I had cops stand on my porch once for over a hour while other officers were securing a search warrant . They finally arrived with the warrant and then destroyed my front door and roll up door on my garage. It was pretty destructive the way they entered and then placed me in cuffs at gunpoint and then started cutting open my gun safe as well as a floor safe in my bedroom. They were tearing my house up looking for drugs and cash as well as firearms. Finally they discovered they were at the wrong house. I tried to tell them they had the wrong house from the beginning. But they had no interest in the effort required to verify the addresses. I won a judgment of $71 ,891 for damages after a 5 year court battle
I wish law enforcement and the judges could get much more easily removed for this kind of cataclysmic failure. Qualified immunity .. most urgently needs to be significantly scaled back for the people.
Key phrases: "I do not consent to any searches or any seizures." "I want a lawyer immediately." "I do not answer questions." "I am invoking my right to remain silent." "Am I being detained, or am I free to go?"
Plead your 5 th and 6 th, don’t ask me any questions without my lawyer present. Consent to nothing, then go silent. At that point they have 20 minutes to fool you into talking. Just wait it out.
NOTE about CONSENTING to search your car: I’ve heard of case where owner sued Police for damaging his car while they were searching it. The judge responded with “You gave up your rights when you consented to the search of your vehicle so you can’t sue for damages”. So that's another reason not to give a consent.
This is great information that I had to learn the very hard way. Short story: I was the driver of my gf’s car and she was in the passenger seat. Got pulled over by the sheriff on the claim I was going 30 mph over the speed limit. I had cruise control set at 5 mph below the speed limit because of all the potholes. I had to handguns on me I legally owned. When I went through a handgun safety class the old man said during his presentation “if you get pulled over and have a gun on you. Do the right thing and let the officer know immediately upfront.” Not knowing any better, that’s what I did. The sheriff Immediately pulled me out of the car, took my gun and then began searching the car (with my consent thinking I was doing the right thing) 3 hours later, 6 city officers, 2 K9’s and a completely destroyed vehicle, I end up in handcuffs getting hauled to jail with 2 felony charges. The sheriff claimed he found a few flakes a weed on the floorboard of the passenger side. Interestingly enough, in court, there was no way for the lab to retest the substance. Do everything this man says. I will never ever ever willingly let ANYONE know when I have a weapon on my person. Cop or not. Stay safe, folks
Thanks for sharing. My intuition always lead to me not disclose that info to the cops whether I had a firearm on me or not. I believe alerting them of a weapons presence, causes cops to act even more eradict than they already behave. This alone confirms my belief that it's better not to let them know that you possess a weapon because their belief is that a firearm is power and they want all the power in most situations💯
This man is 100% correct about them tearing your car up. When I was 17, I consented to a search, and the officer yanked wires out of my amplifier, breaking the terminals, ripping the wires and RCA cables, flipped my subwoofers over on their face, puncturing one of the foam surrounds on the subwoofer, ultimately ruining it. I called the police department and they asked "did you consent to the search?". That was the end of the it. I consented. I've never consented to another search since then.
Tru Dat. I worked with a guy who had his whole RV torn apart because he gave consent to a search. The cops pulled out everything, found nothing, then left him sitting on the side of the road with a big pile of a mess.

The fact that the police can rip an innocent persons car completely apart, possibly destroying your property/car, for "suspicion" is insane and need to be treated like the crime it is.
And the Police are under no obligation to restore your vehicle to "pre-search" condition. They can, and do, leave it just like they made it, seats out, seat covers off, compartments emptied, etc.
Happened to a friend, friend got stopped supposedly for going a little fast, Officer asked where friend going in such a hurry, friend said I need to get my pot home, officer completely shut friend down from further explanation and commenced with a thorough search of vehicle , friend remained quiet 😂only to find NOTHING! Friend had potting soil! The Officer only heard pot! My friend is an Attorney!
I was stopped while carrying here in NH and the officer asked if I was armed. I told him I was, what I was carrying and where, and told him I would comply with however he wanted to handle things. he smiled and said, "how about you don't show me yours and I won't have to show you mine?" I agreed. Verbal warning for speeding, no muss, no fuss.

I work Search and Rescue and have a CCW permit, and if I'm working a crime scene or formally sanctioned search with law enforcement present, I just let them know I'm carrying for safety, and no one cares. Even if they did, I'm fine with showing my weapons. I train and handle working dogs, and those you can see plainly. I don't see the difference. In a traffic stop, the first thing I say is that the dog loose in the back end is trained to prevent him from reaching his arm into the vehicle, and then that I am carrying.

A gun threat was reported at my daughter's elementary school. My daughter was named as part of the group walking during PE when this was "supposedly" said. The city police showed up at my house and demanded to see my guns and said that my daughter couldn't come back to school until they saw them. Turns out after speaking to all parties involved it never happened and was all over jealousy about a boy and my daughter had absolutely nothing to do with the conversation.
So this is a case of being "Swatted" right? Tell us more. I can see where the police could claim exigent circumstances to gain access but by the same token, the police visit is based on hearsay. So it comes down to whether the cops have the nerve to push it and possibly force the door. Very dangerous situation to be sure.
This is an excellent video. I learned at a young age that if an officer is asking you, in any way, if they can search you or your vehicle, they do not have the probable cause to do so. If they have solid probable cause that will hold up in court, they aren’t going to ask. They’re asking for your consent, and you should never give it. In the event that they begin search without asking or getting your consent, you must still make it clear that you do not consent before they begin the search. The point on the 6th Amendment right to counsel is also important. Every time I have made it politely clear that I am very well aware of my constitutional rights and I will fight for them with representation, I have been left to go on my way. Cops don’t like their authority challenged, so politely is key, but they also don’t like to have to defend their criminal behavior in court. And remember, your Miranda rights clearly state that anything you say, can AND WILL be used AGAINST YOU in a court of law!
Being aware is the vital first step but being willing to stand up for them is the vital second step. Its one thing to know a cop is violating your rights, it's another to stand up to them. A comment above is from a guy that had his rights violated while he got some restitution in the end, it cost him five years of court and grief. People get in the situation and think, nah, easier to just bend over now and try to forget getting screwed with therapy.
All of this at the foundation goes against the second amendment. It says the right to bear arms SHALL NOT BE INFRINGED UPON. All of these classifications and forms, the tracking the record keeping all infringe upon that right.

In the states I travel to, as a CWP holder, I am required to state that I am carrying at the point he asks for ID. Never had a problem. Funny thing, a traffic stop in Florence, AZ, the cop stated that city policy required him to take my gun until the stop was over. I carried a 1911 cocked and locked. He struggled with it for 8 minutes before his supervisor showed up. He wrestled with it "trying to make it safe". When they finally got the actoin open, the chambered round fell onto the floor of the cruiser. After a warning for speeding, which I was doing, they returned the cleared gun and magazine. Several days later, I heard from a friend who lived there that the cop who stopped me was in trouble for having "unaccounted for ammo" in his car.
The outcome with the unaccounted for ammo is funny! That said, I am concerned about inquiries on guns, or weapons, when I am traveling about. I'm retired and accumulated various guns over the years, which a several ownerships prior to my possessions. I transport custom pistols and rifles of significant value and worry about any Officer ever stating, "well, I got to check these to see if they're stolen?" I;ve started carrying the purchase receipt for the very common pistol I now carry for self defense; that's how nervous Offical overstep concerns me!
I didn't know Florence had a police department. It's such a podunk town, I've only seen the roid apes from the Pinal County sheriff patrolling, and I wouldn't be surprised by anything stupid they would do.

