My lawyer said, if they had enough evidence to arrest or charge you, they'd do it. Talking to them only gives them a chance to gather evidence against you.

    • @soyounoat2814

rightsideupvt: That is exactly right and what everyone should remember. If they are not arresting you with a warrant, they are attempting to build a case against you. They will twist your words to suit their desire to charge you with a crime even if you are innocent. Not all cops are psychopaths, but many of them are.

We've all seen shows where they lied and arrested a person. Sometimes when they're calling in the details they fudge those, too, so they get permission to arrest when that wasn't even the truth.

I work a third shift, so on my days off, I jog in my neighborhood at around midnight or so. A few days ago, I had cops come to my door and ask me why I was out jogging at 2am. They said it was uncommon and suspicious for someone to be jogging at such an odd time and that I kind of looked like a suspect that was breaking into cars. They asked me to come outside because they just wanted to talk to me. I told them to please leave and they kept on asking why I was refusing to cooperate with them and that I was acting guilty and like someone who was hiding something. They lied and said several people had identified me as the one breaking into cars and if I just came outside and talked to them, we could clear this up. I can only imagine what would have happened if I had gone outside and tried to plead my case right there on my porch.

A couple of years ago some guy lost control of his pickup truck and drove through my backyard, and into the river behind my house. Someone else (not me) called the cops. While they were milling around on my property, one of them demanded my ID and birth date. I refused, and told him I was on my own property, and that I didn't summon them in the first place. He got highly indignant, and said I HAD to give him my information. I told him to get off of my property, and went back inside my home. Whereupon he knocked on my door and demanded I come outside. I ignored him, and he eventually left. I'm sure that police department now has a nice little file on me.

I think we just need the qualification for 'qualified immunity' to be more than showing up at work that day. Violations that cross certain lines should 100% be prosecuted as criminal acts and then a touch more. The police should understand those lines as part of their job, and if they step into criminal behavior are essentially 'not acting as police officers' in that time and not eligible for any immunity. They also should not be shielded from civil liability if they cross those lines.
We shouldn't need a video like this at all. The fact that we do proves that the system has holes that are being abused.

I’m a paramedic, and cops on scene can be extremely helpful. I can use them to ask pertinent questions from family members, to control hysterical family members, or to carry equipment back to the ambulance. Also, many police officers ARE trained emergency medical responders, EMTs, or paramedics.

Even one night I was pulled over for rolling a stop sign. I cooperated and such and in the end I was on my way with a warning. I reiterated to my daughter that what I did is exactly what she should do if she gets pulled over, you stop, don't admit guilt, turn on your lights, roll down all your windows weather permitting and keep your hands visible and answer the basic questions and be polite but never volunteer anything. She said ok and asked why and I answered back with "because, you have the right to remain silent. 1 thing you forgot to mention, and I proved this in court in Brunswick GA. A mailbox has just as much privacy as your home. A cop can not look through ANY recently or previously delivered mail in your mailbox, without a warrant.
In my case, a neighbor stole mail from my mailbox, I was pressing charges, the magistrate was not even aware of mailbox privacy. I demonstrated that nothing can be placed in your mailbox without a postage stamp, I also demonstrated laws on privacy at your mailbox, and, that police need a warrant to search your mailbox. The magistrate actually looked through her book in front of the court, and found I was right.

