I worked on these phones before. There is a screen that goes on top, and a rectangular metal frame that goes inside. On her phone, both were damaged.
The defendant replaces the outer screen and charged her $140 for it. She came back, because the frame needed replacing as well. The defendant offered to fix it, just for the cost of the frame $20. She refused, and got a replacement phone instead from her insurance for $99 .
Now she wants the money back for the screen, because she got another phone, and doesn’t need this one anymore.
Defendant says fine , but we’ll keep 20% , $28 for the past labor.
I don’t think the defendant did anything wrong. The right judgement would have been for her to pay $20 for a new frame. Not the defendant being yelled at , and the plaintiff getting a free screen.

    • @loveification1

Why would she order her to pay $20 when she doesn't need a new frame anymore lol

    • @lisaparrey1343
      @lisaparrey1343 ปีที่แล้ว +2

no because he didn't say anything up front and didn't fix the phone correctly and let her walk away with a phone not properly fixed and then when she came back he wanted her to pay more money to fix it properly. This was so he had her over a barrel and got at least the $140 which the Judge said earlier. Had he done the right thing and either knowing this was a possibility and pulled the screen off and check while she was there or at the time when they pull it off, rang her and said "we have found the frame underneath is also bent, you can either pay another $25 to replace the frame or take it back as is for no cost. He chose to say nothing when she came back to pick up the phone and charge her for an incomplete job, so when she came back either way he still had the $140.00. It was the way it was done regardless of the frame that was the fraud

      1. You watch an edited show that they have to fit into a time slot.

      3. A judge controls the testimony by asking questions and will keep the litigants on track, same as a cross examine attorney will in a court.
      4. Judge has info on the case before litigants come before her so she has an idea of what happened already via their complaint and response. They have all the time in the world to state their case at that time.
      5. Judge doesn’t have time for BS, lies, deflection, non answers or someone’s life story if it’s not relevant to the case.

But we will not charge you labor to install the new frame if you wish to replace it for the 25.00 dollars. It's like having a car repaired and in doing so the repair shop finds additional issues as the are fixing the original issue. they make these phones hard as hell to repair... and they make them with crap batteries so you have to replace them after 3 years anyways, no matter how good you take care of it.
This is pretty much common knowledge. And getting something like that repaired is a Risk, you're taking a gamble.... 150$ is a lot less than a brand new phone for 800$+
But its never gonna be perfect again.
I spent $200 with best buy's crap geek squad to try and fix a $1600 laptop, it was a gamble, but it didn't pay out. They took it apart, but the motherboard was fried because I used a cheap $10 "universal" charging cable that pushed too much power into it too fast! And the cost of the parts to rebuild it, +their hourly rate to work on it, + + + tl'dr: would've cost More than just buying a New one.
So maybe this guy's problem is saying he'll Fix it for $140. When really he should say he'll Look at it, and replace the screen for $140.
But like any problem, once you start working on it, you find More problems, and that Costs More to fix.

I will say that at this point the battery is gone, but other than that it is fine. I had gotten a S9 when the updates stopped working, but I had to get a S20 when my carrier switched to using only 5G a couple months ago. All of my Samsung devices work just fine. Other than the super old S5's battery there are no problems.
I do buy really good cases, too. $60 to protect them from drops is worth it. I've never had a cracked screen.

I do not think Judge Milian was fair this time. The lady took in her phone 2 repair the "screen..." That repair costs $140. When they determined the frame was bent, they told her it would cost an additional $25 that she did not want 2 pay...She wanted another new screen. So he told her he could do that, but it would not fix the complaint she had and there would be an additional restocking fee...I think the judge failed 2 see that this lady was really the one being unreasonable. He charges $140 for a screen change. If upon opening it up you determine there is frame damage, why should that repair cost be included in the original quote? I get what the judge is saying in that he should have called her and said," we opened the phone and there is also frame damage. I am concerned that if we do not fix this as well, the screen is not going 2 fit right. It will be an additional $25, did you want us 2 go ahead and add that service?" Then if she refused, it is 100% on her...

