    I love the passion in your presentation Adv!!! I agree the law is the law, but I believe personally I would not sue a Dr to maintain my child just because the child was 'unwanted'! If the child is unwanted, then give them up for adoption! Unwanted means unwanted!!! I cannot imagine the impact such an arrangement will have on the child's mental status (psychological well-being)...should they find out you as a parent did nothing for them, because you never wanted them!!! That child will hate you as a parent, and it will tear them apart inside to learn that!!!

    What happens when the father is unemployed and the mother earns +-R7000/m ? Can she still bully him for money and alienate/brainwash the daughter towards rejecting the father ?... The father sends clothes, food and stationery whenever he gets money from recycling but gets assaulted and the child's toys get called "demonic" by the mother because the father brought them...

      This sounds like a very bitter situation. The lawyer emphasis that people must pay in proportion to their earnings. As such the mother would be contributing more to maintenance than the father. I think the mom tossing away the father's contributions speaks a lot about how she views the father and wants to transfer any issues she has with him to the child.

      Very helpful video. I have interesting case. I came to SA as a tourist in 2013. And Africans man (of age 55 from Western Cape) made me pregnant . He said he want kid so much , wanna marry and put a lots dust in my eyes. I wasn’t married before and just finished my University.
      He was planning marriage, was driving me around (on his car -credit) and was showing “his” huge villas - what he was renting (from his worlds ), as well he made a present for me with a diamond ring for engagement. Later on (I think on my 6-7 month pregnancy) the truth came out. He was a scammer. He was using foreign women to steal money from them , manipulating through the visas and the other possible ways. …
      so … truth… Tinder - Svinder
      he already was married (with Ukrainian lady- what he made to sell her house for him- and what he was using as his slaver and human trafficking), he had already two kids (girls) from two different Africans women, he already has plenty marriage’s with a Russians ladies what he was using as a human trafficking (and in the end of story deported them), he wasn’t reach as he presented himself (he has a very small cleaning business), even engagement ring was fake - it was made of glass and cost nothing).
      I was sad but much , as I couldn’t even imagine what will be next. So .. he made a human trafficking from me as well… and very short story. He made my life as a hell on my 9 month pregnancy. Was keeping me as an animal in his lil house in the middle of nowhere. When kid was born , he took all my docs from me , that’s I couldn’t run away out of country. After he made for kid SA passport and SA birth certificate and put on his surname. As his financial guarantee trough the kid for future .

    But the father who flee the country, with a divorce agreement on maintainance ,,....cannot be reached from South Africa??? So South Africa is only talk and powerless on this topic.

      You have the right to see the child all the time. It's not dependent on whether you pay maintenance or not.

    Good day just a quick question if it comes to a disabled child an the father refuse to pay maintenance what action need to be taken
    , Cause the father was working for years an when we got a court date to appear in court he told them his retired from work and don't have any pension fund or retirement funds an all his assets are on his family's names

      Hi Lerato. You shouldn't be crippled with fear. The law is on your side and that of your child.
      Please go to the magistrate Court near you and ask for clerks that deal with maintenance. They will gladly assist you. In fact they are obligated to assist you because it is their job.
      Please fight for the rights of your child because they cannot do it themselves.

    If the father is not working, can you claim from the grandmother who is the fathers mother who has a stable job?

      am paying for the chilld who was brought to me at the age of 14.Didnt know of his existance till he was 14,his mother never even told me when she was pregnant.i have no emotional attachment with this child nothing. this yr his 20 yrs

    If the father says he doesn't want to be involved but then says all they will do is financial support whenever they can. What do you do then?
    I see a lot of women complaining about fathers not regularly contributing to financial support and having to hunt the men down to contribute.
