    I had cops stand on my porch once for over a hour while other officers were securing a search warrant . They finally arrived with the warrant and then destroyed my front door and roll up door on my garage. It was pretty destructive the way they entered and then placed me in cuffs at gunpoint and then started cutting open my gun safe as well as a floor safe in my bedroom. They were tearing my house up looking for drugs and cash as well as firearms. Finally they discovered they were at the wrong house. I tried to tell them they had the wrong house from the beginning. But they had no interest in the effort required to verify the addresses. I won a judgment of
    $71 ,891 for damages after a 5 year court battle

      I wish law enforcement and the judges could get much more easily removed for this kind of cataclysmic failure. Qualified immunity .. most urgently needs to be significantly scaled back for the people.

    This man is 100% correct about them tearing your car up. When I was 17, I consented to a search, and the officer yanked wires out of my amplifier, breaking the terminals, ripping the wires and RCA cables, flipped my subwoofers over on their face, puncturing one of the foam surrounds on the subwoofer, ultimately ruining it. I called the police department and they asked "did you consent to the search?". That was the end of the it. I consented. I've never consented to another search since then.

      I worked with a guy who had his whole RV torn apart because he gave consent to a search. The cops pulled out everything, found nothing, then left him sitting on the side of the road with a big pile of a mess.

      Same thing with a border search. They can tear your whole car up, pulling out seats, spare tire, wheels off, even pull the bumpers off and more. Even if they find nothing they have No Legal Responsibility to put Any of it back together and often just turn over the pile of parts to you with a smile and "you are free to go". Yea, in what now?

      Plead your 5 th and 6 th, don’t ask me any questions without my lawyer present. Consent to nothing, then go silent. At that point they have 20 minutes to fool you into talking. Just wait it out.

    Great video with one add: NEVER step outside your door if Police show up without a warrant. Your rights change the minute you step outside the threshold of your home. Police will use all kinds of tactics to get you to exit your home. DO NOT!

    The fact that the police can rip an innocent persons car completely apart, possibly destroying your property/car, for "suspicion" is insane and need to be treated like the crime it is.

      And the Police are under no obligation to restore your vehicle to "pre-search" condition. They can, and do, leave it just like they made it, seats out, seat covers off, compartments emptied, etc.

      Happened to a friend, friend got stopped supposedly for going a little fast, Officer asked where friend going in such a hurry, friend said I need to get my pot home, officer completely shut friend down from further explanation and commenced with a thorough search of vehicle , friend remained quiet 😂only to find NOTHING! Friend had potting soil! The Officer only heard pot! My friend is an Attorney!

    NOTE about CONSENTING to search your car: I’ve heard of case where owner sued Police for damaging his car while they were searching it. The judge responded with “You gave up your rights when you consented to the search of your vehicle so you can’t sue for damages”. So that's another reason not to give a consent.

      I’m sick of people blaming “the other” side or group of society. If people eased their kids the right way this wouldn’t happen.
      People act their learned behavior out be it as a policeman or government official or that contractor you hired.
      It boggles my mind that people think, in a corrupt and foul culture/society, that one part of it can be “clean” while other part somehow completely “corrupt”.
      We are made of the same people.

    I live in MD. About 6 years ago during hunting season. I was pulled over for having a blown 3rd light (that red light on the back of a truck above the cab). So, I opened the glove box to get the registration. I was hunting 6 hours earlier. I had shot gun shells in the glove box. Tho officer didn't say a word. About 90 seconds passed, and out of nowhere, 9 other cops and a helicopter showed up. They run up on me and torn me out of the truck. Tossed me to the ground and stood on my back repeatedly asking for the gun. But I had already put it back into my safe at home. They didn't believe me and torn my truck apart. So I only asked one question: What if I had a gun? It's hunting season. They didn't answer. So they had me for over an hour and didn't find a gun. They let me go by just leaving me. At night, I got in the getto (Baltimore) with my property in the gutter, and it was dark. I felt really protected and served.

      That's a hard sell -- if door is open, they may present you from shutting it, and callng a Sherriff/Lawyer WHILE in a stop situation would only be an aggravation. I'd like to know what Esq. Jeff thinks about making declarations on 2A rights, even 6A rights, and asking for the officer to call for a Sherriff (or PD if the Sherriff conducted the stop). It's like I've seen many times, folks demand the officer to provide their name/badge, and request for a supervisor (makes sense if you're a woman and don't want to be searched by a man, etc.)

    It's very disturbing that in this country, after more than 250 years, it is very easy for any police officer to find a 'legal' way in which to physically assault any citizen and justify it in court. Unless you stand like a statue you are subject to any punishment they want to inflict on you. Scary.

    Back in the mid 70's. I did work at the border. I had no idea of protocol so I asked.
    They told me that I would have to leave my vehical and an agent would take me to the work location.
    When I got back to my vehical, doors wide open, tools scattered on the ground, pappers were blowing around in the wind, and my car seats were stacked up outside my vehical.
    I was in shock. They tore my car apart, they did not give explaniation and would not help me put it back together. I was furious. Im here doing work for you and you destroy my car !
    I called my boss, he came to the site and said we will never be doing work for them again. He also paid me for the time and parts to put my car back together.

