I have a friend who her husband was in the military and the military told her that due to the intense way her husband passed away from the military that he was qualified for benefits so she went and looked into it the military had killed her husband today he stepped off the airplane his life it ended and it was service connected to the poisons that they cost and the military said do not you do not have to turn that in because it was service-connected can you answer. In other words he gave his life for our country our country killed him our government kills him and he gave his life for our country the military said that his death was service connected and that she should not be having to turn that in to the government because of it was service connected he died serving our country.
Mr. ED I have never heard anything of what you just said and my husband was 39 years old and he was a veteran...they also stopped my and my son's benefit as age 16 and he did a secondary...when he graduated he went to college...I have come to realize that I might as well let this matter go...I have learned a lot...thank you for your time 😊
Hi Ed , I reached out to you months ago about this exact situation. I filed for Survivors Benefits over 1 year ago and I haven't received any money to date. I had an appointment scheduled with social security to find out the person that scheduled the appointment doesn't even come into the office on the day my appoitment was scheduled. I have given my original documentation to someone at my local office to make copies only to find out 5 months later those documents were never upload into the social security system. At this point I have resorted to getting my State Representative involved in assisting me. I am beyond frustrated with social security to say the least.
That's the best way to solve an issue like that. Contact your federal politician on their website. There's usually a button that says need help with a government agency. When I ran my social security office any time we got those, those were the highest priority.
Finally! I have been confused over DRCs and now you finally made it clear! It is based on whether the spouse is alive or deceased. I wanted to answer a simple question: "To give my surviving spouse the largest survival benefit, does it do any good to go to 70, or are my survivor benefits to my spouse capped at the FRA amount at 70?" As I understand it now yes, wait till 70 if your prime concern is ensuring your spouse gets the largest amount of survivor benefit.
@@MyGovExpert I thought even if the Spouse that dies but didn't take SS until 70 the surviving spouse can only get up the FRA of 67 of the deceased spouse .. in other words the survivor does not get the 70 amount benefit...
Thank you Dr. Ed! After getting advice from you in one of your live Q&A sessions last fall, I applied for survivor benefits. I was divorced years ago, and I didn't realize this was an option for me. I received my first benefit payment this week. I can let my own benefit amount increase until I am 70 and then I will be getting a nice raise! 😁

My husband recently passed away on June 1, 2024. I will be 59 in July. I'm currently receiving SSDI. Can I wait until i turn 60 next year to collect? Or does the amount increase as I get older? I'm not wanting to decrease the amount.
My grandfather passed away two years ago and my grandmother sent the required documents at that time. To this day they have not answered her calls nor given her any information about the money. On one occasion they told her that they did not recommend her to call them because they would put her last on hold, which really made me upset since they were basically making a disguised threat to her just because she wanted to know novelties about the process. Reading the comments I realize that my grandmother is not the only one going through this situation, it is truly frustrating and disapointing that this type of abuse and injustice happens. They are basically denying people of their rights by delaying them and refusing to answer.
My young husband passed away in 2013. I went to SSS office and they told me that I can claim SSS benefit when I reach 60 even if I get remarried in future. I am also a worker and have a current husband who I married in 2018. Can I apply for SSS spousal benefits now that I am turning 62? I intend to file for my own SSS retirement on my 67 years old?
Thank you for helping so many! I have a question for you with the new laws. I have been on disability for the past nine years. My husband passed away a year before I received ssd. Away a year before I receive social security disability. So I'm receiving disability and / survivor benefits? I will be turning 62 in December of 2024. Will they automatically roll me over for the same amount of money? Do I need to do anything on my part? Thank you!

