  • The family of Maya Kowalski, the subject of Netflix’s “Take Care of Maya,” allege that a report of child abuse from Johns Hopkins All Children’s Hospital led to Beata Kowalski taking her own life. The Kowalski’s are suing doctors, the Department of Children and Families, and Johns Hopkins All Children’s Hospital for $200 million dollars in connection to Beata’s death. According to court documents, the child abuse case against Beata was pushed forward after Maya’s physician confirmed her condition, complex regional pain syndrome, was not the fault of her parents. During the time Beata was separated from Maya, she took her own life.

    My daughter has EDS and I can't tell you how horrible we both have been treated by doctors. She's been in bed almost 5 years and she's 17. Please educate doctors about Ehlers danlos, CRPS, pots, mast cell activation syndrome, and chronic fatigue syndrome. I've cried every day for 5 years . The mistreatment of the children and caretakers has to stop!!

      I have EDS, POTS, Fibromyalgia, Severe brain injury and there’s so many others. I remember when there was a time someone in the hospital that didn’t like how protective and proactive my mom was for me. I was 10yrs old just got into a severe accident in a wagon, I broke my neck, elbow, shoulder, thumb and had a closed head injury and I was getting wheeled back to get an MRI or CATscan (I can’t remember which) but I wanted my mom to be with me. I was 10 remember and no problems in my past getting a MRI or CATscan with my mom in the room she just had to wear a vest because of radiation… well the technician wheeling me to get the scan with my mom behind me after we were told by the physician that she could be with me.. well the tech didn’t agree and shoved and punched my mother….. no consequences on the tech’s end because the hospital stood by their staff and said the staff felt like my mom was gonna control the scan… I felt at fault because if my illness wasn’t there my mom would have never gotten shoved and/or punched. I bet you anything Maya feels if she wasn’t sick her mom wouldn’t have taken her life and I pray Maya sees this and if you do Maya this is my message to you, Maya I want you to know this is NOT your fault whatsoever. You can’t help your diagnosis and you couldn’t go into the future and already know the situation. You didn’t know that JHACH would have done what they did. Praying for justice for the whole Kowalski family!

      Yes, he certainly has great compassion, and very thorough it seems. No bungling patients out the door with a prescription after 5 minutes.

    That Dr was great. I think it was the first time in this trial that the defense was truely on the robes. He was advocating, caring, thorough, clearly very intelligent, and very earnest in making sure the jury was informed. I'd trust that Dr any day. Among the sea of misfortune this family endured, Maya was very lucky to have someone like that in her neck of the woods.

    Mayas face is one that has experienced so much pain. I really hope she wins her case big so that every US hospital is put on notice about how to treat patients

      Her brother looks the same way. This whole case is sad. The hospital keeps trying to throw blame on DCF, but they were absolutely complicit. At any time, they could have told DCF that Maya did indeed have CRPS and the parents were correct in trying to get her pain under control. They billed half a million dollars for CRPS treatment, but apparently didn't think it was pertinent to advise DCF of that fact. Dr. Smith is responsible for taking thousands of children from their parents, and has already been found liable for botching Maya's care. Her insurance had to pay the family 2 million dollars. Keep in mind that the attorneys take a big chunk of any settlement. I'm sure the defense won't allow them to introduce that information, though.

      I was just going to comment about this. Poor girls countenance just screams from all of the physical pain from crps, and emotional pain from being detained away from family and then losing her mother. Yet, she still has such a sweet, innocent childlike face. And i don't mean to be inappropriate, idk how old she is now, just making an observation. She's been through so much, yet even through all the physical pain at first, she was still a happy child, with the love and support of her family.

      He was a very credible and personable expert in CRPS. Loved his deadpan humor about the tip jar every time the plaintiffs attorney interrupted him.
      He was also very comfortable in his testimony and not intimidated in the LEAST by the cross exam.

    I don’t understand you all who are talking crap about this mom. Any decent mom or dad who had a child like Maya would go to the ends of the earth to find help for their child like her parents did. You find a treatment that apparently works, she has to go to the hospital and that hospital doesn’t listen to you concerning her history and what has worked for her. Then they decide to keep you from your child because they think you are crazy for fighting and advocating for your child….what exactly would you do as a parent? All she wanted was to be heard and how scared Maya must have been without any contact with her family. The mom kills herself and as the surviving parent you find out this same kind of thing has happened that lots of parents have been falsely accused at this hospital just like Maya’s mom….I’d sue the crap out of them too! If nothing other than to cause this to come to light and make them relook at their procedures.

