While I chuckle at this whole situation, I also agree w/ the Cop in saying, "It's not a normal thing to encounter". Perhaps it's a sign of the times & he'll be seeing a lot more of this, truly I don't know? It's an ugly thing & I don't show my love in that way but to each his own..... lol, one thing is clear; police can stop anyone at anytime for anything ! We see this everyday so they can/do stop people just b/c they can! I personally don't go out of my way to have an encounter w/ them & flipping them off is inviting them to stop me. Judges are part of the process or working group, and rarely will rock the boat; it's usually when a case gets to a higher court that cheesy behavior can be set aside.
Should be a crime punishable by 1 year for every second they have someone pulled over. And if they were to arrest the subject, then they should be charged with armed kidnapping.

As a past telemarketer calling in donations foR C.O.P.S. and other PIG BS, I can tell you that because of a PIGS stature in the community they are not allowed to ask for donations. That's why we get calls from telemarketers on behalf of the PIGS. If I'd have known I was gonna be calling in donations for PIGS, I never would have taken the job but bills needed paid and I was already hired so I didn't try that hard to get the donations.They were paying me $15 an hr and I made sure I called in less than $10 an hr..lol

Thank God, I was pulled over by a state trooper as a teenager and had a very bad experience, got threatened to be taken to jail over sesame seeds off a hamburger bun I had scraped into my ashtray , I was told that was pot residue, at this point in my life I had never seen a joint nor knew what pot even looked like.... I wish cell phones and body cams were available in those days
I learned today that it takes years for a citizen to be approved for social security disability benefits, but it only takes 30 seconds to end those benefits. My father was disabled & he passed away & I had to call to end his benefits. It was waaaay easier than anything usually is with the government.

When I was an 18 year old woman, I had a retired police officer in front of me (in civilian vehicle) brake checking me out of no where on a perfectly clear sunny summer day on a rural road. I finally had enough of his BS so I passed him & gave him the finger. I drove away & never looked back. When I finally got to my destination, he had followed me all the way to private property to block me in & get out of his car to confront me about it. The dude was like 75 years old by the looks of it & he was so proud of the fact that he was a retired police officer. He screamed at me & threatened me that he could charge me with assault for giving him the finger lol. Being so young & dumb I was terrified & just nodded my head in agreement to get him to go away. If he would have tried that on me now that I am 30, he would have had another thing coming.
The police officer needs to be personally responsible and accountable. Why should all citizens and taxpayers be accountable for this officer's totalitarianism 😢
@bhambhole I know a few, but they are a slim minority. My best friends dad was a Constable (Texas) and has since retired, but then went back to work as a LEO- he is the only honest cop that I've ever met in my life. When I got myself into trouble, back in college, he saved my ass. It embarrassed me so much, it changed my life forever. It wasn't the arrest or actions that embarrassed me, but having him come in the middle of the night to get me- it was truly a humbling experience.

Then you give an example of your friends dad, who "saved your ass" one night when you were in college. But hm helping you out if trouble because you were his sons friend isn't honest at all. Sounds like he was doing you a favor that he wouldn't do for the average citizen if he didn't know them. That goes to show that they don't treat everyone the same or fairly, and makes it sound like he doesn't have any integrity or honesty at all. I think that's the most interesting part. There's quite literally zero evidence of the alleged crime being committed. Edit: I forgot to add the DA should have thrown out the case as soon as he realized there was no evidence (unless you count the cops theoretical hearsay) to prosecute. Instead the DA decided to add a charge that had exculpatory evidence (evidence that proves the person is innocent).
You ask for it... you're gonna get something! The extortion bit is the big eyebrow-raise for me. A cop can make provocative threats, but a DA or Judge looks completely corruptible like that.

My mouth literally fell open when the Trooper said "I'm going to arrest him". The most blatantly retaliatory arrest I have ever seen. That prosecutor requiring a donation to a "Charitable Organization" in exchange for dropping charges...that's legally called "extortion". Somebody needs to do a deep dive on this guy's connection to this "Charitable Organization", there's something off here in a big way.

