I’m a US citizen married to my husband recently. He is in the process of waiting for the green card to get approved. The interview was canceled due to Covid-19. Do you think they will provide my husband the green card without interview too?

I am a nurse in the Philippines. We were interviewed last year. We had undergone a medical exam before the embaasy interview and have been vaccinated. The clinic where we had our medical exam said they will just be sending the results to the embassy. But when during our interview they found out that i the principal applicant's medical exam was not forwarded to the embassy. Now when we were interviewed the consul said he will just wait for the arrival of my medical result . All of my 2 dependent's medical result were forwarded to the embassy. Then the consul also added that we are recommended for approval , only he will have to wait for my medical exam results for 2-3 weeks. And we repeatedly asked the consul if we are approved or not , and he said just the same we are to be recommended for approval. So i presumed that we are approved. Because our passport was also not returned to us. I contacted the clinic where we had a our medical exam and they said they have already forwarded it . Days laterI I checked the ceac website and I the principal applicant was on administrative processing and my 2 dependents were on a ready status. After 2 months our passports was returned to us. And after a month I received a letter that our case was returned to USCIS. In the letter it says that we were refused due to INA 221g section (5). My employer had filed something to the USCIS and said that w/in 60 days there will be a response , it's been 60 day and I am not able to get a response. Question: Is there a possibility for us to undergo a medical exam only and no embassy interview to approve w/o unde interview , only

Hi Gazelle, this is a great question. I have a client who just had his Form I-360 approved but his I-485 is still pending. I think this could go either way (either require an interview or approve without an interview). I am hoping the interview gets waived and the case gets approved!
I got my I-360 approved last week without an interview and my I-485 is pending, I also hope it gets waived, I’ll just have to wait and see. I’ve Been waiting 2 yrs, so I advice...be patient. Wish you the best ♥️🙏🏼
my wife and i applied for removal of restrictions on her green card. we received an extension for her green card then a notice of reassignment of our case to another office and then our interview was waived, so she now has her 10 year green card. we will be applying for citizenship for her in august of this year
It is great they waive interview. But USCIS still need to do the background check. Service appointment center for fingerprint is still close. Hope it would reopen soon.

Applied for AOS EB3 category. Had our successful interview end of February.. just before the pandemic started. USCIS officer told us all is good and he will approve it. Is now 3 months later.. i assume as our priority date is not current (was current in February)..will take some time. How do we see/know that it got approved and we are just waiting for the prio date to become current ? On the USCIS website when i log into my case it still says that the interview got scheduled. My mom is here on a B2 visa.(3years with multiple entries) she supposed to go back on May 11th 2020.but her flight has been canceled and borders has been closed as well, due to Covid-19.We did applied for visa extension(I-539)a month before the day she supposed to return. Hi Lina, generally if an extension of status application is filed timely, the applicant does not accrue unlawful presence while the application is pending. However, if the case is denied, and the applicant's I-94 is expired, the applicant will accrue unlawful presence from the date of the denial and their visa will likely be cancelled. ME and my wife didn't go to an interview back in 2017 when she had her condition removal. Our marriage is legit in a first place. I put my wife's name in every assets we have, bills, insurance, life insurance, bank accounts. If I own something her name is included to that particular thing. I sent those documents to the USCIS when she applied for her condition removal. Same thing when she applied for her U.S. Citizenship. Everything went very smooth. Our case became more solid when we included the birth certificate of our first child.

Hi thanks for the info my question is My application was 601a I get the interview day from NVC and I went to country I was born for consulate interview I did my medical exam and I receive email from consulate 4 days before my interview was saying all interview is cancel because of the covid-19. Do you think there will reschedule the interview from who ever was first. Hi Marisa, great question! USCIS is still processing extension of status applications for E2 status. To do this, your application should be filed before the expiration of your current I-94. If you are renewing your visa, you can apply for the renewal but the consulates are currently not conducting routine visa interviews. Also, travel to the U.S. is more challenging right now due to increased travel restrictions (aimed to slow the spread of COVID-19). Hello, I-751, Joint Petition for Removal of Conditions on permanent Resident Status . I got an 18 months extension letter. Biometric is not done yet, it was cancelled due to Corona Pandemic. Should I expect interview?
The waiver seems to be randomly used with employment-based visas. How is it determined who gets the waiver? Is it a lottery? Do some cases seem less believable, thus needing an interview?