Back in the mid 70's. I did work at the border. I had no idea of protocol so I asked. They told me that I would have to leave my vehical and an agent would take me to the work location. When I got back to my vehical, doors wide open, tools scattered on the ground, pappers were blowing around in the wind, and my car seats were stacked up outside my vehical. I was in shock. They tore my car apart, they did not give explaniation and would not help me put it back together. I was furious. Im here doing work for you and you destroy my car ! I called my boss, he came to the site and said we will never be doing work for them again. He also paid me for the time and parts to put my car back together.

That's a hard sell -- if door is open, they may present you from shutting it, and callng a Sherriff/Lawyer WHILE in a stop situation would only be an aggravation. I'd like to know what Esq. Jeff thinks about making declarations on 2A rights, even 6A rights, and asking for the officer to call for a Sherriff (or PD if the Sherriff conducted the stop). It's like I've seen many times, folks demand the officer to provide their name/badge, and request for a supervisor (makes sense if you're a woman and don't want to be searched by a man, etc.)

First, if the cop starts getting aggressive because its obviously not going his way, you should tell him, if we cannot have a normal conversation between 2 adults, then end everything right there. The cops have no right to talk to you if you don't want to, doesn't matter what they claim.
The goofiest recent thing in legal circles is you cannot exercise your right to remain silent by being silent. You must verbally advise you choose to remain silent. You must speak, to stay silent. Staying silent is now obstruction.
This only applies to voluntary interviews. Miranda still is required if there is coercion. And they can't compel you to speak, they can just comment on your silence at trial which is normally an absolute no go. Not legal advice but a simple primer.
Not accurate. You can just be silent. It can be considered 'suspicious' if you're talkative until they ask you about a specific thing and then you go silent, according to the Texas case that created that precedent.
If I’m in my home and he doesn’t have a warrant tell them they are trespassing. If you get pulled over by a cop do the following: 1st Invoke your 1st Amendment Right to Film as a member of the press. 2nd Invoke your 5th Amendment to answer any questions without the presence of your attorney. 3rd Invoke your 4th Amendment to inform the cops that you refuse any and all searches. Some states have a duty to inform, or a duty to inform when asked if you're carrying a firearm when they pull you over. In AZ, they can even 'hold' it for the duration of the stop.
When you purchase a home - consider the porch area... My current home has a fully enclosed porch with its own set of exterior storm and inside doors which are always locked as is the inside door to the house proper. When I go to answer the door I close the inside door and never unlock the outside storm door. No foot in the door, no chance for home invasion, and no open area to see something suspicious to establish probable cause! If your home doesn't have the same arrangement consider adding the enclosed porch - at very least, install an exterior storm door that remains locked even if you open an inside door.
It's great advice - put as many barriers as possible between the inside of your home and the outside world. But unless I'm expecting someone or it's someone I recognize, I simply don't answer the door to strangers no matter what type of outfit they have on.

I went for a home set well back off the only road into the area (only home on the street) stone and mortar fence line backed up by six acres of hedge maze, gate house with armed private security (all of whom I know and trust and pay well), private drive to main house, blast proof doors, bullet proof windows blast louvered shutters quarried limestone block walls, roof is gabled to a fare-thee-well with many covered hides along roof line. But I've been thinking lately, all that might not be enough. So I'm wondering if it might be worth it to install a murder-hole at the front entrance. Just in case. Thoughts?

Yes, thank you very much for the information! I have only been stopped by officers three times in my lifetime (I'm in my 60s). Once for a headlamp out (actually just very dim) and that officer was very polite and professional and let me off with a verbal warning. I replaced it the very next day. Don't ask for trouble! Once I was stopped in New Mexico and they said I was speeding, which I was not. I didn't argue, I looked over the ticket and it said that if I didn't sign the ticket that I would be taken into custody. I was passing thru that state with my cousin on the way to get some of his belongings. The last thing I wanted (or needed) was to go to jail on a three-day weekend trip! Did my out-of-state license plate encourage the LEOs to enrich their county at my expense? I think so but it would have cost me a lot more time and money to fight it in court so needless to say I found another route back! So I've gotten only two tickets, one for the New Mexico speeding ticket (undeserved) and the other was for parking on the wrong side of the road which is ridiculous since that is why a vehicle has rear-view mirrors. County governments are always finding ways to enrich their coffers as well as their pocket books, I have no doubt!

@@tomnisen3358 Yes it's true that if you don't already have a lawyer or can't afford one then you can get assigned a public defender, however you should know that public defenders are often fresh out of law school with little experience and its pretty certain they didn't graduate anywhere near the top ot their class. Technically you'll have legal counsel, but the real question is how competent and committed they are to aggressively defend your rights. This is the unfortuate reality that folks who aren't well to do will face when they go to court.

I was stopped on a highway for speeding and the state trooper asked if I minded if he searched my vehicle. "Of course I do !", I told him a bit resentfully. I think my answer sort of surprised him because I was assertive and didn't hem and haw about it (this was around 1982). When he asked why I minded so much I answered "Because this is America and we have a Constitution, and I swore an oath to protect and defend it (I was in the Army at the time). I was stopped for speeding and now you want to search my vehicle with no crime or warrant, so I do mind if you search it." I don't know how he felt about my words, but I was respectful overall, and didn't swear or cuss him out. He told me about drugs being shipped in cars with out of state plates and then handed me my ticket and I was on my way. He was smiling as he turned and walked away, so it didn't go too badly.

When you remind them they need a signed warrant to enter your home the cops get pissed and force their way in and arrest you for obstruction for not complying for letting them to come in to beat the shit out of you and to violate your rights.
First things first. Always look through the peephole and ask who they are before you open the door. Second, do not open the door for strangers. Especially not for the police.
I just don't answer the door for anyone that's not been invited. Once I see/hear them leaving then I may choose to open the door depending on who it is.

What you forgot to mention is the logic behind the "consent to search" question. If they ASK for consent to search it means they DO NOT have probable cause to search.
I asked for consent hundreds of times when I had a warrant on me. That’s done in case the search warrant gets thrown out for whatever reason. Which happens more than you think. So if you give consent, that’s just an easy way to avoid the legal issues that may be identified by a sharp attorney to get the warrant thrown out, and everything they found under its authority, isn’t admissible. But if you give consent, you just took a potential avenue of attack for your lawyer. Never consent, don’t be aggressive or argumentative, and stay calm. Jeff nailed it on this one.
Well normally they won't even ask. They have all sorts of tricks to make the average person think that they DO HAVE the right to search it because they can say they smell alcohol of weed or some bullshit. They can also say they saw you reaching for something so like he said, make sure you stay nice and still from the moment you see those lights. Also, the best thing is to make sure you have NOTHING in your vehicle so if they DO pull their bullsh!t and find nothing, you got them on illegal search and multiple violations of your rights. Oh, and DEFINTIELY make sure you have no open alcohol containers. If you are returning 15 bags of empties at the end of a good summer party month, make sure you have no alcohol on your breath or in your system too. Then make sure none fell out and rolled under you're seats that might appear one night if you get pulled over after stopping for a beer after work.
That is not always the case. Sometimes, especially if it is a traffic stop, they are trying to save you and them some time. They can detain you until they get either a warrant delivered to the site, or a drug dog to arrive to walk the car. This can take a couple of hours or so. It is situational. If you have time, just wait, if not let them look and be on your way.
@justobserving170 nope. Not an accurate statement the SCOTUS has ruled on several occasions that on a TS u can only detain someone for a reasonable amount of time I.E. The amount of time it would take to do the business of writing a ticket(s) so if a K9 Is an "hour" away...not reasonable
The biggest problem is the immunity given to police and other officials. Why should they not be held accountable for breaking the law just because they do it on duty.
Thank you. I live in Mississippi & have a advanced Conceal carry permit. I was not paying attention to the speed ( 45 in a 35 ) passed by a unmarked police vehicle. He lighted me, we knew why he stopped us, we were smiling, gave him my license which returned a 1023 meaning license to carry. This guy was cool, told me to be more careful & said he loved people who carried guns.

