Our landlord didn't want to replace our water heater, took them a month and that's after she threatened to evict us if we didn't just deal with it so she served us a demand of possession. She refused to accept our rent, twice. And now we got an eviction notice with a false claim, claiming we damaged the property. All of which we have evidence against. We have a video of the day before we got that notice that shows the entire inside and outside being spotless.

So, when they refused to accept rent, you put the rent in an escrow account? Or at least, you got it in writing that they refused? baymanagementgroup is SO right, document your claim. Either party can make false claims, so BOTH parties should document.

if you're a tenant in good standing and your landlord is harassing you; my advice is document everything. that includes dates, times, pictures and videos. give them a warning that if harassment doesn't stop, you will take legal action and you have evidence to back it up. this usually works, as most landlords don't want to go to court and don't want their reputation ruined.

True, unfortunately I had a landlord send someone to use aggressive tactics on me, by aggressively talking to me, so it ended in a phisicall confrontation with the guy, because he blocked my way, I'm a very good tenant I don't bother other tenants, I pay every month and I did nothing to deserved this, and I currently always stress out knowing my landlord want to hurt me if I don't pay in time, where as I never let a month pass without I pay.

I have never had problems anywhere I've rented and the previous rental was there for almost eleven years. I moved into the last place and never been subjected to such sadistic and malicious treatment. I've not only never even so much as plugged a toilet or sink nor damaged anything anywhere I've rented and yet was accused of some of the worst things without proof and always had my deposits returned, while this one has stolen and won't return it even despite being taken to court and winning. I even filed a human rights/harassment complaint locally, provided a lot of evidence and it was dismissed stating no probable cause, when they didn't even bother to investigate nor ask for the other evidence I have.

@@JoeyTeam31 I'm a LL and this puzzles me. If you're a "very good tenant" why would LL see any reason to be aggressive? If you're quiet, pay rent in full on time every time, aren't damaging the unit, park where you're supposed to, why would he be aggressive? What has he got to be aggressive about? Something doesn't seem right.
Your post mentioned paying rent 3 times, and you said that a month doesn't pass without rent payment, but are you saying you pay in full, on time, every time? If not, you're not as good a tenant as you think. NOT SAYING that justifies aggression; just saying that IF any of those potential issues I mentioned are true then maybe you aren't quite as good of a tenant as you think. Just for example- a LL that eventually gets all rent due him isn't the same as paying in full on time. The LL has bills due too.

Not only do they sometimes enter your unit without notice or permission, but sometimes they may start criticizing stuff they know you've had for a number of years with no issues
As long as you pay to live there, that place is your home. You have the right to the use of both indoor and outdoor space without landlord harassment, especially if you've had outdoor items in the same spot for years with no issue.
Let's say you've had see amenity of your own parking spaces and your own attic. Or basement for the whole time you've lived there. And now you are landlord is trying to strip you of your right to use it
You need to stand up for what's right for yours if it came with your unit, especially if you've been there for quite a while. This is especially true if you know your landlord gets drunk from drinking too much
Sometimes landlords will start nit picking as a form of harassment when they have absolutely no legal grounds to evict you, so they'll poke and prod to try to make your life their miserable until you leave, which is what they wanted anyway.
When this happens, you need to log everything, really document and keep every correspondence as proof harassment has been going on.
Let's say you don't bother no one and you pay the rent in full on time each month and you Let's say you don't bother no one and you pay the rent in full on time each month and you don't get in trouble
Let's say all of a sudden out of nowhere. You're landlord decides to start with you.
You need to really stand app to them and demand they back off after you've already explained. Whatever the situation is and you know you're NOT in the wrong.
If they keep it up, you need to demand a stop right NOW
They may keep pushing the issue, even after you told them to stop more than once. If they keep pushing the issue after you've already told them to stop and after explaining yourself and letting them know you're not discussing it. No further, that's when it becomes HARASSMENT
That's when you also know you have a narcissistic landlord. Alcohol really worsens these problems, because they CAN get DANGEROUS when they've NEVER been dangerous toward you BEFORE
That's when you really need to start reaching out toward resources and start getting some help when you feel it maybe necessary.
That's when you really need to start reaching out toward resources and start getting some help when you feel it maybe necessary.
Don't let the abuse continue, put a stop to it.

Unless there is some kind of clear emergency, your landlord cannot just come in whenever they want. Most jurisdictions require a minimum of 24 hours notice, but also a valid reason for the visit. Unfortunately, many landlords think that because they own the property, they have more control. But a tenant with a legal lease has a right to quiet enjoyment of the premises.

