    YESSS!! Record, document, record, and repeat!!! Even if you won't need to use it a least you have documentation, because God Forbid it's likely that landlord will F up again in some other way!! As soon as I move in and out of a place, I video every tiny thing!! I don't trust any of them or rental management companies especially! Beware!!!

      Documentation without the Landlord knowing it could mess you up. A savvy friend once told me to email everything. If the manager replies..it's been documented. If they don't respond you have proof you sent a letter. Regardless it's better just you doing all the work

      You can video record plain view like things you could view with your own eyes. You may audio record obliviously if you are a participant in the conversation.

      @@bornlozer123 First check if your state is a one or two party state and make sure you are also aware of these laws, when speaking to anyone in another state. Mine is a one party state, so don't to tell them anything nor get their persmission to record them either.

      In many cases, a professional management company is held to a higher standard of transparency than a private landlord. But regardless, keeping detailed records is valuable for all sides in case a dispute or issue arises.

    I have a landlord who divided a one-bedroom apartment into 2 units. I am unit A and there's another tenant living next door to me which is Unit B. After living for four years here come to find out that we shared the same circuit breaker box which is in my apartment unit A. All of the sudden unit B has a bad outlet in his kitchen that blows off if used in which blows out the lights in my bathroom that are connected wall to wall. I myself had a bad outlet in my unit in which I took extension cord and connect it to another outlet so I resolved that problem. Unfortunately Unit B refuse to do the same and calls the landlord for repairs. Landlord refuse to repair the problem and threatened to evict both of us, if I don't take responsibility for another tenant's electrical problem and turn on the outlet every time they use it and it goes out. This situation has interrupted my peace in the unit. Every time I use the bathroom weather on the toilet or taking a shower if they use the outlet and it blows out they bang on the wall until I turn it back on 🤦 landlord also wants me to give them access to my apartment if I'm out of the house, or out of town or at work. Landlord wants no part of this problem. I apologize for the long explanation. But is this illegal? #West_Palm_Beach

      That is an illegal code violation. Each unit is required to have a breaker in it, on it's own circuit. I believe it is fire code, not just electric. It is NOT LEGAL for the other tenent to have access to your unit at ANY point in time. BOTH of you need to stop paying rent until landlord pays electrician to put a breaker in other unit and separate your wiring. They 100% CANNOT EVICT EITHER OF YOU! Write a letter, tell them what I just typed here. Let them know you will BOTH be contacting a landlord tenent lawyer.

      If you are paying for the electric in the other apartment that is definitely illegal. It is possible when homes are divided into two units this can be in error but needs corrected. If it goes to court you could ask for your electric bills refunded as in shared meter situations the landlord is responsible for this utilities.

    What can the residents do when the landlord makes false assumptions about the residents, especially during the lease renewal process? Is this considered normal for the landlord to engage in such cruel and inhumane treatment, as well as unsafe conditions. They expect you to comply 100% without question. But when you are questioning the landlord's ability to do his/her job thoroughly and accurately, they get offended because you are asserting your constitutional rights to the utmost. A former president once said, "If you want to test a man,'s character, give him power.". If a former president said this, and knew what he was talking about, the landlord should have been about the business of serving the residents. Not the other way around. Continue to bring this to public attention. This is necessary.

      If the landlord is doing something wrong, or not holding up their obligations, that is not a license to also not comply with your obligations as a tenant. In fact, if the matter goes to court, this could damage your case. That said, a landlord can choose to non-renew a tenant for a variety of reasons.

      A tenant doesn't have to sign a new lease or continue on, just like a landlord doesn't have to.