    This is great information that I had to learn the very hard way.
    Short story:
    I was the driver of my gf’s car and she was in the passenger seat. Got pulled over by the sheriff on the claim I was going 30 mph over the speed limit. I had cruise control set at 5 mph below the speed limit because of all the potholes. I had to handguns on me I legally owned. When I went through a handgun safety class the old man said during his presentation “if you get pulled over and have a gun on you. Do the right thing and let the officer know immediately upfront.” Not knowing any better, that’s what I did. The sheriff Immediately pulled me out of the car, took my gun and then began searching the car (with my consent thinking I was doing the right thing) 3 hours later, 6 city officers, 2 K9’s and a completely destroyed vehicle, I end up in handcuffs getting hauled to jail with 2 felony charges. The sheriff claimed he found a few flakes a weed on the floorboard of the passenger side. Interestingly enough, in court, there was no way for the lab to retest the substance.
    Do everything this man says. I will never ever ever willingly let ANYONE know when I have a weapon on my person. Cop or not.

    A gun threat was reported at my daughter's elementary school. My daughter was named as part of the group walking during PE when this was "supposedly" said. The city police showed up at my house and demanded to see my guns and said that my daughter couldn't come back to school until they saw them. Turns out after speaking to all parties involved it never happened and was all over jealousy about a boy and my daughter had absolutely nothing to do with the conversation.

      So this is a case of being "Swatted" right? Tell us more. I can see where the police could claim exigent circumstances to gain access but by the same token, the police visit is based on hearsay. So it comes down to whether the cops have the nerve to push it and possibly force the door. Very dangerous situation to be sure.

      All of this at the foundation goes against the second amendment. It says the right to bear arms SHALL NOT BE INFRINGED UPON.
      All of these classifications and forms, the tracking the record keeping all infringe upon that right.

    Having your vehicle is good working order, obeying speed limits and obeying all traffic laws will avoid 90% of law enforcement interactions while traveling in the first place. This is an excellent video and a good refresher for those of us who hold a JD.

      Being aware is the vital first step but being willing to stand up for them is the vital second step. Its one thing to know a cop is violating your rights, it's another to stand up to them. A comment above is from a guy that had his rights violated while he got some restitution in the end, it cost him five years of court and grief. People get in the situation and think, nah, easier to just bend over now and try to forget getting screwed with therapy.

    When you purchase a home - consider the porch area...
    My current home has a fully enclosed porch with its own set of exterior storm and inside doors which are always locked as is the inside door to the house proper.
    When I go to answer the door I close the inside door and never unlock the outside storm door. No foot in the door, no chance for home invasion, and no open area to see something suspicious to establish probable cause!
    If your home doesn't have the same arrangement consider adding the enclosed porch - at very least, install an exterior storm door that remains locked even if you open an inside door.

      It's great advice - put as many barriers as possible between the inside of your home and the outside world. But unless I'm expecting someone or it's someone I recognize, I simply don't answer the door to strangers no matter what type of outfit they have on.

      I dunno. Me I'm half arsed paranoid. I went for a home set well back off the only road into the area (only home on the street) stone and mortar fence line backed up by six acres of hedge maze, gate house with armed private security (all of whom I know and trust and pay well), private drive to main house, blast proof doors, bullet proof windows blast louvered shutters quarried limestone block walls, roof is gabled to a fare-thee-well with many covered hides along roof line. But I've been thinking lately, all that might not be enough. So I'm wondering if it might be worth it to install a murder-hole at the front entrance. Just in case. Thoughts?

      Yes, thank you very much for the information! I have only been stopped by officers three times in my lifetime (I'm in my 60s). Once for a headlamp out (actually just very dim) and that officer was very polite and professional and let me off with a verbal warning. I replaced it the very next day. Don't ask for trouble! Once I was stopped in New Mexico and they said I was speeding, which I was not. I didn't argue, I looked over the ticket and it said that if I didn't sign the ticket that I would be taken into custody. I was passing thru that state with my cousin on the way to get some of his belongings. The last thing I wanted (or needed) was to go to jail on a three-day weekend trip! Did my out-of-state license plate encourage the LEOs to enrich their county at my expense? I think so but it would have cost me a lot more time and money to fight it in court so needless to say I found another route back! So I've gotten only two tickets, one for the New Mexico speeding ticket (undeserved) and the other was for parking on the wrong side of the road which is ridiculous since that is why a vehicle has rear-view mirrors. County governments are always finding ways to enrich their coffers as well as their pocket books, I have no doubt!

      @@tomnisen3358 Yes it's true that if you don't already have a lawyer or can't afford one then you can get assigned a public defender, however you should know that public defenders are often fresh out of law school with little experience and its pretty certain they didn't graduate anywhere near the top ot their class. Technically you'll have legal counsel, but the real question is how competent and committed they are to aggressively defend your rights. This is the unfortuate reality that folks who aren't well to do will face when they go to court.

    I was stopped while carrying here in NH and the officer asked if I was armed. I told him I was, what I was carrying and where, and told him I would comply with however he wanted to handle things. he smiled and said, "how about you don't show me yours and I won't have to show you mine?" I agreed. Verbal warning for speeding, no muss, no fuss.

