    I had cops stand on my porch once for over a hour while other officers were securing a search warrant . They finally arrived with the warrant and then destroyed my front door and roll up door on my garage. It was pretty destructive the way they entered and then placed me in cuffs at gunpoint and then started cutting open my gun safe as well as a floor safe in my bedroom. They were tearing my house up looking for drugs and cash as well as firearms. Finally they discovered they were at the wrong house. I tried to tell them they had the wrong house from the beginning. But they had no interest in the effort required to verify the addresses. I won a judgment of
    $71 ,891 for damages after a 5 year court battle

      Plead your 5 th and 6 th, don’t ask me any questions without my lawyer present. Consent to nothing, then go silent. At that point they have 20 minutes to fool you into talking. Just wait it out.

    Back in the mid 70's. I did work at the border. I had no idea of protocol so I asked.
    They told me that I would have to leave my vehical and an agent would take me to the work location.
    When I got back to my vehical, doors wide open, tools scattered on the ground, pappers were blowing around in the wind, and my car seats were stacked up outside my vehical.
    I was in shock. They tore my car apart, they did not give explaniation and would not help me put it back together. I was furious. Im here doing work for you and you destroy my car !
    I called my boss, he came to the site and said we will never be doing work for them again. He also paid me for the time and parts to put my car back together.

    Great video with one add: NEVER step outside your door if Police show up without a warrant. Your rights change the minute you step outside the threshold of your home. Police will use all kinds of tactics to get you to exit your home. DO NOT!

    This man is 100% correct about them tearing your car up. When I was 17, I consented to a search, and the officer yanked wires out of my amplifier, breaking the terminals, ripping the wires and RCA cables, flipped my subwoofers over on their face, puncturing one of the foam surrounds on the subwoofer, ultimately ruining it. I called the police department and they asked "did you consent to the search?". That was the end of the it. I consented. I've never consented to another search since then.

      I worked with a guy who had his whole RV torn apart because he gave consent to a search. The cops pulled out everything, found nothing, then left him sitting on the side of the road with a big pile of a mess.

      Same thing with a border search. They can tear your whole car up, pulling out seats, spare tire, wheels off, even pull the bumpers off and more. Even if they find nothing they have No Legal Responsibility to put Any of it back together and often just turn over the pile of parts to you with a smile and "you are free to go". Yea, in what now?

    I was stopped on a highway for speeding and the state trooper asked if I minded if he searched my vehicle. "Of course I do !", I told him a bit resentfully. I think my answer sort of surprised him because I was assertive and didn't hem and haw about it (this was around 1982). When he asked why I minded so much I answered "Because this is America and we have a Constitution, and I swore an oath to protect and defend it (I was in the Army at the time). I was stopped for speeding and now you want to search my vehicle with no crime or warrant, so I do mind if you search it."
    I don't know how he felt about my words, but I was respectful overall, and didn't swear or cuss him out. He told me about drugs being shipped in cars with out of state plates and then handed me my ticket and I was on my way. He was smiling as he turned and walked away, so it didn't go too badly.

      And the Police are under no obligation to restore your vehicle to "pre-search" condition. They can, and do, leave it just like they made it, seats out, seat covers off, compartments emptied, etc.

      Happened to a friend, friend got stopped supposedly for going a little fast, Officer asked where friend going in such a hurry, friend said I need to get my pot home, officer completely shut friend down from further explanation and commenced with a thorough search of vehicle , friend remained quiet 😂only to find NOTHING! Friend had potting soil! The Officer only heard pot! My friend is an Attorney!

    NOTE about CONSENTING to search your car: I’ve heard of case where owner sued Police for damaging his car while they were searching it. The judge responded with “You gave up your rights when you consented to the search of your vehicle so you can’t sue for damages”. So that's another reason not to give a consent.

      That's a hard sell -- if door is open, they may present you from shutting it, and callng a Sherriff/Lawyer WHILE in a stop situation would only be an aggravation. I'd like to know what Esq. Jeff thinks about making declarations on 2A rights, even 6A rights, and asking for the officer to call for a Sherriff (or PD if the Sherriff conducted the stop). It's like I've seen many times, folks demand the officer to provide their name/badge, and request for a supervisor (makes sense if you're a woman and don't want to be searched by a man, etc.)

    I was stopped while carrying here in NH and the officer asked if I was armed. I told him I was, what I was carrying and where, and told him I would comply with however he wanted to handle things. he smiled and said, "how about you don't show me yours and I won't have to show you mine?" I agreed. Verbal warning for speeding, no muss, no fuss.

