    My sister in law claims that she is strong and independent women.
    And she always used to say me that i am not dependent on my husband.
    After separtion demanding half of his salary income and showing that she is jobless.
    She so conveniently turned or switched into strong independent women to abla nari.
    Sometimes i feel like i am witnessing some psychological disorder.

      just because we don't have gender neutral marriage laws in the country and women take advantage of it/misuse it to take money from their husbands doesn't mean women shouldn't get equal pay and equal rights.
      Those are basic rights that the feminist movement stands for and an anomaly of the justice system cannot undermine its importance.
      Please understand these are two very separate issues, just because they both relate to women and finances doesn't make them similar.
      Making such a statement is not very different from the logic that since parents don't give their children freedom of speech and expression in the house, they shouldn't ask for the right to freedom of speech and expression from the court. Try to think about it.
      The lack of stringent gender neutral marriage laws leads to women taking advantage of it, correct; but does this mean women don't deserve rights and payment for the work they do?
      Its like taking rights away from citizens because one of them committed murder.
      I hope I could make my point.

    Court should ban 498a and dv till atleast 5 years of marriage or till child is not there.if a women complains of harassment during this period divorce should be granted with no alimony.

      What system? The system is different in Australia compared to India. In Australia, the wife can get 50% of all property brought by couple during the marriage.
      So let's say the man bought a house when married. When divorce occurs then the house value must be split and given to wife. Obviously in reality the house can't be physically spilt so it's sold and half of the money goes to the ex wife.
      Technically, if the wife bought the house and divorce occurs then 50% will have to go to the ex husband.
      In India, the cap is ⅓ of salary. There is no house selling.
      Which is better? Paying ⅕-⅓ of salary - which would go to supporting your children if any or selling off house?

      @@devilback8871 And you fool don't know that there are judgement where court have rejected maintenance to such woman who leaves job deliberately to claim alimony. In such case, husband's lawyer cross examined her and asked her what was reason of leaving job. She said she wanted to take of his kids. Then Husband simply showed resignation letter of wife as evidence which exposed her lies. She quit her job before maintenance case because the date of resignation is mentioned on that letter. I can give you that judgement.

      @@tribikramdas2181 I just thought of the most simplest of loopholes that can be used, the complexities can be added to make the case for the women, the law is biased for women for good reason but smart women misuse it frequently and their are many such cases were the women accuses the husbands family of harassment(mental/physical).
      So dont act like numbnuts here, I support women rights however talking about these loopholes and improving them will only make the system better but the problem is people like you dont even want to acknowledge that the problem is there.

Yes, there are loopholes no doubt but that doesn't mean that husband should fighting false cases of 498a/DV merely because the law is biased for woman. Loopholes are there no doubt, but it is the victim which expose those loopholes through evidence. Like I said in my previous comments.

      In India, it is said that divorce rate is 1% but many people don’t get divorced for society, kids and many other reasons, doesn’t mean they are happy. Divorce rate is still higher in urban areas in India, especially metro cities.

      No bcz, the girl leaves her parents house and comes to stay with you. The moment you are getting married your wife is half the owner of your property as you forced her to leave her parents. So now after divorce the court says give the wife 'her' share of property. If you want to change the rules then change it from the beginning where the girl will not leave her parents house.

    As a woman(LAW STUDENT).. the concept of giving maintenance to a well educated woman is beyond my understanding and core values exceptions are there if the woman is having a child then maintenance is required 'ONLY for raising THE CHILD' and not for the woman,she should be earning for herself.. feminism was introduced to protect the 'under privileged' and 'oppressed' women but at present time it is misused by the 'women of privileged class' and because of a few women a lot of men suffer.. just for a few women innocent women are suspected and judged and the actual victim do not get justice .. This Needs To Stop!! we need to create a safe society where anyone irrespective of their sex can live freely without the fear of being accused of anything as it's not about a man or a woman it's about 'humainty' and 'morals'. This bullshit in the name of feminism needs to stop!!

    As a woman, I totally agree with gentlemen here. They should only be liable for their kids' expenses, and it should be split half and half between them. If guys you bought property together during marriage/relationship while women worked and/or raised kids and stayed home mum etc. She'll get half of that house but not ongoing financial support.
    Guys, you should sign a petition to change your constitutional law and/or family law. Otherwise, women will take men for a ride.

Now in India getting employment is very difficult..... Idealistically I think one should be able to get job with mba degree but reality is that leaving job ( out of workforce) for more than 2 years reduce your value in the market.... Company will not accept you with more than 2 years of break......... So it is difficult for housewife to get job after marriage....

    There is need to change the laws like this in every 25 years or so. Be specific in terms of the liability. Eg. Those who marry between 2025- 2030 this will be the law, and 2030- 2035 this will be law etc. It has to be progressive manner. Responsibility should be there on both husband and wife. Social councilors should be there to make the ladies to have their own life. Ladies should not sacrifice their professional life for the sake of family, and later complaint that they did not get proper world exposure. Even the law makers did not think in progressive way. They made laws according to their mindset.

      Prenuptials don't hold in India as courts don't acknowledge marriage as a contract according to Hinduism (as oppose to in the western countries where it is).
      But they also grant divorce and alimony contradicting themselves considering there is no procedure of divorce in Hinduism, not even a name for it in Hindi.

    To all people commenting in the comments section against women, here is the reality check from a woman who is undergoing divorce. My husband beat me up and sent me to my parents house. He purposefully did it to get rid of me and our 5 month old baby and get remarried again. He filed for divorce 3 months later. I objected and was not willing to get divorce because I was not willing to give up and was scared to raise my daughter alone. It took me a fortune to fight against divorce. Just to get me agreed to divorce my husband and his lawyer slut shame me and the legitimacy of my daughter in front of the court in every single hearing. I'm too poor to run a maintenance case. I have to provide for myself and my daughter and take leave from work every time there is a court hearing. It's already difficult to raise a baby alone as you might need leaves if baby is sick, etc. it's not easy to run a maintenance case. You have to spend lakhs for getting thousands. Law mat be helpful for women who can afford to run cases against cheating men. But women like me, it's too costly and I might or might not win anything if I file a maintenance case.

    From 2011 - 2015 I was fighting divorce. I am from Kolkata she filed from her native place North Bengal. There were 9+ cases. I had to either take leave travel with laptop overnight on diff dates. This went on for few yrs. I was jailed under 498A, lost job, awarded 60%+ of salary as maintenance. Finally, out of court settlement. She took my son when he was 4yrs back in 2011.

    If a divorce happened Bcz of husbands fault - adultery, cruelty, hid some serious medical condition etc then this is 100% justified. Otherwise if wife did something wrong or it’s simply a no-fault divorce then it’s not ok.

    There is a huge potential in India. Majority of Indian house wives are dissatisfied with their marriage given most of the marriages are arranged. A divorce lawyer could earn in billions per year just from fees. He just need to pipeline the court proceedings.

    I am a girl and find this extremely inappropriate.
    I understand this law might have been made years ago when ladies didn't use to work.
    However, this must be changed now. Nobody should give maintenance to other person
    Exception - if there is a kid involved, then both can share kids expenses to be fair.