      Same. I work Search and Rescue and have a CCW permit, and if I'm working a crime scene or formally sanctioned search with law enforcement present, I just let them know I'm carrying for safety, and no one cares.
      Even if they did, I'm fine with showing my weapons. I train and handle working dogs, and those you can see plainly. I don't see the difference. In a traffic stop, the first thing I say is that the dog loose in the back end is trained to prevent him from reaching his arm into the vehicle, and then that I am carrying.

      Also, I carry my revolver with me backpacking and on wilderness searches, so it's used to rain, ice, snow, etc exposure; I just maintain it accordingly. 😅

    I was stopped on a highway for speeding and the state trooper asked if I minded if he searched my vehicle. "Of course I do !", I told him a bit resentfully. I think my answer sort of surprised him because I was assertive and didn't hem and haw about it (this was around 1982). When he asked why I minded so much I answered "Because this is America and we have a Constitution, and I swore an oath to protect and defend it (I was in the Army at the time). I was stopped for speeding and now you want to search my vehicle with no crime or warrant, so I do mind if you search it."
    I don't know how he felt about my words, but I was respectful overall, and didn't swear or cuss him out. He told me about drugs being shipped in cars with out of state plates and then handed me my ticket and I was on my way. He was smiling as he turned and walked away, so it didn't go too badly.

    As a police officer of 20 years I have only once asked to see a persons weapon. After a self defense incident and I knew some rather gun-ho newbies were on the way lights and sirens. I advised the person of this and said if you want you can place it in your vehicle or my patrol unit. I gave them the choice and they placed it in my unit freely. This way I could put out over the radio the weapon is secured making it a bit safer for all of us.
    What I will say is this. I patrol a rather rural small town area. My backup is usually a ways out, with that I consider the fellow citizens exercising their 2nd amendment rights as my closest backup. Our state has both constitutional concealed carry and open carry along with concealed weapons permits class 1&2. I encourage folks to carry and love having chats about the new handgun or rifle they got and even the in-depth conversations about why they chose it or the ammo they chose and why. I am the type of cop I am because I took to heart what the lead instructor said after we passed our tests and prepared for academy graduation. He said " Be the cop that gains the public's trust and respect to where you have five people jumping beside you to back you up instead of in front of you to take you on."
    I will say this as a peace officer I cannot give legal advice. With that if you ever have to use your firearm or even display it to diffuse a situation, PLEASE PLEASE call your attorney and don't say a damn thing even after given your Miranda rights. Here is why, our cameras will be on we put what is said in our reports and that all goes to the court. So in other words make it a clear as clean glass for your attorney to represent you. Stay strong ya all exercise your rights. Oh and if your ever in my neck of the woods feel free to pull up say hi and have a chat about the type of iron you like.

      Excellent information. In my home State (N.C.), CCP holders are required to inform a traffic officer: "I am a CCP holder and I am/or am not exercising my right today" as soon as he approaches my vehicle." How do you (as an officer of the law) want that reply issued.

      To answer your question. You stated it perfectly. You stated you have a permit along with exercising your right. The only thing I would say or add is the location of the weapon. Reason being you will be reaching for license, registration, and proof of insurance. By giving location of weapon this can ease the situation on the officers side. Especially if you get a jumpy young pup.

    One thing I would like for you to address, and maybe you did in another video that I haven’t seen yet, is what the interaction should look like if you’re pulled over for a traffic stop and you are carrying concealed in a duty to inform state. Some of us have as a condition of being issued our concealed weapons permit, a duty to inform that we are carrying in any official interaction with police. I was stopped several years ago and informed the officer that I have my concealed permit and that I am currently carrying my firearm. The officer immediately called for back up, and when that officer arrived, he took possession of my firearm, completely disassembled it, and ran the serial number to “ensure it wasn’t stolen.“ He certainly violated my fourth amendment rights that night, but I knew the side of the road was not the place to become belligerent so I complied and called my attorney the next morning. I did not consent to the unlawful search because I did not know he had run the serial number until he handed me my firearm back completely disassembled along with an empty magazine and a handful of bullets.

      Same has happened to me many times in Michigan. I'm surprised if I'm pulled over and told as is your 2nd Amendment right and NOT handcuffed. Each of those other times I was handcuffed, searched, weapon confiscated, serial number run, unloaded, returned after 30 to 45 minutes, let go. No apology. I'm looking for civil rights attorney now to sue the last one. He actually perjured himself in court lying about his police report. All charges dismissed lack of evidence but his testimony kept my friend in jail 120 days because he asked for a $25000 cash bond. 2500 i could have put up. Malicious prosecution. Cruel and probably not unusual punishment. Perjury. Violation of civil rights under color of law.

    In the states I travel to, as a CWP holder, I am required to state that I am carrying at the point he asks for ID. Never had a problem. Funny thing, a traffic stop in Florence, AZ, the cop stated that city policy required him to take my gun until the stop was over. I carried a 1911 cocked and locked. He struggled with it for 8 minutes before his supervisor showed up. He wrestled with it "trying to make it safe". When they finally got the actoin open, the chambered round fell onto the floor of the cruiser. After a warning for speeding, which I was doing, they returned the cleared gun and magazine. Several days later, I heard from a friend who lived there that the cop who stopped me was in trouble for having "unaccounted for ammo" in his car.