I live in Pennsylvania and have been residing at my apartment complex for over 12 years.
In the beginning, it was great. My neighbors was respectful, friendly, and peaceful. So where thier kids.
I never had to worry about my garden being destroyed by the neighbors' kids or my outside decorations stolen. It was quiet, even on the weekends, and the only sounds that was loud was of kids playing.
My property manager was nice, respectful, and made sure that no illegal activities occurred on the property. Also, no one who committed crimes or was convicted of a crime was allowed.
But now it's terrible. About a year or so ago, new people moved in with their kids. All single moms with multiple kkds and no husbands.
These new kids are troublemakers and bullies. They have picked on the kids that was here before them, and when those kids fight back, these fatherless kids cry and act the victim.
The moms of these kids do NOTHING. They are immature and do not discipline or provide supervision when thier kids are playing outside. They let them stay out until late at night.
My property manager has changed too. Her husband just died and she is taking it out on me and some of my neighbors.
She does nothing about the trouble kids even when they broke the wheels off of some of the dumpsters here.
And when my 11 year old daughter informed her about it, like we should, the PM took her frustration out on my daughter!
Also, one of the moms of these horrible kids are affiliated with a biker gang! The PM put the safety of everyone here when she let that mom move in.
I am scared for my kids' safety everytime thry get off the bus because these kids are known to hit other kids while getting off the bus. I am seriously looking into what I can do about this PM.

Hi @summerruby201, we are sorry to hear of this troubling situation. All tenants have a right to quiet enjoyment of their rental home. If the entire complex is under the same property management, then any complaints should be lodged directly with them. In addition, it is vital to keep a record of any encounters you or your family has. That may include photos, video, or notes on any phone or in-person conversations. If nothing is done to remedy the situation, and there is no one else within the management company you can contact, you may want to seek the advice of a local attorney. However, if neighbors or other people in the area are damaging or stealing your belongings, you may need to reach out to local law enforcement to make a report.

I've lived in a rental house for 12 years my landlord is over here everyday she puts things outside without telling us and they trip me she Nails boards into the ground and I've almost broken my neck she rewires the electronics and they have started fires she is over here every single day what can I do. our rent is constantly paid on time we don't do anything to bother anyone but she will not leave us alone. We had a mold problem and she put wood up over the mold she hired unlicensed contractors to take out a window and each room. she told me at the time I had to let them use my electricity when I refused she sent a text saying I'd have to get out in 48 hours if I didn't let them use my electric what can I do I've called everywhere this is making my hair fall out literally she removed the mailbox off of our house and she stuck it on a railing for stairs and it is destroying my mail. I tried to speak with her about it but she actually blocked my number she texted my 26-year old son when he's at work working a double shift she's coming over to paint but instead she Nails things into the ground right atop water pipes. she belittles me and talks down to me and it ignores me she blocks my driveway where I can't even use the property that we pay to use I can't even let my dogs in the backyard because she's here she is driving me insane. please help me tell me what I can do this woman is driving me insane she is taking away our peace and quiet the things that she tries to do herself in danger our health I'm in Texas where can I go to get help.for the last eleven years we have told her this house is unsafe she has ignored us and threatened to throw us out when I ended up in the hospital with a ruptured appendix they found three bacterial infections that's when she all she did was put more plywood over the old rotten wood to look good to the city she hasn't done anything to help us .I am not exaggerating this woman is here every single day yet she doesn't fix anything she won't even give me my mailbox back she just starts gardening in the yard like she lives here. we live in the house with the windows not even attached to the walls

This sounds like a complex and frustrating issue that we are sorry you are experiencing. Since BMG does not operate in Texas, I am not as familiar with their rental laws. However, I found the article linked below that may be helpful for you. If you have a signed legal lease, then as a tenant, you have the right to quiet enjoyment of the premises. My advice would be to document these incidents however you can via photos or videos along with a log of when the incidents occur. You may need to engage local law enforcement or reach out to the local Housing Authorities to file an injunction.

I thought that this video would be about tenants harassing landlords, like my last one did, and not the other way around. Tenants are brutal, sometimes, and that is a major factor as to why rents are so high. My last Tenant accepted a beautiful home in a beach community, but every month would ask for significant improvements that often cost over $1000 -- nearly in excess of the rent paid. Near the end, she said that I was trying to kill her and her cat because I wouldn't install a $7000 AC unit in a community with a mean temperature of 64 degrees. When she said that she had cancer and that my husband and I were "supposed" to take care of her, I had had enough. Whereas, previously it was an Airbnb, and I tried renting to her to make things easier for me, I had to re-convert my home to an Airbnb to keep enough income coming in to pay for the taxes and mandated utilities. Tenants sometimes think that Landlords owe them more than habitability, and those types of Tenants should rally try to buy.

