    Abolish qualified immunity and make cops carry individual liability insurance. So taxpayers don't have to pay out these claims. Doctors who work in hospitals as well as CPA's that work for large firms have to carry liability insurance. But we have them, don't we?

      You know what.. that is actually a good idea, or at least the beginning of one. Some form of that might work to stop this sort of behavior. But straight up making officers buy insurance policies would mean lower pay for officers and fewer joining up, and most police forces in the country tend to want more officers. I can also see a downside to this though. Which is that officers will become wary of accidentally violating someone's rights and not fully investigate cases that they could and should have. But for extreme cases like this, where its an obvious right that has been flouted, there needs to be severe punishments involved, even if its because of incompetence. your basic constitutional rights should be something even the dumbest officer is aware of and understands.

      Or just educate officers on the most common laws they use to "fish" for crimes. Instead of saying it gives them carte blanche to arrest whoever legally slows down their investigation.
      I assume that's what they're told, because it seems only a small minority of officers actually know when they can and can't pursue certain enquiries.

      Correct. As far as I am aware the police are not allowed to solicit trespassing. If the owner themselves has not asked for someone to be removed for trespassing the police cannot do so.

    Imagine getting arrested under false pretenses for trespassing on your own property by a trespassing cop on a power trip who had no right to arrest your father, also under false pretenses, only to get screamed at by the officer to stay calm when he carelessly points a loaded weapon at you.

      ...and the courts are more than happy to clean up the cops messes. Give them qualified immunity, decide they didn't have probable cause to arrest for this offense but they did for another offense, decide a beatdown from the cops involved de minimis violence instead of excessive force, etc. Courts are supposed to be a shield to protect the citizenry from the government. How great a job are they doing? Cops are supposed to enforce the law professionally without fear or favor. How well are they living up to that standard?

They get an insurance stipend which is the lowest cost insurance premiums for cops that haven't had lawsuits, if they can't afford insurance because they're bad cops that's on them

    The biggest problem i have with the knock and talk rules is that they were told to leave. The officers were told they were trespassing and refused. Normal citizens would be arrested at that point, but these officers feel they're above the law and that's an issue.

      Exactly. Even if they can skirt around the issue initially claiming the knock and talk law allows them access, at the point they are verbally told 'i'm trespassing you off my property, leave' 3+ times, they are violating the law by staying.
      No one else is given the privelege of verifying with the person trespassing them that they own the property to ensure the trespass is legitimate... so why should these police have the exception when they are there with no reasonable articulable suspicion.

      Even when one DOES hemorrhage a ton of money to take the case to court, and even IF they win and are awarded a favorable judgement these tyrants STILL find no repercussions funneled down to them, as its ultimately the regional, and state, taxpayers who will be the ones on the hook for, and eventually satisfying, the monetary debt that is incurred because of these morons illegal and immoral actions. This is the march into the Oblivion of Totalitarianism that We the Peoples complacency, distraction, ignorance and disregard has found us sat squarely in the center of. Our first mistake was having EVER outsourced our OWN safety, security and well being to ANY other entity. And the second mistake being (after already foolishly committing the first) to then fail to pay attention to the actions and undertakings taking place thereafter. There was a reason the Romans employed "Bread and Circuses" as a means of sedating the populace through distraction and appeasment. It's a solid method of turning watchful gazes away from the direction you would rather they not be focused on to begin with.

      I can think of a couple of other instances that it might be useful.
      For example, if someone is breaking the window of a car to gain access, and they claim that it's their car and the keys are locked in the trunk, checking ID to confirm it matches vehicle registry would confirm no crime was committed.
      But that ID would not need to be run to do that. Just compare it to the paperwork that should be in the car anyway.

      I gave this kid an ASVAB in 2011 and he was not even close to being qualified to be in the military. He has a 3.0+ GPA from taking easy classes. He scored a 5 on the ASVAB and is currently a police officer in Lynchburg, Virginia.

    Probably 30+ years ago my grandfather pulled a pistol on a sheriff who was trespassing on his property and told him to kick rocks.
    Yea a ‘no trespassing’ was posted and no retaliation against my grandfather ever took place.

      2 things:
      First, I'm pretty sure that property ownership is public record, and therefore it is perfectly within the capability of the officer to find that out before they enter the property.
      Second, I'm pretty sure to arrest someone for trespassing you need the property owner to make a complaint. Without an authorized person making a complaint how can an officer arrest someone for trespassing?
      If there's 100 people on the property having a party do the cops think they can roll up and arrest everyone unless they get explicit notification by an authorized person for each person there? This cops argument makes no sense

      Most of them can barely pass the academy, let alone any sort of law exam. Police forces are getting worse and worse, I mean who would want to be a police officer these days.       However, it's none of their business and I still won't show them!!
      I've had officers and deputies ask why I am standing on my hill, next to a street for an Uber.
      Blah blah, ID, prove ownership, give me the address!
      Honestly, I agreed with the address, that was new!!
      If I was breaking in, I probably wouldn't know the address, unless it was a targeted address or a person who is aware of their surrounding!!!
      (The address didn't help!!!! But was interesting to me!)
      They ran the plates when a supervisor arrived, and everything was fine!!!
      Yet, when my business stopped giving to their charity, it went insane!!!
      Employees and customers pulled over!
      They parked in front of the stop sign right in front!!!
      To fix it, I donated to the state police and it was great for three years until they went insane!!!
      No matter what happens, learn to defend yourself and pray you have enough money for the court system!!!
      It doesn't matter who you are!!!

I dont even live in an urban area, its in the middle of Amish country, you can drive 5 miles out and find property like this, and tons of corn fields to feed cow, but theres people living in town for a reason. some of us cant even afford a gun let alone a whole ass property.
      as much as i hate my nosy neighbors theyre the reason i can even get food delivered and manage to scrape by.

    The officers were investigating a potential crime. Without being able to establish whether a crime had been committed, they committed trespass, and arrested someone for trespassing without appropriate authority. They should be locked away until they understand that the law applies to them as well as others.

You don’t id if no law was broken. “Not cooperating with police” isn’t a valid reason to arrest in Virginia.

      Anyway, if you know you've done nothing wrong wouldn't it be simpler to provide your ID and then take it to court?

    It's amazing to me how many tickets get written and arrests are made simply because a cop gets their feelings hurt or has too much ego.

      Any system requiring unquestioned authority will result in such abuses. Our current system requires unquestioned authority because while the innocently accused may suffer, we certainly can't have a system where the justly accused are allowed to dictate the resolution of a situation.
      But there's already a technical solution - as soon as there is a meaningful interaction, beam that body cam feed back to a supervisor with an audio feed into the cop's ear to help take the on site cop's ego out of the equation.

    Imagine walking through your front door and cops barging in to demand your ID because they think its trespassing, or even show up in your yard and do the same. Both these cops needs to loose their jobs

    This dude needs to be fired, charged, and lose his qualified immunity. Absolutely insane. The last straw for me is when he flagged the dude with his own firearm. Sure is funny that these guys have no problem rolling up on law abiding citizens with firearms on their own property yet probably avoid going after actual criminals that pose a physical threat.
    And how the hell is the ID going to prove that they guy is the homeowner?

      Only thing I can think of is if it has the same address on it and/or the cops use their laptop to double check it.

      ID won't help them PROVE anything. All property ownership in the US is public information. All the police would have to do here is a literal google search of the address to see the last change of ownership, and compare it to the name provided.