      Same. I work Search and Rescue and have a CCW permit, and if I'm working a crime scene or formally sanctioned search with law enforcement present, I just let them know I'm carrying for safety, and no one cares.
      Even if they did, I'm fine with showing my weapons. I train and handle working dogs, and those you can see plainly. I don't see the difference. In a traffic stop, the first thing I say is that the dog loose in the back end is trained to prevent him from reaching his arm into the vehicle, and then that I am carrying.

      @@jason200912 I've yet to have anyone that actually asked. Like OP said, I tell them the type of weapon and where it's located on my body, and they don't follow through. Granted, I am a small woman, and I don't look like much of a threat.
      Also, I carry my revolver with me backpacking and on wilderness searches, so it's used to rain, ice, snow, etc exposure; I just maintain it accordingly. 😅

      Don't just record locally stream to an online secure account as well.
      There's many videos online of cops breaking people's phones or deleting videos. The online account will keep the online version of the video regardless

      Being aware is the vital first step but being willing to stand up for them is the vital second step. Its one thing to know a cop is violating your rights, it's another to stand up to them. A comment above is from a guy that had his rights violated while he got some restitution in the end, it cost him five years of court and grief. People get in the situation and think, nah, easier to just bend over now and try to forget getting screwed with therapy.

    A gun threat was reported at my daughter's elementary school. My daughter was named as part of the group walking during PE when this was "supposedly" said. The city police showed up at my house and demanded to see my guns and said that my daughter couldn't come back to school until they saw them. Turns out after speaking to all parties involved it never happened and was all over jealousy about a boy and my daughter had absolutely nothing to do with the conversation.

      So this is a case of being "Swatted" right? Tell us more. I can see where the police could claim exigent circumstances to gain access but by the same token, the police visit is based on hearsay. So it comes down to whether the cops have the nerve to push it and possibly force the door. Very dangerous situation to be sure.

    I was pulled over by a Missouri State Trooper because I was speeding. I had two 9MM with me one on the passenger seat and one in my cup holder in the center console. He never batted an eye, said I always encourage people to carry, then took my license registration and insurance to his car and never mentioned the pistols or asked me to get out but I just left my hands on the steering wheel. He returned my things, said have a nice day but please slow down. Had this happened in my home State on kommiefornia, I would have been arrested on the spot. I love rural Missouri.

      Back in 86 , I was 16. I would drive 40 miles one way to work at night to work. This was in Harris county Texas. My oldest brother advised me to carry his 45acp. I was pulled over one night by Texas DPS trooper for a tail light that was going on and off. He saw the 1911 on my seat and asked to have a look at it. He cleared it, then felt the trigger pull weight ( obviously he was a 1911 enthusiast) he asked me why I carry it when I'm only 16. I told him how I have this long drive to Conroe to work and it's always at night. He wrote me a warning for the tail light, loaded my 45 back up handed it to me , and said be safe out there tonight. I❤️ Texas.

    It's very disturbing that in this country, after more than 250 years, it is very easy for any police officer to find a 'legal' way in which to physically assault any citizen and justify it in court.     In the states I travel to, as a CWP holder, I am required to state that I am carrying at the point he asks for ID. Never had a problem. Funny thing, a traffic stop in Florence, AZ, the cop stated that city policy required him to take my gun until the stop was over. I carried a 1911 cocked and locked. He struggled with it for 8 minutes before his supervisor showed up. He wrestled with it "trying to make it safe". When they finally got the actoin open, the chambered round fell onto the floor of the cruiser. After a warning for speeding, which I was doing, they returned the cleared gun and magazine. Several days later, I heard from a friend who lived there that the cop who stopped me was in trouble for having "unaccounted for ammo" in his car.

      The outcome with the unaccounted for ammo is funny! That said, I am concerned about inquiries on guns, or weapons, when I am traveling about. I'm retired and accumulated various guns over the years, which a several ownerships prior to my possessions. I transport custom pistols and rifles of significant value and worry about any Officer ever stating, "well, I got to check these to see if they're stolen?" I;ve started carrying the purchase receipt for the very common pistol I now carry for self defense; that's how nervous Offical overstep concerns me!

    From a deputy’s perspective, I really appreciate the way y’all give information. You’re not saying all officers are bad people and you always stress people stay calm and respectful. I know defense attorneys are not the most popular with a lot of officers but more of us are not threatened by this information because we respectfully do our jobs.     When you purchase a home - consider the porch area...
    My current home has a fully enclosed porch with its own set of exterior storm and inside doors which are always locked as is the inside door to the house proper.
    When I go to answer the door I close the inside door and never unlock the outside storm door. No foot in the door, no chance for home invasion, and no open area to see something suspicious to establish probable cause!
    If your home doesn't have the same arrangement consider adding the enclosed porch - at very least, install an exterior storm door that remains locked even if you open an inside door.

