      It being a class action lawsuit means if the 5 mil is awarded it would be split amongst all the people represented by and including the plaintiff. Part of the lawsuit is reasonable, but other parts are not, not being refunded after the game was cancelled while being charged for the game including the dlc is reasonable but all the rest is just what the plaintiff's lawyer told them to say in order to actually get the case seen by a judge because despite some shitty activity on Aspyr's part it's not enough for a lawsuit.

    This lawsuit is completely justified. Aspyr advertised a product. People paid money for that product. Aspyr never released the product, and never offered a refund. As such, they should be held accountable for this.

      They could have waited out the release of the game until they knew the dlc was coming our or AT THE VERY LEAST told people outright that the dlc has a chance of not coming out and to wait on buying the game based on that but no they used it to sell more copies

    The thing that really annoys me is the fact that they just left everyone in the dark. If there was a legal issue, they should have told everyone what that issue was. Give everyone the real reason and tell them what is going on.

    Honestly, it's hard not to blame Aspyr, and this lawsuit isn't surprising to me. I mean if you announce and advertise a product, and then at the next to last second cancel said product and offer everything but a refund for the people who already bought it, you're pretty much digging your own grave at this point.

    I’m the person who filed the lawsuit (Mal-Luh-kai) due to the false advertising from the announcement trailer. They used it as a selling money grab. But the injury? Idk what this video is talking about there. and I encourage everyone to hop on this lawsuit. The lawyer wants to speak to everyone. So please reach out. Thanks for the video.

      As for the injury - in the lawsuit I read, there's a section which states:
      *20. Plaintiff suffered an “injury in fact” because Plaintiff’s money was taken by Defendants as a result of their intentional false advertising. Furthermore, Plaintiff suffered an “injury in fact” by paying for something he believed had content, features, and characteristics that it did not have*
      *21. Plaintiff and Class Members were undoubtedly injured and lost money as a result of Defendants’ misleading, deceptive, fraudulent, and intentionally false advertising.*

    It should have been a class action lawsuit for everyone who bought KOTOR 2 on switch. They promised it, advertised it and most (or a lot) of people only bought it for the DLC. They should have refunded, but because they didn't then they deserve to get sued.

      i dont know why they won't add the bug fixes and QOL changes to the PC version that they added in the mobile ports in some optional beta branch so you can still get the original experience.

    The lawsuit is justified, they should not have advertised the restored DLC if they didn’t get 100% legal approval for it. I held off buying KOTOR 2 on the Switch just in case that happened

    But the blame should be toward Disney and Lucasfilm not Aspyr.

      ​@@jachymfoj if the issue is that the dlc was not made by an officially licensed partner - it's the licensor (owner of the IP) blocking the DLC.
      I'm more inclined to say Disney's fault.
      Pre-disney LucasArts were licensing two star wars games a year. They were still precious with the SW IP, as long as it stayed within the universe.
      Since Disney dismantled it, gave exclusivity to EA, Lucasarts went down to 4 SW games a decade.
      I work with a clothing brand in the UK, with Disney as a client. It usually takes 6 months of approvals, even for simple design changes. "Can we move Stitch's head 3cm to the left?"
      "Nah, ask again in 6 weeks"
      Disney are very protective and great at merchandising but are terrible in the gaming industry, they just don't know the market.

      I have heard the issue was with Disney:
      1. They don't want any legal loose ends for the creators of the dlc to be able to sue them in the future. Yes, the dlc was mostly content already on the game discs, and it was put together by non-official sources.
      2. The dlc changes the canon of the story.
      I wonder if Disney is doing anything with the KOTOR series, characters, and timeline, or at least, is planning to? They would have no reason, aside from the very real issue of legalities, to be against KOTOR2 releasing with the dlc.
      So, I would say it's an issue of legalities, unless they are planning on canonizing KOTOR/KOTOR2TSL.