Many places in Michigan if you say you don't consent, they will bring in a dog and say it hit. This has been done to me several times. I do not use or transport drugs and have never had anything found during a search. It felt as though by denying consent many officers get upset because how dare you deny them.
Someone I know wink wink and his friend got pulled over just as his buddy lit up the blunt. His friend freaked out and put it out and threw it under the seat. The cop walked up and wanted to search. He denied and they brought the dog. Dog somehow didn’t hit on anything 😂. Someone I know got lucky that night.
That can be used as a defense in and of itself. If they make you wait for a K9 unit, unless it's nearby, that is unreasonable extension of the traffic stop. This does have some precedent, but can go either way based on the circumstances.
@@GReaper if you watch On Patrol Live, they make people wait on K9s all of the time. A few weeks back they walked a dog around a man who had been riding a bike. Not the bike, the man. I had never seen anything like it until then. It was pouring rain and even though the dog did not alert, the cop lied and searched the guy anyway. They found nothing at all. It's interesting how many laws the cops will break on live TV.

Good stuff! We had a local sheriff's deputy here that was doing consensual searches in traffic stops and he was planting drugs in the vehicles of the folks he stopped. He was ultimately discovered by a sharp-eyed Assistant State Attorney that took the time to carefully review his body cam videos. The case is State of Florida v. Zachary Wester. #Subscribed

As a police officer of 20 years I have only once asked to see a persons weapon. After a self defense incident and I knew some rather gun-ho newbies were on the way lights and sirens. I advised the person of this and said if you want you can place it in your vehicle or my patrol unit. I gave them the choice and they placed it in my unit freely. This way I could put out over the radio the weapon is secured making it a bit safer for all of us. What I will say is this. I patrol a rather rural small town area. My backup is usually a ways out, with that I consider the fellow citizens exercising their 2nd amendment rights as my closest backup. Our state has both constitutional concealed carry and open carry along with concealed weapons permits class 1&2. I encourage folks to carry and love having chats about the new handgun or rifle they got and even the in-depth conversations about why they chose it or the ammo they chose and why. I am the type of cop I am because I took to heart what the lead instructor said after we passed our tests and prepared for academy graduation. He said " Be the cop that gains the public's trust and respect to where you have five people jumping beside you to back you up instead of in front of you to take you on." I will say this as a peace officer I cannot give legal advice. Excellent information. In my home State (N.C.), CCP holders are required to inform a traffic officer: "I am a CCP holder and I am/or am not exercising my right today" as soon as he approaches my vehicle." How do you (as an officer of the law) want that reply issued.
To answer your question. You stated it perfectly. You stated you have a permit along with exercising your right. The only thing I would say or add is the location of the weapon. Reason being you will be reaching for license, registration, and proof of insurance. By giving location of weapon this can ease the situation on the officers side. Especially if you get a jumpy young pup.

In the state of Oklahoma if you are carrying a firearm you are only required to inform the officer if they ask and it is illegal for them to disarm you unless you are committing a crime. The law is Title 21 Section 1290.1.

7:40 In Michigan as soon as you're pulled over if you have a CPL (CCW in most States) and you're carrying your concealed weapon on you, you have to inform the police officer as soon as they get to the window. There have been cases of people who didn't tell the police officer for maybe 45 seconds to a minute and a half and still were arrested for not following that rule. So in some cases, you have to tell the police right away when they come to the car.
I was out fishing one day and pulling my kayak out of the water. I had my Glock on me and the officer clearly saw it. He pulled up asked me how the fishing, not so good I said. Packing up and heading some place else. Never once asked me about my gun. Very professional

I love that you cover topics that other attorneys rarely cover... Rarely hear about invoking your 6th amendment rights as important as they are. By refusing to answer questions and asking for an atty, it puts you at a great advantage (as long as you remain quiet after.) It's Very important that you remain quiet, bc once you start talking again, they can ask questions which if answered, most likely will be admissible in court. I've even seen cops talk "amongst each other" close enough to the suspect for him to overhear (on purpose of course) in order to invoke a response so that the suspect starts talking again. They normally say something along the lines of hey, this is the same guy that did XYZ on abc st last week, or that's a lot of dope in the trunk, etc... since they're just talking amongst each other, when the suspect interrupts and says "no I wasn't", or "there's no drugs in the car", they can ask questions again, so stay quiet, as hard as it can be... I was pulled over several yrs ago en route to purchase baby formula. I realized rather quickly the direction the stop was going in (asking if anything illegal was in the car, etc), I invoked both my 5th and 6th, which REALLY pissed them off. I was illegally detained/searched and ultimately arrested after 3 officers falsified evidence. I didn't beat the ride, but I did in fact beat the case and now I'm suing the department with help from one of the best civil rights attnys in the country! (just turned down a 40k settlement offer last week) REMEMBER... YOU CANT BEAT THE RIDE, BUT YOU CAN BEAT THE CASE! And a bonus is getting to see them play defense while your attorney deposes them... I’m lucky to have retired in Polk County Florida. Where our Sheriff Grady Judd, is a staunch 2nd Amendment supporter, who has told me personally in conversations, that if any federal officers who inform his agency they intend to come in and investigate any law abiding citizen, they will actually be told to LEAVE NOW! Unless they have something in writing on a Federal form or Search Warrant! That even if they do they will be required to be escorted by a Deputy. If I should encounter one at my door and he/she has no warrant, first thing to do is dial 911, informing them what’s going on, then call Sheriff Judd on his cell phone!