      I dunno. Me I'm half arsed paranoid. I went for a home set well back off the only road into the area (only home on the street) stone and mortar fence line backed up by six acres of hedge maze, gate house with armed private security (all of whom I know and trust and pay well), private drive to main house, blast proof doors, bullet proof windows blast louvered shutters quarried limestone block walls, roof is gabled to a fare-thee-well with many covered hides along roof line. But I've been thinking lately, all that might not be enough. So I'm wondering if it might be worth it to install a murder-hole at the front entrance. Just in case. Thoughts?

    As a police officer of 20 years I have only once asked to see a persons weapon. After a self defense incident and I knew some rather gun-ho newbies were on the way lights and sirens. I advised the person of this and said if you want you can place it in your vehicle or my patrol unit. I gave them the choice and they placed it in my unit freely. This way I could put out over the radio the weapon is secured making it a bit safer for all of us.
    What I will say is this. I patrol a rather rural small town area. My backup is usually a ways out, with that I consider the fellow citizens exercising their 2nd amendment rights as my closest backup. Our state has both constitutional concealed carry and open carry along with concealed weapons permits class 1&2. I encourage folks to carry and love having chats about the new handgun or rifle they got and even the in-depth conversations about why they chose it or the ammo they chose and why. I am the type of cop I am because I took to heart what the lead instructor said after we passed our tests and prepared for academy graduation. He said " Be the cop that gains the public's trust and respect to where you have five people jumping beside you to back you up instead of in front of you to take you on."
    I will say this as a peace officer I cannot give legal advice. With that if you ever have to use your firearm or even display it to diffuse a situation, PLEASE PLEASE call your attorney and don't say a damn thing even after given your Miranda rights. Here is why, our cameras will be on we put what is said in our reports and that all goes to the court. So in other words make it a clear as clean glass for your attorney to represent you. Stay strong ya all exercise your rights. Oh and if your ever in my neck of the woods feel free to pull up say hi and have a chat about the type of iron you like.

      Excellent information. In my home State (N.C.), CCP holders are required to inform a traffic officer: "I am a CCP holder and I am/or am not exercising my right today" as soon as he approaches my vehicle." How do you (as an officer of the law) want that reply issued.

      To answer your question. You stated it perfectly. You stated you have a permit along with exercising your right. The only thing I would say or add is the location of the weapon. Reason being you will be reaching for license, registration, and proof of insurance. By giving location of weapon this can ease the situation on the officers side. Especially if you get a jumpy young pup.

    I took a Criminal Justice class when I was in college, and the instructor was a Detective with the County Sheriff's Dept. He told us that if a person has a concealed handgun license and they're ever pulled over, the best course of action, roll down your window, put both hands out the window, and when the officer comes up to the window and asks for your license, insurance, registration, before you move your hands, you should tell that officer, "I have a concealed handgun license, and I do/don't have my gun with me," because when they run your name in their computer, it'll show you have one, and then they'll come back and ask if you're armed. Fortunately I've only been pulled over once and had to deal with this, and it was a VERY funny interaction with the cop.

      This only applies to voluntary interviews. Miranda still is required if there is coercion. And they can't compel you to speak, they can just comment on your silence at trial which is normally an absolute no go.

    If I’m in my home and he doesn’t have a warrant tell them they are trespassing. If you get pulled over by a cop do the following: 1st Invoke your 1st Amendment Right to Film as a member of the press. 2nd Invoke your 5th Amendment to answer any questions without the presence of your attorney. 3rd Invoke your 4th Amendment to inform the cops that you refuse any and all searches.     Thank you. I live in Mississippi & have a advanced Conceal carry permit. I was not paying attention to the speed ( 45 in a 35 ) passed by a unmarked police vehicle. He lighted me, we knew why he stopped us, we were smiling, gave him my license which returned a 1023 meaning license to carry. This guy was cool, told me to be more careful & said he loved people who carried guns.