    Aspyr should have not used the dlc mod for marketing. You know damn well they knew it was a legal nightmare and that it might not happen but they were very happy to use it as a marketing tool. They could have waited to release the game when they knew if the dlc would be a thing or not but again, they chose money. Aspyr doesn't deserve sympathy it's a business that wronged people not a person that messed up

    Usually, I feel lawsuits in the American justice system are silly or overblown, but this is needed. Not only did they PROMISE to include the DLC, but after it was canceled, a lot of the staff and the mod-maker stood with their hands in their pockets saying they did nothing wrong. Not only did they deceive customers, but showed how callous they are towards their customers' pleas. This is a problem across the gaming industry: too often, companies promise certain products or versions of said products and end up delivering inferior products to video gamers for the same price. Anthem, Bioshock Infinite, Fallout 76, Star Wars: Jedi Survivor, etc. These corporations, as powerful as they are, need to start being put in check.

    This should be a lawsuit for specific performance. IANAL, but in real estate school we learned that you can sue someone who backed out of a sale of a home and force them to buy/sell it. I could see that happening in this case where they’re suing to force Aspyr to release the mod.

    I was one of those people who bought kotor 2 on the switch, and it took over 3 months for them to send me a code for a free game with crappy communication. Every time they asked for some credential I’d send it and then they’d ask for one more thing to verify, that happened like 3 times… but at least I got force unleashed on my switch now🤷‍♂️

    they 100% deserve it imho, but i don't have high hopes that this lawsuit will lead to anything "useful" (for us). I think realistically they will settle outside of court and that will be that...

    I can only speak for myself, but personally I only bought KotOR II on Switch for the DLC. I had no intention of playing it without it, since everything I've heard about the game is that it felt incomplete without the Restored Content. I didn't want to play an incomplete game, so I never had an intention of buying KotOR II. I only bought it because the advertisements made it very clear that the Restored Content was included in the purchase as a part of future DLC. I was looking forward to the game because I'd never played KotOR I OR II before but knew of their reputation. I still have no intention of playing KotOR II without the Restored Content. And this is the first time I've even heard that the DLC was canceled AND that they were giving people a free game from their library as an apology. They clearly didn't try very hard to inform people that bought the game that these things happened. I'm more than likely too late to redeem that free game so they really did scam me.
    I agree with this lawsuit. I hear people saying the lawsuit is stupid because it's about a video game, but it's important to hold companies accountable for false advertising practices at every opportunity. Companies should NEVER be allowed to get away with false advertising, ever, regardless of the product. Aspyr advertised something and people like me bought it because of that advertising, and that advertisement turned out to be a lie. If they didn't have the Restored Content set in stone then they shouldn't have advertised it.
    EDIT: And the argument that "Aspyr faced legal issues behind the scenes" is a moot point. Again, if they didn't have it set it stone, in a contract, that the Restored Content would be released, then they had no right to advertise it as part of the product. That ALONE makes the lawsuit justified. Now, while I don't agree that Aspyr did any of this intentionally, that again is moot. They falsely advertised a product, which means they should be held accountable for that action.

      I already own it on PC but wanted the dlc on physical cartridge even bought the collectors edition pretty sure I already owned the games they offered as a sorry so I'm interested to see how this goes

      Just play it on your phone. TSLRCM works on mobile versions of the game.

    Ok, so the mod creator backed Aspyr up, and said it wasn't the company's fault. If it wasn't their fault, then who's was it, eh? At least give us some answers, Aspyr! Not some pre typed corpo script.

    Larian needs to do kotor 3 or the remake.....I'd give em my money gladly...provided its made with the same passion as bg3. Just reuse assets on this one to expedite the game.....all I want is bg3 star wars

    The fact that it didn’t release with the game suggests it wasn’t ready to go as some sources suggest. Clearly, if Aspyr had done their due diligence, this should not have been an issue, and if it was released with the game it would have limited the effects of any further legal action from any party post-release, as long as they could prove everything was investigated

      Can confirm it was 100% complete. The issues with the mod came up later after completion from a third party who interjected on it's release. There was on-going discussions to deal with the issue but they hit an impasse and it got cancelled.

    I never got a freaking "free game code" and bought the switch version for the dlc. This is all news to me and yeah, geeze, I'm annoyed too

    If they hadn't advertised the DLC many wouldn't have bought it. Anyhow it was stupid not to offer the refund. Aspyre should've realized that the offered alternatives were probably already owned by many of these fans.
    Bare minimum they SHOULD'VE given fans an explanation.
    All they did by doing it this way, was shoot themselves in the foot. Fans who would've been loyal customers were turned off. And they told others who now are less likely to buy too. Doesn't much matter if they win the case: they've ALREADY lost the loyalty. Maybe it'll force out the details on WHY they didn't release it though. I wouldn't be surprised if Disney got greedy and demanded total ownership of said mod that has been released free in PC version etc to so many fans.

