    The one im seeing more often is asking when you graduated from high school. Its one of those *questions that won't allow you to continue the online application without answering it.

      probably so they can do the math and figure out about how old you are. then they can push you aside for younger and cheaper.

    I'm always intrigued by the fact that employers aren't allowed to discriminate based on race, sex, age, handicap, etc., but they are permitted or required by law to ask the questions that identify this information. Why is it needed? Just curious.

    Chances are, you are not getting the job if you continue to tell the interviewer "that's an illegal question"

      Luis Mendoza- true. It’s a hard position to be in. You can be right in not answering but you might be perceived as difficult...likely you’re not getting the job.

      True. You be labeled as "hiding something" or "difficult to work with", even they know they are crossing the discrimination line.

    I loved the way you systematically broke down the process of answering illegal questions.
    A major challenge occurs when in your country these questions are not considered illegal and discriminatory quesstions are common. It can actually lead you to lose the job if you refuse to answer.

If you're asked questions that are technically not illegal but are discriminatory in nature, then be sure to ask them to clarify how this will relate to or impact your ability to do the job.       True. I have worked as a Recruiter in Brasil, and there are no illegal questions there,but now that I'm in the UK I've had to learn quickly what these questions are.

    JT, have you seen the "Disabilities" portion of the application process today? Among the conditions listed are diabetes, cancer, depression. The answer options are: "Yes, I have a disability (or previously had a disability)," "No, I do not have a disability," or "I do not wish to answer." This appears to be discriminating. Would you provide some insight for this?

      True! I've seen this as well. It appears also to be violating the HIPPA rules of requesting disclosure of an applicant's private patient medical information with this LONG list of ailments they want you to acknowledge you may or may not have. Again, what does that have to do with whether the applicant can perform the job. Discrimination is real and they do it in "sneaky, subtle way" during the interview to "weed out" people. I've heard people say these things when they went for jobs. Sad.

      I have heard both sides of the issue on how to answer that question. I wish I knew how to answer. If you check the box that says “I don’t wish to answer” it kinda sends the message that you are hiding something from them. However you cannot _prove_ that they’re asking a discriminatory question!

    I’d rather answer than not. Not answering is guaranteed to take you out of the running (even though you’ll never get told that’s the reason why) while answering may give you a chance. Just my opinion.

      We would definitely say trust your gut. If you feel like you'd have a better chance answering any illegal questions you're asked, then go for it. Just be sure the keep the tips that JT discusses in this video in mind. :)

    I can definitely relate It's insanely true someone mentioned "what are you currently making"? That is a great one and tricky question.
    I've been waiting tables since 1999. The industry is hard and competitive and most people don't understand the abuse we have to take from staff also guests. The process of applying for a restaurant job the hospitality industry is like a "casting call" and they do ask most anything they want. They want a picture with Resume is another one I love.
    I don't have children but "what are you looking to make" just jumps at me never realized it's illegal, do they think your wasting their time or never waited tables?
    The management can cut your shifts to save money no one to protect you. Career-wise much success but overall more sadness wanted to move into management. I've worked high end corporate to smaller 30 employee's but the industry has changed most have no HR department either suck it up or go to a Manger.
    Now that this Covid epidemic made me re-think everything. I'm in the process of changing my career not even in Phase 1 yet :/

    Very good information. Recently, in two interviews the hiring manager inquired about my family and kids. As much as I tried to dodge that politely, they eventually got some answer out of me. I did end up saying yes I have a family and ended up just there. Some managers asking such questions so have a reason behind it like how many dependents does the candidate have, is a/he married, will this be an interference to candidate’s working hours, taking time off, etc. Other angle can be how many people will be having benefits when hired. One more thing they ask is number kids and how old are they. This is way to figure out candidate’s age range. On the other hand a single man or woman interviewing for the same position may have a better chance to get it but also more susceptible to be looking other opportunities and switch jobs quickly. It all depends what the motive is behind all those illegal questions.

    During the job interview, the manager asked "Where are you from?" I replied "isn't it illegal to ask me where I'm from?" . The manager persisted but I held my ground. I did inform the manager that I am authorized to work in this country.

    I recall being asked, during an interview, when I was young and fairly naive yet a feminist, I was asked whether I had a family. Taking stock, I looked the guy in the eye and said, I have no commitments that would not allow me to do my job or take on overtime with reasonable notice. I went back to my agency and my rep told me they were interested in me "anyway." Thus, my question is - have times changed really? Or, will the person who points out the problem lose points? Thanks for the video, at least I know I'm not crazy !!

    JT- It really depends on the context you place this in. Sometimes the companies are also trying to assess whether there would be a higher expense of lodging, relocation depending on the size of the family etc, with that question. At the end of the day it is a cost to them. So if they are getting a competitive talent on lesser cost, its absolutely understandable. Yes absolutely the choice of answering it is of the individual.

    Some recruiters ask these types of questions which is ridiculous, like they would like to get to know me on a personal level, not even have much idea as to where they should be placing you for interviews, as far as job functionalities, skill sets, etc.

    Asking if you have any kids could be a innocent question(illegal) but even if it is innocent, it will still be used in the hiring process whether it is meant or subconsciously. I would say "I have a family, do you? Never go into detail and turn it around so that you use it to connect to the interviewer. People love talking about their kids.

    I had a digital interview recently that was contingent on completing a "voluntary", but still required Predictive Index Survey loaded with age, race, gender questions that I had to complete before being able to compete for the company's open position. I thought it was rather strange to say the least. Are some of these company's posting job openings to data mine peoples information and re-selling it to third parties to help put dollars on their bottom line? Thanks for your time JT ! = )

    A Texas Workforce Employee, a job search trainer, was asked in her initial interview how old she was. She gave a great big smile, added a twinkle in her eye, and replied, "How old would you like me to be?" She got the job!

    I involuntarily told the interviewer I had seizures in the past but that I was seizure free almost 2 years, she asked what to do in case,,, blah blah blah... But then said something odd to me. " I hear weed is Good for that",, i was like hmmm no I don't take drugs medical or not. That was the oddest remark I ever heard in an interview!

    I was just asked my date of birth on the application. No place to respond with anything other than the birthdate and can’t continue on if you don’t respond.

    It is very frustrating when you face that kind of situation.
    Funny, but seriously I am thinking about how fair is if you say: "a minute, please, I want to record our conversation in my smartphone", then ask to repeat the question, due to the fact they probably believe is fair to ask illegal questions.

    Thank you for this video! And for all the videos you make! I had to answer illegal questions during my job interviews before and I must say I felt really uncomfortable answering for example
    When are you planning to have your children? (Sounds almost like I had to provide them with my ovulation calendar)
    So now I have children and writing down the phrase you said about having children. :)

    You know that NO interview questions are actually illegal, right? The part that's illegal is rejecting a candidate based on information you gather from questions about marital status, religion, etc. That means the best practice is not to ask questions about religion, etc but it's not illegal to do so. You might consider revisiting how you've framed this.