I'm so glad, once again, to be a country boy, who lives in a lowly populated, rural area. Most of us never purchase our guns through this background system. We've all been very suspicious of these background checks, and putting our names into any systems that we can avoid from the start. Most of our firearms, on average, are a decade old, or older. Everyone I know has baught theirs second hand, and many of them have been sold and traded second hand over and over again. I wish them luck trying to track everyone's guns out here in country places like Kentucky where I live, or West Virginia, Ohio, Tennessee, North and South Carolina, Florida, Georgia, Alabama, Mississippi, Texas, Arkansas, Louisiana, Oaklahoma, Kansas, Nebraska and several others. Not one single firearm ever manufactured can be tracked to my name, and I plan on keeping it that way to. Also, Im sure law enforcement works completely different in big cities, and large metropolitan areas, but here in the country, these feds are going to find it hard to find any police, city or county, who are going to just willy nilly infringe on their citizens rights. I know for a fact, the Sheriff in my County, here in Kentucky, has said publicly he will not do anything that isn't supported under the constitution , regardless of who shows up and trying to order him, or pressure him. Yep, as a guy who doesn't generally want to cause issues and wanting to help, I was willing to talk to the police. I won't do so again. I had police knocking on my door, so I go and tell them what I was doing throughout the day as they accuse me of something. I tell my story once again, and they insist that my truck was tagged as being involved. They say "this place has a camera, will it confirm that you were the only one in the vehicle . . ." blah, blah, blah. I assumed it was an elicitation exercise or something. But nonetheless, I was getting mad. Like really, can I actually go down for some shit? And then they do this nefarious shit where they use my story when question my brother (who wasnt present during my questioning) asking if I did what they alleged or was it possible I did while engaged in what I actually did. They essentially tried to merge their story with my facts.
If they're NFA there's a form 4 with a tax stamp. And your local PD has a photocopy... because part of the process is local endorsement stating it doesn't violate any local laws to own said NFA gun...and for, air fingers quote, administrative purposes, most PD's keep a copy of all documents they endorse. So while it's NOT gun registration, it's "Gun Registration." Food for thought.

@@bbrainstormer2036 A very quick Google brings up case precedent: "In 2013, the U.S. Supreme Court concluded that a witness's silence to a question can be used against them in a criminal case (Salinas v. Texas). There, the suspect voluntarily answered some of law enforcement's questions. The suspect had not unequivocally invoked his right to remain silent" They answered some questions and then later decided to go silent without invoking their 5th amendment rights and their silence was used against them. Given this precedent was set a decade ago there are likely many examples of this happening now.
I've been pulled over 4 times since January of 2020. Every single time, I've notified the officer/deputy/trooper (yes, all three have pulled me over) that I am a CCP holder, and I am carrying. I was told that this will always put the LEO on edge and make them suspicious of you. That has never happened. The trooper asked if he could disarm me, and I agreed. The other three times, the LEOs said, "Don't show me yours, and I won't show you mine." I am always polite and treat them with respect. And I haven't been ticketed at all.

I got pulled over in 2000 driving across the U.S. (Vermont to Nevada) on my own. It was either Arkansas or Tennessee. My vehicle was plated in Quebec. I wasn’t speeding. The reason given was that I didn’t have a front license plate, which felt off to me as I had never had that issue before. The officer then moved to the passenger side window. Elbows on the window sill, arms dangling inside my car. I remained polite, never got out of my car, gave the officer my driver’s license, insurance, registration. He handed them back. He asked where I was going on my own, was I going to visit anyone, had I gone there before. He kept looking to the back seat, where there was nothing. At that point, he was creeping me out fully because I could tell he was just looking for a reason to either fine or arrest me. Funny enough, he never asked to look inside my trunk. Finally he let me go and wished me a good trip, to which I just said thank you and drove the feck off. Thanks for this info.

I got in serious trouble in my younger days. Since then I drive the speed limit, wear my seatbelt, don't drink unless at home. Been pulled over a few times. License, registration and proof of insurance are together in a little folder. No furtive movement, no small talk nor answer questions regarding their reason for the stop. Never give them any reason to escalate. Remember that bearing arms is not limited to firearms.
Officers are no longer allowed to ask you if you know why they pulled you over. They will now be required to tell the driver the reason for the stop rather than asking questions designed to get information, at least in CA. Thanks to Assembly Bill 2773 effective January 1, 2024.

Excellent Information. I truly appreciate the "Furtive Movements" advice, especially related to a Traffic Stop.. While encounters can go sideways, my experience has been to Set The Tone of each encounter early on... My personal technique for "Setting The Tone" regarding a Traffic Stop is, 1.) Find some relatively safe place to pull over. Don't drive five miles to a church parking lot, but do consider the Officer's Safety when you pull over to the side of the road. 2.) Turn the vehicle off, and turn on the interior lights ( if dark ). 3.) Keep "Furtive Movements" to an absolute minimum. ( me personally, I have my window down and my wallet in hand, with both hands on the wheel, Before the Officer exits his/her vehicle. 4.) I take the lead in opening the conversation. In a loud, clear, and sincere voice I say Good Morning/Day/Evening, how may I help you. Don't misunderstand me, what I've outlined has nothing to do with defending your Rights. This video has done a very good job of addressing that... All I'm saying is, A.) If you act in compliance right out of the gate it makes it more difficult for an Officer to feel or falsefy that they are in danger. B.) Cops are ( most ) people too, If you look out for their well-being, they will be less likely to attack your well-being. Again, please don't misunderstand me, if they want you, they will still play every trick in the book.... I'm talking about creating a clear difference between your actions and the actions of an Officer who's inclined to work outside of their authority... It can make a difference in court.

I was stopped by TX DPS the other day here South of Houston & I had my AR on my passenger seat & my Glock 19 in plain view on my dash. It was a "Ran a Red light Stop" & he didn't say anything about my weapons. He took my ID, went back to his unit & reviewed his camera. Then came back & stated, I made the light by 1.5sec & have a great day. Very friendly stop.
I also had a friendly interaction with a Trooper recently, north of Austin. I was going 5 over the speed limit or so. He asked where I was going, I told him I was going to see my son play in the high school band an hour away. Turns out he played the same instrument when he was in band. I think talking helped me avoid a ticket. He didn’t ask about any guns.
Assuming TX law is different than Florida, but here you cannot have a firearm on your dash (or seat, or under your seat, etc). Has to be in an enclosure with a lid (like a box, or a gun case, etc). Glove box or center console would suffice.

First time viewing your channel, now subscribed. Outstandingly good info. I live near McKinney and have a Carry permit. Also used to work in a gunsmith shop where we gave the conceal carry classes. Have been stopped a few times and no issues. I was told by our gun store lawyer. Mind you this was 2005 and earlier. When cop is at your window. Already have your DL and your CCW licenses out and ready to give them. Also announce if you have a firearm with you and where it is located. Never have I had a cop ask to see it or try and take possession of it. Most have said just don't move that direction or along that line. Believe it or not, there are a lot of cops that think only law enforcement and military should own or have guns. When the Texas Carry Licenses first came out. The Police Chief in Richardson, issued zip lock bags to every street cop. Saying. When you pull them over, take their gun. Here is the kicker. Disassemble it and unload the mag into this zip lock and give it back that way. Well, they pulled over a lawyer, like yourself that knows gun laws. He had a field day with them over this. Why, you hand me my ticket and a bag of parts. You drive off and now I am unprotected while I put my gun back together or if I can put it back together. In our gun shop we had a few come in asking us to put it back together for them. IMO, if you own it you should be able to reassemble it. Yet, not required. That is why there are gun shops.
One of the best tricks I have ever used is KEEPING YOUR HANDS ON THE STEERING WHEEL at all times. If you have tinted windows roll them down AS YOU ARE PULLING OVER, NOT while he is walking up to your door. When he asks for your information then politely state where it is and that you are going to reach for it and any additional moments that you are going to make such as undoing your setbelt to be able to better reach your ID and insurance. I see people all the time getting all huffy and puffy and drinking their drinks, keeping their hands down by their legs where the officer can't see them while fidgeting and im like are you trying to get shot?
Correct me if I am wrong, they aren't allowed to "keep track of" who owns what weapons. I'm fairly certain the SCOTUS ruled on a case and made gun owner registrations illegal.
I live in MD. About 6 years ago during hunting season. I was pulled over for having a blown 3rd light (that red light on the back of a truck above the cab). So, I opened the glove box to get the registration. I was hunting 6 hours earlier. I had shot gun shells in the glove box. Tho officer didn't say a word. About 90 seconds passed, and out of nowhere, 9 other cops and a helicopter showed up. They run up on me and torn me out of the truck. Tossed me to the ground and stood on my back repeatedly asking for the gun. But I had already put it back into my safe at home. They didn't believe me and torn my truck apart. So I only asked one question: What if I had a gun? It's hunting season. They didn't answer. So they had me for over an hour and didn't find a gun. They let me go by just leaving me. At night, I got in the getto (Baltimore) with my property in the gutter, and it was dark. I felt really protected and served.