      The outcome with the unaccounted for ammo is funny! That said, I am concerned about inquiries on guns, or weapons, when I am traveling about. I'm retired and accumulated various guns over the years, which a several ownerships prior to my possessions. I transport custom pistols and rifles of significant value and worry about any Officer ever stating, "well, I got to check these to see if they're stolen?" I;ve started carrying the purchase receipt for the very common pistol I now carry for self defense; that's how nervous Offical overstep concerns me!

    Many places in Michigan if you say you don't consent, they will bring in a dog and say it hit. This has been done to me several times. I do not use or transport drugs and have never had anything found during a search. It felt as though by denying consent many officers get upset because how dare you deny them.

      That can be used as a defense in and of itself. If they make you wait for a K9 unit, unless it's nearby, that is unreasonable extension of the traffic stop. This does have some precedent, but can go either way based on the circumstances.

I had never seen anything like it until then. It was pouring rain and even though the dog did not alert, the cop lied and searched the guy anyway. They found nothing at all. It's interesting how many laws the cops will break on live TV.

      This only applies to voluntary interviews. Miranda still is required if there is coercion. And they can't compel you to speak, they can just comment on your silence at trial which is normally an absolute no go.

    In the state of Oklahoma if you are carrying a firearm you are only required to inform the officer if they ask and it is illegal for them to disarm you unless you are committing a crime. The law is Title 21 Section 1290.1.

PS: I taught my sons from a young age to only say, "I want my lawyer." And then shut up. Little did I know how much advice like yours would save my sons future. 3 months before he leaves for college he's arrested. Thanks to him following advice like yours, and even though the cops were pissed, he did what he was told. My attorney got the case dismissed in 10 mins and credits my son's silence for killing his charges. My son left for college the next day. I was so proud of him

    Thank you. I live in Mississippi & have a advanced Conceal carry permit. I was not paying attention to the speed ( 45 in a 35 ) passed by a unmarked police vehicle. He lighted me, we knew why he stopped us, we were smiling, gave him my license which returned a 1023 meaning license to carry. This guy was cool, told me to be more careful & said he loved people who carried guns.

      If they're NFA there's a form 4 with a tax stamp. And your local PD has a photocopy... because part of the process is local endorsement stating it doesn't violate any local laws to own said NFA gun...and for, air fingers quote, administrative purposes, most PD's keep a copy of all documents they endorse. So while it's NOT gun registration, it's "Gun Registration." Food for thought.

    From a deputy’s perspective, I really appreciate the way y’all give information. You’re not saying all officers are bad people and you always stress people stay calm and respectful. I know defense attorneys are not the most popular with a lot of officers but more of us are not threatened by this information because we respectfully do our jobs.     One of the best tricks I have ever used is KEEPING YOUR HANDS ON THE STEERING WHEEL at all times. If you have tinted windows roll them down AS YOU ARE PULLING OVER, NOT while he is walking up to your door. When he asks for your information then politely state where it is and that you are going to reach for it and any additional moments that you are going to make such as undoing your setbelt to be able to better reach your ID and insurance. I see people all the time getting all huffy and puffy and drinking their drinks, keeping their hands down by their legs where the officer can't see them while fidgeting and im like are you trying to get shot?

      Don't just record locally stream to an online secure account as well.

    What you forgot to mention is the logic behind the "consent to search" question. If they ASK for consent to search it means they DO NOT have probable cause to search.

      I asked for consent hundreds of times when I had a warrant on me. That’s done in case the search warrant gets thrown out for whatever reason. Which happens more than you think. So if you give consent, that’s just an easy way to avoid the legal issues that may be identified by a sharp attorney to get the warrant thrown out, and everything they found under its authority, isn’t admissible. But if you give consent, you just took a potential avenue of attack for your lawyer. Never consent, don’t be aggressive or argumentative, and stay calm. Jeff nailed it on this one.

      Well normally they won't even ask. They have all sorts of tricks to make the average person think that they DO HAVE the right to search it because they can say they smell alcohol of weed or some bullshit. They can also say they saw you reaching for something so like he said, make sure you stay nice and still from the moment you see those lights. Also, the best thing is to make sure you have NOTHING in your vehicle so if they DO pull their bullsh!t and find nothing, you got them on illegal search and multiple violations of your rights. Oh, and DEFINTIELY make sure you have no open alcohol containers. If you are returning 15 bags of empties at the end of a good summer party month, make sure you have no alcohol on your breath or in your system too. Then make sure none fell out and rolled under you're seats that might appear one night if you get pulled over after stopping for a beer after work.

      That is not always the case. Sometimes, especially if it is a traffic stop, they are trying to save you and them some time. They can detain you until they get either a warrant delivered to the site, or a drug dog to arrive to walk the car. This can take a couple of hours or so. It is situational. If you have time, just wait, if not let them look and be on your way.

