My uncle is an officer and so are a few other family friends. While these incidents happen more then they should, they are still a very small percentage of all police encounters. A lot of law enforcement will actually review a lot of these incidents to avoid encounters like this and actually do their duties correctly. I don't know if you were encompassing all law enforcement or just those cops but just wanted to point that out either way. (I usually find that small town cops will be more likely to abuse their powers, due to less training and less accountability).
Yeah this situation was scuffed. You could hear the officer speaking notice the gun when he stepped out like he caught his tongue for a second. What I think probably happened was this dude came out with his gun holstered as a show of "dont fuck with us" (which is fair. He made NO direct threats) and I'm guessing that second cop picked up on that and went off on him for it. I would have definitely started it off way less forceful just something like "Whooooa there, fella, can I just double check that you have a permit for that. I apologize, but we have to check for a permit by state law." instead of telling him to put his hands up and telling him to disarm himself. I do think he furthered the argument though. The women were on his side but they were trying to de-escalate the tension by just telling him to go inside. I think that would have been the safest thing to do; just back off and let things just chill down, but I also understand not wanting to be oppressed by the police like that. Then the officers display some pathetic and petty behavior towards them afterwards too. Pretty stupid stuff, man. Officers should have immediately apologized and explained that they were startled by him coming out with his gun. It's embarrassing to admit it, but it's better than just yelling at the guy. If the dude wouldn't drop it after that apology, I'd say he was in the wrong then. The officers just like refused to admit that they were wrong, though. How are we ever supposed to function as a society when nobody wants to apologize for their mistakes? It's crazy. Edit: I didn't even see that the officer pulled his gun (I watch these videos while doing other things/not being tabbed in to TH-cam). That's insane that he pulled his gun on this guy for just having a gun on his hip, and then they went and found his car to give him a ticket. Pathetic.

This includes, but is not limited to, a person's lack of knowledge that their statements are being heard or can be heard by Police and used by Criminal prosecuters. See, e.g., _Illinois v. My concern is the parking tickets they placed in retaliation. While they did not arrest Mr. Branch, they cost him money out of spite. Most people don’t have an emergency fund and sometimes an extra $200 in parking fees can be devastating.
They went searching for his car specifically and wrote a ticket. Abuse of power under the color of law, in my opinion. The only thing I disagree with ATA about is calling the officers’ threats “empty”. Those threats may not have come to fruition, but they could have detained him, disarmed him, arrested him, or shot him. Each of their threats were full of potential and self-perceived authority. Cops have the right to escalate. What many cops seem to fail to understand is that they also have the responsibility to de-escalate. The 2nd Amendment means that cops in the USA need to understand the difference between simply carrying (bearing) arms and brandishing them, and to safely interact with people who are armed. Furthermore, these specific officers need to understand that it's not only police officers who are allowed to bear arms in the USA. They should have just remained calm and kept an eye on him in case he did reach for his weapon. If they were really concerned about it, maybe go so far as to ask to see his licence. But any officer who brandishes their gun on a person who is clearly not threatening them needs to be disciplined at the very least.

Lmao. Though, to be fair, they also have a right to not testify against themselves.
@@miguelzavaleta1911 then what is the point of giving them body cameras. If they don't need to hold themselves accountable why are they being recorded
@@miguelzavaleta1911 There's a big difference between the right to speak in the First Amendment and the right to *not* speak in the Fifth.
The Fifth Amendment only applies to _compelled_ statements. See _Holt v. Territory of Utah._ It is only violated when involuntarily compelled statements are introduced at trial. See _Chavez v. Martinez._ It does *not* apply to voluntary statements regardless of the circumstances. As the Supreme Court ruled in _Frazier v. Cupp,_ deception used to elicit confessions does not render the confession "compelled" so long as the statement was voluntary. This includes, but is not limited to, a person's lack of knowledge that their statements are being heard or can be heard by Police and used by Criminal prosecuters. See, e.g., _Illinois v. Perkins._
The First Amendment is not absolute. See e.g. _U.S. v. Schenck._ It's _especially_ not absolute with on-duty Government officials. Free speech rights are secured to the citizens, not those under colour of law. As such, public officials have free speech rights if they're conducted as a private citizen, not in uniform. See _Garcetti v. Ceballos._ But even if it were, the First Amendment does not protect a right to speak about one's violations of law.
Whenever you hear the “where did you get your Law degree?” Line, You know your about to see a cop violate someones rights
"Same law school you went to, officer."
You also know you're dealing with an ignorant tyrannical probably treasonous cop who doesn't know the law.

@@AlcideIzMine I'd vote for this. At least something approximating an Associate's degree from an accredited law school.
Because he told them off, they had to do something to try and show him that they hold power and that they will do anything they can within their power to hurt innocent citizens who were minding their own damn business.
Yeah that is a huge concern for me as well. They should never retaliate that is not their job and its repulsive how they behaved.
And cops say "why do you hate us?"

The only thing I disagree with ATA about is calling the officers’ threats “empty”. Those threats may not have come to fruition, but they could have detained him, disarmed him, arrested him, or shot him. Each of their threats were full of potential and self-perceived authority. They should both be fired immediately!!
Empty is the wrong word, yes, those threats should have been called, "Uncalled for threats".
Literally every interaction with a cop implicitly carries the threat of death
They were empty because they didn't carry the weight of the law behind them.
Totally agree. Police make unlawful arrests all the time and then it's up to you and a lot of your money to prove otherwise. Then the department will try and sling mud on the wall to see what can stick so they are not liable for being sued. Sickening.
@@adirtymuppet They didn’t have the weight of law so the threats might’ve been empty in that limited sense. BUT officers have the ‘authority’ to make on-site decisions that could include detainment, disarming, arrest, and various levels of physical force. Their actions may not hold up in court, but they operate on-scene with an assumption of authority that he would have to convince the judiciary was missing. Besides, no court action would change the harm he had already felt if they had followed through on their very real threats.

Body cameras shouldn't be able to immediately turn off at the cop's discretion. That kinda defeats the purpose of having a body cam to begin with. Now their new "tactic" is to play copyrighted music to try preventing the videos from being posted to social media platforms.
It’s a good tactic. That way everyone can get the correct story after it’s investigated, good or bad, instead of one sided social media.
@@bfpierce Disagree. If they know they're in the right then there's no reason for the music
I agree but there are some problems with that. Given the video fidelity that we see, the amount of hard drive space required to keep the recordings for many officers would be pretty dang high.
Course I don't know how they store the recorded videos, so I may be completely wrong on that.
@@diablorises For some reference, 500 hours of HD video takes about 1 TB of storage. You can buy a 20 tb drive for approximately $600. Assuming 40 hours are recorded/week, they could store almost five years of video for $600/officer. Seems reasonable to me.

Pulling a gun on someone is not an "empty threat".
He meant the legality of the threats

Some (very few) jurisdictions if they press the off button it actually locks the video file to prevent tampering and deleting.
