      I am sure someone has considered that Kristin could have had her drink spiked instead of assuming she consumed enough alcohol to pass out on someone’s grass. The police are taught to never assume anything. They can’t run a tox screen on Kristin. So intoxication could be either alcohol she willingly drank or it could be something else that was secretly put in her drink. Had creepy Flores been at the parties Kristin drank in? Hmmm. I remember this case well. I lived in Santa Barbara then. It was such a sad case. I am sure the Smart family are wonderful people and they deserve answers.

      Did everyone miss Dr. Grande’s point? The campus police were too busy slut shaming the dead victim then focusing on the obvious foul play. Getting drunk does mitigate Paul’s blame for rape/murder. You don’t need to be Sigmund Freud/Sherlock Holmes to understand. It seems like Penguin Freud is above the pay grade above here.

      @LDiamondz 4 ปีที่แล้ว +2

      @@LDiamondz I guess the difficult part from the cops point of view is that if there is going to be a group of people that are completely unpredictable, flaky, loose and spontaneous, it is going to be campus living college students. It of course doesn't mean she was any of these things but I have a feeling they compromise on how quickly they rush into something that appears odd because it would happen daily. Still, it seems they were to slack.

      In my kids school was one boy, when he and his friends went to a bar, they didn’t let him in. He body was found in deep water a week later.
      A girl on her way home took a short cut through a building site, leaned against a low railing, fell over it about three meters, died probably immediately. They were 17 and 18 years. The boys friends could have put him in a taxicab and paid in advance. Stockholm is no big, would have been safe.

      Yup. My parents did the same for me as I got into my early 20s. It wasn’t bout gender or what was more or less likely to happen. It was ‘drunk people are not in the place to handle sudden emergencies.’ Doesn’t matter if your friend is a 6’4, 200 lb dude. He could go on a drunken stroll, pass out on train tracks, and get hit. He could magically find a set of keys, drive somewhere, and kill a whole family in an accident. He could fall off a balcony and have brain damage, or he could meet an even bigger, stronger, more coherent dude just looking to hurt someone. If they are pitching a fit about being babysat, let them tantrum themselves out while you stand your ground, like you do with a toddler. They’ll fall asleep/pass out soon enough. Make sure they are not critical and can’t get hurt in their sleep, and enjoy watching them in silence. Get a damn baby monitor if you must. We always had the DDs stay at the parties for that reason. Obviously, drunk people need supervision.

      I understand that sentiment, but it's easier to be brave in the youtube comments section than to be a woman late at night getting groped by a creep. She was likely terrified and bolted. While everyone would like to think they'd be brave in situations, you just don't know what you'd do. I'm a 6' 220 pound dude, but I am trying to put myself in her situation. And she is likely tormented to this day. I feel badly for her.

      It sounds like she was scared of him and she had to protect herself as well. It’s understandable that she may not have wanted to risk her life to protect someone she didn’t even know. She definitely could have alerted campus police after she got away or something like that, but I don’t think that it’s fair to expect her to have stayed there and potentially fight this guy off.

      Especially the lie. If he got them the same way any young man gets a black eye, they got into a fight, you would just tell the cops that you got into a fight. You may be concerned about telling police due to fear of been charged for assault or something, but I don't think so.

  • @whoever6458
    @whoever6458 4 ปีที่แล้ว +89

    I think the cops used the fact that she happened to be drunk when something bad happened to her to dismiss the entire value of her life and not take her disappearance and likely murder seriously. People are allowed to drink and, while she may have been drinking underage, it's a big problem if the police are blaming victims just because they were drunk. In medicine, we're not allowed to ignore patients just because they're drunk. We even treat drunk drivers who have killed a bunch of people because it's our job. Likewise, it is the job of the police to investigate crimes even if the victim hurt someone else while drunk and then was subsequently hurt themselves. If you're investigating her disappearance, her alleged intoxication level doesn't matter and it's also important to note that, since they haven't found the body, they actually don't know what her level of intoxication was.

  • @gerardacronin334
    @gerardacronin334 4 ปีที่แล้ว +350

    While Smart’s behaviour was clearly not smart, she could not be held responsible for her own disappearance and murder. The police bias here was “she had it coming”. Shameful.

      She wasn’t a big drinker. She was most likely drugged by Paul. She was also over 6 feet tall. She didn’t have time to consume the amount of alcohol she needed to be falling over drunk between when her roommate left and the witnesses saw her.

    • @stt5v2002
      @stt5v2002 4 ปีที่แล้ว +8

      @@Ariel-ck9he You need to avoid making these types of cognitive errors. You are asserting the following. That although she was known to be drinking heavily and behaving exactly as is common under that circumstance, another cause was present. And that the cause was being drugged, specifically. And that you know exactly who did it. While your scenario is not disproven, it is not even close to likely.

