    How does a Power of Attorney come in use to register a Relinquishment Deed ?
    Stamp Duty differs for every State. Every state has different laws for payment of Stamp Duty and Registration Fees.

    Mam just subscribed to your channel... Good info provided... In the case of Joint owners (Spouses), Flat 'A' Husband is 1st owner Wife is 2nd owner, Flat B Wife is 1st owner, and Husband is 2nd owner. In this scenario, the Joint partners are 50% owners in each flat. So how does one relinquish/realise their Portion in favour of the other amicably? Will this avoid complications while selling the property? In case they have different views on their inheritance.

    Hi Mam, we bought a land of 1 acres in 2010 from Persion C. But unfortunately I got a lawyer notice regarding fake sale from person A. Actually in 1997 land owner(person A) gave the power of attorney to one person B. Unfortunately land owner death on 2002. Person-B sold the land to Person-C on 2003 using that void power of attorney. We boughy that land from person C at 2010. But I got a notice from person-A legal heirs now. What I need to do ? Person A legal heirs saying.. they don't have knowledge at the time.. he was age 5 on that time.. now he is the major. How can I keep that land with me ? I don't want to loss that land ?

      When you purchased the land, there must have been a chain of agreements of previous sale. You must have checked before buying the land.
      Power of attorney which was used to sell the land was not valid, as the main owner who gave the power to sell had died.
      you can only take a defense of being a bonafide purchaser who purchased the land in good faith.

      how to draft a deed where , there are five brother . and out of which three are giving there share to two brother . hence 1/5 was earlier part , for each brother now 3 brother are executant and they are releasor , two brother are benificary now with 1/2 - 1/2 share of property . kindly send me details how it will execute. as i want to prepare the deed my self

      But Register nahi hai.
      Or Principal ने all property sale right holder को दे दिये है।
      Yeh condition hai.
      A प्रिंसिपल है और B होल्डर है और 1990 (GPOA) दी थी B को । और B ने C को 1997 में sale deed करदी थी। अब C पर्सन D पर्सन को sale deed कर रहा है । और D पर्सन में खुद हु।
      और यह right way है कि नहीं। ओर future में कोई case तोह नही होगा। legal है किया illegal ।Please solve Problem

    Hello mam, I just subscribed to your channel. I need a small clarification please.
    An ancestral property is shared between 4 brothers after fathers death & these brothers has one sister whom which they haven't considered during partition.
    Now 4 brothers are separated & not in good terms.
    Now only one of them wants to get release deed from his sister for the part of the original property which he has got from partition.
    Is it possible to get a release deed done for limited part of property which one brother has received?

      Inherited Property rights can be transferred only when the testator has died. Inherited rights cannot be used unless the property is actually transfrerred in your wife's name or before her father dies. Your wife if wants to release her rights, can do so onl after her father's demise.

      Unregistered property ? All properties need to be registered with the nearest sub regisrar. Unless the ownership is not confirmed property cannot be transferred through any mode.

      Huge Difference !
      Gift deed is used to transfer ownership of any property to anyone need not be inherited property,
      whereas relinquishment deed is will include only the names of the legal heirs eligible for the inherited property. through relinquishment deed, one cannot transfer ownership to any person, its just to surrender or give up one's own rights in "inherited property"
      this is the basic difference, though there are many other differences

      Property if located in Maharashtra, power of attorney to sell the flat has to be registered before the sub registrar.
      agar aap khud (owner of the property), sub registrar ke samne jaaker, power of attorney ko register nahi karwaya toh aisa power of attorney valid nahi hoga.

    We are total 4 children to my father the property is in my father's name and my father died 10 years back and the property is not divided yet .is it possible to gift my portion of property to my sister .Because it is not divided, should we first partition the property in to 4 parts and difine the boundary of divided property and then gift my portion to my sister.pls tell me ,is it necessary to divide the property first then gift it.       Property can be partitioned by executing a partition deed. If there is a dispute between the family members, it is better to partition the property and then gift individually.

    Can you pls answer this question:
    I am from mumbai maharashtra and i have reached a lawyer recently for POA and gift deed but it is not going as planned.
    Every time i visit to collect the final papers lawyer changes terms i.e ask me to add more documents or create more affidavit or will deed. And also the charges wrt each service chances on his demand. Thus what to know the following.
    What is cost of registration of gift deed and power of attorney?
    So that i can ask him to negotiate.
    Also note his fee structure is draft he charge some amount and registration he charge seperately.
    So can you tell me market standard.

    Can a "Releasor" give up a part of inherited property. For eg. After death of father elder brother is adult but younger brother is minor so property got transfered to elder brother but now as younger brother became adult so elder brother wanted to give part of yonger brother to him. Can a Elder brother execute release deed?

    A real case please guide. Agriculture property is situated in Uttar Pradesh. Three owners live in maharashtra and fourth owner living in Uttar Pradesh. So, please advise can power of attorney or deed's can be execute in maharashtra as the three owners did not wish come in UP.

    Hi mam
    kindly solve the below query regarding partition of ansestral property.
    My father had 3 brothers with my father being the eldest. Now me and their respective sons want partition of the ansestral property except the younger one. Though the rest 3 parties only want their respective 1/4 share and not any share of the above mentioned younger brother. Can you let me know the procedure for the partition in case when one party is not ready to take his share of ansestral propery with some hidden intentions and others also don't want more than their respective shares. Can we go with the following options:
    Appoint a custodian and give his share to him. If so, under which rule and procedure.
    Or any other legal option available for out of court settlement with due procedure and legality, so that in future no litigation is attracted.