    I live in oklahoma and I thought my landlord l. Was a good guy but 2 days ago. He broke into my rental house druck with somewhere guy. I'm 73 yrs old in a wheel chair and was threatened and told that I was out in 5 days. What?? I called the cops they came in as this asshole did handcuffed him and took him away. When the were questioning him he knew I was watching he turned and flipped me off with both hands. That was really professional if him! Right?? I think he was drunk and mental too. He posted an eviction notice on my door today. Please he's such a looser. I will try to sue him. He broke so many rules on our contract. Good grief

    God i don’t know why it so tough to get a landlord to fix something. I got such the run around when I needed the landlord to fix my hardwood flooring from a moisture issue. I showed her the damaged floor and ask can we get a contractor in to cut some these planks and see what’s going on under the floor and weeks went by until anything happened the contractor came said it’s due to moisture cut some the damaged planks and found no wet spots or any moisture he said whatever was there dried up but something got in but hasn’t been there for awhile. So I got the planks replaced with peace’s that were close to matching I didn’t even care if they matched or not I just wanted a good floor again. But man did it take forever like why this didn’t have too take so long to do something

      Length of time depends on a multitude of things. Seems Tenants want it done on their schedule. Not the landlord. We give the tenant a choice of 3 different days to choose from to schedule. Seems everyone wants it done on their minute not the other party. If the problem takes more than a day to fix, then the matanence would have to get their on matanence schedule. Not the tenants schedule.

      ​​@@jaynordiaz4609I'm a homeowner. They are correct. Contractors HAVE A SCHEDULE and MUST be booked IN ADVANCE. You can call the landlord all you WANT, but that does NOT mean a contractor IS available on YOUR schedule. If your landlord does not like what they did to her floor, they are in deep doo-doo. This was not a pertinant issue. A landlord cannot just send whoever whenever for someone else. But-this is why I wrote a petition to put a ban on single family home rentals. Homes are not built, zoned or designed to be rented out-they are built to be owner occupied only.

      Timelines for repairs, especially ones trying to diagnose an issue, can be delayed for several reasons including the availability of a qualified contractor and the severity of the issue. For instance, an active leak such as a pipe break may have been handled differently than some damaged floorboards. But, hopefully everything has been resolved.

    Landlord accused us of causing the condensation coming from the air-conditioning unit. And said that our laundry was a fire hazard.

    I own my townhome. When it came time to help my 91 year old mom in her house, l decided to rent out the (then) pristine townhome to a kindergarden teacher, her mom and her adult son, and a tiny Yorkie Terrier. Within a year, the dog had ruined all the baseboards with urine, the window coverings were destroyed, the floors were sticky with gunk, the light grout was black with gunk, the new kitchen faucets and bathroom faucets were never cleaned, the stainless steel kitchen sink looked like peanut butter and mold were smeared all over it. Now, last week, the son had a bowel movement and used a lot of paper. It didn't flush down. He kept trying and flooded the upstairs bathroom, which then cascaded into the kitchen below.
    My insurance will be demolishing the bathroom and kitchen, which will take a few months. I asked them if they could move asap. They hired a lawyer who is now requesting $25,000 in relocation fees. OUTRAGEOUS. They f up my place AND win the asshole lottery.

      What a terrible situation and I am so sorry you are dealing with that. While there are a lot of wonderful tenants out there who will care for the property, there are also some really bad ones.

    4:30 - Wrongful Eviction.
    If all tenants are given a notice of eviction stating "Change of Use" of the building as the reason, contact a tenant attorney before vacating the units. This reason is often used when building owners want to increase the rent more than allowed by CA Rent Control. An attorney will check to verify that the owner has submitted required paperwork with local government offices for the Change in Use of the building.

      Knowing your rights as a tenant is key! Unfortunately, there are a lot of bad landlords out there who play the system.

    My landlord consistently shows up unannounced. I've told her only to come when we've previously scheduled an appointment but she still shows up anyway. This week, she's already come to my apartment twice. (I know it's her because she announces herself.) According to the lease, I'm only obligated to answer the door for inspections, pest control etc. so I stopped answering. She doesn't enter but the knocks/doorbell have certainly woken me up and her visits are becoming more frequent. Can this be considered a breach of "quiet enjoyability" and harassment?

      @@deeelle697 Thank you for the advice. A lawyer told me that I can only go to court and file a harassment claim if I can prove that the landlord is intentionally doing it to make me move out. I was told that this is really hard to do. Although, different lawyers say different things. What's your perspective on this?