Yes I do agree with you but I also think the repair shop was in the wrong too. They should have her the ultimatum.
Pay the extra to fix the frame and replace the screen or well refund you everything but the labor we've already incured tearing the phone down and you can have it done somewhere else thus saving them from liability.
Or at least had her sign a waiver stating she knows the frame is messed up but is refusing to pay meaning that screen repair will not be to complete perfection and she relinquishes her rights to sue the company later.
It's no different then having a bent brake rotor. You can still use it but it won't work properly. The shop has to make sure they aren't liable for future damages and lawsuits

    • @giondennis6808
      @giondennis6808 3 ปีที่แล้ว +4

@@NyxHunter the problem is, until they remove the screen 2 find the problematic frame, they don't know it is there. At that point they can not place the broken screen BACK on. The screen needed 2 be replaced either way, but the frame was bend as well and she didn't want 2 pay the additional $25. Their ONLY option was 2 replace the screen and leave her with the bent phone if she didn't want 2 replace the frame. So in doing THAT work, they were entitled 2 the $140. They DID that actual work just as they had quoted and should have been paid for it. It wasn't fair that they did the labor for the job, provided the screen and got no pay for it. @NyxHunter 3 ปีที่แล้ว +1

@@giondennis6808 yeah. I do feel bad but they didn't really do a good job of explaining themselves both to the client or the judge.
They should have told the client hey because of how you broke the screen there may be hidden damages we can't quote yet.
And they should have told the judge that because the original screen was cracked by the same incident that bent the frame they matched and thus hid the frame damage till it was opened up and that their initial price was only based on damage they could see. (Same with a car accident. The repair shop is only gonna quote what they can see and if they find more they call for permission) Which is what he was trying to say when he said that they only fix what the customer reports to them. Just didn't do well. He knew what he meant just wasn't able to speak it in a manner the judge could understand as someone who doesn't do phone repair.
Personally the technician should have been in court to explain exactly what was wrong Preferably with pictures from the repair since you should always document and cover your ass.
I will admit though that there is a serious problem with phone repair shops scamming customers so Judge wasn't wrong to assume this was just a ploy. They failed to persuade her otherwise.
I chock this one up to a bad communicating defendent. Id wager if he'd had a few pictures showing the frame damage and how it would be hidden by the og screen and effect the new one it'd be a different story. Or even if he'd just used an analogy to a car accident since they have a lot of similarities with hidden repair costs and unknown damages.
Judges are still people too so sometimes a rulling isn't perfect.

ty for saying if you charge x for a fix, stay to that price instead of trying to get a little more per person. If you do business right, you will get more customers.

Why doesn’t the judge just listen. She asks questions and then cuts him off mid answer. the frame was bent, she asked for just a screen replacement, if she wants the screen to fit well pay to fix your frame too.

The judge was dead ass wrong on this one. You cannot tell if the frame is bent until you take the screen off and try to replace it. Apparently the judge doesn't understand that..

I don’t know if anyone realized or am I missing something when the judge brought up the pictures of the phone on the tablet its all the same phone but the phone on the pictures on the tablet was a LG and the phone she handed the judge was a Samsung so i dont know if i am missing something but they are two different phones and they didn’t even look alike.

I get that they wouldn't know about the main frame being bent until they opened it up, but all it takes is noticing she needs a new main frame and putting the screen on isn't going to fix the issue and then call her and tell her what further repair she needs to correctly fix the phone and go from there. Not notice the main frame is bent, know it won't sit right or work right, but you put a new screen on anyway and wait for her to pay for the screen repair and then tell her she has a bent main frame. That's like putting makeup on a pig...it's still a pig! Be upfront and don't surprise customers after they pay with further problems you saw and could have fixed and could've communicated prior to see what the customer wanted to do. If he would've called her and told her before she came back thinking it was fixed, she probably would've just paid the extra $25 to get all done.

When she sat on it? Lol!! Heck no, you can’t fix a “crack” on a phone screen, the screen has to be replaced or the phone won’t be right!
Sometimes the Judge is so annoying, by not letting ANYONE finish a dang sentence after SHE asks them a question! Or she constantly interrupts litigants thinking she already knows what they are going to say!!

I’ve been repairing cell phones since 97’ (I cut my teeth on Motorola bag phones). I worked for AT&T mobile back when they had real technicians in every location, and we got our training from, Motorola, Nokia, Erickson, etc. I’m still repairing cell phones. I can see a bent frame as soon as the customer hands it to me. I immediately point it out to them, or if the counter person took it in I call my customer, and if they don’t have another number I wait to repair until I talk with them. Most of the time the frame can be straightened if your a quality shop with the right tools. Frame straightening tools cost money and a lot of small shops don’t want to spend that money. The defendant is right though, there are problems that you can’t know exist until the screen is installed, or at least connected to test it.