Talking to tenants as a landlord is part of the job. But it is always a good idea to follow up conversations with an email or some sort of written form. It's also a good idea to take notes on any communications you have with your tenants.
For tenants, it is important to vet your landlord! You are renting the property, but you are also signing up for a relationship with the landlord. If they are evasive or sketchy from the start - this will not improve later on.

Sometimes you may have a good tenant who has no help, but the landlord does. This is no fair fight if the landlord suddenly steps out of line and does something to the tenant or oversteps bounds and violates the tenants rights. That's when the tenant met at some point need to get some kind of help to back them up and help them protect their rights. Sometimes a landlord can use a subtle threat and hang your residency over your head if you don't give them their way regarding let's say something you have that you've had for years. Let's say the landlord wants to modify it and you don't want to go that route because you don't want that kind of change. It can be something like an outdoor item that's serving multiple purposes and has been for a number of years. Now all of a sudden the landlord wants to step in and tell you how to live by strongly suggesting a modification to that item. Let's say you're protecting part of your territory with that item and the landlord wants to intervene and tell you how to live by suggesting something else you're not really on board with. The landlord can't tell you how to live, but when they go that route, they are in a way overstepping their bounds and illegally trying to tell you how to live. For instance, let's say they want you to have a smaller version of that item and you're happy with what you have. In a way they are skirting the law and telling you how to live with less of that item. If you don't give them their way, they can suggest that they understand if you must find a different place. Or, they may ask you how you feel about moving and strongly suggest you work with them or else. If the landlord has people in their corner and the tenant doesn't, that's when the tenant met at some point need to find some kind of help. This could be a face-to-face interaction with absolutely no proof whatsoever that the landlord said anything. However, let's say the landlord might say something like the city said this or that when really maybe the city said nothing about whatever it is in your backyard. The city doesn't go around patrolling people's backyards and violating your privacy. They do their job with the street and that's it. They don't go violating people's yards, the landlord is the one criticizing someone's personal outdoor items
One other thing that was covered is Property Management handling property for the owner. Even if the property management starts something, it's still grounds for you to get some legal help. Assert your rights and don't back down. As what was pointed out, document everything

‘Voluntary Eviction’ where tenant is asked to leave with at least 60 days notice for various breaches including not paying non Covid related rent. Going forward if applicants display rude behavior in the beginning I do not have to rent to them. I learned my lesson.

In New Mexico and according to the lawyers at legal aide, judges tend to always favor landlords and it's not illegal for landlords to retaliate. It's your word against theirs and screw away with any evidence and proof the tenant has, while their word is accepted as gospel truth. They are free to do whatever they please and when presented with evidence in court, these courts just ignore it and yell at you for trying to answer their question, while they coddle the landlord like a crow wearing toddler in pampers seated on a royalty pillow. They are not landlords, but greedy, gluttonous, fraudulent and exploitive slumlords who are enabled and allowed to break the laws that they've created.

Laws vary from location to location, but it is generally never a good idea to simply take matters into your own hands or threaten tenants. It can only lead to more issues. It's best to deal with serious disputes through mediation, local authorities, or the legal process.

@@karadanvers6136 Without more information, it is difficult to provide a definitive answer. Generally, installing a shelving unit (or modifying the property in any way) without permission violates the lease, requiring you to restore the property to its original state. However, the shelves in the referenced video are freestanding. If your shelves are also freestanding, one could argue that they are just another piece of furniture. That said, unsecured shelves do pose a safety risk as they could topple over, similar to other furniture.

Did you get a copy of this legal agreement between you and the landlord? If so then you may very well have a case. If not, you may be screwed
Did you keep all of the receipts of all of the payments that you made on this house? If so, you may very well have a case, but only if you also have a copy of the land contract agreement between you and the seller
If you haven't already done so, you may want to start setting up some hidden security cameras that pick up audio. Start recording everything. Once you have enough evidence, call the bar and get a renters rights lawyer and tell them what you told us here while also turning in a copy of your evidence. If there are any papers in your possession tied to this agreement, get copies after copies after copies in case you need to hand them out to not just your lawyer, but also the judge and anyone else who may be interested in knowing more about your story. You may also want to call the news media in your area and have the landlord recorded. Since you may have social media, you may also want to go live and see if it goes viral
If you know who this owner's Bank is, you may want to go secretly and quietly talk to this bank by sitting down with a banker and telling them what you just told us here. Tell them you ran into a situation where there's a land contract situation, the seller is taking your money but is threatening to sell the property out from under you before you pay it off.
If you have a copy of the seller agreement between you and that seller, take a copy of that and hold on to a copy for yourself
Another thing you want to do is get any secret recordings by first setting up some hidden cameras in hidden spots where the landlord would be none the wiser. Put those hidden cameras in some spots they'll never look and you know it. Make sure they also pick up audio as well as all visual. Set them up when the landlord is nowhere to be found, then you're ready. I personally would set up several throughout your property. Just give them enough rope to actually hang themselves figuratively speaking
Just like you probably know not to tip your hand in a game of cards, you shouldn't tip your hand in this situation either. Make sure to not even say a word to the landlord, don't even let them know what's coming. Steamroll them like a Bamboozled freight train so they don't know what hit them. Just do it without warning and just steamroll them suddenly and without warning. Until then just keep quiet but just make sure you're in a safe location before calling your State Bar. You may also want to call the HOA and see if this place you're buying is registered. If so, report the incident. Another source you can also turn to besides your State Bar is the fair housing, your local mayor, and your State Attorney General
If there are any health concerns such as mold, get pictures and turn them into the health department