@LouisMihai I asked the cop about 6 times, "What if I did have the gun?" he didn't answer. I called his Sargent and asked because I was going hunting the next day and would have the gun with me. I had cops stand on my porch once for over a hour while other officers were securing a search warrant . They finally arrived with the warrant and then destroyed my front door and roll up door on my garage. It was pretty destructive the way they entered and then placed me in cuffs at gunpoint and then started cutting open my gun safe as well as a floor safe in my bedroom. They were tearing my house up looking for drugs and cash as well as firearms. Finally they discovered they were at the wrong house. I tried to tell them they had the wrong house from the beginning. This is great information that I had to learn the very hard way.
Short story:
I was the driver of my gf’s car and she was in the passenger seat. Got pulled over by the sheriff on the claim I was going 30 mph over the speed limit. I had cruise control set at 5 mph below the speed limit because of all the potholes. I had to handguns on me I legally owned. When I went through a handgun safety class the old man said during his presentation “if you get pulled over and have a gun on you. Do the right thing and let the officer know immediately upfront.” Not knowing any better, that’s what I did. The sheriff Immediately pulled me out of the car, took my gun and then began searching the car (with my consent thinking I was doing the right thing) 3 hours later, 6 city officers, 2 K9’s and a completely destroyed vehicle, I end up in handcuffs getting hauled to jail with 2 felony charges. The sheriff claimed he found a few flakes a weed on the floorboard of the passenger side. Interestingly enough, in court, there was no way for the lab to retest the substance.
Do everything this man says. I will never ever ever willingly let ANYONE know when I have a weapon on my person. Cop or not.

I believe alerting them of a weapons presence, causes cops to act even more eradict than they already behave. This alone confirms my belief that it's better not to let them know that you possess a weapon because their belief is that a firearm is power and they want all the power in most situations💯

This man is 100% correct about them tearing your car up. When I was 17, I consented to a search, and the officer yanked wires out of my amplifier, breaking the terminals, ripping the wires and RCA cables, flipped my subwoofers over on their face, puncturing one of the foam surrounds on the subwoofer, ultimately ruining it. I called the police department and they asked "did you consent to the search?". That was the end of the it. I consented. I've never consented to another search since then.

The fact that the police can rip an innocent persons car completely apart, possibly destroying your property/car, for "suspicion" is insane and need to be treated like the crime it is.

I was stopped while carrying here in NH and the officer asked if I was armed. I told him I was, what I was carrying and where, and told him I would comply with however he wanted to handle things. he smiled and said, "how about you don't show me yours and I won't have to show you mine?" I agreed. Verbal warning for speeding, no muss, no fuss.

Same. I work Search and Rescue and have a CCW permit, and if I'm working a crime scene or formally sanctioned search with law enforcement present, I just let them know I'm carrying for safety, and no one cares.
Even if they did, I'm fine with showing my weapons. I train and handle working dogs, and those you can see plainly. I don't see the difference. In a traffic stop, the first thing I say is that the dog loose in the back end is trained to prevent him from reaching his arm into the vehicle, and then that I am carrying.

A gun threat was reported at my daughter's elementary school. My daughter was named as part of the group walking during PE when this was "supposedly" said. The city police showed up at my house and demanded to see my guns and said that my daughter couldn't come back to school until they saw them. Turns out after speaking to all parties involved it never happened and was all over jealousy about a boy and my daughter had absolutely nothing to do with the conversation.

So this is a case of being "Swatted" right? Tell us more. I can see where the police could claim exigent circumstances to gain access but by the same token, the police visit is based on hearsay. So it comes down to whether the cops have the nerve to push it and possibly force the door. Very dangerous situation to be sure.
This is an excellent video. I learned at a young age that if an officer is asking you, in any way, if they can search you or your vehicle, they do not have the probable cause to do so. If they have solid probable cause that will hold up in court, they aren’t going to ask. They’re asking for your consent, and you should never give it. In the event that they begin search without asking or getting your consent, you must still make it clear that you do not consent before they begin the search. The point on the 6th Amendment right to counsel is also important. Every time I have made it politely clear that I am very well aware of my constitutional rights and I will fight for them with representation, I have been left to go on my way. Cops don’t like their authority challenged, so politely is key, but they also don’t like to have to defend their criminal behavior in court. And remember, your Miranda rights clearly state that anything you say, can AND WILL be used AGAINST YOU in a court of law!

Being aware is the vital first step but being willing to stand up for them is the vital second step. Its one thing to know a cop is violating your rights, it's another to stand up to them. A comment above is from a guy that had his rights violated while he got some restitution in the end, it cost him five years of court and grief. In the states I travel to, as a CWP holder, I am required to state that I am carrying at the point he asks for ID. Never had a problem. Funny thing, a traffic stop in Florence, AZ, the cop stated that city policy required him to take my gun until the stop was over. I carried a 1911 cocked and locked. He struggled with it for 8 minutes before his supervisor showed up. He wrestled with it "trying to make it safe". When they finally got the actoin open, the chambered round fell onto the floor of the cruiser. After a warning for speeding, which I was doing, they returned the cleared gun and magazine. Several days later, I heard from a friend who lived there that the cop who stopped me was in trouble for having "unaccounted for ammo" in his car.

They told me that I would have to leave my vehical and an agent would take me to the work location.

First, if the cop starts getting aggressive because its obviously not going his way, you should tell him, if we cannot have a normal conversation between 2 adults, then end everything right there. The cops have no right to talk to you if you don't want to, doesn't matter what they claim.
The goofiest recent thing in legal circles is you cannot exercise your right to remain silent by being silent. You must verbally advise you choose to remain silent. You must speak, to stay silent. Staying silent is now obstruction.

Some states have a duty to inform, or a duty to inform when asked if you're carrying a firearm when they pull you over. In AZ, they can even 'hold' it for the duration of the stop.

When you purchase a home - consider the porch area...
My current home has a fully enclosed porch with its own set of exterior storm and inside doors which are always locked as is the inside door to the house proper.
When I go to answer the door I close the inside door and never unlock the outside storm door. No foot in the door, no chance for home invasion, and no open area to see something suspicious to establish probable cause!
If your home doesn't have the same arrangement consider adding the enclosed porch - at very least, install an exterior storm door that remains locked even if you open an inside door.