      @Angela video evidence of the landlord knocking/ringing is what you need. If you can show a pattern of this, and especially if it's during weekend or late evening hours, you have a case

    My landlord hasn’t don’t repairs or basic upkeep for the whole 15 year period we’ve lived here. They’ve had neighbors harass us to force an eviction for over a year since 2022- current day. We’ve always paid our rent on time.
    They’ve employed neighbors to force an eviction and use emotional distress repeatedly.
    They haven’t repaired anything or kept the electricity up to date on current property codes. There’s mold growing on the walls in multiple units and they refuse to fix the problem. They won’t do renovations because they’re refusing to pay for the damage and housing fees during the repairs. Our electricity and heating system is not working properly which is a fire hazard.
    They overcharge for the bill which we have paid through out the years of bad electric wiring that is completely outdated.
    Our ventilation system doesn’t work at all and is an outdated system that has to be updated and changed to be up to property codes.
    They’ve been avoiding repairs for years. When we brought up the mold years ago he told us to clean it and to be thankful. The mold is from the ceiling because of the bad roofing and no slant which means that the water is held onto the roof longer. He doesn’t pay for regular maintenance for the whole building like cleaning gutters, pool maintenance, and laundry room maintenance. Along with that wiring being outdated and not following electrical codes as well.
    They’ve done improper logging work which resulted in a tree falling on a neighbors house and continue to do cheap fixes when the trees aren’t able to withstand near a shallow bank due to the creek.
    He also used part of the properties for his own personal storage.
    He doesn’t keep up with pool maintenance by following city codes and used hose water to fill it which eventually causes health hazards because of the water system he refuses to fix the pool cleaning filtration.
    Along with refusing to have heating in the pool ever since we’ve lived here for 15 years and before that.
    I would have tried to work it out if they didn’t employ others to harass us all hours of the night and day.
    When we moved in they did no remodeling that were up to code standards at all for example sealed windowsills were a code standard even when we moved in. So refusal to do these things is long overdue and I think we have been patient for long enough.
    There’s mold growing on the windowsills because they refuse to do those repairs. The windows barely shut.
    The walls have no insulation. The bathroom shower is peeling off of the wall. The counter in the kitchen is doing the same because it’s done with patchwork with seal glue. Just overall really cheap fixes. I am still shocked they had the audacity to even rent this.

      Having neighbors participate, if provable, is certainly harassment and would be something to report to local authorities. Many of the maintenance issues you cite sound like they could be building code violations. In this case, it would be a good idea to speak with your local code enforcement authority.

    There should be lawyers for people on HUD to fight for your rights a lot of people don't know what I know and they're not knowledgeable like me and even if you are you're going to get screwed if you don't have a good lawyer and you're not going to have one

      If you live in Travis County you can get in touch with Austin Tenants Council for help. You might be on hold for awhile but stick with it, you'll eventually speak to a human. Worked for me

      ​@@bonitagilbert7190in NM they only give free attorney services to those on HUD. The most the rest of us can get is legal aid which is only counsel the legal aid advisor feels you should do

      It's not a HUD issue-Landlord Tenant Law applies to ALL, and it is a renter's responsibility to look up and know the law when they first start renting. Landlord Tenant Law attornies are available for everyone too. 😊 A juicy case is a juicy case! 😂

      All tenants have the same rights and responsibilities under the law, regardless of HUD status. There are qualified landlord-tenant law attorneys in most locations who are ready and willing to help.

      It should be a automatic eviction If tenants sign a contract/lease that only 3 authorized persons are going to live there and then 5 more subleaser move in without the owner's legal authorization.

    Well if you're on HUD you can guarantee you lost your security they'll find a reason there is no normal wear and tear you're supposed to rebuild their house for them if you live there 14 years

      How much is retained from a deposit is unique to each property and situation. Many tenants get their full deposit back, some get nothing - but there should always be a documented reason for any withholding.

      Depending on where you are, there may be legal aid services or some lower-cost options available. Depending on the issue, trying to work with the landlord or through a mediator may help avoid a costly court process.