    I was pulled over by a Missouri State Trooper because I was speeding. I had two 9MM with me one on the passenger seat and one in my cup holder in the center console. He never batted an eye, said I always encourage people to carry, then took my license registration and insurance to his car and never mentioned the pistols or asked me to get out but I just left my hands on the steering wheel. He returned my things, said have a nice day but please slow down. Had this happened in my home State on kommiefornia, I would have been arrested on the spot. I love rural Missouri.

      Back in 86 , I was 16. I would drive 40 miles one way to work at night to work. This was in Harris county Texas. My oldest brother advised me to carry his 45acp. I was pulled over one night by Texas DPS trooper for a tail light that was going on and off. He saw the 1911 on my seat and asked to have a look at it. He cleared it, then felt the trigger pull weight ( obviously he was a 1911 enthusiast) he asked me why I carry it when I'm only 16. I told him how I have this long drive to Conroe to work and it's always at night. He wrote me a warning for the tail light, loaded my 45 back up handed it to me , and said be safe out there tonight. I❤️ Texas.

    I'm so glad, once again, to be a country boy, who lives in a lowly populated, rural area. Most of us never purchase our guns through this background system. We've all been very suspicious of these background checks, and putting our names into any systems that we can avoid from the start. Most of our firearms, on average, are a decade old, or older. Everyone I know has baught theirs second hand, and many of them have been sold and traded second hand over and over again. I wish them luck trying to track everyone's guns out here in country places like Kentucky where I live, or West Virginia, Ohio, Tennessee, North and South Carolina, Florida, Georgia, Alabama, Mississippi, Texas, Arkansas, Louisiana, Oaklahoma, Kansas, Nebraska and several others. Not one single firearm ever manufactured can be tracked to my name, and I plan on keeping it that way to. Also, Im sure law enforcement works completely different in big cities, and large metropolitan areas, but here in the country, these feds are going to find it hard to find any police, city or county, who are going to just willy nilly infringe on their citizens rights. I know for a fact, the Sheriff in my County, here in Kentucky, has said publicly he will not do anything that isn't supported under the constitution , regardless of who shows up and trying to order him, or pressure him. This Sheriff is a good, Godly man, who cares about freedom, country, constitution and would rather be fired then do anything he feels is wrong, or un American.

    If the ATF comes to your door CALL THE SHERIFF!!! The sheriff is the top law enforcement officer of the county. Number one you have another person's testimony, and of the sheriff doesn't tell the ATF to get out of his county or they'll be in his jail, elected a different sheriff.

    Something that has worked for me in the past is answering questions with questions. For example Oficer says do you mind if I search your car for drugs or weapons. My response, do I have to let you. They have to answer no and then you know you don't have to consent or if they say I can't answer that you know he is trying to set you up to fall in their traps.

    I was out fishing one day and pulling my kayak out of the water. I had my Glock on me and the officer clearly saw it. He pulled up asked me how the fishing, not so good I said. Packing up and heading some place else. Never once asked me about my gun. Very professional

    I love that you cover topics that other attorneys rarely cover... Rarely hear about invoking your 6th amendment rights as important as they are. By refusing to answer questions and asking for an atty, it puts you at a great advantage (as long as you remain quiet after.) It's Very important that you remain quiet, bc once you start talking again, they can ask questions which if answered, most likely will be admissible in court. I've even seen cops talk "amongst each other" close enough to the suspect for him to overhear (on purpose of course) in order to invoke a response so that the suspect starts talking again. They normally say something along the lines of hey, this is the same guy that did XYZ on abc st last week, or that's a lot of dope in the trunk, etc... since they're just talking amongst each other, when the suspect interrupts and says "no I wasn't", or "there's no drugs in the car", they can ask questions again, so stay quiet, as hard as it can be...
    I was pulled over several yrs ago en route to purchase baby formula. I realized rather quickly the direction the stop was going in (asking if anything illegal was in the car, etc), I invoked both my 5th and 6th, which REALLY pissed them off. I was illegally detained/searched and ultimately arrested after 3 officers falsified evidence. I didn't beat the ride, but I did in fact beat the case and now I'm suing the department with help from one of the best civil rights attnys in the country! (just turned down a 40k settlement offer last week) REMEMBER... YOU CANT BEAT THE RIDE, BUT YOU CAN BEAT THE CASE! And a bonus is getting to see them play defense while your attorney deposes them... Funny how much they squirm/throw each other under the bus while being questioned under oath.

    I’m lucky to have retired in Polk County Florida. Where our Sheriff Grady Judd, is a staunch 2nd Amendment supporter, who has told me personally in conversations, that if any federal officers who inform his agency they intend to come in and investigate any law abiding citizen, they will actually be told to LEAVE NOW! Unless they have something in writing on a Federal form or Search Warrant! That even if they do they will be required to be escorted by a Deputy. If I should encounter one at my door and he/she has no warrant, first thing to do is dial 911, informing them what’s going on, then call Sheriff Judd on his cell phone!

Back in 2018, when legislators in all their wisdom had never had a law on the books to prevent that awful crime. So like they alway are prone to do, they went TOO FAR! With a Sheriff showing them how far they went. That has since corrected the situation. But there are folks out there that need to be protected from themselves, for our sake. That’s still better than any blue state refusing your Second Amendment entirely.

