- The International Court of Justice just delivered another land-mark ruling concerning Israel’s illegal occupation of Palestine that, judging from Netanyahu’s furious reaction, must really hurt. So, let’s have a look at this.

Before going into the ruling of the International Court of Justice (or the ICJ as I will call it from here on), let’s make it clear what we are dealing with here.
Because, while this is a highly significant decision that had to be duly voted on by all the court’s 15 judges, it is not an enforceable judgment over a concrete case brought to the ICJ by a UN member, like the South Africa case against Isreal. There is no “guilty” verdict or punishment attached to this one. What the court produced was a so-called “advisory opinion” on a legal matter which the UN General Assembly asked it to produce.
Why did the Assembly do this? Well, advisory opinions from the ICJ are the most authoritative interpretations of international law that you can get. It means the court’s 15 lawyers and their teams studied a certain legal question for months and years and then deliver a judgment in the sense of a “super expert opinion” on the matter.
In the practice of international law, these opinions then become “sources of law,” which itself can serve several purposes
1. They can be the basis for future verdicts on concrete questions if members decide to drag each other to the court.
2. They can inform UN members at the General Assembly and the Security council of what the law actually says, which makes it easier to argue for or against resolutions that might be proposed. Which is something we can expect to happen in this case. The General Assembly will certainly in the future create resolutions that will be based on this verdict.
The second thing to note is that while Israel forcefully “rejects” the ruling and certainly won’t adjust its behaviour. This is a big set-back for the Zionist project.
You see, International Law is not like domestic law. It’s not enforceable the way that domestic law is. It also doesn’t come about the same way as domestic law. Domestic law is made (usually) by legislative bodies, (usually) called parliaments. They are more or less concrete rules which are then used by the state machine to structure social live inside a country.
International Law doesn’t work like that, because there is no world parliament with the same force over everyone. The UN General Assembly might look a bit like a parliament but it really isn’t the same kind of institution. International Law represents first and foremost the “general collective will” of the international community as expressed through treaties, declarations, custom, and-expert opinions.
So what this verdict signifies is another instant of “the world” not recognising Israel’s claims over Palestinian lands. Of course Israel is angry now and says, literally, “The people of Israel are not occupiers in their own land and in their eternal capital, Jerusalem” - this is actually a quite useful statement, because exactly this is the core of the issue. The verdict means that the world does not recognise precisely this claim, namely that Israel, by virtue of Jews having lived in these lands 2000 years ago, derives some magical historical rights over the land. This is not a concept of international law and won’t be one. And Isreal is furious about not being able to impose its will here.
Because, you know, this is a very big problem Zionism since Isreal’s entire political strategy is to just create facts on the ground. Isreal’s idea ever since its establishment in 1948 has been to just ignore international law, do things that are clearly considered crimes under that law, just take the land, replace the people who are living there, and, over time, let that become a fact of international live.
This is not even a new strategy as this is exactly how all successful settler colonial states were created. New people from Europe eradicated native populations, set up their own states and those became members of the international community by virtue of all other states at the time recognising them. You see, recognition by other states is really the core of how international law works.
International Law is the will of the world, so if the wold loses the will to oppose Israel and actually recognises its claims, then those claims will become “legal” in the sense of being recognised by the international community. Past actions will always remain illegal under past IL, but for the future they will become recognised and the illegality of them will seize.

Since ICJ had set precedent on Palestine land now, so I encourage Syria to consider seek the same ICJ ruling to reclaim Golan heights.
Sure, countries like Syria, which lose territory in a war which THEY started should always get that territory back. That's fair. Oh, the people in Gaza had 17 years of independence to stop suffering. International aid organizations and other nations poured billions of developmental aid into this very small area, which should have produced prosperity and well being for everybody in there. If you had just given every person in Gaza an equal share in all those billions, they would all be terribly well off today. But instead, the fascist Hamas dictatorship stole that money and used it to build tunnels like ratholes throughout the whole country, stuff them with missiles and other arms, and finance terrorist activities. The only thing which has held back the so called Palestinians is their idiotic following of terrorist factions which LIVE to destroy Israel rather than to build up their own people. Those terrorist factions, backed by all the Arab states in the area, TURNED DOWN the offer of an Arab state in Gaza and the West Bank in 1948 when both of those areas were controlled by Egypt and Jordan, respectively. They could EASILY have built up a prosperous state in those areas, and, hell, Egypt could have thrown in the Sinai peninsula to provide the bridge between the two areas. Instead, all of the Arabs chose to hate Israel and refuse the offered state. And they have done that for 70 years. Learn some history, instead of just whining about the poor people who have followed terrorist leaders all their lives.