My father did an interview back in 2018 but requured additional waiver. The waivers got approved earlier this year and we recently submitted police clearance, and DS-260. Does my father need another interview or can we expect it to be approved without one?
Hi Farzana, people outside fo the United States are still required to attend a visa interview to receive a non-immigrant or immigrant visa. As of today, the embassies and consulates are mostly not handling routine visa interviews. It is not yet clear when the consulates and embassies will resume these services.

Hi Nayla, thank you for your question! By "under investigation," do you mean cases where an RFE (request for evidence) was issued? We have a few cases pending with RFE's issued, but we have not yet heard back on those cases. I hope this helps.
Ashoori Law Yes, their family based application was under investigation and an RFE was issued for more evidence. Response has been provided and so far no answer from USCIS. I told them it’s a good sign at least there is no NOID. However, it would be great to know if other clients started receiving response or there is an overall air silence. Thanks for your videos!
Great question. If the EB2 NIW applicant is outside of the U.S. and is applying for an immigrant visa they will have to attend an interview. If they are in the U.S. and applying for an adjustment of status, they will still have to likely attend an interview, but there is a chance that the interview might possibly be waived (not a guarantee though).

From what you've seen, is this only happening with AOS interviews for people already in the US, or is it also happening for interviews overseas as well?
Hi Anthony, great question. I have not seen this happen oversees at the consulates. I believe that people will still have to attend visa interviews at the consulates once they reopen.

Hi Jean! Thank you for your question. For those outside of the U.S. there are 3 main issues that may impact them: 1. Consulates and Embassies are still mainly not conducting routine visa interviews 2. There is an Executive Order restricting the issuance of new visas (FYI, there are many people who are exempt from this Executive Order) 3. There are travel restrictions from certain countries which may prevent non-essential travel.
My step son is 21 years old and has been in the US since July of 2019 on a K2 he had an adjustment of status interview that was originally scheduled for April 1st but was canceled due to Covid 19 pandemic. There has been no correspondence from USCIS at all except for the initial cancelation letter. As you have recently filed your case, by the time your case is ready for an interview, it is most likely that USCIS will have resumed interviews as they were pre-COVID. I hope this helps.

Hi Desiree! Thank you for subscribing and thank you for your question! It is possible that USCIS could waive the interview for a two-year green card (but not guaranteed). The waiver of these interviews is not a formal policy by USCIS. This is just something that we have observed since in-person interviews were cancelled to slow the spread of COVID-19. While it is possible that they could waive the interview requirement for a marriage based adjustment of status, it is also possible that they can wait to schedule the interview once USCIS resumes in-person interviews. Hi Jackie, great question. For VAWA, the prima facie determination is just the first step. The I-360 still must be approved, as does the adjustment of status (Form I-485). If your question is about whether I think VAWA cases may get approved without an interview, (this is just speculation) but I believe that the majority of VAWA cases will still require an interview. Due to the risk of fraud, I think USCIS will still require interviews for the majority of VAWA cases.

My green is approved today without an interview! It says I will receive the card in three weeks! I'm so excited.

That gives us some hope. My wife and I had our interview in July 2019 about two and a half years after marriage/paperwork.
We waited and waited and recently when we called them in April 2020 they said they will be scheduling a second interview. Which doesn't make sense. It has taken them nine months to just let use know this. Based on what I am reading here we are hoping they will waive off the interview for us. Considering our first interview went smoothly I don't see any reason for them to even schedule a second one. Any input would be appreciated. Location NYC.

Is now 3 months later.. i assume as our priority date is not current (was current in February)..will take some time. My mom is here on a B2 visa.(3years with multiple entries) she supposed to go back on May 11th 2020.but her flight has been canceled and borders has been closed as well, due to Covid-19.We did applied for visa extension(I-539)a month before the day she supposed to return. Hi Lina, generally if an extension of status application is filed timely, the applicant does not accrue unlawful presence while the application is pending. However, if the case is denied, and the applicant's I-94 is expired, the applicant will accrue unlawful presence from the date of the denial and their visa will likely be cancelled. What about visa had interview was denied because of public charge it was not legal when filed in 2017.
ME and my wife didn't go to an interview back in 2017 when she had her condition removal. Our marriage is legit in a first place. I put my wife's name in every assets we have, bills, insurance, life insurance, bank accounts. If I own something her name is included to that particular thing. I sent those documents to the USCIS when she applied for her condition removal. Same thing when she applied for her U.S. Citizenship. Everything went very smooth. Our case became more solid when we included the birth certificate of our first child.

