      Yes. That law makes it a "duty" for employers to publish the average male and female wages putting men at a disadvantage when trying to get a pay increase or into that senior position.

      Absolutely. The whole 2010 Equality Act, although passed by a Tory government, was another stage in Blair's destruction of Britain and was flawed from the beginning, effectively legalising certain kinds of discrimination. It is particularly used as a stick with which to beat down the native British (white) majority.

      As a waiter in the 90s, I once served someone from behind and said excuse me madam but it was actually a man rocking an amazing Guns and Roses mane. We both laughed and moved on. Before my voice broke as a kid I answered the phone and they thought they were speaking to a girl not a high pitched male not yet through puberty. Again we laughed. This misgendering thing is nonsense. No one wants to cause any offence but it’s not even being corrected and either he or she it’s them and all these ridiculous pronouns. People make mistakes even when it’s nothing to do with transgenderism. Crocodile Dundee famously checked for himself a couple of times in that movie. We all laughed about it moved on and we didn’t seem to have people playing victim.

    I have a screenshot in which India calls another male-to-female trans woman a "man". The person is Debbie Hayton. If you ask me or Debbie we can show you the screen shot. If India believes this to be a crime why hasn't he handed himself in to the police?

    Why is the barrister talking about transgender identity rather than transgender/gender reassignment as per the Equality Act. Does he know his subject at all?

      Because he is talking about the hate crime framework not the equality act. In the hate crime framework it is transgender identity in the equality act (civil law) it is gender reassignment.
      Disappointed that nobody took on the ridiculous situation where the hate crime framework allows anybody to ‘perceive’ anything to be ‘hostile’ and have the police record a NCHI against someone which is very clearly open to abuse.

      I hope you save the same lack of acceptance for anyone who is religious, as by definition it's even more based in delusions with no basis in biology, physics, chemistry. Truth is not only a scientific statement but one that has been philosophically debated for centuries. At least with the transgender debate we are discovering that hormones have a driver in the issue and think we will find out more with time. Religion will never have any scientific backing as like Trans it is all about deep routed feelings and beliefs. I am happy to accept both as people's truth's are accepted every day, and science cannot yet fully explain human feelings and emotions. You could counter and say 'it's dangerous', and I agree it does have potential negatives, particularly for hard won women's rights, but these can be delt with by cooperation and understanding. If you want to see real danger based in belief not science, just look at what is going on in the middle east right now. For societies to stop accepting religion would be far more beneficial to humanity that a marginal trans denial. I personally believe in live and let live however.

    The Equalities Act is in itself unworkable. Islam as a religion condemns homosexuality and 3 men in a Reading park lost their lives from this belief. Yet new laws will make it illegal for gay people to purely criticise Islam. Speech needs to be totally free and only become a criminal act when the words become actions.

    "India has a certificate"? I've got a certificate too .. a birth certificate, which states name of my parents etc .. and my sex/gender. So, are all birth certificates now invalid? Can I now tell the policeman who catches me drinking a pint of cider when I'm 12 that I am actually 18? "But your birth certificate proves you are 12!" ... "Yeah, but I've chosen to be 18 today"

    Far too much legal process in this country is revolving around the feelings of certain people. It is not my job to affirm the mental delusions of other people.     Facts don't care about feelings, I don't believe in gender or the misogynistic and toxic ideology that goes with it, so why do I have to play their game? Their wants and demands come at women's expense where is the kindness there? When were women consulted on any of this? NEVER. How do you misgender if gender is a made up concept and part of an ideology and not real? This is what happens when you bastardise and manipulate language to suit an ideology and a political agenda, we end up with compelled speech and I will NEVER agree to that.

    you can't call a person that was born male and stayed male for 40+ years and suddenly that's been under a knife a woman
    you can change your looks to look like a woman but you cant be a woman you cant change male chromosomes to female chromosomes and you can't give them female parts like Sexual Reproductive organs so there for not a woman and its the same for women that want to look like a man

    Being ‘kind’ by addressing people by their preferred pronouns when that pronoun does not align with their biological sex is good if that is as far as it went. The problem is that it goes beyond just addressing them by their preferred pronouns. These people think that because they are addressed by their preferred pronouns it gives them rights to enter safe spaces or partake in sports in the gender they identify as, not as their biological sex. For that reason I will not ‘be kind’ by addressing people by their preferred pronouns until it is made clear that trans women cannot enter women’s safe spaces or trans men cannot enter men’s spaces.

    He says it’s unkind to misgender but women can’t afford to be kind. If we call one by their chosen pronouns we cannot then object when then enter our spaces such as changing rooms and toilets or sports. Women are always expected to be kind.