He was abusing disorderly laws. That's not how it works. Cops can't be offended ON BEHALF of others, someone has to actually make a complaint and then give the cop their information for the report and show up in court to testify as to being offended from hearing a word. Cops can't just go around doing this. 😒

The fact that this happened five years ago and no federal charges for civil rights violations has occurred speaks volumes on the ineffectiveness of law enforcement when crimes are committed by those in positions of authority. The justice system is not policing its own.
@Boggyboytad I guarantee you that you can snag anyone who takes directly-adversarial action to clearly-established case law to a review board with a complaint. Absolute Immunity (granted to judges) means they can't be sued but they can be fired. And trust me. Nobody wants to be fired from a job where you get paid a lot of money to sit down all day and referee two nerds duking it out, or (even better) the ability to literally shut annoying people up and kick them out of your office. There's lots of reading you have to do on your office days, sure, but that's it. You don't even type up your own paperwork. The state pays someone to do all that
Fun fact: in Germany, it is generally illegal to flip anyone off in traffic. Flipping off anyone is considered defamation, but doing it general public usually has no legal consequence. Flipping off someone in traffic can get you fined. And some form of "contempt of cop" Is actually a crime here, though I don't know what it is actually called. But in the US, this is inexcusable

@@TSteffi If you are referring to Beamtenbeleidigung, that does not exist in German law. Flipping off (or insulting) a cop has the same consequences as flipping off or insulting anyone else. Other countries may have different laws though.
@@Arsenic71 You are partially right. There is no special paragraph for Beamtenbeleidigung. It is a special case of §185 Beleidigung. While technically not different from normal citizens, it is prosecuted very differently. While a §185 violation reported by normal citizens is rarely prosecuted at all, it is almost always prosecuted in case of officers. This happens because in case of officers, the state attourney will almost always assume 'public interest' and try to get the highest punishment possible. But in case of private citizens, public interest is almost always denied, fines are negligible and charges will often be dropped. It is a bit different if it happens in traffic. Reason here is that insults and defamation is likely to aggravate a driver, making them more agressive and possibly causing dangerous acts. For that reason, public interest might be granted in that case. But I'm not a lawyer, so there might be other factors at play there.
Most areas of the country are EXTREMELY safe and through technology and such policing has never been easier. Pair that with more money and personal in law enforcement than ever means cops just legitimately have not much to do.

You're already allowed to fine me for a crime, you shouldn't be allowed to make me pay strangers because you're dropping a crime. ((As if there was a single crime in this case. There isn't a single crime committed here, but lets play pretend like the cop and judge.))

This was 100% retaliation by the cop and every American citizen wouldn't insult a state actor for stopping the citizen because the state actor's feelings were hurt.
I flipped a state cop off in my state of RI for pulling over cars indiscriminately. He quickly pulled me over and issued me three violations for a dirty back window, a sticker in my side window and a frame around my license plate. Being a clear retaliatory stop I fought it court. The cop never showed and all three violations were dismissed.
Had a very similar thing happen. Got a huge citation in the mail for an off duty cop trying to intimidate me. Pulled the 911 records of her trying to get me arrested while we were driving in traffic. (Where the off duty broke several traffic laws trying to stop me in her personal vehicle because i yelled at her to stop texting and driving) Long story short, after 8 months of no shows, and threat of lawsuit, it was expunged from my record and the officer shortly after resigned and found other employment.
Because Vermont is a liberal state. And liberals( these progressive radical liberals I mean, not ALL democrats) are appalled when their feelings get hurt and do everything in their power to silence you.

@@beepbop6697- That's not necessarily true. I've seen other officers claim that the person's silence indicated that they were having a mental health problem. There's really not much you can do when an officer is intent on mistreating you. You should generally focus on trying to survive and document the situation, as well as not providing a basis for more charges (legitimate or not).

I never realized that someone revealing their middle finger was trying to get my attention. Is that some universal sign for "I'm being kidnapped, need help" or "I am suffering from a seizure and need immediate medical attention!" In my ignorance, I might have missed a chance to save someone's life. This stop definitely did not appear to be based upon "concern" for the well-being of his victim.
Unfortunately it'll never happen, the court system does everything it can to protect their buddies. This has been going on for 50+ years now and our government fails to hold them accountable sadly.