I had two cops knock on my door late one night just after I got back from my class. I think they must have seen me come in from the car park. They asked if they could come in. I didn't have anything to hide so I let them in. They spent nearly two hours hanging about in my sittingroom asking random questions. It was all very mystifying.
I was very tired, just wanted to go to bed. I offered them tea or coffee or herb tea if they preferred, about 3 times.
After some time one of them saw I had 3 rolls of aluminium foil & accused me of having it for the purposes of cooking up drugs. I assured the officers that I have never been a drug user but sometimes use aluminium foil to make models. They asked me if I had any to show them, which I did not, having fairly recently moved to that location. I offered to demonstrate making one but they were not interested.
When it was past one in the morning I just wanted then to leave. I was tired of being polite, which is how I was brought up to treat police officers. I was on the point of asking them if I could now go to bed. I didn't mind if they wanted to stay sitting there. But maybe they sensed that they had spun this pointless conversation out as long as they could & decided to leave. As they left the male officer said that he believed me about the drugs. "You arn't bright enough for that", he said. As they exited I heard the female officer protest at his rudeness.
Later I had two officers turn up fairly early one Sunday morning. They knocked on my back door, I glimpsed one of them from my bed but they didn't look in my direction. I decided not to get out of bed unless I had to. They promptly left.
I heard one of them tell someone over the road, "Well theres no-one there now." All I can think is that the resident had seen me looking out the window, using binoculars to watch the birds on my little tree & assumed I was spying on her.
So if the police call now I know what to do.
And we are supposed to believe the police are terribly busy?!!!

Then they proceeded to ask questions about drugs in my home, claiming they had received an "anonymous tip" about drug activity there. I said I knew nothing about any drugs and told them to leave my property. As I was closing the door, the one apparently in charge said if I closed the door they would be back with a search warrant for my home.
I then asked him if he was prepared to lie on the affidavit in support of the warrant. They all got puzzled looks on their faces. He asked what I meant by that. I replied, "You showed up at my door asking for someone who has never lived here and coincidentally is currently under indictment for molesting my daughter. He was arrested by your agency. In order for you to get a warrant, you will absolutely have to misrepresent facts to obtain it." Then I again told them to leave my property and I closed the door.

Dogs can be trained to make any type of movement - which can be initialed by a mere sound or word from an officer. I don't know why defense attorney's don't subpoena police dogs in court. If the judge does not allow it then demand any 'evidence' the dog obtained be thrown out.

When i was about 15 I saw an entire battalion of state cops descend on my neighbors house around 9pm. Spotlights, dogs, yelling into a bullhorn, the whole 9 yards. They were even creeping through our backyards. Apparently they thought she was harboring a fugitive, but they did not have enough probable cause to get a judge to sign off on a warrant so they put all their eggs into intimidation.
She stood them off ALLL night 😂, it was around 3am when they finally left, looking like the losing Superbowl team walking off the field. The guy they were looking for was never there, never even knew my neighbor. It was bad here-say info.

And the all night (actually only til 3AM?) terror fest for her 2 small children and rescue dog could've been avoided by just letting them go in to make sure the fugitive wasn't there. This sounds like a fantasy "what if" scenario, not something that actually happened (although I'm sure there are plenty of paranoid people with things to hide, including fugitives, who actually do make their children suffer through a standoff rather than letting law enforcement do their job). If you really think all police are bad, you need help. Are you sure you're not confusing a video game you were playing with an actual real-life situation? If there's a reasonable belief that a fugitive is hiding in someone's home, pretending that homeowner is a hero by not giving in to the 'battalion of state cops' who want to find him is a bit naive.

Under the "Trespass Act" in Ontario, you can notify (written or verbal) anyone or any organisation that they are prohibited from entering your property, BEFORE they ever even have a chance to enter. If they disregard that "prior notice", you yourself can arrest them or call police.
Giving prior notice removes any "Implied" licence to enter and they are criminally trespassing as soon as their foot crosses the line, even if you are not there to tell them to leave. This law applies to anyone including police.
My local (Peterborough OPP) police service have targeted, harassed, assaulted (Illegal arrests) and used the "Implied" licence to enter my family's properties many times years ago to carry on with this conduct. I served them "Prior Notice" under the "Trespass to Property Act" and now they are prohibited from entering and I made it clear I will arrest them.
Their harassment ended and the false charges have also.

