As a retired LEO - this officer really pisses me off. If I was his supervisor and saw this video, he would be immediately reprimanded. It is not an officer's job to talk the victim out of pressing charges. If a crime has been committed, the job of the officer is to take witness statements and verify damage. Conducting a valuation of the damage and suggesting its only $25 worth is inappropriate; further, if a wiper was yanked off with any kind of force - there is no telling the potential damage to the actual mechanism of the wiper and its wiring. This is why you conduct your investigation, gather all the information of parties involved, and then file charges upon completion of the investigation when the paperwork of actual cost of repair returns. At the end of it - there is a difference between criminal mischief and criminal damage to private property.
Years ago my wife and I were visiting her family in another state. Guy pulled out infront of us and I was unable to completely avoid hitting him. The at fault driver had no license, and no insurance. He was allowed to drive away from the scene. One officer doing the crash report told me that my damage was minor and I should be able to drive away. I had a feeling it was worst due to the camber on the drivers front wheel. While he was still there I crawled under to inspect and the lower control arm was snapped in half. Cops are not mechanics. Most aren't even mechanically inclined. If you don't know, you shouldn't talk.
Police always do talk to victims to not press charges cause they don’t wanna go after criminals but come at you full force if you told them to do their job properly.
Exactly. Maybe it was just the wiper, in which case, yeah, I would just replace it rather than deal with any process I have to go through to press charges or get paid. But that cop isn't a car mechanic, he doesn't know if it's just the wiper. If she damaged the mechanism or whatever, that could be over a thousand dollars to replace with parts and labor.
AND when you talk a victim out of pressing charges, you dismiss what happened to the victim. You tell the victim what happened to you isn't a big deal get over it. What you tell the suspect is bad behavior of any nature (ripping off rear wiper for example or even slapping someone) teaches the suspect/tells suspect you can get away with anything
Same. Not to be that person, but if they don't see consequences the first time, it's probably not the last time it's going to happen. You could even argue that it's an act of consideration to press charges against idiots like this because you're trying to help prevent it from happening to anyone else in the future.
Let's take this one step further. If someone were to kick my car and damage it, I'd press charges specifically for the police report number. I'd take the car to a dealership to get it fixed, even if it costs me far more than an aftermarket shop would. Go ahead and pay to get it fixed, get the receipt, go to the local state crime victim's compensation fund, and file for reimbursement. Why? Because the perp then gets saddled with the extra order for restitution that sticks for 20 years, except instead of me having to pursue it privately, the state fund pursues it with far more resources and tenacity than I have.
The cop didn't want to do the paperwork, and would rather work as an insurance adjuster. I bet if anyone did that to a police car, they would arrest them instead of saying, "Oh it's only $25 of damage, not worth it." 😂
As a LEO I can confirm these officers were being lazy attempting to talk the ride share driver out of pressing charges. Plain and simple laziness. And he’s more than welcome to continue his job so he doesn’t lose money and return to give his full statement later. This department needs to get buttoned up.
The stuff they had to deal with after, no wonder they would be lazy at a case they feel they could have been solved if the lady just paid the Lyft driver for the damages.
I agree 100%. What next kick a Mercedes and put a big dent? He wants to be made whole. It’s not $25. If it’s broken by electrical that could be a couple hundred dollars. Give him his money.

Cops getting upset with the Lyft driver because he doesn't want to stick around is hilarious. He was nice enough to leave his contact information with an officer, in case they need his statement, and he wanted to go back to work and that was their reaction? They think he is playing a "game" with them? Yeah, it's called the game of life and the man wants to get back to making money.
That shit pissed me off too. Like wtf if anything they should be happy he’s not blocking up the road and is trying to just no get entangled into any potential other messes.
Ya I was confused about that too, like he's loosing money, he stayed around for that whole ordeal and it clearly escalated into something else that wasn't about him being involved, so obviously he wanted to leave if he didn't have to stick around.
The driver even had to point out to the loser cop that his partner was struggling with the lady he just tried to get the charges dropped for lol. That was bike cops attempting a "power move" after struggling with a little girl and trying to get out of paperwork.
NEVER let a cop tell you whether you should press charges or not. It's not their job, and technically they aren't even allowed to do that. Cop could of gotten in a lot of trouble if the Lyft driver reported that a cop told him not to press charges.
Bro literally even a LAWYER cant tell you what to do legally. They can only give you advice. You have to make the decisions yourself. You can defer to them obviously but a lawyer legally cannot make a decision for you or sway your decision a certain way. They can only give you the facts and the choices. They can tell you what THEY would do but ultimately the decision is up to you. They can tell you "this is a good deal" and "doing this would be stupid" but they cant say "you have to do this" or "you shouldnt do this". I know it seems like a fine line but it's extremely important legal precedent.
In south africa even if you dont want to press charges the goverment judicial system tends to charge them with a crime even if you dont want them to. 😂 So a kid who is 14 will go to juvi. And our juvis are like actual prisons. Focused on reabilitation yes, but no escape. If you do your sentence is increased. And if you're sentenced at 14 to say tend years. On the day you turn 18 off to adult prison for another 6 years. Its why your laws for prosecution against minors simply dont work. There is no punishment. No accountability. No luxuries taken away, no practical job skills taught. There must be punishment.
@@trendywipp3715 I would say majority lives are ruined because of that plus it will be hard for them to get a job in a company. Those who are in jail go through a judge.

