area blocked off an entire intersection. Literally within in seconds of that first cop pulling us over we were surrounded by 30 cops with guns pointed at us and everything. They completely stopped all traffic and actually evacuated people out of the cars that were next to ours. Just completely blocked off the entire street it was fkn crazy! They made me throw the keys out the window, step out back up to the sound of my voice etc etc… same with my two buddies in the car. They made me walk backwards until my back hit the barrel of a cops shotgun. The cop even said “go ahead move one muscle please give me a reason to shoot you.” They then handcuffed and separated all 3 of us into different cop cars where we would spend the next 2 and half hours in the heat with no ac in the middle of California summer. The police wouldnt tell any of us why this was happening for hours except one dick ass cop coming back to yell at me every 5 minutes while they were searching my cars asking me “where the f*** is the gun at?! You don’t want to tel me okay don’t worry when we find it, we’ll make sure you get the maximum sentence.” Then would slam the door and go back to ripping my car apart. They threw my homework for college all over the car floor and spilled my drink all over it. They ripped my center console off its factory seal. Just completely destroyed my car. I kept trying to tell that coo I had no idea what they were talking about I kept asking them why they were doing this and told them there is definitely no gun in my vehicle! After they couldn’t find the gun they finally had a cop come talk to me. Again this is like 2-3 hours later. The officer said look we don’t know much except your license plate came back as “under investigation for an armed robbery” that occurred earlier this afternoon in the neighboring city (Citrus Heights PD of Sacramento county) That’s all we know and we have police from that city on the way out here to come talk to you. We were in the city of Folsom CA when all this happened. Finally after another couple hours, 2 officers from Citrus Heights PD showed up and they were even worse!!!! Treated us like we were straight dirt. They said this guy was robbed at gun point for his wallet at a del taco by a black guy with short dreads and a red shirt. Which just happens to fit my friends description to a T! They said the victim was on the way to see if we were the people who indeed robbed him. This entire time we kept saying check the del taco cameras we had absolutely nothing to do with this shit. We’re not that kind of people!!!!!! Nope they didn’t believe us. So much for innocent until proven guilty 🤦‍♂️ while we waited for the victim to show up the police kept harassing us and trying to scare us into snitching on each other. But none of us had anything to do with this crap! “Don’t want to talk to us huh? That’s okay will make sure you get the maximum sentence for all your charges.” Dude they were so evil man. They were ready to destroy all of our lives right there!!! We were so excited when the victim got there cause he can see we weren’t the ones who robbed him! But nope. He fkn points out my black friend cause he looked exactly like the real guy who robbed him. But he told the cops he didn’t see my car or me n my other friend that was with us. They tried to scare us into telling the “truth” again but we already were!!! So they arrested my buddy for armed robbery. No gun was found and it was solely based on the victim pointing him out. They let me and my other buddy go but not without more threats. Again we kept saying to check the damn cameras at del taco. They didn’t care. I even went to visit my buddy in Sacramento county jail and on my way out. Get this. 50 cops swarm me as I was getting into my car parked at a parking meter right in front of the jail entrance. I was detained YET AGAIN! For 2 hours because they forgot to take my license plate out the system. DUDE WTF!!!!!!
    It took them 1 week for them to check the del taco cameras to see it was a different guy who robbed that man in the parking lot. So my friend did a week in jail for absolutely nothing. We filed complaints but we were young n dumb but also scared to take action against them. We definitely should have tho and it’s one of my biggest regrets. This was definitely way before body cams. Ahhh sorry for the so called short story lmfao but as I started typing it just makes me so frustrated as I reminisce this horrible memory. Those cops treated us like we were FBI most wanted.

      Obviously, this is not a case of “few and far between” complaints filed against this officer, and I suspect the nature of the complaints will affect how long the complaints remain actively on his records.