    Where I live in a dorm and my room pours down like a shower. I took pictures and videos. Im thinking about suing or just move out on an emergency leave. Health problems I do have since the three years Ive been here have gotten worse

    This video has me terrified. I'm not a landlord; I let some homeless friends into my house to give them time to find shelter, but they immediately changed the lock on my guestroom and changed our relationship to adversaries. They won't leave although I asked them to 8 months ago, and they're threatening to sue me for $1 million if I try to evict them. I thought this was preposterous, but after seeing this video, I can believe they are gathering evidence against me over much of these things, including having guests come over without having first obtained their permission. They have me by the short hairs and they are taking full advantage of that. As a homeowner, it is looking to me like this couple is planning to take my fully paid house away from me...legally. This is truly terrifying. I am elderly, disabled, paying all the utilities, not charging any rent, and living on a small Social Security income. If they do this to me, and I now believe they will try, I am SOL, I will be the homeless one and they will have all my assets. 😢 How can this be justifiable?

    i moved into the house im in back in 2004 and i have paid out over $250,000 dollars in rent and i have never had a lease.I am handycap and i always payed my rent,my land lord even got payed back rent and future rent and i nave got a reciept for 650 dollars i paid when i moved in the property.the property is not maintained.when it rains the back yard the sides of the house fill up with water after it rains and the water stands for weeks at a time.my rent is paid in full as of june 2022 and my social security check was late and then 30 minutes after i told the landlord my check was late he put a typed notice of evection in my mail box and sent one in the mail.what legal right do i have to stay in the house.the back yard has a building thats ben falling down for 20 years and her won't tear it down the house has cement floors and are like walking on a frozen lake,when it rains hard water comes in the back door. also this house is a dust bowl the ceilings have dust and the return ducts are always full of dirt. and his reason he wants me out is to sell it because his mother is sick.its not my fault that she is sick.i have pictures to prove what this house looks like in the back and front yard.and being handy cap doesn't help me. i have all the reciepts for 20 years of payments some where late but always paid.the landlord refused the rent for July because he was pissed off because my social security check was late.

      Contact a tenant attorney. It sounds like they are a slum lord and fully deserve to be sued.

    Number 3 is definitely a easy win I just don’t know where to start, no installation rotten wood floors squirrel infestation in attic, fault electrical issues no snow removal or ice removal does those problems sound like something the landlord and I can work out ?

      Hi Michael, not all issues can indeed be resolved simply. That said, landlords and tenants are bound by a legal rental agreement, which outlines each individual’s rights and responsibilities. So, working together whenever possible is always best. Ideally, the property owner will be able to address your concerns promptly. If not, taking steps to establish your efforts to get them to fix the issue is critical. Be sure to keep records of any/all maintenance requests you have made and take plenty of photos. From the possible safety concerns you described, you may need to report the property to the appropriate housing authority if the landlord refuses to take action.

      If you are renting a house, you are in charge of snow/ice removal. You can write landlord a letter, list the issues. The squirrels are a health issue due to feces and urine-let them know that. Are you at risk of falling through the floor?

    I’m suing a property management company for leasing a residence that has no working heater, chronic leaking, a broken lock on the patio door, latex paint on the floor, fixtures improperly installed and that’s just the habitability part. When I notified them of the issues they gave me a bunch of phone numbers for handymen (none licensed) including the same dude who has been out here twice for the leak/flooding issue . I’m so naive I assumed they would offer to pay for me to stay elsewhere while the issues were addressed - I can’t imagine not doing my job and then asking the customer to do it for me. I’m actually too busy running a small business giving people what they pay for and was a landlord myself until recently.
    I called a lawyer and got a new place because their response tells me all I need to know about how they conduct business.
    Don’t trip over a dollar to pick up a nickel when it’s comes to property / being cheap gets expensive fast.

      We hope that your situation has improved. It is never a good idea to have tenants work directly with repairmen, this should be the property owner - but there are a lot of landlords out there who feel differently. Additionally, we always recommend renter's insurance to our tenants. It is a great way to protect your belongings, but can also help with living costs if a unit becomes uninhabitable due to needed repairs or an emergency.