Just a point about what 'Advisory Opinions' are, and them being 'non-binding'. I see lots of apologists/news anchors emphasizing and leading with that, as if the ICJ ruling is just a suggestion and legal vibing. That is a mischaracterization. 'Non-binding' has a specific meanings, but there are also other legitimate senses of political/legal obligation that arise from Advisory Opinions.
There are two kinds of cases the ICJ can hear, 'Contentious' cases (e.g. [South Africa] v. [Israel]) and 'Advisory' cases (with the long descriptive names). Contentious cases are submitted by the states in dispute, with higher thresholds for jurisdiction and generally require consent of the parties. They are to do with circumscribed disputes that exist between those parties, and the ruling is said to be 'binding' on them because Art 94(1) of the UN Charter requires States "to comply with the decision of the ICJ in any case to which it is a party," and 94(2) directly allows for Security Council resolutions to ensure compliance (but keep in mind they can still be vetoed anyway). Advisory cases are submitted by the UN Security Council or General Assembly, in order to generally clarify the international law/status of broader issues to do with the law itself, but because there are technically no parties to the case, Art 94 is not engaged and so it could be said they are non-binding by default.
But that does not make Advisory Opinions mere suggestions or optional. The law that comes out of ICJ Advisory Opinions is the globally authoritative precedent/interpretation of international law for all UN Member States and international legal bodies. For instance if the ICJ interprets something comes under a 'preemptory norm' (mandatory legal principles that can have no exceptions), what follows can be considered 'binding' on all states, like in this case where they found self-determination is a preemptory norm and its fulfillment cannot be subject to conditions of the occupier (i.e. Oslo). Or that facts of Gaza after 2007 amount to occupation, that is a 'binding' interpretation which puts it under the Law of Occupation/Geneva Convention. And given the ICJ found a violation of Article 3 of the CERD Convention (i.e. apartheid), that becomes the official interpretation of Art 3 for all ratifiers of CERD, which then engages all the obligations (and any enforcement mechanisms) that flow from that legal instrument. The same goes for the Rome Statute and ICC, the ICC has to follow the ICJ's interpretation of the legal (ir)relevance of Oslo, and so totally negates the UK's wacky objection that Oslo precludes jurisdiction because 'Palestine already delegated its criminal jurisdiction to Israel' (there can be no exceptions to the preemptory norm of self-determination).
It also affects all domestic regimes and their incorporation/use of international law. Keir Starmer made releasing legal advice of the UK gov about arms sales to Israel and compliance with International Law a major election issue (licensing compliance with IL is also a part of domestic UK law). It’s hard to overstate how much he has staked his whole personal/government brand on following/'respecting' International Law. Starmer/the gov has constantly dodged questions by saying “these are legal issues for a court to decide” and exploiting vague aspects of International Law. Now that the ICJ has provided authoritative clarity, Starmer has painted himself into a corner of indisputable hypocrisy. He technically could say the gov is not directly required to comply with the ruling via Art 94 of the Charter, but he cannot deny any of the ICJ interpretations themselves (e.g. that there is a system of apartheid), which are no longer up for debate, and which may give rise to binding obligations through other means. Whether that is in the bodies/treaties that a State is party to that are impacted, leverage for negotiations, areas of domestic law that incorporate international law, and any political weight/mechanisms that are tied to compliance with international law, all of which are irrelevant to Art 94 per se. The EU (itself a creature of international law) also heavily/procedurally incorporates International Law, with major implications.
Ultimately all International Law is a game of battling sources, instruments, and interpretations amongst states, but the ICJ interpretation trumps them all. The particular obligations and enforcement will come down to the specific reasoning/arguments relied on in the Advisory Opinion, and the ancillary treaties/norms/bodies of law that are brought into play. But just saying a case is 'advisory' and 'non-binding' as a whole in the colloquial sense, is not a valid argument. At best it's not the full picture, at worst it's utterly misleading.

Even if there is no legal enforcement, there is this aspect of global human populations that have a sort of herd mentality. Some individuals and various human organizations are likely going to look at this ruling and make subsequent decisions about business contracts. The "we don't want to do business with you" has the immediate impact of "we're not getting the business contract now because they don't want to work with us." The reason being this ruling or the general Palestine situation might not be stated out of a fear of the U.S. or Israel's retaliation, but if a decision is made when there are equally suitable alternatives in a competitive environment does it really matter if some party states the reason or not? For example, someone might say "Oh, I like this Japanese software product better than this Israeli software product because of x y or z reason." The real reason maybe winds up being the general ickiness of working with Israel given the current geopolitical situation but that doesn't have to be the exactly stated reason.

Pascal, is it correct that this ruling respects the existence of a majority Jewish state, ie. a racist enclave on Palestinian land (a beach-head of racist European colonialism in the strategically important middle-east). Didn’t the “two state solution” imposed on the Palestinians by the UN in 1948 create the right of Israel to create an apartheid - a predominantly Jewish - state? Isn’t that the original crime? And isn’t this ruling consistent with that original decision?