Never listen to a cop try to quote you a price to fix a car he won't be working on. Maybe you could get lucky and find a wiper arm for $25 but if the motor's broken that's more money out of your pocket. Never feel sorry for making a sloppy drunk suffer for their own actions
Quite right. Also the loss of earnings for the evening of the offence, and the motor being repaired consequently putting the car out of action. The officer’s attitude is all wrong, I bet the story would be very different if the offender were a young black male.
@@pauljordan4452 Assuming the motor has to be replaced, obviously depending on the extent of the damage, since it was the back door/lid, in most cases you have to remove the interior panel to access anything electrical. There is the time to diagnose the issue/extent of the damage, the time to remove what's necessary to be able to diagnose the issues, and the time to actually repair/replace the damage components. Keep in mind that a lot of shops charge labor by the hour, anywhere from $125 to $250. The time put into the car to do all the diagnostics, the time it takes to do all the necessary repairs, the cost of parts on top of the labor time, doing such a job could easily cost $500. Just to throw out there, most fail to recognize that the labor hours are largely determined by what the manufacturers say. So if the job takes 2 hours to do and a tech gets it done in 1 hour, you're still being charged for 2 hours. A tech's experience and ability to beat the book time won't reduce a customers total bill.

@@Green_Expedition_Drgn There's more than just the windshield at play here. The motor that moves the wipers back and forth was damaged, and that's a lot more than $25. Even if the damage was $10, an LEO is not an assessor and should never, ever talk someone into or out of pressing charges.
These cops should be fired. She broke his rear wiper and the cop says to the victim, "Do you REALLY want me to charge her and take her to jail over $25?" A broken rear wiper is a lot more than $25. The motor could be broken, the actual housing itself is a hundred bucks. The labor to have it fixed is probably about a hundred bucks, too. His car's value is decreased because of it. His car in the shop to have it fixed is at least a day he can't work. This "only $25" could easily wind up costing him close to a grand.
I thought the same thing! "I assessed the damage.." Not his job.
If someone kicks my car and damages it, I'm pressing charges
Me too.

Wiper motors for some cars are even more than that.
Explain why it takes so long.

The cops saying "that's not how it works" to the victim saying call him when they're ready for his statement is disgusting. Who do you people think you are? You're one purpose for being there is to protect and serve that Uber driver, not dominate and detain him on your terms. That bike female cop is not cut out for that line of work.
So you don't think the male cop would have complained about getting kicked? On what evidence are you basing your opinion?
@kurtkaster5666 They need to do things properly. Yea he was a victim, but you need the victim there to actually assess damages... what if he drove off and got in a wreck? How much of that damage would they have pictured since he drove off? Or what if the victim had an awful mindset for pressing charges, and wanted more out of it so they drive off and dent their car more making the damages look worse? The cops saying "that's not how that works" for letting him go is a precaution, not a twisted show of power you're presuming. Statements also become much less accurate the more time passes from an accident. They should not have let him go continue work right after. Common sense.
@@foxstarx8321 except its on the cop that told him it was okay to go... i get that he didnt know so its not entirely his fault, but that driver is a worker as well. he might rely on busy nights like that to get by and expecting him to wait 30+ min for them to deal with a battery when its already 12 in the morning isnt something someone is going to do. you're one to talk about doing things properly by the way lol, last time i checked, cops arent allowed to say things like "is $25 really worth taking someone to jail over?" and talk people out of pressing charges.
And he ended up staying & telling the male officer that he works 3 jobs. He shouldn’t have to replace a part on his car torn off (criminal mischief) and lose money he’d be earning driving the drunks home for the next few hours. And I’ve absolutely seen officers let a witness or victim go & give a statement later, especially if the suspect is out of control or needs SFST’s.

The cop SHOULD NOT be trying to get the Lyft driver to drop this. This cop should be reprimanded.

"Is $25 worth taking someone to jail?"
Intentionally damaging property is disgusting, being drunk is not an admissible excuse. If anything, it only proves you are irresponsible and need some form of punishment. I'm halfway through the video and hope she was cited at least, but the cop trying to downplay it is gross.
exactly. nothing more annoying then a drunk who uses booze as an excuse to be wicked
I think it’s important to include the original charge when the charges are resisting arrest. And who knows if it just needs a new wiper- the mechanism might be broken. It could cost hundreds of dollars.
Me: yes.
The cop has done this enough times to know that if the charges are pressed, he will have to go to court. The victim will have to go to court. Probably multiple times. And even if the lady is actually convicted the judge will give her like a month of probation, sentence suspended. Is it really worth it? I think he just explained it badly.
He said the whiper wasn't working so she probably broke the motor also.thats definitely. Ore than 25 dollar fix.
That police officer trying to convince the Uber/Lyft driver not to press charges because it's "only 25 dollars" is fking rediculous. It doesn't matter if the damage is worth 1 dollar, you're breaking someone's damn property, that behaviour should NOT be ignored.
That cop at the station had me laughing "what in the world did you bring us?!?"
Dodge Journey rear wiper arm can be $25 with aftermarket parts but the motor can cost up to $90. Shops can charge between $80-$120 per hour.

Agree with you, this is fairly old now but when the vid first came out everyone was furious in the comments at the cop for the same reasons.
@@guyanomaly Very well said. It may only be $25, but the driver should not be the one to pay that. If the cop wants to give the driver his own money so that he will just leave at that then let the cop do that, but the driver shouldn't be out just because the amount is low.

Officer Soup Sandwich wants to get paid for doing literally nothing. It's a good thing the victim told him his partner was rolling around in the middle of the street with the suspect. It's not his job to determine damage, to someone else's property. Wiper blades, like everything, are expensive. If the armature and motor were damaged, it could be a couple hundred bucks easy. Poor conduct on the officers part.
you might want to go to a different auto shop, you're being ripped off if they charge you a couple of hundred for that.
Hopefully, insurance can cover the auto damage, especially with a police report of some sort.
EDIT: Then again, a deductible makes minor damage fall to the owner. I forgot about that.