      I doubt most parents would take their child to Mexico for a "treatment" that has a 50% chance of resulting in death. Ketamine was the likely cause of Maya's severe stomach pain, so it would not be medically appropriate to give her more of that drug.

      your wrong, most parents would if it was only thing that would help. My parents agreed to surgeries that had 80% fatality risk. I'm nearly 40 and think all my parents decisions were the right way to go. You don't know unless you have experienced it first hand. If your child had cancer and there was a risk 50/50 with treatment would you just say no to treatment???@@janeen70

      Exactly, her mom fought just to see her and this pig judge blocked her. Her should be a co-accused in this case yet here he is presiding over this heartbreaking case.

    They ruined this little girls life, and robbed her family and her of happiness and wholeness. Admit your mistakes and Pay up. This is excruciating to watch. I can’t imagine what the family is experiencing while they sit through and participate in this trial. 😢

      I'm surprised that you have CRPS and aren't questioning why Maya's symptoms don't add up and also that at no time in any video does she show any of the signs of someone who is experiencing discomfort, much less the worst pain possible. Also, had no originating injury (strange), allover pain, which started in the stomach. Having CRPS yourself you know that the pain of CRPS Type I always starts with an injury where the pain from the injury seems normal at first, and appropriate for the type of injury but morphs into severe nerve pain. So, what was the "injury" she suffered where the pain was just "all over". What kind of fall, or accident, or surgery does a person have that results in pain all over the body? And why have we never heard of any INJURY we've only heard that she started with asthma, allergies, and then some kind of stomach ailment. Not stomach INJURY, stomach AILMENT. No injury of any type, but somehow gets CRPS Type I?
      I have CRPS type II for almost 24 years at this point. And all I had to watch was the Netflix special in order to see enough video of Maya to see that she doesn't have CRPS Type I or Type II. Which one do you have and how did you get it,. i.e. what was the precipitating injury?
      Also, I have no problem believing that Maya has SOMETHING. So, she is suffering and deserves compassion. But she doesn't have CRPS. The symptoms match conversion, which is more sympathetically called FND. She may also have Munchausen by proxy. No less than 4 hospitals eventually came to the conclusion that either conversion or MBP were going on, even though they originally accepted the RSD diagnosis as a possibility.
      Dr Chopra mentioned he's personally treated 100,000 patients. That is crazy. There are only about 200,000 patients with both types of CRPS at any given time, i.e. some die and others develop the condition, so the population stays fairly constant, per RSDSA organization which is the longest running source of information on CRPS available.

      @@lb2645 That was stated after they filed the lawsuit. And that is only ONE of the issues why she doesn't have CRPS. There are at least TWO things that all the sudden she is now saying that in the 2.5 years that she was dealing with whatever (not CRPS) she has, she and her mother and father NEVER EVER EVER said there was a sprain. Do you not realize that once they filed a lawsuit they MUST stick to CRPS diagnosis and they HAVE to fill in the blanks. They researched online, realized the problems with their case and now are stating things they NEVER EVER EVER EVER EVER said during the whole time she had the illness.
      And what a miraculous recovery she has had now that she is NOT being treated for CRPS. Do you truly not see the problem there?

      I thought the injury was the result of an allergy to a muscle related injury with an allergy to a muscle relaxer that caused her excruciating stomach pain at which point her trunk started burning, and thats also when the cough started. I don’t know how to diagnose CRPS, but why would Maya respond positively to all CRPS treatments then?

    What an amazinglingly compassionate and lovely Dr. The CRPS specialist is. People in pain need comic relief and he has a very genuine and kind delivery.
    The defense attorney cross examining the doctor clearly has a superficial understanding of the difference between controlling some symptoms vs controlling acute, chronic debilitating pain. And in psrticular, controlling pain in an unsophisticated child versus an adult with life experiences in suffering.

      @@jpepper6309Agreed. The whole case is based on it. It would have bolstered a lot of the plaintiffs witnesses testimonies if they’d come after the doctor. Sequence matters and her attorney is so unskilled, it’s miserable to watch.

      Her attorney is horrible. He is constantly fumbling around and muttering and even asking questions more than once. He seems to forget what he’s doing and is so unorganized it makes me upset. Her case is a strong case based on horrible facts and for it not to be presented in at least as coherently as something like the Depp/Heard case was makes me angry for her and her family. This case deserves someone much more competent than this lead attorney. The other attorney is much more clear and concise. I really wish he were running this case. I pray he gets it together soon.