    Whatever third party that came in and forbade Aspyr from releasing the DLC seemingly did so in a way that Aspyr could not disclose who they were.
    I'm thinking it was Lucasfilm or Disney itself. And they knew Aspyr would take a hit if they weren't able to disclose the specifics, but they chose to force them not to anyway just to give themselves plausible deniability. A sacrifice. This caused many Aspyr employees to leave in protest which then lead to the disaster that is the Battlefront Classic Collection.

      It's very possible. A former Aspyr employee had a similar thought to you when I discussed it with them. They weren't aware of the specific details but they knew it was some kind of legal dispute with Disney or Lucasfilm.

    They should offer a full refund for all who want one...I was waiting to play it...I was fortunate I didn't buy first...because I sure didn't buy after...I have many copies on xbox but no PC so I've not had the opportunity to play the restored version...and with dlc is the only way I'd buy more copies

    The fact still remains A spyr and Saber still advertised the free dlc and they kept swearing up and down that it was coming when they actually cared enough to respond and they still didn't tell anyone until way after they found out it was getting cancelled so at the very least it was still false advertisement therefore they were still falsely advertising and promising the public content that they DIDN'T DELIVER THEIR PROMISE SO AT THE VERY LEAST SABER AND ASPYR NEED TO BE LEGALLY CLEARED TO MAKE AND RELEASE THE CONTENT THEY PROMISED AS A RULING IN THIS LAWSUIT!!!!!!!

    To think, Aspyr releasing the Tomb Raider Remastered Collection was starting to win people over. It was certainly a good start imo. I sure hope this lawsuit doesn't interfere with that release, because I already pre-ordered it.

    $5 million dollars seems like a reasonable sum for a class action. In a class action lawsuit, if the jury finds in favor of the plaintiff, the sum of the ruling will be divided evenly amongst all injured parties (everyone who purchased the game prior to the announcement that the DLC had been canceled), which I imagine is quite a few people

    For me it's not about the actual result. The result should be in testimony and discovery. Why advertise a product when it wasn't legally cleared?? When did the "Legal issues" come about? What justifies a code instead of a proper refund?
    Unfortunately a Lawsuit is one of the few ways consumers can get these answers.

    I think there is some truth to the claim of deception. Aspyr took pretty much a year to announce the cancellation of the DLC. Holding back this announcement is deceiving people into thinking it will still happen. People who might have bought Kotor during that timeframe where the DLC was essentially canned already, but Asypr didn't announce it yet.

    ROFLMAO! so, first Aspyr forces Poem Studios to shut down the fan remake of KOTOR 2 in UE4 (the devs from Poem actually offered to work for them so they can keep going with it after almost 5 years of work), then promise to integrate TSLRM when the fans went mental asking for it (which is actually the basis of this whole lawsuit), then announce it will be released as a DLC (scummy move but greed is greed so w/e), then cancel it. also, which creator of TSLRM supports them? 'cause only the first restoration project has a single creator. and as far as i remember, he only consulted with the team that worked on the second one but never actually worked on it.

    Seeing as this is a month old, I’m probably late to the debate. I didn’t purchase KOTOR II on the Switch but I tend to agree with a lot of the comments saying that advertising the DLC is where Aspyr went wrong, whether they intended to mislead or not is irrelevant, they did advertise the DLC, which was more than likely to sell more copies of the game. They didn’t deliver and should have offered a refund, not a code for a free game.

    Its simple, Kotor 2, thanks to Zenimax, is an unfinished product. An amazingly writen one albeit. However their use of the words "restored content dlc" was obviously a way to connect to the "restored content mod" for the pc versions. They new it would be the main selling point since not having it is basicly using a inferior version. If people new theyd pull out of the dlc, then theyd just buy the steam version for less than 20 usd, around 5 usd durring steams many sales. And get the restored content mod at no extra cost.

    I am more pissed that KOTOR 1 had a game breaking bug in the final Korriban temple where you cannot complete the puzzle because its BROKEN. You cannot complete the game on KOTOR 1 Switch. Aspyr support ignored all complaints about it for years so its still broken.