    I’m being illegal evicted in NC because the office manager send me an illegal rental lease with the wrong dates on it. There is what I’m trying to tell you, The beginning date of rental lease is August 1, 2023 and ended on February 28, 2023. My rent is current and I’m looking into getting legal representation to fight this issue. The eviction notice told me to move out of my residence in two weeks. I received this eviction notification on Saturday, August 19, 2023. I tried to discuss this issues with the landlord’s property management and she refuses to correct her mistake. Just sharing my story.

    Anybody can be a landlord wich is wrong they should get a permit or license by the state to know the rules and regulations according to the laws knowing the tenants rights as priorities. We need to vote to expand our rights.

    We get what we pay for. I have rented many houses and apartments over the years. I sometime place a online add when i am looking for housing in a new city. I alway put the price of rent i will not excrpt because its too low. I have friends that have 2 dogs and complain that the property provider wont fix things that break after they moved in. I told her they couldn't afford to fix it. Your rent is barrly covering the taxes, insurance and mortgage. Untill the mortgage is paid off, There not making enough for the hassle of owning a rental property.

    I have yet to find a firm that protects tenants in pennsylvania I've gone through things in the past when I sued with evidence I found out that the landlords attorney calls ahead to the magistrate or judge pay a few bucks and case thrown out its called a(SPECIAL CASE) an say it the merits or failure to state or make a claim if there was a firm or group of lawyers or attorneys I would go back an sue every landlord I ever had a lease with

    They do not have to keep up with the maintenance if you're on HUD where I live in Batavia New York they Overlook things I'm about to be homeless cuz I complained that's the truth the woman at heart will tell you if you don't like it move I got one leg I can't move

    I have a serious issue with my landlord, we moved in almost 2 years ago it started with the septic tank took him 5 months to even fix after I got completely fed up and sent him a picture of what I had to see every day which was not pleasant..but he found a way to blame us for that...I don't even flush toilet paper down it or sanitary woman things just what needs to go down there he took 5 months to fix in wich those 5 months i had to plunge every day and clean constantly on top of working 2 jobs...the next issue was an infestation out of this world with roaches I still have to this day I told him about the roaches he brings things for me to spray here and there but they are so intense it's bad..I have decided ok everything goes in the fridge and zip lock bag everything in the cabinet and if that not horrible I had no animals and a flea infestation inside my home so bad for several months I sent my landlord pics well more than hundreds of bites marks and puss on my feet from fleas...it was torture of at least 4 months and when I kept sending pics of my welts and actual bumps from fleas he said if I'm not satisfied then I should move from the property since I'm not happy there...and I told him that I'm unhappy with fleas biting me every second of the day..I was so taken back with him at that point....I told him I found a company whos willing to do the treatment and how much it would cost but he refused...so I tried doing the job myself seeing as i could not afford to do the treatment...I don't even have animals y would I have fleas...I bought some things to try and make it go away and all it did was send me to the hospital for chemical poisoning so when I got out of the hospital and contacted the landlord and told him thats it you have to fix this
    ..I almost killed myself tryna treat this issue i went to the hospital...I sent him updated pictures of my bites all over my body and his solution was to get a friend to spray something..which didn't work because I was still being feasted on every seconds I had a new bite a new swell and it drove me crazy so 1 month later he had his friends do it again spray after tryna get him to help to re spray, around the flea situation eventually it got solved after months of begging and pleading and I still have scares all over body that are permanent from this battle...I noticed after the flea situation I started getting really sick in my home..I could not put my finger on it...my ears hurt and itch my eyes burn and water I'm getting rashes on my skin I'm getting nose bleeds foggy brain, memory issues headaches fatigue symptoms coughing breathing issues and it was like that for a while until I started smelling Moisture like mold so walls started turning colors I told him he needs to test for mold because I'm getting sick I told him I was healthy before I rented this home and now I'm so sick I have to force myself to work to be able to pay the bills..I can't afford sick days 3 months later he decided to do the test FINALLY after 3 months..which was recently and came out positive for mold 3 types he said it was not harmful and so I decided to Google the symptoms I was having and mold is related to those symptoms....I told I'm we truly need to speak about this and his resolution is give me 900 dollars and I move....I know I have lasting health issue from this it's been a complete night mare since I signed the lease and every time I have an issue he looks for a way to blame me..I have messages and proof of me begging him for help and his responses because something tells me that I feel like I should take him to court...I really need some advice guys anyone?

