Instead you should have said police stopped a man that did NOT match the description and then illegally detained him for not IDing which he was not required by law to do. The suspect had black shorts, the man had white shorts. The suspect had short hair, this man was bald. The suspect had a little scruff on his chin which the victim emphasized. This man had a full beard. She described the suspect as being average, medium build. This man was large and heavy. Lastly the suspect had a green shirt. The victim said it was green like GRASS. The man had a bright neon green-yellow shirt. Therefore, he DID NOT match the description. The only thing that matched was that he was a black man.
He didn't even "match the description" at all, other than having a green shirt. NOTHING ELSE MATCHED and even whe the woman who had been assaulted told the police it "was NOT HIM." The true suspects ex-husband came to the scene and said that wasn’t him and they still arrested him and put him in jail for 2 or 3 days because they said that he assaulted them. Get it right, this isn’t just a mistake. Don’t just jump on the side of police. (other than ethnicity). Mr. Ometu was exercising his rights as a citizen. The LEO's were within their boundaries to _detain_ him, pending further investigation. The moment the description made it reasonably obvious that this was not the person, _REGARDLESS of Mr. Ometu identifying himself or not,_ LEO were legally bound to release him from detention. Also, as a matter of law, LEO can not forcibly take a detained person "for a ride". An arrest would have to be made first - which ironically would make it mandatory that Mr. Ometu identify himself. The Failure to Identify crime in the state of Texas requires you to provide police officers your name and certain other identifying information *when you have been arrested,* not _before._ Also, The police can detain you when they have a *reasonable suspicion* that you have committed a crime. For Mr. Ometu, the police had no *reasonable suspicion* of a crime at that point, as in the course of their investigation, more details became clear regarding the description of the suspect, which 100% did not match that of Mr. Ometu. (other than ethnicity). Mr. Ometu was exercising his rights as a citizen. The LEO's were within their boundaries to _detain_ him, pending further investigation. The moment the description made it reasonably obvious that this was not the person, _REGARDLESS of Mr. Ometu identifying himself or not,_ LEO were legally bound to release him from detention. Also, as a matter of law, LEO can not forcibly take a detained person "for a ride". An arrest would have to be made first - which ironically would make it mandatory that Mr. Ometu identify himself.

Actually, you do have to identify yourself to police if they have reasonable suspicion to detain you, which they had. All this talk of “you don’t have to identify yourself” is what’s getting people in trouble. The only time you don’t have to identify yourself is when they just approach you for no reason at all to conduct a field interview just to talk
