- MORE than 20 serving ministers may refuse to vote for Rishi Sunak’s smoking ban, The Sun can reveal.
The free vote on outlawing anyone born after 2009 from ever legally buying fags is due within weeks.
And there was confusion tonight over whether the vote on a total ban on disposable vapes would not be whipped.
Downing Street rowed back from public claims the ban on throwaway puffs like Elf Bars and Lost Marys would also be considered a matter of conscience.
No10 tonight insisted that no final decision had been made.
But Mr Sunak defended his clampdown despite it already illegal to sell vapes to anyone under 18.
He cited ease of access to single-use products targeted at kids and vowed to “stamp out” the trade with a full ban.
And No10 insisted there were no current plans to ban over-18s from vaping - after the Department for Health said the vapes “should only be used by adults as a tool to quit smoking.”
After the PM announced today that he is pushing on with his plan to increase the smoking age by one year every year, senior Tories went public with their concerns.
They were led by ex-PM Liz Truss who branded the policy “profoundly unconservative.”
But Mr Sunak hit back: "I don't think there's anything unconservative about caring about our children's health.”
The Sun can reveal more than 20 current serving ministers have “deep suspicion” of the policy and abstain or vote against it when it reaches the Commons.
In total more than 50 Tory MPs are said to be against the policy - but the plan has the support of Labour, meaning it will almost certainly pass into law.
Today the British Vape Trade Association said the ban will drive one million to the black market and push up smoking numbers.
Shares in vaping firms tumbled this morning - with the ban on course to come in by the end of the year.

Yet another freedom lost. Tobacco tax earns the government £10b annually and costs the NHS around £3.6b the same as alcohol. Why not ban alcohol too? They should be putting every penny of that tax money into the NHS if that’s what they’re so concerned about.
They should legalise drugs too! All drugs, nobody who uses drugs cares about the legality and if legalised the country would earn a fortune in revenue, the drugs would be safer, criminal element gone, some of the money made could go to education and treatment. Its a win win.

Have you ever heard of people taking a sick day because they had one to many cigarettes on a night out, or run people over due to, to many cigarettes in their system, wanting to fight emergency workers because they had to many cigarettes. Spot on , I smoked for 25 years and now I vape I've never had a hospital admission for smoking but I've had 6 for alcohol misuse and the dedicated rehab programme I went on was NHS funded and it was 90% alcoholics and it was a ongoing thing so 1 finishes another begins like a revolving door , alcohol needs addressing it's far to easy to access and causes mayhem for police etc

It's already illegal for under 18s to buy the vapes. Schools report the shops that illegally sell to children, but the trading standards say they can't do anything... Why not just enforce the current law?

Omg! So true! I never thought about it like that before. They stop “advertising” real cigarettes & fancy jazz up the vapes instead & now kids are landing up in hospital needing lung transplants it’s like “okay time to rethink our plan”. The best plan would have been to leave cigarettes alone & not brain wash kids into vaping is healthier & cooler & let people make their own minds up to smoke or not. Great point though, I was always bewildered why cigarettes got hidden & vapes came out on full display with bells & whistles. Now I get it!