      Yes, thank you very much for the information! I have only been stopped by officers three times in my lifetime (I'm in my 60s). Once for a headlamp out (actually just very dim) and that officer was very polite and professional and let me off with a verbal warning. I replaced it the very next day. Don't ask for trouble! Once I was stopped in New Mexico and they said I was speeding, which I was not. I didn't argue, I looked over the ticket and it said that if I didn't sign the ticket that I would be taken into custody. I was passing thru that state with my cousin on the way to get some of his belongings. The last thing I wanted (or needed) was to go to jail on a three-day weekend trip! Did my out-of-state license plate encourage the LEOs to enrich their county at my expense? I think so but it would have cost me a lot more time and money to fight it in court so needless to say I found another route back! So I've gotten only two tickets, one for the New Mexico speeding ticket (undeserved) and the other was for parking on the wrong side of the road which is ridiculous since that is why a vehicle has rear-view mirrors. County governments are always finding ways to enrich their coffers as well as their pocket books, I have no doubt!

      @@tomnisen3358 Yes it's true that if you don't already have a lawyer or can't afford one then you can get assigned a public defender, however you should know that public defenders are often fresh out of law school with little experience and its pretty certain they didn't graduate anywhere near the top ot their class. Technically you'll have legal counsel, but the real question is how competent and committed they are to aggressively defend your rights. This is the unfortuate reality that folks who aren't well to do will face when they go to court.

      If they're NFA there's a form 4 with a tax stamp. And your local PD has a photocopy... because part of the process is local endorsement stating it doesn't violate any local laws to own said NFA gun...and for, air fingers quote, administrative purposes, most PD's keep a copy of all documents they endorse. So while it's NOT gun registration, it's "Gun Registration." Food for thought.

    Many places in Michigan if you say you don't consent, they will bring in a dog and say it hit. This has been done to me several times. I do not use or transport drugs and have never had anything found during a search. It felt as though by denying consent many officers get upset because how dare you deny them.

      Someone I know wink wink and his friend got pulled over just as his buddy lit up the blunt. His friend freaked out and put it out and threw it under the seat. The cop walked up and wanted to search. He denied and they brought the dog. Dog somehow didn’t hit on anything 😂. Someone I know got lucky that night.

      That can be used as a defense in and of itself. If they make you wait for a K9 unit, unless it's nearby, that is unreasonable extension of the traffic stop. This does have some precedent, but can go either way based on the circumstances.

      @@GReaper if you watch On Patrol Live, they make people wait on K9s all of the time. A few weeks back they walked a dog around a man who had been riding a bike. Not the bike, the man. I had never seen anything like it until then. It was pouring rain and even though the dog did not alert, the cop lied and searched the guy anyway. They found nothing at all. It's interesting how many laws the cops will break on live TV.

    I was out fishing one day and pulling my kayak out of the water. I had my Glock on me and the officer clearly saw it. He pulled up asked me how the fishing, not so good I said. Packing up and heading some place else. Never once asked me about my gun. Very professional

    I'm so glad, once again, to be a country boy, who lives in a lowly populated, rural area. Most of us never purchase our guns through this background system. We've all been very suspicious of these background checks, and putting our names into any systems that we can avoid from the start. Most of our firearms, on average, are a decade old, or older. Everyone I know has baught theirs second hand, and many of them have been sold and traded second hand over and over again. I wish them luck trying to track everyone's guns out here in country places like Kentucky where I live, or West Virginia, Ohio, Tennessee, North and South Carolina, Florida, Georgia, Alabama, Mississippi, Texas, Arkansas, Louisiana, Oaklahoma, Kansas, Nebraska and several others. Not one single firearm ever manufactured can be tracked to my name, and I plan on keeping it that way to. Also, Im sure law enforcement works completely different in big cities, and large metropolitan areas, but here in the country, these feds are going to find it hard to find any police, city or county, who are going to just willy nilly infringe on their citizens rights. I know for a fact, the Sheriff in my County, here in Kentucky, has said publicly he will not do anything that isn't supported under the constitution , regardless of who shows up and trying to order him, or pressure him. This Sheriff is a good, Godly man, who cares about freedom, country, constitution and would rather be fired then do anything he feels is wrong, or un American.

But I had an officer asked me no less than 20 times if you could search the vehicle. if I would’ve said the first five times am I free to go that would’ve shut down 15 times.     In the state of Oklahoma if you are carrying a firearm you are only required to inform the officer if they ask and it is illegal for them to disarm you unless you are committing a crime. The law is Title 21 Section 1290.1.

    I’m lucky to have retired in Polk County Florida. Where our Sheriff Grady Judd, is a staunch 2nd Amendment supporter, who has told me personally in conversations, that if any federal officers who inform his agency they intend to come in and investigate any law abiding citizen, they will actually be told to LEAVE NOW! Unless they have something in writing on a Federal form or Search Warrant! That even if they do they will be required to be escorted by a Deputy. If I should encounter one at my door and he/she has no warrant, first thing to do is dial 911, informing them what’s going on, then call Sheriff Judd on his cell phone!