    Good stuff! We had a local sheriff's deputy here that was doing consensual searches in traffic stops and he was planting drugs in the vehicles of the folks he stopped. He was ultimately discovered by a sharp-eyed Assistant State Attorney that took the time to carefully review his body cam videos. The case is State of Florida v. Zachary Wester. #Subscribed

    I got pulled over in 2000 driving across the U.S. (Vermont to Nevada) on my own. It was either Arkansas or Tennessee. My vehicle was plated in Quebec. I wasn’t speeding. The reason given was that I didn’t have a front license plate, which felt off to me as I had never had that issue before. The officer then moved to the passenger side window. Elbows on the window sill, arms dangling inside my car. I remained polite, never got out of my car, gave the officer my driver’s license, insurance, registration. He handed them back. He asked where I was going on my own, was I going to visit anyone, had I gone there before. He kept looking to the back seat, where there was nothing. At that point, he was creeping me out fully because I could tell he was just looking for a reason to either fine or arrest me. Funny enough, he never asked to look inside my trunk. Finally he let me go and wished me a good trip, to which I just said thank you and drove the feck off. Thanks for this info.

    I got in serious trouble in my younger days. Since then I drive the speed limit, wear my seatbelt, don't drink unless at home. Been pulled over a few times. License, registration and proof of insurance are together in a little folder. No furtive movement, no small talk nor answer questions regarding their reason for the stop. Never give them any reason to escalate. Remember that bearing arms is not limited to firearms.

      Officers are no longer allowed to ask you if you know why they pulled you over. They will now be required to tell the driver the reason for the stop rather than asking questions designed to get information, at least in CA. Thanks to Assembly Bill 2773 effective January 1, 2024.

    Being polite is very important!! You can absolutely refuse to answer questions and refuse searches while also being polite. A good officer (most of the cops out there) will respond positively to politeness. "Officer, I appreciate the tough job you have, but I do not consent to you searching my car." "Officer, it has been several minutes, I was wondering if I am free to go or if I am being detained?" "Thank you, I appreciate your work in keeping the city safe, have a good day." Even if the cop wasn't the nicest cop, you might also be helping the next person he encounters have a better interaction.

    I was pulled over in a company vehicle 2 times in one night for a headlight being out. 1st was local police and the 2nd time was by a sheriff. Police officer gave me a verbal warning and told me to get it fixed.
    The sheriff's deputy was great. She knew the officer who pulled me over after I told her. She then said Chevy is known for bad headlight cabling, walks to the front of the van, and slaps the hood just over the headlight one time. The headlight turned back on. We both laughed. She said "Well looks like your headlight is working, have a good night sir."

      "In 2013, the U.S. Supreme Court concluded that a witness's silence to a question can be used against them in a criminal case (Salinas v. Texas). There, the suspect voluntarily answered some of law enforcement's questions. The suspect had not unequivocally invoked his right to remain silent"
      They answered some questions and then later decided to go silent without invoking their 5th amendment rights and their silence was used against them. Given this precedent was set a decade ago there are likely many examples of this happening now.

    To me... as Polish citizen who never been to US... the relationship between police and citizens in United States seems to be fundamentally broken.
    I never saw Police as this oppressive force. I had a ticket written once in my life. As pedestrian for jaywalking - I happened to jaywalk on red light for pedestrians right in front of traffic police car with some friends. Police stopped at sidewalk with their car, never left their car, we stood in line to police car's windows on both sides while they wrote each of us tickets - they were apologizing to us while writing tickets, citing if they let us go without doing anything they could get in trouble as multiple other drivers saw us. The amount was insubstantial - equivalent of 10 USD. When I was young Police gave us a ride home when some assholes stole wheels from my parent's car.
    I was routinely stopped twice as pedestrian and couple times as driver, each time interaction was polite and neither me or police officer created any artificial problems.

      It used to goid relations up until Bill Clintons era in our part if the state I live in. My son got a ride by the sherrif a couple times from school when I was detained in traffic and got latw, we had no cell phones in those days. Now some of the sherrifs are worst culprits. This country is gone commie.

      It is TOTALLY broken! The police are no longer intended to "protect and serve" they are tax collectors and bullies in many cases. It is sad to see what they have been transformed into! In Europe Police cars are very visible because they want people to know they are there to help our police cars are most often not plain and they try to hide cause it isn't in their best interest if you see them early.

      Your experience is pretty much how it used to be in the USA as well. There became a shift for a few reasons over the last 100 years. Turning police into "Tax Collectors" in the 20s with what we call "Prohibition" and the Volstead Act. This made alcohol illegal. This put people who wanted to drink at odds with law enforcement who had to stop them. That law was overturned, but the damage was done. Step by step we saw cops put in a situation to not "keep the peace" with measur d application of justice but as Law ENFORCEMENT Agents. Many times that meant no justice, just compliance. An example is a woman assaulting her husband, calling the cops saying he assaulted her. The cops show up and see all his things broken, his clothes on the front lawn and scratches and bruises on his face and neck but no injuries on her - and either arrest the man or tell him to just take his things and go somewhere else for a few days. Why? Because one time a woman sued the police department and won.
      Now with the culture of hate thrown at police, it disincentivizes good people from becoming cops. Often you get people with an authoritarian streak, bullies and such who don't care how they are treated. They like the power of the badge and gun.
      I know too many good people who have quit the profession and too many bad cops getting promoted. It's sad.