It's great advice - put as many barriers as possible between the inside of your home and the outside world. But unless I'm expecting someone or it's someone I recognize, I simply don't answer the door to strangers no matter what type of outfit they have on.

I went for a home set well back off the only road into the area (only home on the street) stone and mortar fence line backed up by six acres of hedge maze, gate house with armed private security (all of whom I know and trust and pay well), private drive to main house, blast proof doors, bullet proof windows blast louvered shutters quarried limestone block walls, roof is gabled to a fare-thee-well with many covered hides along roof line. But I've been thinking lately, all that might not be enough. So I'm wondering if it might be worth it to install a murder-hole at the front entrance. Just in case. Thoughts?

Yes, thank you very much for the information! I have only been stopped by officers three times in my lifetime (I'm in my 60s). Once for a headlamp out (actually just very dim) and that officer was very polite and professional and let me off with a verbal warning. I replaced it the very next day. Don't ask for trouble! Once I was stopped in New Mexico and they said I was speeding, which I was not. I didn't argue, I looked over the ticket and it said that if I didn't sign the ticket that I would be taken into custody. I was passing thru that state with my cousin on the way to get some of his belongings. The last thing I wanted (or needed) was to go to jail on a three-day weekend trip! Did my out-of-state license plate encourage the LEOs to enrich their county at my expense? I think so but it would have cost me a lot more time and money to fight it in court so needless to say I found another route back! So I've gotten only two tickets, one for the New Mexico speeding ticket (undeserved) and the other was for parking on the wrong side of the road which is ridiculous since that is why a vehicle has rear-view mirrors. County governments are always finding ways to enrich their coffers as well as their pocket books, I have no doubt!

@@tomnisen3358 Yes it's true that if you don't already have a lawyer or can't afford one then you can get assigned a public defender, however you should know that public defenders are often fresh out of law school with little experience and its pretty certain they didn't graduate anywhere near the top ot their class. Technically you'll have legal counsel, but the real question is how competent and committed they are to aggressively defend your rights. This is the unfortuate reality that folks who aren't well to do will face when they go to court.

I was stopped on a highway for speeding and the state trooper asked if I minded if he searched my vehicle. "Of course I do !", I told him a bit resentfully. I think my answer sort of surprised him because I was assertive and didn't hem and haw about it (this was around 1982). When he asked why I minded so much I answered "Because this is America and we have a Constitution, and I swore an oath to protect and defend it (I was in the Army at the time). I was stopped for speeding and now you want to search my vehicle with no crime or warrant, so I do mind if you search it."
I don't know how he felt about my words, but I was respectful overall, and didn't swear or cuss him out. He told me about drugs being shipped in cars with out of state plates and then handed me my ticket and I was on my way. He was smiling as he turned and walked away, so it didn't go too badly.

Once upon a time a search warrant was required to enter the home to execute an arrest warrant.
The police cannot arrest you inside your home without a search warrant. This is why they always ask you to step outside.
It took only 200+ years to get where we are now. The nation's best years are behind us and in a few more generations our rights and freedoms will be but a distant memory. 🙁

What you forgot to mention is the logic behind the "consent to search" question. If they ASK for consent to search it means they DO NOT have probable cause to search.
I asked for consent hundreds of times when I had a warrant on me. That’s done in case the search warrant gets thrown out for whatever reason. Which happens more than you think. So if you give consent, that’s just an easy way to avoid the legal issues that may be identified by a sharp attorney to get the warrant thrown out, and everything they found under its authority, isn’t admissible. But if you give consent, you just took a potential avenue of attack for your lawyer. Never consent, don’t be aggressive or argumentative, and stay calm. Jeff nailed it on this one.
Well normally they won't even ask. They have all sorts of tricks to make the average person think that they DO HAVE the right to search it because they can say they smell alcohol of weed or some bullshit. They can also say they saw you reaching for something so like he said, make sure you stay nice and still from the moment you see those lights. Also, the best thing is to make sure you have NOTHING in your vehicle so if they DO pull their bullsh!t and find nothing, you got them on illegal search and multiple violations of your rights. Oh, and DEFINTIELY make sure you have no open alcohol containers. If you are returning 15 bags of empties at the end of a good summer party month, make sure you have no alcohol on your breath or in your system too. Then make sure none fell out and rolled under you're seats that might appear one night if you get pulled over after stopping for a beer after work.

That is not always the case. Sometimes, especially if it is a traffic stop, they are trying to save you and them some time. They can detain you until they get either a warrant delivered to the site, or a drug dog to arrive to walk the car. This can take a couple of hours or so. It is situational. If you have time, just wait, if not let them look and be on your way.
@justobserving170 nope. Not an accurate statement the SCOTUS has ruled on several occasions that on a TS u can only detain someone for a reasonable amount of time I.E. The amount of time it would take to do the business of writing a ticket(s) so if a K9 Is an "hour" away...not reasonable
The biggest problem is the immunity given to police and other officials. Why should they not be held accountable for breaking the law just because they do it on duty.

Thank you. I live in Mississippi & have a advanced Conceal carry permit. I was not paying attention to the speed ( 45 in a 35 ) passed by a unmarked police vehicle. He lighted me, we knew why he stopped us, we were smiling, gave him my license which returned a 1023 meaning license to carry. This guy was cool, told me to be more careful & said he loved people who carried guns.
It could have ended differently if you looked non white.
Statistically speaking, people with concealed-carry permits commit less crimes than even police do. There is no better person to have as a neighbor.

Many places in Michigan if you say you don't consent, they will bring in a dog and say it hit. This has been done to me several times. I do not use or transport drugs and have never had anything found during a search. It felt as though by denying consent many officers get upset because how dare you deny them.
Someone I know wink wink and his friend got pulled over just as his buddy lit up the blunt. His friend freaked out and put it out and threw it under the seat. The cop walked up and wanted to search. He denied and they brought the dog. Dog somehow didn’t hit on anything 😂. Someone I know got lucky that night.
That can be used as a defense in and of itself. If they make you wait for a K9 unit, unless it's nearby, that is unreasonable extension of the traffic stop. This does have some precedent, but can go either way based on the circumstances.
@@GReaper if you watch On Patrol Live, they make people wait on K9s all of the time. A few weeks back they walked a dog around a man who had been riding a bike. Not the bike, the man. I had never seen anything like it until then. It was pouring rain and even though the dog did not alert, the cop lied and searched the guy anyway. They found nothing at all. It's interesting how many laws the cops will break on live TV.