Back in 2018, when legislators in all their wisdom had never had a law on the books to prevent that awful crime. So like they alway are prone to do, they went TOO FAR! With a Sheriff showing them how far they went. That has since corrected the situation. But there are folks out there that need to be protected from themselves, for our sake. That’s still better than any blue state refusing your Second Amendment entirely.

    If you get pulled over. Stop the car, turn it off and take the keys out of the ignition. If they ask you to exit the car, do so but lock the door as you're getting out and close it. If they ask why you did that: "Habit." Now, continue with the stop. I've seen cops get INSIDE a car when the driver exited and left the door open, I've also seen them open the door to give a cursory look inside.
    I had a cop pull in behind me on the Jersey Turnpike after I had a flat and was on the side of the road trying to fix it. Not being from anywhere NEAR that area (I was moving) I didn't know I was supposed to stay ON the road. Seriously? That's what the cop told me that I was just supposed to stop my car in the lane and wait for assistance. Come on NJ! That's DANGEROUS! Anyway, when the cop saw that I was just about to get my spare on, he helped me finish up, then took his flashlight and looked in my tiny car to find it full of boxes and stuff. He asked why and I told him I was moving (My plates were Arkansas.) He asked if he could search my car! I thought about telling him no but then decided I would by telling him "Sure! Just do me a favor and put it all back in afterwards. It took me 2 hours to get all that in there." He decided against it after looking again. I know how to load a vehicle be it truck or car to where there's no spaces. An ant couldn't crawl between the boxes!
    I could tell you a horror story about a simple traffic stop that escalated into being detained for 20 minutes while they got a dog out to search my son's car even though he did everything right and subsequently got arrested for what the officers called 'knuckles' in the pocket of his girlfriend's jeans, inside her suitcase, inside his trunk after the dog ran around his car 5 times and then sat at the trunk when the officer lowered the leash which they called 'alerting for drugs.' Ending? after 18 months, all charges dropped. He was on the side of the road for 2 HOURS!

    Good stuff! We had a local sheriff's deputy here that was doing consensual searches in traffic stops and he was planting drugs in the vehicles of the folks he stopped. He was ultimately discovered by a sharp-eyed Assistant State Attorney that took the time to carefully review his body cam videos. The case is State of Florida v. Zachary Wester. #Subscribed

My attorney got the case dismissed in 10 mins and credits my son's silence for killing his charges. My son left for college the next day. I was so proud of him

    Cops showed up at my door saying that they were investigating a missing person named XX. They asked me if I knew that person. I did not know that person and told the officer so. He asked me if anyone else was in my home. I said no...the truth. He kept asking me if he could come in to look around. I said no repeatedly. He became more insistent...and I became equally insistent that he could not come in. At that point the missing (as it turned out, the person's spouse) showed up and started to walk up my driveway toward the back of my house. I told the officer that she was unknown to me and I wanted her to leave my property.....at which point the officer removed her...with the threat of being arrested for trespassing. The cops left without any further action. I said NO...and they had to leave.

    I love that you cover topics that other attorneys rarely cover... Rarely hear about invoking your 6th amendment rights as important as they are. By refusing to answer questions and asking for an atty, it puts you at a great advantage (as long as you remain quiet after.) It's Very important that you remain quiet, bc once you start talking again, they can ask questions which if answered, most likely will be admissible in court. I've even seen cops talk "amongst each other" close enough to the suspect for him to overhear (on purpose of course) in order to invoke a response so that the suspect starts talking again. They normally say something along the lines of hey, this is the same guy that did XYZ on abc st last week, or that's a lot of dope in the trunk, etc... since they're just talking amongst each other, when the suspect interrupts and says "no I wasn't", or "there's no drugs in the car", they can ask questions again, so stay quiet, as hard as it can be...
    I was pulled over several yrs ago en route to purchase baby formula. I realized rather quickly the direction the stop was going in (asking if anything illegal was in the car, etc), I invoked both my 5th and 6th, which REALLY pissed them off. I was illegally detained/searched and ultimately arrested after 3 officers falsified evidence. I didn't beat the ride, but I did in fact beat the case and now I'm suing the department with help from one of the best civil rights attnys in the country! (just turned down a 40k settlement offer last week) REMEMBER... YOU CANT BEAT THE RIDE, BUT YOU CAN BEAT THE CASE! And a bonus is getting to see them play defense while your attorney deposes them... Funny how much they squirm/throw each other under the bus while being questioned under oath.