      Keep in mind that videos like this present the absolute worst case scenario when in reality, the overwhelming majority of US citizens go their whole life without ever having a negative encounter with the police.
      Also, this guy is a lawyer, and lawyers love to give people the impression that the police are always out to get them because it's good for business.

    Regarding traffic stops I like that you encourage people to be calm and polite and to verbalize their intentions so as not to acquiesce or provoke by being silent such as “I do not consent to…..” and “I exercise my right to remain silent” and “I am not resisting” and “am I free to go?” and “am I being detained?”
    Settling matters in court however is a problem since the courts barely have a clue about our Rights, where they come from, and many public servants are compromised.
    Those traffic courts are administrative courts, non-judicial, and have limited jurisdiction. They follow rules, procedures, and statutes. You are not going to be allowed to bring up the Constitution, Federal or State.
    What’s going to happen will happen and you will have to take your suit to another venue.
    Regarding traffic violations and remaining silent. If you are in an accident with another party remaining silent will cost you if you are the one receiving the ticket when the other party was at fault.
    I had that happen to me because I thought my argument would be made in court where I was to present my evidence. Nope. The other guy got off and I paid the consequences through a fine, points on license, and increased insurance premiums because I was a greater liability.
    I was told by the court I was to have settled the matter there with the officer who was at fault. After learning so much more about the legal system I am not so sure the court officer was correct.
    May 1788 in Federalist No. 78 Alexander Hamilton wrote :
    “A Constitution, is, in fact, and must be regarded by the judges, as a fundamental law.” ”The constitution ought to be preferred to the statute, the intention of the people to the intention of their agents.”
    ”Nor does this conclusion by any means suppose a superiority of the judicial to the legislative power. It only supposes that the power of the people is superior to both; and that where the will of the legislature, declared in its statutes, stands in opposition to that of the people, declared in the Constitution, the judges ought to be governed by the latter rather than the former. They ought to regulate their decisions by the fundamental laws, rather than by those, which are not fundamental.“

      Consider how you define traffic violations. You can have sudden acceleration or reckless driving for example. One is a civil infraction and one is a criminal charge. There is very little black and white in the legal systems. Most scenarios are very case specific.

      The reason constitutional arguments get shut down in traffic court is that people who make them usually have no idea what they’re talking about and the judge is not going to let them waste everyone’s time. If you’re willing to go to a law library (provided free in many jurisdictions) and can find a precedent to support an argument a judge WILL hear it, though they may or may not agree with it. Your vehicle crash example wasn’t specific enough to be sure, but it sounds like you expected the judge to determine fault in the crash, which is not something they do. You were cited, they decide whether you were guilty or innocent of that charge. That’s it.

"Traffic court" is not administrative, it is judicial, but you may appear before a magistrate or other part-time judicial officer that may know the law and care. More likely, you will be part of a massive docket and your case just pushed through. The opportunity to make oral constitutional arguments is virtually zero. Does anyone out there know of or ever filed a pleading? That is extremely rare and if a so-called low end traffic matter, you will likely get laughed at. As suggested, there are so many missing details that it is difficult, if not impossible, to provide even fundamental commentary.

    On a reasonable amount of time for a traffic stop. I was stopped once, and the officer didn't exit his car for 22 minutes. I sat calmly without moving. He then came up and asked for all the usual documentation. I had my registration and wallet in the glove box along with a legal pistol. I informed him of this fact asking how I should proceed. He said let him open the glove box. I said I was consenting to no search of any kind. Asked if he couldn't check that everything was up to date on his computer from my license plate after verbally ID'ing myself and giving my driver's license number. He agreed to that. Let me go in the end, but the total stop was over 45 minutes. Since then I make sure there are no firearms in the same place as such documents. He never told me why I was stopped.
    Do you have an advice on how best to handle such a situation?

      Why not sue them under rodriguez Supreme Court case. The rodriguez instance lasted 29 minutes in the stop.

      SCOTUS has ruled that around 10 minutes 15 minutes at the most is enough time to detain for a traffic stop. Always keep track of the time when the cherries and berries come on to the time you are free to leave.

      I head off some of the potential drama by having my license, registration, and insurance card in hand at the window by the time the officer approaches, then I make eye contact with a smile and before the officer can utter a word, I ask "Why did you stop me? " All together, it seems to catch them off guard and they just want to be rid of me.

    This is one of the clearest, most concise legal advice videos I've ever seen. Thank you.
    I know in Mississippi if you have a firearm in your vehicle you have no duty to inform the officer during a traffic stop. However, I think if you're carrying or have one that will be visible if a door is opened and you've been asked to step out that you should definitely very politely inform the officer before he has a chance to see it and go into a cop panic. It has been a long time but I have gone through driver's license check points and had my pistol in my holster in my right hip. Even though I had no obligation to do so, I told them that I had a holstered weapon that I had to reach past to get my wallet. The response was a thank you for telling them. One said as long it remains we definitely have no problem. At such a checkpoint an officer in front of the vehicle of on the side could easily get a glimpse of a holstered firearm in such a situation so I feel like it's best to head it off. I assume, though, in other cases if my license plate has already been run that the officer has been informed that I hold an Enhanced Carry permit so the assumption would be that I'm armed.
    Perhaps, if you haven't already, you could do a video explaining such situations and how the laws can be very different between states.