      First off I'm so sorry. You've been through alot. I'm no expert here, but I would find legal action to take him to court for everything. The 900 is just hush money. I'm about to rent out my first house soon and I'm just learning what I need to do before hand. Your comment has taught me one thing, I need to setup a appointments for bug spray every 6 months for my peace of mind. I'll check for mold as well. Hope you're okay

      This sounds like my landlord. I'm now in court once again with him bc he's evicting me to retaliate & not repair severe issues including mold & structural damages. Make sure you document everything in writing to the landlord or between both of you!! Continue to request repairs and always get some type of receipt that he/she has received your request/demand letter. Contact your housing authority to conduct an inspection it he won't comply with safe, habitable standards. Much more, but I'd definitely look into your state laws as well as getting a consult with an attorney regarding such. Good luck! Slum lords are the absolute worst

      Remind your landlord that female fleas jump 40 feet, remind landlord that when roaches are seen and not pro destroyed, the walls get 1" think wirh roaches on inside. Let your landlord know that sewage kills people.

      A landlord has the right to refuse to sign a new lease with you. A landlord does NOT have the right to do what one jacka** did-kick us out because he was stalking me, entering my unit while I was sleeping (awake to VERY locked doors WIDE open), sexually assault me, then kick us OUT because one day my son said, "Leave my f***ing mom ALONE." So...would need to know your context!😂

If the les are broken you can usually ask for relief spelledoutin the law and be it 100 dollars or 2x the rent paid you need to decide if it is worth pursuing whatcouldbe negotiated in mediation and through sample letters from consumer affairs.

Both of which could require speaking with a local attorney if they cannot be resolved. It is important to always keep communication professional with your landlord and document everything. If you have social media messages, make sure you save screenshots. If they are refusing to address the required repairs, and it is a risk to the health and safety of yourself or others, your local code enforcement agency may be able to help.

    Might sound silly but it states in my agreement that I’m allowed to park 4 vehicles on the premises. I have a car and my girlfriend has a car. We only have 1 spot assigned to our apartment # but I have to park further down but it’s still in the premises of the apartment. Many people here have this problem. There’s not enough spaces for people to park. I asked my landlord and he said. Your allowed to have 4 vehicles but only 1 can be on the premises. But it states on the agreement. I’m allowed to park 4 on the premise. Wtf I’m getting threatened my car will be towed

    Had a horrible landlady who rented her grandparents’ old house to me, and she knew there was black mold yet purposefully hid that from me. I was able to sue her successfully, got put up on very nice accommodations while she got the rental “up to code”. 😎

      I've got other issues like treats and intimidation and attempts to fraud me. That's on tope of the damages.

      Correct. Landlords and tenants should both complete a move in and move out inspection to document condition and agree on any existing issues or repairs that need to be made. However, when a maintenance issue arises during your lease, it is a good idea to take photos or a video of the problem and keep a record of any communications you have with your landlord.

    I rented a trailer from somebody and they do not repair the damage that has been done from rain on the roof he close the vent but didn’t repair the roof he also had a crack in the shower that caused water damage to the wall on the other side he also did not repair it he just glued the whole closed. Then the Central air conditioner wasn’t working properly and he couldn’t fix it so he told me to order two window air conditioner units and he will reimburse me I made the purchases through Walmart online and when I bring him the online receipt that I had printed out he refused and said that it wasn’t a receipt. I know I have a case I just don’t know what to do do

      If you purchased the units and he refuses reimbursement, they are YOUR property, YOU own them, and get to take them with you when you leave. That's how THAT works! 😊😅 And, he has no reciept to prove HE bought them, so when you take them with you, he cannot take you to court-just REMEMBER that, because he sounds like an a**hole who will threaten you for keeping your own property! 😂😂😂😂