As a police officer of 20 years I have only once asked to see a persons weapon. After a self defense incident and I knew some rather gun-ho newbies were on the way lights and sirens. I advised the person of this and said if you want you can place it in your vehicle or my patrol unit. I gave them the choice and they placed it in my unit freely. This way I could put out over the radio the weapon is secured making it a bit safer for all of us.
What I will say is this. I patrol a rather rural small town area. My backup is usually a ways out, with that I consider the fellow citizens exercising their 2nd amendment rights as my closest backup. Our state has both constitutional concealed carry and open carry along with concealed weapons permits class 1&2. I encourage folks to carry and love having chats about the new handgun or rifle they got and even the in-depth conversations about why they chose it or the ammo they chose and why. I am the type of cop I am because I took to heart what the lead instructor said after we passed our tests and prepared for academy graduation. He said " Be the cop that gains the public's trust and respect to where you have five people jumping beside you to back you up instead of in front of you to take you on."
I will say this as a peace officer I cannot give legal advice. With that if you ever have to use your firearm or even display it to diffuse a situation, PLEASE PLEASE call your attorney and don't say a damn thing even after given your Miranda rights. Here is why, our cameras will be on we put what is said in our reports and that all goes to the court. So in other words make it a clear as clean glass for your attorney to represent you. Stay strong ya all exercise your rights. Oh and if your ever in my neck of the woods feel free to pull up say hi and have a chat about the type of iron you like.
Excellent information. In my home State (N.C.), CCP holders are required to inform a traffic officer: "I am a CCP holder and I am/or am not exercising my right today" as soon as he approaches my vehicle." How do you (as an officer of the law) want that reply issued.
To answer your question. You stated it perfectly. You stated you have a permit along with exercising your right. The only thing I would say or add is the location of the weapon. Reason being you will be reaching for license, registration, and proof of insurance. By giving location of weapon this can ease the situation on the officers side. Especially if you get a jumpy young pup.

In the state of Oklahoma if you are carrying a firearm you are only required to inform the officer if they ask and it is illegal for them to disarm you unless you are committing a crime. The law is Title 21 Section 1290.1.
In N.H. there is no duty to inform.

7:40 In Michigan as soon as you're pulled over if you have a CPL (CCW in most States) and you're carrying your concealed weapon on you, you have to inform the police officer as soon as they get to the window. There have been cases of people who didn't tell the police officer for maybe 45 seconds to a minute and a half and still were arrested for not following that rule. So in some cases, you have to tell the police right away when they come to the car.
I was out fishing one day and pulling my kayak out of the water. I had my Glock on me and the officer clearly saw it. He pulled up asked me how the fishing, not so good I said. Packing up and heading some place else. Never once asked me about my gun. Very professional

I love that you cover topics that other attorneys rarely cover... Rarely hear about invoking your 6th amendment rights as important as they are. By refusing to answer questions and asking for an atty, it puts you at a great advantage (as long as you remain quiet after.) It's Very important that you remain quiet, bc once you start talking again, they can ask questions which if answered, most likely will be admissible in court. I've even seen cops talk "amongst each other" close enough to the suspect for him to overhear (on purpose of course) in order to invoke a response so that the suspect starts talking again. They normally say something along the lines of hey, this is the same guy that did XYZ on abc st last week, or that's a lot of dope in the trunk, etc... since they're just talking amongst each other, when the suspect interrupts and says "no I wasn't", or "there's no drugs in the car", they can ask questions again, so stay quiet, as hard as it can be...
I was pulled over several yrs ago en route to purchase baby formula. I realized rather quickly the direction the stop was going in (asking if anything illegal was in the car, etc), I invoked both my 5th and 6th, which REALLY pissed them off. I was illegally detained/searched and ultimately arrested after 3 officers falsified evidence. I didn't beat the ride, but I did in fact beat the case and now I'm suing the department with help from one of the best civil rights attnys in the country! (just turned down a 40k settlement offer last week) REMEMBER... YOU CANT BEAT THE RIDE, BUT YOU CAN BEAT THE CASE! And a bonus is getting to see them play defense while your attorney deposes them... Funny how much they squirm/throw each other under the bus while being questioned under oath.

I’m lucky to have retired in Polk County Florida. Where our Sheriff Grady Judd, is a staunch 2nd Amendment supporter, who has told me personally in conversations, that if any federal officers who inform his agency they intend to come in and investigate any law abiding citizen, they will actually be told to LEAVE NOW! Unless they have something in writing on a Federal form or Search Warrant! That even if they do they will be required to be escorted by a Deputy. If I should encounter one at my door and he/she has no warrant, first thing to do is dial 911, informing them what’s going on, then call Sheriff Judd on his cell phone!

Back in 2018, when legislators in all their wisdom had never had a law on the books to prevent that awful crime. So like they alway are prone to do, they went TOO FAR! With a Sheriff showing them how far they went. That has since corrected the situation. But there are folks out there that need to be protected from themselves, for our sake. That’s still better than any blue state refusing your Second Amendment entirely.

I'm so glad, once again, to be a country boy, who lives in a lowly populated, rural area. Most of us never purchase our guns through this background system. We've all been very suspicious of these background checks, and putting our names into any systems that we can avoid from the start. Most of our firearms, on average, are a decade old, or older. Everyone I know has baught theirs second hand, and many of them have been sold and traded second hand over and over again. I wish them luck trying to track everyone's guns out here in country places like Kentucky where I live, or West Virginia, Ohio, Tennessee, North and South Carolina, Florida, Georgia, Alabama, Mississippi, Texas, Arkansas, Louisiana, Oaklahoma, Kansas, Nebraska and several others. Not one single firearm ever manufactured can be tracked to my name, and I plan on keeping it that way to. Also, Im sure law enforcement works completely different in big cities, and large metropolitan areas, but here in the country, these feds are going to find it hard to find any police, city or county, who are going to just willy nilly infringe on their citizens rights. I know for a fact, the Sheriff in my County, here in Kentucky, has said publicly he will not do anything that isn't supported under the constitution , regardless of who shows up and trying to order him, or pressure him. This Sheriff is a good, Godly man, who cares about freedom, country, constitution and would rather be fired then do anything he feels is wrong, or un American.

I was born, raised, and still live in one of the states on your list, by the grace of God. What concerns me is that, with all of these liberal fools coming in droves from New York, Illinois, California, Oregon, and Washington and invading conservative states, we are one election away from a bad sheriff, congressman, and governor. They’ve wasted no time gaining city and county council seats and working their agendas into local matters, and I see gangs of them on social media attacking our state congressmen and governors trying to influence future elections. Yep, as a guy who doesn't generally want to cause issues and wanting to help, I was willing to talk to the police. I won't do so again. I had police knocking on my door, so I go and tell them what I was doing throughout the day as they accuse me of something. I tell my story once again, and they insist that my truck was tagged as being involved. They say "this place has a camera, will it confirm that you were the only one in the vehicle . . ." blah, blah, blah.
I assumed it was an elicitation exercise or something. But nonetheless, I was getting mad. Like really, can I actually go down for some shit? And then they do this nefarious shit where they use my story when question my brother (who wasnt present during my questioning) asking if I did what they alleged or was it possible I did while engaged in what I actually did. They essentially tried to merge their story with my facts.

And your local PD has a photocopy... because part of the process is local endorsement stating it doesn't violate any local laws to own said NFA gun...and for, air fingers quote, administrative purposes, most PD's keep a copy of all documents they endorse. So while it's NOT gun registration, it's "Gun Registration." Food for thought.

From a deputy’s perspective, I really appreciate the way y’all give information. You’re not saying all officers are bad people and you always stress people stay calm and respectful. I know defense attorneys are not the most popular with a lot of officers but more of us are not threatened by this information because we respectfully do our jobs. I’m not in Texas but just like the manner in which you are giving information.

They answered some questions and then later decided to go silent without invoking their 5th amendment rights and their silence was used against them. Given this precedent was set a decade ago there are likely many examples of this happening now.