    ALL of these aspects concerning driving, NEED to be taught to new drivers! When I was 17ish, I went through an ordeal with getting pulled over one night at the beach for "driving left of center" (which I knew I wasn't doing). With how far back the cop was from where I pulled out of a hotel parking lot and the time it took him to flip his lights on and catch up to me, there was no way he could have seen that... even if it were true. He pulled me and 2 friends out of the car, searched all of us, stuck me in his front seat... turned his heater on and pointed all the vents at me (at night but still during the summer time), while I was in his car...he tore the inside of my car and my trunk apart, came back and accused me of stealing a cd player that I had in the trunk (knowing the hotel didn't have radios, I had brought mine from home), and the last thing he did was ask me didn't I remember him from the previous years festival when he arrested me. Now, I hadn't been to the beach in 5 years prior to the weekend that this "traffic stop" happened. But, he kept telling me he know it was me because he remembered my name and address because of how much trouble I caused at whatever festival he was talking about where he supposedly arrested me. After about an hour and a half of being pulled over and all this back and forth, I told him that due to the fact my mom was the assistant clerk of superior court where I lived at the time... I did everything I could to stay out of trouble, as to not reflect badly on her as a mother or as the assistant clerk. I told him that if he didn't believe me about any of what I told him, he could call her up right then and they could discuss it. He quickly ended the conversation and left. Of course, my friends and I had to put stuff back in the car and just took everything he threw in the floorboards and we threw it in the trunk so not to waste time putting stuff back where it belonged. Without question, when my kid got the driving permit, we started having conversations about this sort of stuff. I wholeheartedly believe it should be taught during drivers ed classes and reviewed when testing for getting their permanent license.

    I got in serious trouble in my younger days. Since then I drive the speed limit, wear my seatbelt, don't drink unless at home. Been pulled over a few times. License, registration and proof of insurance are together in a little folder. No furtive movement, no small talk nor answer questions regarding their reason for the stop. Never give them any reason to escalate. Remember that bearing arms is not limited to firearms.

      Officers are no longer allowed to ask you if you know why they pulled you over. They will now be required to tell the driver the reason for the stop rather than asking questions designed to get information, at least in CA. Thanks to Assembly Bill 2773 effective January 1, 2024.

    I got pulled over in 2000 driving across the U.S. (Vermont to Nevada) on my own. It was either Arkansas or Tennessee. My vehicle was plated in Quebec. I wasn’t speeding. The reason given was that I didn’t have a front license plate, which felt off to me as I had never had that issue before. The officer then moved to the passenger side window. Elbows on the window sill, arms dangling inside my car. I remained polite, never got out of my car, gave the officer my driver’s license, insurance, registration. He handed them back. He asked where I was going on my own, was I going to visit anyone, had I gone there before. He kept looking to the back seat, where there was nothing. At that point, he was creeping me out fully because I could tell he was just looking for a reason to either fine or arrest me. Funny enough, he never asked to look inside my trunk. Finally he let me go and wished me a good trip, to which I just said thank you and drove the feck off. Thanks for this info.

    I was pulled over in a company vehicle 2 times in one night for a headlight being out. 1st was local police and the 2nd time was by a sheriff. Police officer gave me a verbal warning and told me to get it fixed.
    The sheriff's deputy was great. She knew the officer who pulled me over after I told her. She then said Chevy is known for bad headlight cabling, walks to the front of the van, and slaps the hood just over the headlight one time. The headlight turned back on. We both laughed. She said "Well looks like your headlight is working, have a good night sir."

      Yep, as a guy who doesn't generally want to cause issues and wanting to help, I was willing to talk to the police. I won't do so again. I had police knocking on my door, so I go and tell them what I was doing throughout the day as they accuse me of something. I tell my story once again, and they insist that my truck was tagged as being involved. They say "this place has a camera, will it confirm that you were the only one in the vehicle . . ." blah, blah, blah.
      I assumed it was an elicitation exercise or something. But nonetheless, I was getting mad. Like really, can I actually go down for some shit? And then they do this nefarious shit where they use my story when question my brother (who wasnt present during my questioning) asking if I did what they alleged or was it possible I did while engaged in what I actually did. They essentially tried to merge their story with my facts.

    This should be required content in all US high school curriculum.
    We teach our kids about the branches of government, about the judicial system, about law enforcement.
    We never teach them how to protect themselves from overreach or foul play from those branches of government.
    At a minimum, setting your lawyer up to be easily successful is crucial.

    Something that has worked for me in the past is answering questions with questions. For example Oficer says do you mind if I search your car for drugs or weapons. My response, do I have to let you. They have to answer no and then you know you don't have to consent or if they say I can't answer that you know he is trying to set you up to fall in their traps.