They banged on her front door, banged on her bedroom windows (she lives on a ground floor flat) then they went around the back and banged on her patio door, tried the door handles, then they traced their flashlights along the side of her curtains.
She didn’t know it was the cops because they didn’t identify themselves and was reaching for her phone on the bedside table to call 999 (we’re in the UK) when she heard the distinctive sound of their radios.
Ironically it was her freezing up in fear that saved her. She just stayed in bed, completely silent. They’d just startled her out of a deep sleep so she wasn’t thinking clearly. Fortunately they went away.

I was extremely scared and looked in the peep hole only to see it was a cop. I didn’t answer the door. The way he was aggressively knocking I thought he was going to break it down. Now there I am-elderly and greyhaired. I had a knock and talk attempt. They claimed they had an alarm warning and were checking if my system had sent an alarm signal. Well I was sure it was turned off. But they did see my ADT sign so maybe that was their premise. A total of six cops looking at me. Of course, you can refuse to open the door, but can you ask them to leave the property? Since the exterior of property is common, how much can the police look around? Can the police hang out at your front door since it is common area? Can they look in your windows? In my lay opinion I believe they can look in your windows, even in an upstairs apartment. And any 'contraband' they see would be considered to be in "plain view" and they could get a search warrant.
That's if they don't just kick in your door right away to seize the "evidence", as an "exigent circumstance".

    • @guycoburn1633
      @guycoburn1633 7 หลายเดือนก่อน +4

@@TonyGarrett-p1c If you have a house, then the immediate area around the house is "curtilage" and looking in windows may be considered an illegal search, especially if the windows are not easily viewed from the front door. For example, the cops cannot go around to your side yard or back yard to look in windows, and use that view to establish "probable cause" for an arrest. The evidence they found by looking in a back window would likely be excluded by the Court. The "plain view" doctrine has limits based upon reasonableness.
That's why I asked the question; I'm curious how far the "curtilage" principle applies to multi-family housing buildings. There are likely some cases on the topic.

Two women came and looked at him and offered WAY less than what he was worth. We held firm on the price. They (unknown to us) make a report to animal control. We get back home, and find out they have gone through two closed, but unlocked gates... walked down to the barn, taken pictures, and GOD knows what else. We come home and there's a yellow piece of paper with the officer's number for us to call. Luckily, everything was good. They saw empty feed sacks, and barrels three quarters full. Plenty of hay, horses (we were rehabilitating two) had water, hay in the racks and fans running to keep them cool. After police performed an arrest outside my apartment front door I found a gun in the street after the police left.
I wanted to return the gun to the police, but I didn't want to get shot, or accused of theft so I called the non-emergency 911 dispatcher (this number gets you the same people who answer 911 calls, but lacks the priority a 911 call gets)
I explained the arrest (which she knew about) and said one of the cops had dropped a flashlight. I was afraid if "gun" went out over the police radio, I'd end up with 40 cops shooting into my house.
So a few minutes later a knock on the door and a cop asking about a flashlight. The cop seemed confused because he knew what he had lost.
I'd left the "flashlight" on the table, well out of reach, so I opened my door wider so he could see my table. He said, "That is not a flashlight."
I didn't want to admit that I had told the 911 lady it was a flashlight because I didn't trust the police so I said, "Nonsense. If a cop lost his gun that would be a big deal. But losing a flashlight is no big deal."
The cop looked at me as if he wasn't believing what he had just heard, then just said, "Thank you."
At this point I invited the cop in to retrieve his gun, and now I had a new friend.
Later he told me he was in full panic mode when he realized he'd lost his gun. He was on his way back when the call about the lost flashlight came in.
He had no idea what that was about and he started to fear an ambush. But he'd carefully looked around and saw no sign of anyone hiding, he finally knocked on my door.
When I told him why it was obviously a flashlight he was just stunned. No civilian had even done anything like that for him.
At this point I told him the real reason I told dispatch it was a flashlight, and he said my fears were completely justified. He was one of the good cops, and he was just as worried as I was about police misconduct.