Today they came through to replace the air filter but had the wrong size filter. I told
them I already replaced it as they had not come through in a while. One of the two
individuals asked about a fire extinguisher and I told them that there’s a fire alarm
right above your head. How are you going to ask about something that you didn’t
provide. Idiots. Then the Mexican looking one points out something on the ceiling
that actually wasn’t even there. Claiming that it was some sign of a leak. So I
showed him an actual crack in the ceiling that he didn’t seem to notice. He was
able to locate that. The crack was pointed out to a previous landlord associate.
It’s never the same person when they do come around every 3 months in
South Carolina. Harassing me to buy the property when they won’t stop raising
the lot rent is a form of landlord harassment that I have been experiencing with
these fools. Besides the usual nasty notice threats of charging $75 for not
cutting the grass and anything else they seem to want to come up with. I give
them one time to do that and no more good tenant that always cuts grass and pays on time for them. Come lease renewal I will be out, games like that I do not play. Clearly
it does not seem to matter how good of a tenant you are these days they are going to
try to test you no matter what. Yeah this is Columbia again palmetto palms

Is it considered harassment when the landlord starts targeting you as being rude and disrespectful to him (and verbally abusing your roommates) because you didn't hi to him (for good reason cos he's a dick to you when you do say hi for no reason)? And is it also considered harassment when he says you can't have contact with any other tenants except through him? I'm making plans to move anyway and the rental market is tough but I have a feeling both examples above are harassment. Oh yeah and I don't have working heat most of the time either because my living conditions aren't to code I'm pretty sure

    • @0annonymous
      @0annonymous 10 หลายเดือนก่อน +1

You're right, yes it is harassment and you can call your State Bar and get a real good renters rights lawyer who handles these types of cases because they've heard it all before
What you want to do is make yourself very scarce and limit contact when you know this person is going to be around your place if they happen to be there at times it's not even necessary.
Talk to your roommates and make a plan do not let this person in and don't answer the door to them or acknowledge them
Just because someone knocks doesn't mean you must answer. If you know how to make a plan and practice laying low when this person comes around, it's going to help you all a lot, especially if you keep your doors and windows shut and locked, the drapes drawn and show no signs at your home, especially at night. If you know how to keep the TV and music down so low or even off that no one knows your home, you're actually safer. If they see the car in the drive, change that plan if you don't have a garage. Even if you choose to park in a garage if you have one, shut and lock the door, cover the windows from the inside and make sure you have the key on you. Also you want to make sure your landlord can't tamper with your garage door, there's a certain way to disable that from inside the garage, and I think it's as simple as using a zip tie on the mechanism. That is unless technology has changed the design.
If you have no garage, you may do better to park much further away from home, and take a bike or walk home. If you can park at a friend's or relatives, just walk home. Tell them what you told us is going on and make that arrangement. In fact I'd park all of your cars off-site somewhere if I was in your situation. It's better if no one has a car, so that way you can get a bike and bring it in when not in use.
If you must come into contact with this person, make sure you try to stay as calm and quiet as possible and make your contact with them as short as possible. Limit your contact with this person and don't talk to them no more than absolutely necessary. They shouldn't be in contact with you unless there's an absolute valid need. I personally would set up hidden cameras because most likely you're going to face retaliation. If you move, the person has one and they get the idea they can do what they did to you to others. Personally I'd sit still and collect evidence. Don't get aggressive, just stay calm if you even can. Next time this person comes over unannounced and unnecessarily, make sure to have hidden cameras installed or if that's not possible, make sure someone is recording and don't make it obvious. Make sure the camera man stays Out Of Reach of that aggressive person and don't let that person come near that cameraman. Have a protection strategy to protect the cameraman collecting evidence on everyone's behalf. Practice that strategy when that person isn't around and make sure you know it like the palmame hand. Then when this person comes around, spring into action with what you all practiced before. Tell no one what you're doing, but do tell others outside of your circle what's going on and what this person is doing, especially if you must go live on social media