My sister's husband age 49 passed away in December. She recently applied for SSA survivor benefits and is currently receiving approximately $2500 for her and $2500 for their 6 year old. From what we understand her $2500 stops for my sister when their daughter is 16 (10 years). My niece's stops at 18. Thanks for all the great advice and information. Quick Question, my husband passed away two years ago while on SSA, I am still working with decent salary. Am I qualified for spouse SSA benefit now I am 60 while still working full time. Thanks advance!
So overwhelming. My wife just passed away 03/2024 and she was the bread winner. I am 49, we have three boys all under the age of 16. How in my scenario do I handle apply? (I have been unemployed for over a year due to my own health issues I am currently working on). Hoping the survivor benefits will be enough to pay the rent etc. My situation is fairly unique and any chat about math or numbers and its all greek to me. Thanks!
So sorry to hear that. Please call SSA today and file for surviving children benefits. 800-772-1213 Also, I ask about surviving child in care benefits as well... but there probably won't be any money left over after they give benefits to your children. They will explain that to you.Take care, Ed
What if they were on SSDI at time of death and under 50 years old would I receive the SSDI amount or what he would have received from his SS at full retirement age ?
My wife recently passed at 64 three months before her 65th birthday and when she planned to claim SS benefits. I retired about 2 years prior to her passing and was receiving my pension benefits. I applied for and was awarded survivors benefit but the benefit was reduced to zero because (as it was explained to me) my pension benefit - 75%, was more than the awarded survivor benefit. That's when i was made aware of the GPO. (Government Pension Offset) The rule that says a government (federal, state or local) employee who earns a pension, and you DON'T contribute to SS... My issue is I've been contributing to SS while working at this same job for nearly 40 years. I never stopped contributing to SS and it was never offered to me as an option to stop. Am I missing something? I've since submitted a "reconsideration" application, but I've not heard from SS yet.
Thanks for the video. My wife passed away January 2023. We were both in our 60s. She was 62 and disabled for many years and getting SS disability. I was 66 and getting my own SS.. She was getting about $2000/month and I was getting about $1900/month. Am I entitled to any SS benefits from my wife's account? At the time she passed I notified SS that she had passed and they sent me a check for about $250 one time payment but no more of her regular checks. Thanks
Ed, I have a question, My sister inlaw is 72. She started receiving benefits at 62. She has minimal income, so the benefits were low. Hi Ed, I wrote to you earlier, but I'm not sure I understood you correctly when you were talking about the survivor's benefits at 82.5%. My husband was on S.S.D.I. for decades due to many severe illnesses, and he passed away about one week after my 60th birthday, and so I was able to get survivor's benefits, of course at only 71%. My question is, can I still go in and claim the cap benefit you were talking about, and get the benefits increased to 82.5% now that I am 62 and a half??? I sure hope so because I am getting less than the average amount for Social Security and can barely get through the month, especially since I live in AZ where the temperatures get up to 115 degrees, and the air conditioner is very expensive to run, even if I only cool it down to 85 degrees! Thank you, Dr Ed!❤❤❤ I was divorced over 30 years ago after having been married for 17 years. My ex is currently living. I recently contacted SS regarding survivor benefits after watching another one of your videos. I was told I would not be entitled to survivor benefits because I would not have been living with him when he passes, which they stated is required to receive survivor benefits. Did I misunderstand what you said? Is there a way to file even if he is still currently living so I don't have to keep contacting SS to see if he has passed? Can I ask for a letter from SS confirming my request? Thank you for all your help!
Hello, you won't be entitled to the LSDP of $255 if you don't live with him when he passes. But you will be entitled to survivor benefits if you are not currently married (or married after 60) and your benefit amount is not more than his amount. Too many new employees at SSA! Sorry! Want to support our channel: ko-fi.com/edweir Thank you!!
You can't file for survivor benefits until your ex is actually deceased. They are also not going to accept your request to notify you when he dies. That will be up to you to figure that out unless you have actually filed for Social Security benefits on your own work record. When you do that, they will ask you about previous marriages. If you provide them with the marriage certificate and divorce decree that will be entered into your file. Then when he does pass you should receive a notification from them. This is all assuming that you haven't remarried, or you are single again, or you remarried after the age of 60. You didn't mention your current age and his current age. If you are both at least 62 and you are single you are potentially eligible for a spousal benefit. Do you have your own Social Security work record?
@@byronmill thank you! We are both receiving SS benefits according to SS. I am on my own benefit becauae it is more than one half of his benefit amount. I have not remarried. If he remarried would that effect my benefit? Considering how much misinformation I have received from SS I don't trust them notifying me when he passes. I do not have contact and he lives in another state. Is there a way to protect myself if they don't notify me when he passes from losing benefits? Can I request they confirm or deny my eligibility in writing?Would they put a letter of request in my file and send me a copy? I asked the last representative at SS multiple times about my eligibility after learning I was eligible according to what I learned from Dr Ed. She insisted I was not entitled to survivor benefits since I no longer lived with him. I hate having to call SS every 6 months to be sure I don't miss out on benefits but I will certainly do that if that is my only option. Thank you for your help.
@@sonjah1913 sorry for the delayed response, I didn't get a notification that you had asked a question. If your ex was to remarry it would not affect your eligibility for surviving spouse benefits in any way. Also, since you are past the age of 60 it would not affect your eligibility for surviving spouse benefits if you were to remarry. Remarriage would only affect eligibility for spousal benefits in your case, but as you described you're not eligible anyhow because your PIA is greater than 1/2 of his PIA.

