First Amendment Test: Security Guard Says I Cannot Take Pictures "Under Chevron's Law."

- DP Security guards seem to be under the impression that Chevron corporate policy forbids individuals from taking photographs and video of the property from a public sidewalk. They needed a lesson in First Amendment law, and it was my pleasure to give it to them.
This video was filmed primarily with a Sony a6000 (mirrorless) camera.

I’m retired Illinois state LEO and security guards like this are common…when in reality a security guard is supposed to observe and report…that’s the extent of the job description. Problem is lots of 40-60 year old guys with failed careers/life choices working as a guard for $14…hour want to project legal authority they do not possess to compensate for their lack of success in life.
Fowler needs to stay inside Chevron’s property. He is a danger.

Hi from a 9 year career security enforcement officer. Not a patrolman, not a guard, an *enforcer* of policy. You are absolutely right. You did nothing wrong and never violated Chevron property. Chevron has no law, they only have policy. You did good to stand up to these morons. And thanks for not blurring any faces, if they show up at my site I'll tell my F/S to send someone else.

I applaud your ability to stay calm and resolute. We need more people like you. I on the other hand have a personal space rule. Violation of said rule results in immediate and relentless first strike. No other reason to violate someone's personal space other than physical assault or intimidation to do so.
For a while I was an armed guard, and there is one golden rule about company policy.....

Any day when people exercise their Constitutional (legal) rights and record the reactions of self important, self righteous buttercups to the sight of people engaged in lawful public photography is always the good days of auditing.
The only bad thing about it is that after more than 6 years their are still snowflakes who lack the intelligence to comprehend that their feelings and egos do not trump the law.

This is still probably my all-time favorite.
It's a shame Chevron's Fire Department didn't show up. The fire in that guard's butt must have been painful for the rest of his shift.
Essentially, by acting outside the scope of his authority, the security guard is breaking the law. I suspect his bosses realized this and quickly reined him in. He is lucky.
He wasn't trying to intimidate anyone, which is why he walked up that close to the camera and put the craziest look possible on his face.
legend has it that the security guard has since been seen chasing the google earth car around trying to prevent them from taking pictures as well, some say he even climbed the roof with a tarp to block them from taking satelite photos of the facility as well.
He didn't "back down". He was forced to go back to his position by his boss or risk losing his job. Of course, if you ask me, he should have lost his job anyway for not doing as he was told WHEN he was told, but that's another argument.
A uniform can do amazing things to some people's ego.
I doubt Chevron instructed this security company and this guard to confront people outside the property line.
No, they didn't, and the woman yelling at the idiot to get back on their property was well aware of it.
Phone the security company get him fired or reassigned
I had to do some check on learning with a guard about how to handle people recording o private property.
- 1. What does the property manager or property owner want to happen on their property? If they say they don't want people recording on their property, fine that's easy to handle.
- 2. What is your property line? Do you know where your established perimeter is? If you do that's great, if not you need to get that perimeter confirmed by the property management or property owner. This will assist you in understanding where the line between public and private property is.
- 3. The day has come. Some guy with a lot of time on his hands is taking pictures or video of the property you are overseeing. First, evaluate the situation. Is he causing a problem? By which I mean is he bothering patrons, in peoples way, appear threatening, or acting in an abusive manor towards people? No? Awesome. If he is, that's a different subject.
- 4. Is he actually on your property? If not, no worries he's just some weird guy with a lot of time on his hands. He is on the property? No worries, politely ask him who he is working for. If he does not list a business or tenant on the property you are overseeing inform him that he is on private property and recording isn't allowed. This is where this usually ends, most people just leave.
- 5. It didn't end, he didn't leave, and he is continuing to record. Oh boy, now you have paperwork to do later. Ok, again no worries, take a step back and contact backup if you have it. With the correct information, inform them of what is happening, do not exaggerate. The guy is refusing to follow your request to not record on private property that has a policy against recording. Inform him that you are now directing him to stop recording or to leave the property.
- 6. He decides to disregard you, that's ok no reason to get worked up. If you have backup on the way great, if not just be cognizant of your lack of backup. You now directly ask him to leave the property. He decides to decline, inform him that you are now going to contact law enforcement to have him trespassed off the property.
- 7. At this point, if you do not have backup do not wait around, do not debate further, do not engage in conversation, move back at least 100 feet from the subject and while maintaining visual of him contact your local law enforcement. At this time make sure that you already have a good description of the individual. If you are able to safely do so begin recording him for potential evidence and future use.
- 8. If at #4 they haven't left this is where the hard headed ones usually do. They don't typically want contact with the police.
- 9. He hasn't left and is continuing to record. That's fine, maintain a safe distance and continue to maintain a good visual. The 911 operator may stay on the line with you, if they do just update them of his status every so often or upon a request to do so. For example, maybe he is walking west on the property towards a store.
- 10. When law enforcement arrives, make your presence known to them in a safe manner. The Operator should have asked if you are wearing a visible security uniform, always describe what you are wearing to the operator so police know who to look for. For example, blue polo with security on it and black slacks.
- 11. Inform the officers what the individual is doing and that he has refused to leave private property upon request. Inform the officers that the property manager or owner would like the individual trespassed. If it is a single building provide the address to the officer that he is to be trespassed from as well as a name of the address. If it is a business center or plaza inform the officer that the he is to be trespassed from the entire property, for this provide the address and suite numbers, for example Gold Plaza, 123 Main St. Suites 1-50, the entire property, including the parking lot and all businesses herein. It's more of a pain for the officers but it can usually be done.
- 12. Incident over, now you have paperwork to do and a property manager or owner to call. Back to your patrol.
Simply if they are on public property or not hurting anybody I don't worry. I might make out a report, but that's it.
Why These Filmmakers Are Our Best Chance To Change The World For The Better. The movement to film public servants doing their jobs is a movement on the right side of justice. We need to explain to public servants, while they are being filmed, how this will keep themselves and their loved ones safe. Most evil things are done outside of the light. When these filmmakers bring light, they bring safety to everyone in the light. When someone films an encounter between a public servant(P.S.) and a citizen, all parties are protected. P.S.s have been protected when a third party has filmed an encounter and the film proved the P.I. was in the right. But the filmmakers should not have a hostile attitude from the beginning. If they calmly explain to P.S.s the good that comes from their filming and that only P.S.s doing wrong would want them not to film, then the P.S. should support filming. Remind them that the minority corrupt and dangerous P.S.s are a danger to their loved ones as well. Tell them filming P.S.s as much as possible, not only protects everyone, but it also exposes the P.S.s that are strongly against filming because their wrong deeds are done easier in darkness. Many honest P.S.s may wrongfully assume that the filmmaker is trying to bust honest P.Ss on technical infractions, assure them that this is not your intention. Filmmakers should talk to P.Ss as possible future teammates on their quest for openness, light and safety. Then after all of this is explained, the P.S.s that still don't support filming are probably corrupt. Then tell them to "kick rocks" and expose them on TH-cam so we know who the dark agents are, and we can work to get them out of their positions of power. But if the filmmakers change their mentality, they can recruit honest P.Ss to their cause and really change the world.

I've taught various aspects of private security for a lot of years. None of these people were ever in any of my classes. Walk up on somebody into their personal space is a damn good way to get hurt. He better go back in, if anything happens, at all, the security company he and Chevron all have wonderful houses you can live in.