    The lawsuit is indeed justified.
    I like Aspyr, and it's true, they're getting the brunt of the fallout when it's not just their fault, but they do have responsibility for it.
    Aspyr were the ones promoting a product without knowing they could sell it or not. If you're not 100% certain you can deliver on your promises, don't make them.
    Aspyr clearly has(had) issues with their management, there were too many mistakes made based on what looks like poor communication.
    Add to that their terrible decisions after the whole vertical slice debacle, and you start to see a pattern. A pattern where the folks doing the work itself got shafted by the company's management.

    They should have been more open about whats going on. It's sad and they should be held accountable but it is still a real shame we didnt get the dlc or the truth regarding this. But i honestly dont see aspyr lose this if they have it documented what went on that led to the dlc's release.
    But also maybe not advertise it when your not certain you can actually release it? 😅

    What's disappointing is I never experienced the dlc because I don't own a PC so I got excited about this. I never thought about a class action lawsuit. I'm not that petty

    I feel like the lawsuit is justifiable, at least the argument that owing to the cancellation of the dlc, the advertising for the game is making false claims, idk what the 5 million is compensation for but at the least they owe everyone who purchased kotor 2 on switch a refund
    Also, I wasn't clar on whether the person suing was legally representing themselves but if they are, that does slightly worry me
    Maybe I don't have enough information and the person suing has a decent plethora of legal knowledge though

    Legal jargon aside, this lawsuit will go nowhere. At worst, Aspire/Saber will have to pay a settlement. Most likely, it will just be thrown out, and the person filing it will have to pay their own legal fees. Famously, even successful suits only end up paying out enough for the class action side to MAYBE get a Big Mac meal.

    The way I see it, Aspyr absolutely announced the DLC as early as they did so as to get more sales. One could argue that's marketing, but it could be argued that's only marketing when it works - it's just illegal when it doesn't. When they announced they were packaging the mod as DLC, I thought it was going to be a legal minefield. But assumed that if they had announced it, that must have been all sorted. It may not have sold as many copies, but the safer thing to do could have been to quietly work on the DLC and only release it when it was finished and more importantly given the full legal go ahead. Not an unconditional "yeah, you can totally do that... but we can't sign anything yet for legal reasons". Again, I don't know if they intentionally tried to break any laws, but it's still possible to break laws without having any intent. Perhaps Aspyr proving they didn't intend to is only half the battle. It could be that the judge states there was no real bad guy in this scenario, but laws were broken and people were hurt legally. Punishments aren't just levied for intent, but for outcome. How ironic it would be if all of this is just one big morally grey situation.

    Injury, per legal jargon, can be emotional, or financial.
    "Others similarly situated," just means other people who purchased the game, mostly. They are hoping to achieve reparations (probably in terms of refunds) for everyone who gave Aspyr money for this port.
    "... the amount in controversy exceeds the sum of
    $5,000,000.00 and there are no less than 100 class members." 5 mil is just the minimum amount necessary to qualify a class action lawsuit.

    RCM Team: Sure, awesome, love for you to.
    Aspyre: Cool, full disclosure, this will be a free DLC, so you won't get paid.
    RT: Shrugs. We didn't get paid the first time.
    A: Groovy, we already have the ads made up.
    Fan base: SQUEEEEEEEEEEEE
    Disney Lawyers: Ahem.
    A: Hey, what's up?
    DL: About this "Free DLC."
    A: Yeah? What about it?
    DL: We think there might be a problem
    A: What, we got permission from the creators. And it's a FREE DLC. Free. We don't earn any money from it, so no one can sue us for profiting off of someone else's work.
    DL: Yeah. About that.
    A: "?"
    DL: TSL is pretty much a broken game. Like total dumpster fire. I mean, the RCM is the only way to get the full experience.
    A: Yeah, so?
    DL: You were advertising the RCM as coming with the game right?
    A: "groans" I think I see where you are going with this.

    A: Yeah, you are saying that because we advertised the RCM as a DLC, lots of people bought the game.

    A: That might open us up to lawsuits from the RCM team or their families or something. But they worked really well with us!

    If aspire hadn’t gotten a deal through to use the DLC then they should not have advertised it as a part of the product.