I've been pulled over 4 times since January of 2020. Every single time, I've notified the officer/deputy/trooper (yes, all three have pulled me over) that I am a CCP holder, and I am carrying. I was told that this will always put the LEO on edge and make them suspicious of you.
That has never happened. The trooper asked if he could disarm me, and I agreed. The other three times, the LEOs said, "Don't show me yours, and I won't show you mine."
I am always polite and treat them with respect.
And I haven't been ticketed at all.

I have wondered that, technically the ATF is regulatory. I don’t think they have the same powers as even the FBI for arrests and searches.

We need laws protecting citizens safety. Enough of this one sided bs. If your taken to court and your found innocent than the tyrant should be brought up on charges during that trial. There needs to be accountability for wrongdoing on their behalf and it needs settled then and there.

I got pulled over in 2000 driving across the U.S. (Vermont to Nevada) on my own. It was either Arkansas or Tennessee. My vehicle was plated in Quebec. I wasn’t speeding. The reason given was that I didn’t have a front license plate, which felt off to me as I had never had that issue before. The officer then moved to the passenger side window. Elbows on the window sill, arms dangling inside my car. I remained polite, never got out of my car, gave the officer my driver’s license, insurance, registration. He handed them back. He asked where I was going on my own, was I going to visit anyone, had I gone there before. He kept looking to the back seat, where there was nothing. At that point, he was creeping me out fully because I could tell he was just looking for a reason to either fine or arrest me. Funny enough, he never asked to look inside my trunk. Finally he let me go and wished me a good trip, to which I just said thank you and drove the feck off. Thanks for this info.

I got in serious trouble in my younger days. Since then I drive the speed limit, wear my seatbelt, don't drink unless at home. Been pulled over a few times. License, registration and proof of insurance are together in a little folder. No furtive movement, no small talk nor answer questions regarding their reason for the stop. Never give them any reason to escalate. Remember that bearing arms is not limited to firearms.

Officers are no longer allowed to ask you if you know why they pulled you over. They will now be required to tell the driver the reason for the stop rather than asking questions designed to get information, at least in CA. Thanks to Assembly Bill 2773 effective January 1, 2024.

Excellent Information. I truly appreciate the "Furtive Movements" advice, especially related to a Traffic Stop.. While encounters can go sideways, my experience has been to Set The Tone of each encounter early on... My personal technique for "Setting The Tone" regarding a Traffic Stop is,
1.) Find some relatively safe place to pull over. Don't drive five miles to a church parking lot, but do consider the Officer's Safety when you pull over to the side of the road.
2.) Turn the vehicle off, and turn on the interior lights ( if dark ).
3.) Keep "Furtive Movements" to an absolute minimum. ( me personally, I have my window down and my wallet in hand, with both hands on the wheel, Before the Officer exits his/her vehicle.
4.) I take the lead in opening the conversation. In a loud, clear, and sincere voice I say Good Morning/Day/Evening, how may I help you.
Don't misunderstand me, what I've outlined has nothing to do with defending your Rights. This video has done a very good job of addressing that... All I'm saying is, A.) If you act in compliance right out of the gate it makes it more difficult for an Officer to feel or falsefy that they are in danger. B.) Cops are ( most ) people too, If you look out for their well-being, they will be less likely to attack your well-being.
Again, please don't misunderstand me, if they want you, they will still play every trick in the book.... I'm talking about creating a clear difference between your actions and the actions of an Officer who's inclined to work outside of their authority... It can make a difference in court.

I was stopped by TX DPS the other day here South of Houston & I had my AR on my passenger seat & my Glock 19 in plain view on my dash.
It was a "Ran a Red light Stop" & he didn't say anything about my weapons. He took my ID, went back to his unit & reviewed his camera. Then came back & stated, I made the light by 1.5sec & have a great day. Very friendly stop.
I also had a friendly interaction with a Trooper recently, north of Austin. I was going 5 over the speed limit or so. He asked where I was going, I told him I was going to see my son play in the high school band an hour away. Turns out he played the same instrument when he was in band. I think talking helped me avoid a ticket.
He didn’t ask about any guns.
Assuming TX law is different than Florida, but here you cannot have a firearm on your dash (or seat, or under your seat, etc). Has to be in an enclosure with a lid (like a box, or a gun case, etc). Glove box or center console would suffice.
In TX a pistol only has to be in a holster. Long guns can be displayed

First time viewing your channel, now subscribed. Outstandingly good info. I live near McKinney and have a Carry permit. Also used to work in a gunsmith shop where we gave the conceal carry classes.
Have been stopped a few times and no issues. I was told by our gun store lawyer. Mind you this was 2005 and earlier. When cop is at your window. Already have your DL and your CCW licenses out and ready to give them. Also announce if you have a firearm with you and where it is located. Never have I had a cop ask to see it or try and take possession of it. Most have said just don't move that direction or along that line.
Believe it or not, there are a lot of cops that think only law enforcement and military should own or have guns. When the Texas Carry Licenses first came out. The Police Chief in Richardson, issued zip lock bags to every street cop. Saying. When you pull them over, take their gun. Here is the kicker. Disassemble it and unload the mag into this zip lock and give it back that way. Well, they pulled over a lawyer, like yourself that knows gun laws. He had a field day with them over this. Why, you hand me my ticket and a bag of parts. You drive off and now I am unprotected while I put my gun back together or if I can put it back together. In our gun shop we had a few come in asking us to put it back together for them. IMO, if you own it you should be able to reassemble it. Yet, not required. That is why there are gun shops.
I'm going to add that to the million other reasons I prefer a revolver for personal defense.
I do not tell them anything about my firearms that I may have on person or in car as I am not legally required to.
One of the best tricks I have ever used is KEEPING YOUR HANDS ON THE STEERING WHEEL at all times. If you have tinted windows roll them down AS YOU ARE PULLING OVER, NOT while he is walking up to your door. When he asks for your information then politely state where it is and that you are going to reach for it and any additional moments that you are going to make such as undoing your setbelt to be able to better reach your ID and insurance. I see people all the time getting all huffy and puffy and drinking their drinks, keeping their hands down by their legs where the officer can't see them while fidgeting and im like are you trying to get shot?

I live in MD. About 6 years ago during hunting season. I was pulled over for having a blown 3rd light (that red light on the back of a truck above the cab). So, I opened the glove box to get the registration. I was hunting 6 hours earlier. I had shot gun shells in the glove box. Tho officer didn't say a word. About 90 seconds passed, and out of nowhere, 9 other cops and a helicopter showed up. They run up on me and torn me out of the truck. Tossed me to the ground and stood on my back repeatedly asking for the gun. But I had already put it back into my safe at home. They didn't believe me and torn my truck apart. So I only asked one question: What if I had a gun? It's hunting season. They didn't answer. So they had me for over an hour and didn't find a gun. They let me go by just leaving me. At night, I got in the getto (Baltimore) with my property in the gutter, and it was dark. I felt really protected and served.

@LouisMihai I asked the cop about 6 times, "What if I did have the gun?" he didn't answer. I called his Sargent and asked because I was going hunting the next day and would have the gun with me. He just double talked around it and didn't make sense. So long story short I drive about 25 extra minutes to avoid Baltimore city where I95 runs through it