    It’s one thing if doctors honestly don’t know what they’re dealing with, it’s another thing to take custody/have DCFS take custody of a child because they don’t know what they’re dealing with. This case is truly heartbreaking, but to see such strength, determination, and perseverance in this family is amazing.

      That’s exactly it. It’s not wrong that they questioned the diagnosis, questioned the use of such high levels of ketamine, or called CPS with their concerns. None of those things are wrong. It’s all the rest of it that’s the problem. The fact that they made an extremely serious decision/accusation with insufficient information and didn’t make any attempts to rectify once they had more information but instead “dug in” and ignored the evidence.

      This. Exactly. I’d be OK if the hospital recommended different treatment and/or refused to do what Beata was asking. But to take custody of their child because they think they know what’s best is appalling. Her mother obviously loved her, and was not causing her to be sick. I think the hospital and the government should be VERY careful before taking children away. I have heard of countless stories where the system fails children who were beaten so death by their parents, yet, they are quick to take away children from loving parents.

      Eh not entirely. Put the attorney in a bind where the defense directly asked for evidence where they weren't supposed to. Then the judge said well they opened the door but if you offer the necessary evidence to remedy the situation I will then also allow them to introduce even further info they were never meant to go into.
      So he got messed over and if he wanted to fix it they'd let him only if they could mess him over even more

    I just think its disgusting that they wanted to PROVE she was lying so they moved a commode away from her for easy access. Whether she's faking or not that's a basic human right. She was just a CHILD! I understand the protecting her just incase it was munchhousens, but to deny her basic human rights and treat her so terribly. How could anyone? Basic care and basic training went out the window. I pray this family gets the win cause this is appalling. I pray every day for this family. I watch everyday! ❤

    I really dislike this plaintiffs’ lead attorney - I expected him to be much more prepared, polished, and procedurally proper. Second chair attorney is so much better. Ditto re defense attorneys.

    I've been watching parts of this trial over many days. I'm glad it is a jury trial. Have to say, along, with so many others in the various comment sections, that this is the most biased judge I have ever seen. I've watched and participated as a juror in civil trials before, so I do understand how they are supposed to work. I'm wondering if there is an underlying cause for this judge's blatant bias. Keep in mind that it has taken the plaintiff five years of legal wrangling (and costs) to even get to this trial. Methinks the defendants doth protest too much. I hope the jury sees through the shenanigans.

    Every time I go to a doctor, I feel like to them I’m just a chart. I went to one doctor and the whole time he stared at the computer screen and asked me questions and then wrote a prescription and was done. Said a nurse will be in with your paperwork. I was like WOW!!

    The specialist pain doctor is phenomenal! Absolutely loved him! He explained everything so so well. I’m shocked the defense didn’t settle knowing this guy was going to testify. He just won the case in my opinion.

    I don’t know if any of the attorneys are trolling these comments, but if they are - to me, what seems to be getting lost is the fact that they did NOT got to ACH for treatment of CRPS. They went there for the stomach pain. Pain which should have been properly evaluated & treated but was not. ACH went down the CRPS rabbit hole because the mother was trying to advise what worked best for Maya’s individual situation. They did not need a referral for CROS treatment, they needed abdominal pain evaluation and treatment. Everything else that happened is because of the rabbit hole ACH went down. Someone should be sure to point this out!!

      2015 was when the Ketamine coma induced treatment from Mexico was provided and Maya was in a wheelchair. Thereafter. Why dher pediatricians didn't overrule any underlying medical first before subjecting a 10 year old to experimental treatment in Mexico. Should be the real concern?

      @@jenben9686 Being an enlightened/somewhat aware patient to modern medicine is not too different from being on trial. You can't tell them to do without evidence, and it's easier, as the defendant/patient to only intervene when incompetence tries to ruin everything.

    The defense questioning of Dr. Chopra looked bad and only bolstered the prosecution's points. First he pointed out that Maya was in pain caused by emotional stress and turmoil and it didn't improve under John Hopkin's care. The pain didn't improve when John Hopkins removed the mother and family from the child under suspect of MBP. It wouldn't have taken 3 months to determine if the mother or family was the cause. If MBP was an issue, the child would have improved within days or weeks during the separation testing period. The separation testing period shouldn't last months. The hospital labeled the mother an abuser, kept the family separated under those false allegations, which caused unnecessary and further stress and emotional trauma to the family.

      yep. maya was still in that wheelchair for at least a year when she returned home, too. if it was mbp, she would have gotten better in a matter of weeks.