    Aspyr literally single handedly screwing up what little hopes fans have for the kotor series coming back, can’t even handle porting the games and offering codes for games already owned on the store… that’s not compensation, give people a refund lol

    I kinda want this to go more public so that they have to release more information on why Aspyr had to cancel their plans. I want to believe the rumours that Aspyr had the mod ready to go and that higher ups at Embracer or Disney pulled the plug. I’m sure Aspyr had strict instructions or an NDA restricting them to tell the truth. I want this law suit to go through and for the real reason to come out. So that shitty embracer group or stupid ass Disney get the blame they deserve.

    I’m not convinced that the executives didn’t do their due diligence & didn’t have their T’s Dotted & Eyes Crossed before a making a public announcement that they’re *OFFICIALLY PUBLICLY ENDORSING & IMPLEMENTING A FAN MADE DLC OF THEIR SCRAPPED CONTENT!*
    The fan responsible for making this DLC would’ve *GLADLY* given them permission to use his fan DLC mod regardless of the payment circumstances.
    If everyone involved wants this DLC to *OFFICIALLY HAPPEN* then it shouldn’t fucking matter who owns what.. 🤬

      this is why I strongly suspect Disney LFL for this. I can see them adding on a clause like 'oh and we now own the mod forever and its not available for free on other platforms' or something. It wasn't in Aspyr's interest, or the fan who made the mod. But Disney is known to be a control freak.

    If KOTOR ends up being Aspyr’s downfall, they completely deserve it. The way I see it, with the DLC and the KOTOR remake, they’ve made a profit through false advertisement. I purchased all the Star Wars offering on Switch a long time before they announced the cancelation, so honestly the code they offered didn’t mean jack. I’m glad they’re being sued, but I honestly want the DLC instead of their pocket books getting hurt.

    I just wonder how far this will go since they DID offer a free download code for a game to people who bought KOTOR2 Switch. (That's how I got TFU on Switch).
    Of course, to someone who might already own every game that was offered, this compensation was useless.

    Aspyr should have made sure any issues regarding the DLC were sorted out before announcing it. Hell they could probably sort out the issues for a lot less money they they are being sued for. They were just too lazy and too cheap to do so plus they assumed they could get away with scrapping it without being punished.
    Edit: If it was ready to go they should have released it as they said they would.
    Edit 2: And if the problem was Disney, Sony, or Nintendo saying no to the DLC it is still Aspyr's fault because they should have made sure they had the various permissions required before announcing it.

    I think this lawsuit is a little dramatic, but I can understand why this man is doing this. We were promised the unreleased DLC, ans we didn't get it. Also there was no communication from the company for months. Same thing with the Remake. We are getting no communication about it especially after this new situation about the trailer and all the tweets. I do see the other side of this case where it is only a game, stuff happens. Things don't get released. It's not the end of the world. Is it unfortunate? Yes, but we have to move past it and maybe something will happen in the future. An issue I have with a lot of Star wars projects is that things are announced too early and then those projects never get released. It's extremely frustrating.

    The lawsuit is justified they advertised this product and never released it that in itself is wrong as they made profit out of false advertising, plus no communication to thier customers over this for a year and the only bit of communication we got was a statement not once explaining what has gone on or why it wasn’t they just said basically sorry guys can’t give it out and am not refunding but am giving u a crappy assed code for another game that has got any updated graphics or content to make it better so a extremely poor refund instead of all our money back, that’s like me advertising a cure all ales including cancer but only offering a pill that is already on the market have people pay for the cure and I never released it and not giving back the money I received for this product and no explanation as to why am not releasing the product, again sounds like a scam.
    Even if they won the lawsuit no one and I mean no one will ever buy their products again so instead of making this right they are going to lose all credibility and will go out of business i for one will never buy any of their products ever again the company is an ass and all they think about is money for them again that’s the definition or one of the few definitions of a scammer.
    Now if they want to survive this lawsuit or even after the lawsuit they should release a statement explaining everything leaving nothing out and find a way around the legal problems explained they will grant them at the very least credibility for the fans

    On one hand, people deserve what they paid for. But it's funny that the one that sues bought the game and never touch it, waiting for the dlc to arrive. Why not just wait 'til it arrives to make any purchase? People don't think anymore.
    And to be fair, they were giving kotor 2 free on steam (so with restored content) to apologize. I feel like yeah they screw up big time, but people just want to see people lose jobs.