      Innocent until proven guilty is a phrase that applies to the courtroom, not the street. A police officer can arrest anyone for just about anything. That doesn’t mean he is right, but it is within his authority. Imagine if an officer approached a suspected bank robber and said I need to detain you a moment and figure out if you committed a crime, but the suspect says “I didn’t do it” so the officer just has to let him walk away.

    I work in loss prevention and everything this guy did was way out of line. You have to have evidence before you approach somebody you believe to be committing a crime (theft/shoplifting). You can never go off of just suspicion. This guy should not be a cop. He even acknowledged in the aftermath of tasing her that he didn't know if she paid or not. Completely inappropriate behavior on his part.

    What does her id have to do with anything? Also she mentioned going into the store and the cop denied it. The cameras would’ve solved everything but he assumed she was guilty with zero proof.

      thats not entirely accurate. the cop had probable cause to investigate her due to the phone call and not producing the receipt, which would have solved this instantly and not even require her producing an ID. but since she didnt produce the receipt it made her look even more suspicious then originally because shes clearly reguarded. i think the use of that taser was both reasonable and enccesary. i was tired of hearing that women screech. too bad it didint make her shut up.
      funniest thing is how many times ive walked straight out of a store without paying and this has NEVER happened to me. ive had a couple employees spot me over the years, but never even said anything. and i was always long gone before anyone had time to get there. assuming the cops were even called. it honestly boggles my mind that this actually happens to people,,, grocery stores, home depots, walmarts. god dam. the day the cops pull up im not even going to fuss. my tuime will be up.

    She was literally assumed to be guilty, my house and fridge are full of shit I never had to prove I bought. Imagine a cop pulling you over and asking for the receipt for the clothes your wearing or to see the title to your car, or the lease for your apartment. He assumed she was a thief because somebody vaguely suggested she might be. Absolutely ridiculous, good for her for standing up to him but I really wish she didn't have to.

People used to like having cops because they could feel safe that they were doing their jobs. Nowadays most people want to defund the police...       She literally had a piece of white paper she could have handed to him, shown the date and logo of the store, and would have drove off in seconds later. No, she wasn't legally obligated but she was accused of a crime and had the ability to dispel suspicion in literally moments. She opted in to be combative and argumentative every step of the way.

    My Ex and the father of my only child has been a police officer since our 20's and has offend has many police officers do, work OFF DUTY to make financial ends meet anyway, security officers may carrier fire arms but, they don't have the training of police officers in fact, their jurisdiction is within the establishment which they work. YES they can follow a suspect throughout the store and contain them when attempt to leave BUT THEY HAVE TO CALL THE POLICE OF THAT JUSDICTION TO ACTUALLY ARREST THEM, THEY HAVE NO ATHORITY TO DO SO THEY HAVE TO CALL THE REAL POLICE TO EFFECT THE ARREST. Now you have an off duty police officer working as security at a grocery store, he knows the law and is held at higher standards because he KNOWS THE LAW but what does he do, he accosted this woman in her car in the parking lot and demands she show her receipt because she STOLE. OK, SHE repeatedly stated I don't steal, let go back into the store and talk to employee that checked me out and the video which would confirm my ACTIONS , I don't steal!!! The off duty police officer TEASED HER FOR NOT SHOWING HER RECEIPT FOR HER PURCHASES BEFORE HE CALLED THE ON DUTY POLICE OFFICERS, SERIOUSLY!!! She had the receipt for her purchases and yet this off duty police officer indangered her life put the children is was responsible for at the time and she had to rely on those children to call her and family to let them know where she was, SERIOUSLY, WHAT IS WRONG WITH OUR SYSTEM???? How long did that take??? How many REAL CRIMINALS WERE PERPETRATING DURING THAT TIME? That's a RHETORICAL QUESTION. The off duty police officer abused his authority as store surety guard and finally dragged this woman out of car then teased her when her arms were at side then called 911 when she was on the ground because she refused to show him her receipt for her purchases. Thank God he didn't pull his police issue firearm!!!
