Totally disagree with the ruling here. The plaintiff knew this guy wasn't a professional and she was doing it on the down low without a permit. He admittedly didn't do a good job but his time and effort should have been worth something. Not to mention she never gave him a chance to try to fix it. If I'm the judge here I split it 50-50.
people need to realize that just because someone needs a job done and you have a tiny bit of skill to do it, regardless if you need money, you should pass the job to someone more qualified.

"Clean hands" applies if you're actually committing a crime. Failing to get a permit can usually cause civil penalties, but is not generally going to be considered a "crime." That being said, I do wish there was a way the defendant could have gotten paid for his labor in this case.

My deceased husband was a carpenter. stairs are VERY complicated, You have to figure out ahead of time how many steps you will need to fit your space, PLUS, the saw cut also takes up space so that has to be considered, PLUS, make sure whoever is using the steps can handle the height of of them, PLUS, make sure your foot will fit comfortably, plus, figure out the landing and foundation. That is not a job for a beginner.
A lot of places have code as to tread width and height of stairs. I built my own, on research, not that high only 6 or 7 steps and there is a lot more to it than just cutting the wood and nailing it together. Also if you mess up you're not going to just fix it, with stairs you mess up you either have what you have or you redo them. He's just making it sound like he can make some minor adjustments, no way, not happening. That being said, you want to pay that price knowing what a professional job costs, you should be on the hook for something as should he for claiming he could do it. I had no problem doing my own but even after that, a neighbor liked my work and asked me to do hers and pay me and I refused the job because I'm not confident enough to get in to a job like that for someone else.

Plus he did more than half the work building the door and patio. Her only complaint was the steps. Like they forgot the rest of the job was included in the price that wasnt just for the steps.

I am very disappointed with JM here. The defendant seemed like a straight up guy. He was doing the job for a fraction of the cost. Why did she not let him come back and finish? As always you get what you pay for and he was doing his best. JM is so inconsistent. That’s how business works. Stairs can be corrected, nails can be hammered more. This was an insane ruling and I’d be ashamed to call myself a judge after making the ruling.

I understand this. For three years I was mowing a client yard for his mother. Last year I would just mow over their dog waste and say nothing about it. This year they have four pitbulls. Two additional then last year when all they had were two. I went to do their yard a couple of weeks ago. Get to the house and there's like five patches of wet dog waste in one area. I went to pick it up and place it in the trash can. Then I notice there were dog waste all throughout the yard. I text him and told him that I couldn't do the yard until someone came and cleaned up the poop cause after picking up five wet patches of it. I wasn't doing it anymore. That Monday I text to ask if he was home and he text back. I found someone who will do the yard for a cheaper price. I said ok. In a way I was hurt a little but at the same time. I was happy because now I don't have to clean up four pitbull waste anymore.

This will serve him well in the future and I wish him well. They paid for a $1400.00 job and expected a $14000.00 job.

My deceased husband was a carpenter. stairs are VERY complicated, You have to figure out ahead of time how many steps you will need to fit your space, PLUS, the saw cut also takes up space so that has to be considered, PLUS, make sure whoever is using the steps can handle the height of of them, PLUS, make sure your foot will fit comfortably, plus, figure out the landing and foundation. That is not a job for a beginner.

A lot of places have code as to tread width and height of stairs. I built my own, on research, not that high only 6 or 7 steps and there is a lot more to it than just cutting the wood and nailing it together. Also if you mess up you're not going to just fix it, with stairs you mess up you either have what you have or you redo them. He's just making it sound like he can make some minor adjustments, no way, not happening. That being said, you want to pay that price knowing what a professional job costs, you should be on the hook for something as should he for claiming he could do it. I had no problem doing my own but even after that, a neighbor liked my work and asked me to do hers and pay me and I refused the job because I'm not confident enough to get in to a job like that for someone else.

Exactly I wondered why she switch up the case. She also always says the cheap comes at a price or however she says that phrase about when you try to be cheap you pay more in the end. Plus he did more than half the work building the door and patio. Her only complaint was the steps. Like they forgot the rest of the job was included in the price that wasnt just for the steps.

With due respect, our favourite judge got it wrong this time. The plaintiff seems to be one of those people who are never satisfied. Also why didnt her husband work with the carpenter especially when all parties knew that the carpenter had not experience in that type of work - in other words they all knew that they were taking a chance.
I am very disappointed with JM here. The defendant seemed like a straight up guy. He was doing the job for a fraction of the cost. Why did she not let him come back and finish? As always you get what you pay for and he was doing his best. JM is so inconsistent. Normally in these cases she will say that they don't get all of the money back because of the time spent on the work. Shame on her and shame on the plaintiff for bad mouthing him at the end.

I understand this. For three years I was mowing a client yard for his mother. Last year I would just mow over their dog waste and say nothing about it. This year they have four pitbulls. Two additional then last year when all they had were two. I went to do their yard a couple of weeks ago. Get to the house and there's like five patches of wet dog waste in one area. I went to pick it up and place it in the trash can. Then I notice there were dog waste all throughout the yard. I text him and told him that I couldn't do the yard until someone came and cleaned up the poop cause after picking up five wet patches of it. I wasn't doing it anymore. That Monday I text to ask if he was home and he text back. I found someone who will do the yard for a cheaper price. I said ok. In a way I was hurt a little but at the same time. I was happy because now I don't have to clean up four pitbull waste anymore.

The judge only complained about the stairs being a problem. What about installing the door? What about the deck? What about the money this guy put out for supplies? They chose to tear the whole thing down rather than just redo the stairs. That is on them. Now they have all that free lumber and this man gets nothing for all his hard work. This lady called him a bum and put him down when he was trying to do his best and save her money. That shows poor character. I do like the defendants attitude and hard work ethic. This will serve him well in the future and I wish him well. They paid for a $1400.00 job and expected a $14000.00 job.
I think the plaintiff is a pos. His work was crappy but I don't see any reason she should have called him an undesirable and a bum. To be honest, she should have gotten half her money back and not the whole thing. At the end of the day, he was up front about not being licensed and she knew that hiring someone qualified would be EXPENSIVE. She wanted pro work at an amateur price and has the nerve to call him a bum.

I hope justice finds this man, because it didn't in this case. What happened to her saying her spanish phrase, "The cheap becomes expensive?" I'm not saying he shouldn't have paid anything back, but he did spend 3 days, and likely at least a couple dozen hours on that project. He should be paid SOMETHING. He was in over his head, and so was the plaintiff who who was trying to bypass the proper process. Unfair.