I’m disabled 59 and receive survivors, and had 2 sons that are now of age. They where receiving as well. I’m receive it a considerable amount less than what each son got. I’ve called and they said I’m drawing maximum. If my sons drew full amount I still do not receive 71 % of what they drew. Does this sound right? I might add my spouse was not drawing SS but passed from cancer at age 53
A surviving child receives 75%. A spouse depends on how early you file. But there's a widows cap that might get you more. Try requesting a reconsideration and ask them to evaluate the widow's cap, they call it the RIB LIM. Good luck, Ed....and sorry for the late reply.

I applied for SSDI and Retirement at the same time at 64.6 (my FRA is 66.6). My disability was approved but... they made the onset date one year before my FRA. So, I rec'd SSA Retirement for one year. How do they factor that when my ex passes and I am eligible for his (much higher SSA) widow benefits? I technically only took SSA one year early (the second year I was on Disability). My ex started SSA at his full FRA. He now has cancer... very unwell so, it won't be long before this becomes important to me. We were married over 10 years. I figure that since my widows FRA changes my FRA by 4 months I really only took SSA 8 months early. What do you think? Thanks!

My spouse is over 10 years older. Is it true that usually the best strategy (if you bet on living to 80+) is that the older spouse collects SSI at 70 and the younger spouse collects SSI at the minimum age 62?

How does social security base the benefit amount? My husband died at 48. I just turned 61. I am working a seasonal job and will make less than the earnings limit. A friend told me that i should collect on his benefits as a widow, continue to work and also that I could change to mine at 67 or beyond. I am just confused how they calculate benefits. Is it based on what he paid in? Someone said its based on his benefit at FRA, but he did'nt make it to FRA? I do have a phone appt with Social security soon. It's confusing.

Mr. ED I have never heard anything of what you just said and my husband was 39 years old and he was a veteran...they also stopped my and my son's benefit as age 16 and he did a secondary...when he graduated he went to college...I have come to realize that I might as well let this matter go...I have learned a lot...thank you for your time 😊
Sorry to hear you got the wrong information. If it wasn't too long ago, you might request SSA to reopen your case. Take care, Ed
There still could be help for you
Hi Ed , I reached out to you months ago about this exact situation.
Don’t ever give them your original documents if they are irreplaceable. Make copies before you go!
That's the best way to solve an issue like that. Contact your federal politician on their website. There's usually a button that says need help with a government agency. When I ran my social security office any time we got those, those were the highest priority.
They lied to me after my husband passed away, kept playing ball wirh me, finally I got a lawyer and she is working on it already

Exactly! Yea, they make the whole thing way too confusing.
@@MyGovExpert I thought even if the Spouse that dies but didn't take SS until 70 the surviving spouse can only get up the FRA of 67 of the deceased spouse .. in other words the survivor does not get the 70 amount benefit...
Ed you are doing such a great job of helping the general public understand complicated information, thank you.
Thank you so much for saying that. I really do appreciate it.
Thank you Dr. Ed! After getting advice from you in one of your live Q&A sessions last fall, I applied for survivor benefits. I was divorced years ago, and I didn't realize this was an option for me. Can a divorced person collect on their late x-husband if that person is now remarried?
@@vickijd22 Yes!
@@vickijd22 only if that surviving person was remarried after the age of 60, or if any subsequent marriage prior to age 60 has ended in death or divorce.

Keep hearing about if u remarry before 60. Then hear if married 3 times u can collect off the highest amount. Which is it?
Ss.gov is a great resource as well. Be informed..they frequently give incorrect information.
My sister's husband age 49 passed away in December. She recently applied for SSA survivor benefits and is currently receiving approximately $2500 for her and $2500 for their 6 year old. My wife, 9 years older than I, passed away recently, and she was receiving about $300/ month. I should be receiving approximately $3500/month in about 4 years when I retire at 67.

If you're at least sixty years old and you're not working over the annual earnings limit, then you can absolutely file for her survivor benefits.
Please write back to me and let me know, because I don't want to go down there to the office only to find out I can't get it. Thx.
Unfortunately, you can't change later to the same benefit and get an increase.