    I've been pulled over 4 times since January of 2020. Every single time, I've notified the officer/deputy/trooper (yes, all three have pulled me over) that I am a CCP holder, and I am carrying. I was told that this will always put the LEO on edge and make them suspicious of you.
    That has never happened. The trooper asked if he could disarm me, and I agreed. The other three times, the LEOs said, "Don't show me yours, and I won't show you mine."
    I am always polite and treat them with respect.
    And I haven't been ticketed at all.

      "In 2013, the U.S. Supreme Court concluded that a witness's silence to a question can be used against them in a criminal case (Salinas v. Texas). There, the suspect voluntarily answered some of law enforcement's questions. The suspect had not unequivocally invoked his right to remain silent"
      They answered some questions and then later decided to go silent without invoking their 5th amendment rights and their silence was used against them. Given this precedent was set a decade ago there are likely many examples of this happening now.

    I was stopped by TX DPS the other day here South of Houston & I had my AR on my passenger seat & my Glock 19 in plain view on my dash.
    It was a "Ran a Red light Stop" & he didn't say anything about my weapons. He took my ID, went back to his unit & reviewed his camera. Then came back & stated, I made the light by 1.5sec & have a great day. Very friendly stop.

      I also had a friendly interaction with a Trooper recently, north of Austin. I was going 5 over the speed limit or so. He asked where I was going, I told him I was going to see my son play in the high school band an hour away. Turns out he played the same instrument when he was in band. I think talking helped me avoid a ticket.
      He didn’t ask about any guns.

      Assuming TX law is different than Florida, but here you cannot have a firearm on your dash (or seat, or under your seat, etc). Has to be in an enclosure with a lid (like a box, or a gun case, etc). Glove box or center console would suffice.

      @@philipmarsh3522 In an enclosure constitutes a "concealed weapon". In most sane places, open carry doesn't require any permits. (not all places are sane. FL and CA definitely aren't.)

It changes individuals who may have entered the “profession” because they wanted to help society, but ultimately, it changes many of them for the worse. This is what we see in all too many videos. I still believe most cops are good, but far too many are not!

    L i have only been pulled over once by hwy patrol....this is how it went (bcuz speaking to him SAVED me from a ticket!)
    "Hello Ma'am, Officer Smith w the state patrol, do you know why I stopped you today?
    "Probably "
    LOL " I clocked you doing 72 in a 65"
    " I believe it, thats where I had the cruise control"
    LOL again...." just guve me your information please. How is your driving record?"
    " I havent had a ticket in over 10 years"
    He goes back to his car, comes back and says "Yiure right, you have VERY good driving record" (Im licensed in my state to drive any/all emergency vehicles and drive for a living) So, he hands me back my info and says " Im not even going to write a warning: just slow down a LITTLE bit, just a LITTLE "
    I Thanked him and told him to "be safe"
    Him "you too, have a nice day!"

    On a reasonable amount of time for a traffic stop. I was stopped once, and the officer didn't exit his car for 22 minutes. I sat calmly without moving. He then came up and asked for all the usual documentation. I had my registration and wallet in the glove box along with a legal pistol. I informed him of this fact asking how I should proceed. He said let him open the glove box. I said I was consenting to no search of any kind. Asked if he couldn't check that everything was up to date on his computer from my license plate after verbally ID'ing myself and giving my driver's license number. He agreed to that. Let me go in the end, but the total stop was over 45 minutes. Since then I make sure there are no firearms in the same place as such documents. He never told me why I was stopped.
    Do you have an advice on how best to handle such a situation?

      Why not sue them under rodriguez Supreme Court case. The rodriguez instance lasted 29 minutes in the stop.

If you aren’t the type to sue or what not then you don’t really have any recourse but the stop shouldn’t have taken that long and on top of that he never told you why you were stopped. Something stinks bad with that shit

      SCOTUS has ruled that around 10 minutes 15 minutes at the most is enough time to detain for a traffic stop. Always keep track of the time when the cherries and berries come on to the time you are free to leave.

      I head off some of the potential drama by having my license, registration, and insurance card in hand at the window by the time the officer approaches, then I make eye contact with a smile and before the officer can utter a word, I ask "Why did you stop me? " All together, it seems to catch them off guard and they just want to be rid of me.

      Most do not know their rights, rather just enough to know that they need to consult someone that they does. So, invoking your right to remain silent and then speaking to your lawyer is generally wise!!!