      Just an FYI - there was no prosecution in this trial.
      Prosecution is a criminal concept, and applies only to such cases. They prosecute on behalf of the government, and such cases result in guilty or non-guilty verdicts in relation to *charges*.
      This was a civil trial and in such, the opposition to the defence is referred to as the plaintiff. The plaintiff is the accuser, and the person who files the lawsuit. It instead determines the liability of the defence in regards to the actionable claim(s). :)

    That dr was the best witness yet! He was matter of fact, smart, and told the facts the way the jury could understand. This jury is crazy to not side with the family. I can’t believe that now on top of everything else, Maya was SA’d at the hospital!! Wtf is wrong with these people???? This hospital should give her her money and call it a day. I am appalled.

    Dr. Chopra seems like an amazing dr and person. He really made what could have been boring testimony interesting and fun. I will say tho I have personally known people addicted to ketamine. Both physically and mentally who did suffer withdrawal. Actually one who overdosed and died from ketamine. And he would get horrific stomach pains when he wasn’t on it. Curious to see if that’ll get brought up by defense.

      Taking medically supervised treatments of ketamine is very different from someone not in a medical setting taking ketamine. I highly doubt someone in the hospital having it administered is going to overdose on ketamine. Also, I would assume the weening off of ketamine medically supervised would also be quite different. I just don’t think it’s the same thing.

    This trial would go so much quicker and smoother if all the objections and admissions of evidence would have been taken care of before it started. I know that process is determined by the court, but my comment reflects my opinion of the judge. 🤷🏼‍♀️ Also, the lawyers could have been more organized.

    I don't think it is really about the money for this family. Of course they deserve it. To me it is more about bringing an awareness of what happens with CRPS patients. I have a 17 year old student with EDS and CRPS and the parents have been treated in a less than stellar manner. These children are suffering.

    So sad the woman on the hospitals side is sitting I. The back row grinning and smiling when the cross exam the doctor. How could you be smiling happy or even proud of defending what that hospital and all the nurses doctors everything everyone involved did. It’s so sad.

    God bless this man!!!! I didn’t realize Maya likely has Ehlers-Danlos Syndrome too! I have Marfan Syndrome and Vascular Ehlers-Danlos Syndrome. It is so painful, I will be on pain meds for the rest of my life. I have Multiple Sclerosis too and it’s so bad I needed experimental treatment that thankfully the USA was able to give me due to gray areas, but most have to go to Mexico to get what I did just like Maya. It’s tragic, the sad thing is they do these treatments every single day for cancer but yeah. Poor Maya, I pray the jury delivers justice!

      I definitely think some of it is smoke and mirrors. This is an attorney with countless awards, including one of 'the best lawyers in America'. I have watched him come across as flustered and possibly lost & then, seconds later, kill it. I think he's brilliant.

    Not only did they not treat her but they mistreated her He just win the case for her. He laid out timeline getting better and bam JHACH all of a sudden didn’t believe her stopped all treatment. For me also amazing seems no doctor really did compressive exam of maya. And saying psychologically but didn’t even give her treatment for that.

    The lead attorney for Maya has an awkward speaking style. He often hesitates and changes his mind at the start of questioning his witnesses. He sounds whiny. Obviously cares for Maya and her family, but difficult to listen to him and understand his point. Hope it doesn’t adversely affect the jury.

    The point is that this mother was under the direction of amazing drs, none of which would put her daughter's life at risk. She was going by what worked and what she was given by drs. What this hospital did is disgusting. Beata was an amazing mom and as a mother myself, this case is horrendous and triggering because I know first hand how the Tampa drs are and how they and DCF treat parents. It must be stopped! Every penny is what I hope they get. Every fuxxing penny.

    I’m starting to like the judge compared to how he was kind of acting at the start of the trial. I’m not sure if he had to put on a hard face to avoid an appeal that he was biased or what, but he’s growing on me, and seems more fair to both sides now which is great to see!

    Wow just wow on that pain doctor. And oh my the drastic change in her temps in the different part of her body. That's like taking a scan and diagnosis of cancer to me there's no question. And John Hopkins didn't do temps test?? Crazy are they not supposed to be the best of the best on children's illnesses. Her inverted feet showed the child was not faking it. I hope they get the full amount because these big corps that's the only way to punish they all actually should be charged criminally
