      Brandon, I have one question you did not cover: my realtor takes down the MLS ad with my house. In 5 minutes I get 100 calls from other realtors soliciting services. MY NUMBER WAS NOT in the ad. I am not publishing my number. YES, my number on the DNC list.
      So the question is simple: how will realtor prove in the court of law that his call was "a mistake" IF even to obtain my number (e.g. to KNOW i am the owner of the house) the realtor (or his company) had to spend time/money/efforts to legally (or illegally?) obtain the database with "house+owner+phone number" information to bother me as the owner?
      So if we imagine the dialogue in the court:
      - Your honor, the ad for my house did NOT contain my direct number. Only my realtor's number. So if the defendant wanted to offer selling the house he/she MUST have called my realtor. But the defendant used a load of efforts to, as I think, illegally obtain my direct number - that is on DNC list, and to bother me. So what can defendant say on this?
      Defendant: it was purely a mistake. I dialed random number and WOW got to the owner of this very house? :)))))
      No. As soon as any realtor calls directly to the owner whose number is NOT listed in the ad, it is a proven fact it is not a mistake, but an intentional effort to violate my rights.
      Is it not so?

      @@GreenCardShow yes you'd be absolutely right. You have the right to sue if you wish. If not, you'll have to tell them "I'm not interested, take me off your list!" every single call.
      Or you could try a slick way and say they have the wrong number, not everyone removes people from their list.

    What about cold calling neighborhoods where an agent is calling people that are on the dnc but only calling them a couple of times, but also not calling to “sell” them anything, but just to ask if there’s anything the agent can do to help them?

    I met with an agent today to get some advice during my first year and he told me cold calling is illegal in MA and I knew something was wrong. thanks for the info

    If I accidentally call a DNC number and get reported, would my broker be liable for any damages? I would hate to get someone else in trouble for my mistake.

      I’m not a lawyer and per my understanding you need to call someone at least twice before they can sue. If you call only once you should be safe. Not a lawyer though.

    How do I stop these calls? I get maybe 30 calls a week. I'm on do not call list. I tell them not to call. Etc. Even not answering is annoying as they spoof other numbers from my area and I have people that often need to get ahold of me who aren't in my contacts.

    The problem is there are 100's of thousands of RE agents. My house is NOT listed for sale. I still get 3 to 5 calls a DAY wanting to buy my house for Cash. I have told no less than 200 agents to take me off of their call list. How do I make it STOP!!!!!!

      if they are looking to buy your house they are most likely investors then.

    Hi Brandon, maybe you can answer this. I read through the FTC’s rules about the DNC list and saw that informational calls are exempt from the DNC. So if you’re calling an expired listing to find out info about the property, a homeowner asking if they would like a free home evaluation or circle prospecting to invite neighbors to an open house, would that follow under the information exemption?

    the do-not-call list says you cannot call someone trying to sell something. But if you're for example a real estate investor you're not trying to sell them anything you're trying to buy something from them does that still qualify as a violation?

    Mannnn the very end, it's me - the unlucky wife that was served a lawsuit bc my husband sent 2 manual texts to a seller referral which turned out on DNC and we didn't think to check. Next we got shakedown email from wife and then served from the husband who actually responded to Ryan's text and filed trying to make it a class action

    HI Brandon Great info. Quick question. I've been trained by a very high profile sales organization to use a "no pressure cold call". goes like this - for REstate. HI Mrs _____ my name is Merrilee, I'm calling about your house on Main street. Can I tell you why I'm calling and you can let me know if you want to talk to me or not?" I'd be very interested in knowing what your attny friend would say. In my opinion, if they said no, you would just hang up and they would have no idea it was a cold call, if they said sure they are giving you explicit permission to continue? Thoughts?

    One said just now that he is on DNC list and will be filing a report and collect $5k 😂 It was at that moment I thought of switching to a diff business, putting 2-3 of my phone numbers on DNC list and just wait for tele calls all day and record things then file complaints 😂 That'd be a good business.
    I can put the # on my dialers DNC list but I cannot control who else will call you. Its either you change your # or you sell your property 😅😐

    This is from the FTC website. What’s the penalty for companies that illegally call numbers on the Registry?
    Companies that illegally call numbers on the National Do Not Call Registry or place an illegal robocall can currently be fined up to $42,530 per call. What is that about?

      Read the words: "UP TO" like if you are a massive company worth billions and call the U.S. President to sell him your widgets... One annoying realtor who is hungry enough to cold call doesn't have enough money to go after. Read between the lines, it's profitable to call and 1st. penalty is $500. Even a lawyer basically telling you to call doesn't put your mind at ease??? Let's use an easier example: your HOA says NO SOLICITING, and you ask your neighbor if they want to sell their house? Could they report you? YES. Will anything ever come of it... NOPE. It's like no speeding laws, you are bound to accidentally speed occasionally. Do you stop driving? Hopefully not...

      @@ThatBeachDudewell we manually texted a number of a potential seller referred to us and told he the husband wanted a call back. He responded to the 2 texts (manually texted from personal cell) engaging asking questions, then at 2am wife sends threatening email, then 3 months later serves a lawsuit with husband listed as plaintiff. I guess we're that unlucky.

    My brokerage got a complaint about me cold calling them because they are on the DNC. My brokerage said they can get fined a lot of money for this

    Are the Federal DNC list and the State DNC list one and the same? Can I get in trouble if I called someone who is on the California DNC list but not on the Federal DNC list?

    I'm actually on the other side of this. As a homeowner, I am so sick and tired of the long standing real estate maxim that everything has it's price, and anyone can be a potential seller. I am on the DNC registry and constantly receive calls and texts for people wanting to buy my house. I'm to the point where I will start the process of taking these people to small claims court, so thanks for this info.

    Just signed up on the do not call list!! Hope it helps me out. I clicked on one… ONE link of a house I was interested on. Now I’m getting at least 10 calls a day. A day! Like seriously people. If I’m interested, I will call you!! So annoying!

    I called the DNC , had a different name. Requests $1500 payment made to him. It was a one time call. I dropped a voicemail saying my name and if they could give me a call, I never mentioned anything real estate related or offering my services. Which is how I normally approach my calls. Coming from a place of contribution. Do I pay him the money or try to figure out another result.

      How did this turn out? The first and only threat or issue we've ever received was for a referral to potential seller who happened to be on DNc list. The wife then sent threatening email demanding 22k . We tried to explain and apologize for the mistake - 3 months later we are served a lawsuit and they named our broker in it too..

    A couple of the gray areas are Informational Calls & Survey Calls, which are permitted according the DNC website. An informational call would be like announcing to the neighbors that you will be holding an Open House. And I have heard of agents calling to ask more of a survey style prospecting method from which they could either door knock or mail. I would be curious to know what your attorney's opinion as far as violating the DNC rules. Thanks!

    Even if I scrub a list for DNC, how does that apply to mass texting and RVM a purchased list? Is that “ illegal “ to do even if a contact is not on DNC

    Companies that violate the National Do Not Call Registry by making robocalls can be fined up to $43,792 per call. That is such huge money! How much more when there are multiple calls made, right?! That's why it's so important to know which phone numbers on your list are registered under the DNC registry.
    It's easy to report a violation of the Do Not Call Registry. Consumers can report the call made at donotcall.gov if they happen to receive anything, even after asking not to.