Hi Marisa, great question! USCIS is still processing extension of status applications for E2 status. To do this, your application should be filed before the expiration of your current I-94.
If you are renewing your visa, you can apply for the renewal but the consulates are currently not conducting routine visa interviews. Also, travel to the U.S. is more challenging right now due to increased travel restrictions (aimed to slow the spread of COVID-19). Therefore, if you are in the U.S. and your status is expiring in the near future, you may wish to consider an extension of status.

The waiver seems to be randomly used with employment-based visas. How is it determined who gets the waiver? Is it a lottery? Do some cases seem less believable, thus needing an interview?

My father did an interview back in 2018 but requured additional waiver. The waivers got approved earlier this year and we recently submitted police clearance, and DS-260. Does my father need another interview or can we expect it to be approved without one?
Hi Farzana, people outside fo the United States are still required to attend a visa interview to receive a non-immigrant or immigrant visa. As of today, the embassies and consulates are mostly not handling routine visa interviews. It is not yet clear when the consulates and embassies will resume these services.

Ashoori Law Yes, their family based application was under investigation and an RFE was issued for more evidence. Response has been provided and so far no answer from USCIS. I told them it’s a good sign at least there is no NOID. However, it would be great to know if other clients started receiving response or there is an overall air silence. Thanks for your videos!

Great question. If the EB2 NIW applicant is outside of the U.S. and is applying for an immigrant visa they will have to attend an interview. If they are in the U.S. and applying for an adjustment of status, they will still have to likely attend an interview, but there is a chance that the interview might possibly be waived (not a guarantee though).

From what you've seen, is this only happening with AOS interviews for people already in the US, or is it also happening for interviews overseas as well?
Hi Anthony, great question. I have not seen this happen oversees at the consulates. I believe that people will still have to attend visa interviews at the consulates once they reopen.
@@AshooriLaw That's what I had thought. I'm in a bunch of immigration groups around the web and I haven't seen any of this. The most I've seen is some consulates scheduling appointments recently to try and get ahead of the curve for when things do reopen.

Traffic tickets/violations are not criminal offenses. They will be on your driving record, usually this is not of concern to immigration.

Hi Jean! Thank you for your question. For those outside of the U.S. there are 3 main issues that may impact them:
1. Consulates and Embassies are still mainly not conducting routine visa interviews
2. There is an Executive Order restricting the issuance of new visas (FYI, there are many people who are exempt from this Executive Order)
3. There are travel restrictions from certain countries which may prevent non-essential travel.

My step son is 21 years old and has been in the US since July of 2019 on a K2 he had an adjustment of status interview that was originally scheduled for April 1st but was canceled due to Covid 19 pandemic. Hi Isha, while there is a possibility that the interview could be waived, it is more likely that you will have to attend an interview. As you have recently filed your case, by the time your case is ready for an interview, it is most likely that USCIS will have resumed interviews as they were pre-COVID. I hope this helps.

I applied for my green card in March right around the time they were finding out about this virus. I was scheduled for an appt. then they canceled the appt. Then they sent me a letter in the mail that I didn't have to do an in person interview that they would just use my biometrics and finger prints that they already have...so what does that mean for me???

Hi Desiree! Thank you for subscribing and thank you for your question! It is possible that USCIS could waive the interview for a two-year green card (but not guaranteed). The waiver of these interviews is not a formal policy by USCIS. This is just something that we have observed since in-person interviews were cancelled to slow the spread of COVID-19. While it is possible that they could waive the interview requirement for a marriage based adjustment of status, it is also possible that they can wait to schedule the interview once USCIS resumes in-person interviews. Hi Jackie, great question. For VAWA, the prima facie determination is just the first step. The I-360 still must be approved, as does the adjustment of status (Form I-485).
If your question is about whether I think VAWA cases may get approved without an interview, (this is just speculation) but I believe that the majority of VAWA cases will still require an interview. Due to the risk of fraud, I think USCIS will still require interviews for the majority of VAWA cases.