      You are grandfathered in. They can NOT force NEW rules on existing tenents. Be sure to REMIND them of this LAW. I had one place CONSTANTLY threatening to evict me because I had flower pots on my balcony railings, a dog, two dogs. Kept charging into office to say leave me the eff alone because I was there WAY before they were when the owner lived on-site. Lol

    I’m getting evicted because I went to the town to let them know that my home rocks back and forth specially at night when I’m in bed I can feel it rocking like a earthquake .       I'm so sorry that you had an accident. Insurance or no insurance, a landlord must provide a safe and habitable property. Unfortunately, many smaller, private landlords struggle to manage their budget and needed repairs - but that is not an excuse for disregarding safety. Hopefully the times you asked them to fix the issue or any conversations you had after your injury were documented. Your best bet would be to take that documentation and your medical records to a lawyer for review.

      That depends - was the use of the shed included in the lease? If so, that space needs to be provided to the tenant. However, if the use of the shed is not included in the lease, the landlord does not have to provide access.

    Landlord says she smells cannabis outside a tenants door, tries to perform rogue inspection of non smoking stellar elderly tenant without proof, then loudly and publicly “ reminds” this same tenant that they may not smoke marijuana in her apartment. Singled this tenant out with no proof or evidence.

      A landlord does have the right to inspect an apartment if they suspect a violation of the lease or the law. However, proper notice must be given before the inspection takes place - usually 24 hours depending on the notice requirements in your area. If the landlord did not provide any notice, they should have, and it is never good landlord-tenant relations to "loudly remind" or publicly reprimand a tenant.

      My question concerned my rights concerning nasty gossip about me by other tenants. Is a landlord legally required to stop it?

      @@annseven7166 A landlord should not be sharing any details about you with other tenants, it's bad business practice and could get them into trouble. As far as legal advice, we are not equipped to provide that - however, gossip brings up a number of issues that could be pursued in the right circumstances, such as defamation of character or emotional distress due to slander/defamation of character. The key is documenting this however you can and if it has become a serious problem, speaking to a local attorney. Many reputable attorneys provide free or low-cost consultations.

      Hi Nova, without knowing more detail as to what alterations were made or what may be in dispute, we would generally recommend keeping careful records of your own. This includes a video or photos that can thoroughly document the property's move-in and move-out condition. In the event of a dispute, these along with a copy of the inspection can help prove which parts of the checklist are incorrect, whether as an honest mistake or intentional falsification.

    I’m in hell. I live in a roach infested house with a roomate who is constantly smoking crack. Also, I just discovered rats are using the heating vent to travel around the house. Also the house was built in 1926 and I was never given a lead paint notice. I don’t have any rental agreement and my landlord has been in the property multiple times and never announced it. He even told me he went into my room when I was at work. I don’t know what to do . I can’t even barely afford life. Considering just dying. It would be easier

      YOU HAVE THE RIGHT TO PUT A DEADBOLT WHERE YOUR ROOM KNOB IS! 😊❤ Lead paint is fine for adults, and they may have ALREADY abated it, and since it is a 1926, it has most likely been painted over with non-lead paint several times. Painted over lead paint is fine-until it becomes exposed. Again, zero risk for adults-unless you are a kid and lick or munch it. HOW can you live somewhere without a contract??? That's not okay. Contract/lease is to protect both parties. A contract means he cannot EVER enter without your consent. I know times are SUPER hard for everyone. I own my home outright (paid cash), and I STILL might lose my house ANY way because inflation just gobbled up my maintenance budget and plans. 😢 I do not really want to be here either, but we have to stay anyway. (((hugs)))

    Legally binding contract? That's a joke! The judges didn't seem to think so during the pandemic because they took it upon themselves to break those leases and tell the tenants not to pay any rent

    Any chance I can take my previous landlord to court for returning my deposit in 47 days ? & it not being for the full amount. I had numerous complaints and my apartment was becoming a hazard to live in and even they agreed so that I could move out in 30 days instead of 60. I have 4 years worth of pictures

      Nobody gets their full-if ANY deposit back. Place took all but $25 of my $1,000 deposit. I'd only lived there 6 months, and no way I could have done more than $500. The way they are. They keep it over every tiny thing to help pay for maintenance-all just theft.😢

      There are many factors that could contribute to a tenant not getting their full deposit back. However, the landlord should provide you with a documented reason for the amount that was or was not returned. As far as the length of time goes, each jurisdiction has their own requirements, so depending on whether or not that was violated - you may have a case.