I'm on ssi went to retirement when I was 62 can I get spousal support we were married for about 15yrs been divorced for about 20 yrs he's remarried to his 3rd wife can I still get spousal benefits
Both husband and I are drawing SS. We have been married almost 50 yrs. He was previously married for 14 yrs when he dies will I have to split his SS with his first wife?
I am curious if that $22,320 earning cap includes your SS income?
No, just earned income.
@@MyGovExpert Thank you.
It is almost impossible to get that. What does the government do with all that money that people can't get or just quit trying cuz they make it too difficult for a measly $250
How does the new Social Security Spousal Rule that ends in 2024 work for a stay-at-home housewife? How will that affect someone born in the 70s? Are GEN X SOL?
Have to be 70 years old.
Yeah i get that but what happens when i am? @@MyGovExpert
How long do you have to be married to received survivor benefits
I lost my husband past away when he was in his 30s, I didn’t know I could get this. Can I still receive Survivor benefits. I am 73. I do however receive SSA. Please help
If there's more money on survivor benefits, absolutely. call social security and have them check.
My spouse passed away in 2022 at 45 y/o. If I claim survivor benefits at 60 & still work full time. I’m assuming social security will taxed me since my earnest income will be higher. Is this correct?
Social Security will hold back one dollar for every two dollars you go over the annual earnings limit
You can only make 23000 before social security takes $1 for every $2 above 23,000
She can only make $23320.00
I am from the Philippines. 72 years old, my husband died last year in the US. I applied for survivor benefits at the SSA office in US Embassy in Manila. I've never been in the US. I was told I cannot be paid because of my residence.. Can you help me how to claim the benefits due me? My husband worked for more than 25 years there and was already a pensioner. Any help would be appreciated. Thank you.
Unfortunately, that sounds right. You have to have some type of U.S Citizenship or green card, etc..
@@MyGovExpert I have a petition but I'm uncertain of the status since my husband passed away a year ago. Would it be better to apply for a tourist visa instead? Will I still be eligible to claim my survivor benefits if I stay in the US for 30 days? Thank you.
Anyone see a link for purchasing burial insurance? Thank you.

Hello Ed. I have a phone appointment on March 20th to set up Widow's benefits. Will it be possible to also set up an in-person appointment with SS? I just want to confirm that the amount I will get is correct. I don't want to end up with an overpayment issue. Also I have heard you can only have 2K in your bank account. What happens if I get a part-time job at some point and I go above the 2K limit even if it is just for a few days. Can I take some of the money and just put it in a savings account in order to keep my checking account below 2K. Can I divert some money to my retirement account?
If it's survivor benefits, then how much you have in the bank is none of their business. Yes, you can request an in office appointment.
I went to Social security office I got 3 answers.
My husband took Early retirement. 7 years ago he passed away. For what age I will get his maximal SS ?
One officer told me when I'm 60. But I will get less.
One officer told me when I'm 62+half
The Third one told me I have to wait until I'm Reach fully retirement age. 66+4 month.
I'm very confused. Please could you help me to make right decision.
Thank you

My husbanf past away 7 months ago, social security said I cannot claim survivor benefits duw to me still working nag I was only 56 years old...is this accurate?
Anytime you retire early or collect benefits early, then there is an annual earnings limit So that is correct.
Hi Ed, my wife, same age as me, has not worked many years so we’re hoping for 150% of my benefit. Say at 67 I get 3000 and at 70 3800. And family max is 5000. If I retire at 70 do we get 1.5x3800=5700 or just 5000? Thanks!

Sorry!

Thank you!!
Hi , Ed thanks for info on ex spouse benefits. My ex passed before collecting and we both never remarried. He also served in army for 8 years before we married . Can i collect on that?
Hello, not sure about the Veteran's benefits. But if you're at least 60 years old and we're married to him for at least 10 years, then yes.
So I am still working my pay is around $50,000 can I still get survivor or widow benefits? my first husband deceased and was claiming SS and my second husband deceased but was not on SS can I still claim any benefits?
I was told no Donna, if you make under 25,000 a year then you can get benefit, you and I make too much. It was heart breaking to hear this on the phone. We were married 37 years
I’m disabled 59 and receive survivors, and had 2 sons that are now of age.
My husband passed away July 8th. The bank sent his payment back to SSA because they had received notice of his passing. It is my opinion that he was still entitled to a payment in July regardless of passing away because it was for June. I've filed paperwork indicating that but SSA refuses to pay it. Any advice? Thank you so much.

Thanks!
So my wife will only be 53 with 30 years when she retires. If I have Social Security Disability would she get the full amount?

Does pension count as a job towards max amount you can make?
No, a pension does not count.
My spouse is over 10 years older. Is it true that usually the best strategy (if you bet on living to 80+) is that the older spouse collects SSI at 70 and the
younger spouse collects SSI at the minimum age 62?
Not SSI, but retirement. SSI is the welfare program
Thank you so much.
You're welcome!

It doesn't hurt to try.
So I hear you cannot use the children's survivors benefit for food shelter or clothing.
I've never heard of that. If it's shelter and food for the children, you can.