    I live near Buffalo, NY. My step dad was pulled over by state troopers and they asked if they could search the vehicle. He told them he couldn't give permission because it belonged to my mother, and they pulled him from the truck saying that anyone who wasn't guilty would give consent so they had probable cause. He was over an hour late from buying cigarettes before he able to call and tell us what happened, and we had to go help him on the side of the road to clean up all the stuff from inside his truck they ripped out and left on the shoulder. Alot of people around here run into the whole give consent or it'll be used as probable cause crap.

      I'm FROM the Buffalo, NY area and the NY State Police are always violating your rights. Look at their boss. The governor, Hochul. I worked at a company whose parts manager was a former NYS Police officer. He and a few others stole a whole semi-trailer full of electronics. Yeah, corrupt AF!

    The last time i was pulled over. I gave the cop my DL, my Insurance card and my Registartion and my concealed weapon license. Then the cop asked me where the weapon was located. And i told him. Under my armpit. He said dont reach for it. Then he wrote me a earning and let me go. He said im writing you a warning because you was truthful with me. Plus the whole traffic stop was recorded on my dash camera. Plus i had a body camera pointed strait at him. He had to behave. The one time i got a ticket for speeding, i did not tell the tyrant that i had a dash camera with gps. In the court room the judge asked me how i plead. I told him, not guilty. Then he said do you have proof. I said yes your honor, i have a dash camera with gps. And i have the mini memory card with me. He watched the video and was shocked. Then he asked the cop, are you joking with me, wasting my time with this man. He was driving the speed limit, but you wrote him a speeding ticket for going 95 mph in a 70 speed zone. When he was driving 68 mph. Then the judge asked if anybody else is here for a ticket from this cop. About 8 hands rose up. He told those people to give the bayliff the tickets. Then the judge said your all free to go. Then the judge said im going to ask your supervisor to assign you to a desk job. Plus im going to put you on the Brady List. Sir your free to go, heres your mini card back. Reformat it so you can reuse it. Once outside everybody asked me which camera saved them, so i told them and that they can get it on amazon. They all ordered one. Cops need to learn that we the people are catching the true tyrants out there.

      yeah, resisting arrest seems like such a lose charge, considering depending on how you are being arrested and how they handle you, your "resistance" is just a natural reaction to being put in physically uncomfortable situations.
      I get resisting arrest, when the dude tries to get up and run away, but if his only "crime" is that his arms are not perfectly loose and relaxed to easily put cuffs on, is that really resisting arrest? When you have 2 or more officers pushing you to the concrete floor and pressing you down with force, that's not a nice feeling and it is easier said than done to not do anything.
      I would argue it's similar to demanding a drowning man not try to swim up to the surface. a sane person will have the natural urge to move, to get to safety and remove the uncomfortable feeling. Likewise, if a police officer forcefully holds your arms behind your back in an uncomfortable or outright hurtful manner.

      @@DatAsianGuy When the dude tries to get up and run away, that's felony fleeing. For resisting it is enough to stiffen up your arms when they try to cuff you. Just know this and don't do it. If this is the only thing they charge you with, the charge will 99% get thrown out anyway.
      Just don't do anything stupid in the first place to get yourself arrested - because if you catch some additional stuff on top, like resisting arrest, disorderly conduct, fleeing, battery on LEO etc. (all the fun stuff the people that end up on youtube videos rack up when they scream, squirm, kick, spit, bite etc), it will matter.

    It may have been important to note that many states require you to notify an officer during any encounter that you are carrying a firearm. That varies from state to state, so it’s important that you know the laws in the state you are in.

      That true if you are carrying a firearm on your person. If are not carrying a firearm but have a firearm not in reach (some states consider that a firearm in reach is "carrying") and you are legally allowed to have that firearm and legally stored, most states consider that situation to be different and is better legally protected from arbitrary search and seizure. Unfortunately there are some police officers that don't want to do 100% legal searches and will do "hit and runs", by claiming a false infraction and then see what you consent to.

    Fun story. Years ago I read the police reports in a newspaper and there was a DWI stop by a guy with the same name as a violent nut from my high school. I was surprised that a small town had another guy with that same first and last name because I knew no one was foolish enough to give the one I know a gun and a car with lights on top. A few months later he pulled an on-duty burglary on me so it turns out someone was that foolish. One of the ever-changing cartoonish lies he told me was that random anonymous people were worried about all the guns I was stockpiling. ...zero. Anyway, he became a felon a bit after that and is currently in county jail on gun charges after trying to M someone with an AW, years after losing his legal access to bang sticks. How you get 6 mos for 5 felonies after trying to violently use the thing the law says it's another felony for you to touch (as commented on just before the 7 min mark, he should be in prison for decades) ....