      Kind of and yes it is very worrying. For something to be a hate crime it must be a crime & aggravated by the victim or someone else’s ‘perception’ that it was motivated by hostility towards one of the protected characteristics (which are different to the EA ones).
      Further a ‘non-crime hate incident’ can be recorded if a person perceives someone has said or done something motivated by hostility towards a PC but the thing they said or did is not a criminal offence. This is extremely worrying because a NCHI can be disclosed to future employers where a criminal records check is required. There is no right for this to be forgotten unlike if you were convicted of a crime a while ago meaning NCHI are actually worse than actual crimes in their potential impacts.
      The police are not supposed to record NCHI if they aren’t likely to be useful data re potential later criminal offences but the whole thing is ridiculously vague, open to abuse and unnecessary since judges have always been able to consider aggravating factors in sentencing convicted criminals.
      It allows someone who has one of the hate crime PC to use the police force vexatiously in order to achieve political or other aims & is an extraordinary waste of time.
      Beware any reporting about U.K. ‘hate crime/incidents’ since they are entirely based on whether someone perceives hostility - something that is completely subjective & vulnerable to activism.

    The Dr gets my vote, her interjections were exactly what I was thinking. She is spot on. As for referring to someone as they them, the only way I will do that is after I have consumed a number of pints. Then we can talk they them, not before. I agree with the lawyer that language changes over time, but it changes by evolution not revolution. Not by activists telling us how we will now use the English language.

    I take hormone treatment every day because of cancer.
    It’s insane to me we just fuck with kids hormones and even with adults it’s a huge thing imo.
    My own doctor told me we don’t fully understand how hormones affect the body.
    When my levels dropped I had a complete breakdown and nearly attempted suicide. I wasn’t myself at all. It totally fucked my head.

    That barrister Paul is just plain wrong (MD of "LGBT Lawyers"...). The wording is clear "Any CRIME can be prosecuted as a hate crime if the offender has either:demonstrated hostility based on race, religion, disability, sexual orientation or transgender identity" - there needs to be a CRIME first - something that is criminally illigal in its own right. Can hostility be a crime in its own right? - Yes but people are hostile online all day, every day. So the bar for criminal hostility cannot just be "I was upset by it". Otherwise there would be literally millions of prosecutions a week.
    We simply don't need these laws. We're not undergoing some new worsening of crimes motivated by hatred of these protected classes. If anything, society is more tolerant than it has ever been. If we didn't need these laws 50 years ago, we sure don't need them now. And the fact that people are trying to abuse them to shut others up is a strong sign we need to get rid of them.
    As for "non crime hate incidents" - the police should not be making records of citizens who have specifically NOT committed crimes, by the police's own standards. List-keeping is the sort of thing totalitarian states do to put fear into the populace.

    I see the Barrister has been reading Stonewall notes on the law again. The protected characteristic is 'Gender reassignment' and the law only binds services and businesses, not interpersonal relationships. And scotland showed us you need a GRC to be fully protected by services as it is. So, we can call any man a man rr barrister.

    There is no such thing as mis-gendering because there's no such thing as "self-identification". ID is done by external parties/other people to clearly point out who is who based on their distinguishing characteristics - a John/Jane Doe lying on a slab in a mortuary is not identified by their feelings, but by their DNA or dental records etc. And they're identified as male or female by either a vagina or a penis. Both of which (along with the secondary sexual characteristics that go along with them such as beards or boobs) have been known identifying factors of men and women since we first existed, and trying to change that fundamental fact of identifying people in society is slowly leading to a collapse in law and order, as shown by the ridiculous "non-crime hate incident" rubbish and this "barrister" believing crimes should be decided by someone's hurty feelings.

    If you report an actual crime where peoples' wellbeing, safety, and property are involved the police no longer want to know. If you say something and it's perceived as insulting (it may not be) then they come down on you like a ton of bricks. I no longer have respect for any officer who doesn't have the balls to call out this sort of nonsense as bringing the law (and its enforcers) into disrepute. If I were a police officer I would resign if I had to enforce such ludicrous laws. I urge any who are to so do.

      R v Scottow is better in this case IMO since they were considering malicious comms apparently. Police need to be mindful of Miller v College of Policing too re potential recording of NCHI.

    Literally the worst debate for both sides. Gender identity is completely unrelated to sexuality, the reason it requires a gender recognition certificate is because you’re literally changing your identity. Gender critical beliefs are protected by law, so if you don’t believe a trans woman is a woman surely you can’t be forced to use their pronouns? I personally would use someone’s pronouns, however, I don’t believe people should be forced to use language they disagree with.