    Can you sue your Landlord for discrimination under the fair housing act against your emotional support animal!! If they made up lies to try to deem your dog aggressive? Even If you have written documentation and written positive testimonies by neighbors?

      My landlord was asked numerous times to maintain the trees around the property which had caused damage to both my personal vehicle and company vehicle, and she also didn't hire a licensed contractor to fix the plumbing, which ended up coming out of my pocket (she sent an unlicensed "property manager" and I sent him packing before he even stepped foot in the house.) After my attorney did some digging, she found out that my landlord never had a C.O., and she now has a choice of settling out of court, or taking a chance in court, which could lead to her having to pay back every rent payment since she took over ownership over 5 years ago, not to mention she broke a written agreement to repair a list of issues when she had taken over ownership. Along with legal fees, she's looking at $60,000-$80,000 lawsuit, and my attorney had even offered to settle out of court at $35,000. Unfortunately she decided to take a chance in court, and it's not looking good for her. To anyone out there that works hard and pays their rent on time, do yourself a favor and get a real estate attorney. Landlords think rental properties are a "one way road" when it comes to tenants, and believe it or not, some tenants not only pay their rent on time, but also have a REALLY good lawyer. 🍸😎

      Communication and documentation is key. If you have an animal of any kind, that needs to be disclosed to the landlord. If it is a service animal or for emotional support, this requires additional verification but the landlord cannot ask you to leave based on this.

    So as far as the landlord negligence, what if it was something the tenant had go wrong in the apartment and neglected to notify the landlord and got injured anyway

      This is really a legal question, so we are unable to offer specific advice, however, in general, having an issue and then neglecting to report it only complicates matters. Depending on the injury, it may be something that is covered by either a renter's insurance or a homeowners policy, but these may also take who is at fault into account.

      Both the landlord and tenant should participate in a detailed move-in inspection - if any issues are discovered at the time, it's the perfect opportunity to note these in writing as well as agree on what will (or will not) be repaired by the landlord.

    Help! I'm in a unique situation . Recently, a property that I've been renting for the last 5 years, has had a land dispute resurface that I had no idea was going on. The new owners of the property next door the the property that I rent , paid for a professional survey done and apparently her property line goes through 2/3's of our driveway, and about 1/3 of our backyard. The owner of the property that I rent has just asked that we park on the left side of the driveway until this gets figured out. I'm not looking to sue anyone, as I do understand the dispute, but I'm also not going to be bullied. I'd just like some guidance on what rights I have.

      Asking to park on the left does not sound like a big ask from the landlord. But the key to this situation is going to be communication. It sounds like the property owners have quite a bit to figure out. So, hopefully, the owner you rent from will keep you informed as the process progresses. In this instance, it's probably best to foster open dialogue and work with the landlord as best you can.

    If your tenants don’t allow you to communicate with you shut you out what would you do except file for eviction what you are telling me is the tenants has all the right beyond the landlord the tenants refuse to talk to the landlord and the tenants also have someone else live in the house without landlord permission your advices at this point is helpless

      So sorry if you did not find the video to be helpful in your specific situation. While is it always good advice for both landlords and tenants to foster open communication, that isn't always what happens. However, not communicating with you on its own is not a reason to evict. But if they refuse to pay rent, don't report maintenance issues, break their lease clauses, or refuse to allow access for repairs with proper notice - that is another story. If they have sublet the unit or moved in additional unauthorized persons, that would likely be a lease violation. If that is the case, as the landlord, you should provide written notice of the lease violation that also outlines the consequences (up to eviction) if they do not fix the situation. So whether they speak to you directly or not, we recommend all notices coming from a landlord be in writing, because if you end up having to go through an eviction process, this written proof is vital.