@@TCR2025- I've also seen other officers claim that they were seeing if a person needed help, when they unlawfully detained the person after the person flipped them off. It doesn't really matter at this point because we don't impose significant negative consequences when officers unlawfully detain people for constitutionally-protected speech.
Solicitation of a bribe is criminal, and offering to dismiss for a contribution is a bribe. The prosecutor should be charged with the solicitation of a bribe in this case.
Most lawyers don’t know basic law. They know how to make a deal and that’s it. They don’t do any of their own research, they have paralegals for that. And a little unknown fact is if you ever have to represent yourself you can’t have a paralegal on your side.

When I was an 18 year old woman, I had a retired police officer in front of me (in civilian vehicle) brake checking me out of no where on a perfectly clear sunny summer day on a rural road. I finally had enough of his BS so I passed him & gave him the finger. I drove away & never looked back. When I finally got to my destination, he had followed me all the way to private property to block me in & get out of his car to confront me about it. The dude was like 75 years old by the looks of it & he was so proud of the fact that he was a retired police officer. He screamed at me & threatened me that he could charge me with assault for giving him the finger lol. Being so young & dumb I was terrified & just nodded my head in agreement to get him to go away. If he would have tried that on me now that I am 30, he would have had another thing coming.

My best friends dad was a Constable (Texas) and has since retired, but then went back to work as a LEO- he is the only honest cop that I've ever met in my life. When I got myself into trouble, back in college, he saved my ass. It embarrassed me so much, it changed my life forever. It wasn't the arrest or actions that embarrassed me, but having him come in the middle of the night to get me- it was truly a humbling experience.

Edit: I forgot to add the DA should have thrown out the case as soon as he realized there was no evidence (unless you count the cops theoretical hearsay) to prosecute. Instead the DA decided to add a charge that had exculpatory evidence (evidence that proves the person is innocent).

Absolute Immunity (granted to judges) means they can't be sued but they can be fired.

@@TSteffi If you are referring to Beamtenbeleidigung, that does not exist in German law. Flipping off (or insulting) a cop has the same consequences as flipping off or insulting anyone else. Other countries may have different laws though.

While technically not different from normal citizens, it is prosecuted very differently.
While a §185 violation reported by normal citizens is rarely prosecuted at all, it is almost always prosecuted in case of officers. This happens because in case of officers, the state attourney will almost always assume 'public interest' and try to get the highest punishment possible. But in case of private citizens, public interest is almost always denied, fines are negligible and charges will often be dropped.
It is a bit different if it happens in traffic. Reason here is that insults and defamation is likely to aggravate a driver, making them more agressive and possibly causing dangerous acts. For that reason, public interest might be granted in that case.
But I'm not a lawyer, so there might be other factors at play there.

I flipped a state cop off in my state of RI for pulling over cars indiscriminately. He quickly pulled me over and issued me three violations for a dirty back window, a sticker in my side window and a frame around my license plate. Being a clear retaliatory stop I fought it court. The cop never showed and all three violations were dismissed.
Should’ve sued. That’s an illegal seizure to detain you for it.
So he succeeded in his retaliation, as in you having to deal with it in court. I guess there's no winning with these emotional and fragile cops.

Had a very similar thing happen. Got a huge citation in the mail for an off duty cop trying to intimidate me. Pulled the 911 records of her trying to get me arrested while we were driving in traffic. (Where the off duty broke several traffic laws trying to stop me in her personal vehicle because i yelled at her to stop texting and driving)
Long story short, after 8 months of no shows, and threat of lawsuit, it was expunged from my record and the officer shortly after resigned and found other employment.

There's really not much you can do when an officer is intent on mistreating you. You should generally focus on trying to survive and document the situation, as well as not providing a basis for more charges (legitimate or not).

I never realized that someone revealing their middle finger was trying to get my attention. Is that some universal sign for "I'm being kidnapped, need help" or "I am suffering from a seizure and need immediate medical attention!" Most lawyers don’t know basic law. They know how to make a deal and that’s it. They don’t do any of their own research, they have paralegals for that.
And a little unknown fact is if you ever have to represent yourself you can’t have a paralegal on your side.

If a police officer is flipped off when someone giving him the middle finger it gets highly upset about it you can weed him out firing him evidently that police officer is too thin skin.

god, can you imagine having an argument with him at home? he'd take offense to you getting frustrated and rolling your eyes and pretend he's worried about your ocular health. eventually you go, "ok, fine! whatever! i'm gonna go for a walk," and then he'd pull you aside again for upsetting the kids, who are outside and don't even know this conversation is happening.