      I live in Mississippi and I have a ENHANCED CCW PERMIT AND I AM REQUIRED TO TELL ANY OFFICER A A TRAFFIC STOP THAT I HAVE A CONCEALED CARRY PERMIT AND I HAVE TO SHOW THEM THAT PERMIT AND MY DRIVER'S LICENSE, WHICH BOTH HAVE THE SAME NUMBERS ON THEM.
      MY TAG NUMBER IF RUN THROUGH LAW ENFORCEMENT WILL ALSO SHOW THAT I HAVE A CCW PERMIT.
      I WISH I HAD JUST LET IT EXPIRE EXCEPT I DO TRAVEL TO OTHER STATES AND NEED THE PERMISSION SLIP FROM MY GOVERNMENT.

      No, Mississippi is not a "duty to inform" state. I have had a permit (even though permits are no longer required for either open or concealed carry in Mississippi) since MS began issuing them and I have had an Enhanced Carry since MS started that. I have studied the law on this extensively. It might occasionally be a good idea to tell them but it is simply NOT a requirement.
      You said you wish you had let it expire... there are quite a few places you can legally carry with the IC -- Instructor Certification/Enhanced Carry -- than you can without it. And, of course, the reciprocity with other states is a definite advantage. I go to South Carolina occasionally and they only recognize MS's permits if the permit holder has the Enhanced Carry.

      Thank you for the information but I read the papers when I first got my permit and in it reads I have to let the MHP know that I am carrying a gun.
      If ask for my driver's license I also have to give them my CCW PERMIT.
      I HAVE BEEN STOPPED ONLY ONE TIME AND THE MHP said don't touch yours and I won't touch mine.
      He also told me he already knew that I had a CCW PERMIT BECAUSE HE HAD ALREADY RUN MY TAG #.
      THIS WAS YEARS AGO.

    In 55 years of owning guns of every description including NFA, I have never had a negative interaction with either ATF or Local LE. However, I do agree with every bit of advise you gave. I see nothing wrong or sketchy with the things you say. I have heard stories from others that were more difficult to handle. Of course, living in the pro gun and pro carry state of Florida has been most helpful. I could never imagine living in an anti gun state.

      Yep, as a guy who doesn't generally want to cause issues and wanting to help, I was willing to talk to the police. I won't do so again. I had police knocking on my door, so I go and tell them what I was doing throughout the day as they accuse me of something. I tell my story once again, and they insist that my truck was tagged as being involved. They say "this place has a camera, will it confirm that you were the only one in the vehicle . . ." blah, blah, blah.
      I assumed it was an elicitation exercise or something. But nonetheless, I was getting mad. Like really, can I actually go down for some shit? And then they do this nefarious shit where they use my story when question my brother (who wasnt present during my questioning) asking if I did what they alleged or was it possible I did while engaged in what I actually did. They essentially tried to merge their story with my facts.

    I've been pulled over 4 times since January of 2020. Every single time, I've notified the officer/deputy/trooper (yes, all three have pulled me over) that I am a CCP holder, and I am carrying. I was told that this will always put the LEO on edge and make them suspicious of you.
    That has never happened. The trooper asked if he could disarm me, and I agreed. The other three times, the LEOs said, "Don't show me yours, and I won't show you mine."
    I am always polite and treat them with respect.
    And I haven't been ticketed at all.

    Well not all cops are bad. I been pulled over a few times and it was a breeze with no ticket. First I turn off the vehicle, open every window, turn on ALL inside lights (if it’s night out) and place my two hands on the steering wheel and engage with a simple “Hello officer how are you?”
    Another time i let my 15 year old son drive in the back streets to start teaching him how to drive. He got pulled over and was nervous, I said “Son calm down and do what I say” he did what I said I do above, the officer approached the vehicle asked for his DL, I spoke and said “Officer I apologize but he has no DL and I’m teaching him just in the backstreets how to drive like my dad did for me when I was his age, I’m so sorry and how do we move forward” he looked at me and my son, smiled and said switch seats and go home. I’m sure there are bad cops, but being nice goes along way! Stay safe Yallz!

    It may have been important to note that many states require you to notify an officer during any encounter that you are carrying a firearm. That varies from state to state, so it’s important that you know the laws in the state you are in.

      That true if you are carrying a firearm on your person. If are not carrying a firearm but have a firearm not in reach (some states consider that a firearm in reach is "carrying") and you are legally allowed to have that firearm and legally stored, most states consider that situation to be different and is better legally protected from arbitrary search and seizure. Unfortunately there are some police officers that don't want to do 100% legal searches and will do "hit and runs", by claiming a false infraction and then see what you consent to.

      @@MattEwers-j7m That is not necessarily true. That, too, varies by state. Here in WA, I have been told both ways. The last time I was pulled over (it's been a while) I had my CPL, and the officer only mentioned it after he saw the physical card behind my DL.