      They really do. You have to use the buddy system, and know your limits with alcohol, and never leave a friend alone. I’d also add stay far away from frat parties too, but that’s because the frats at my college were trash. One got shut down because they were covering for a member who repeatedly raped drunk girls at their parties. And that’s not even getting into the hazing.

      YES! My friend who is a very sweet and insecure girl was once at a party with her friends and got drunk after some time. While looking for one of her friends, a random guy came and asked her who she was looking for. He told her he knew where her friend was and lead her away from the others and somewhere more dark. She was oblivious to his attempt and left as she didn't think her friend was there. It could've gone wrong in so many ways.

    People at the party testified that she was not drinking heavily and she was not drunk when she got to the party. At the end of the party, she’s lying comatose on the front lawn. Paul Flores comes out of nowhere to escort her back to the dorm (she can barely walk) and insists that he can handle it alone. Paul then shows up with a blackeye and lies about it. On the podcast, a student working late in the library sees them struggling together in one of the dorm lobbies although this did not come out in trial. Later, there are numerous women who testify that he drugged and raped them. The pattern is clear. There might may not be a smoking gun in this case, but there are numerous pieces of evidence that when gathered together point to his guilt.

    I remember seeing flyers about her missing around San Luis Obispo back then. During that time period, (give or take a year or so, I think) there were 2 more young women (also local college students II believe) who vanished from the SLO area, and seeing their flyers, too. I had lived in nearby Atascadero a few years earlier, then, and my daughter was little, and I found it extra chilling and disturbing, having my own child. As it came out, they found the bodies of 2 of the missing girls (Aundria Crawford and Rachel Newhouse) on the property of a parolee near Avila Beach named Rex Krebbs, who was convicted and sentenced to death. Kristen Smart was never found, but I'd always suspected the same killer of the other women might've also been responsible for her death... You know what natural and appropriate consequences would be for a young adult who drank too much and got flirty at a party? A hangover and an awkward encounter with one of the people they were flirting with once you both sober up. Maybe you stumble around the block with your hangover in full swing, looking for your right shoe, or you find that one of your friends wrote a swear word or drew reproductive organs on your face with a sharpie, and they all claim they don’t remember that happening. At absolute worst, you pee your pants. Murder is not an appropriate or natural consequence for something every young adult does at least once (ie: drink more than you should have at a social event), yet law enforcement acts like it is, for young women. ‘She knew it was dangerous for women to do that.’ Yeah, here’s the thing. We get conflicting messages about our safety our whole lives. We hear ‘don’t walk down the street at night,’ but then those same people turn around and say ‘I don’t get why you need a ride at 11pm for a mile walk. You’re being dramatic again’ when we ask for assistance getting home safe. When someone crosses a line with us or makes us uncomfortable we get told we are too mean for simply saying ‘I’m not interested’ or ‘no thank you’ to these creepy-seeming men when they ask us out. So we stop knowing whether or not we might be in danger. Then we get closer to our roommate, and she opens up about the time she did everything the world tells you will prevent you from getting assaulted, but still ended up being violently attacked by someone she knew for years, who told her ‘let me walk you home so you are safe.’ We stop trying to do the impossible task of pleasing everyone, and guessing what the hell we should or shouldn’t do to reason with an unstable and violent person who does not operate reasonably. We decide we want the same benign and normal experiences that guys have, and usually it works out fine, but once in a while it gets dangerously close to not working out for us. In some cases, it doesn’t work out for us at all, and our lives are ruined, if not over. We just couldn’t read the minds of every person at the party to see who was considering an act of violence. We couldn’t predict the future and avoid certain people. The common denominator isn’t anything the victim did. It’s always the violent predator, because nobody gets raped or murdered if there are no rapists or murderers around.

    Oh-bis-po is how it's pronounced. Thanks for covering this. Walking home drunk from a party was common at Cal Poly as the town was small and the community and campus were relatively safe. Once they reached the dorms, the perceived level of danger was diminished, no one expects a student to murder someone in the dorms, but sadly that's what appeared to have happened. I'm positive the people walking her home wish they would have gone the extra last bit and got her to her room and never trusted Flores. Such a sad and horrible event. I'm thankful that it looks like finally there is some hope of justice taking place after all these years.

    At approximately the same time Rex Allen Krebs ( a sex offender on parole) was active in this area, although he wasn't paroled until 97. He was arrested for two abduction/rape/ murders that have some similarity to this case. It is reminiscent of the plot of Promising Young Woman.

      @@LDiamondz Actually, it really is a lovely area. It's a very small city located in an area of abundant wilderness. However, it's a college town. Unfortunately kids away from adult supervision for the first time, perhaps overdoing it with experimental substance use, or living in substandard unsafe rentals or without reliable transport do become victims to these sorts of offenders.

      Those cases are not similar at all. Other than the fact that the two girls Krebs tortured and murdered were college students. Rex Krebs wasn’t a student. Krebs sought out those poor young girls. It is crazy though to think it happened in SLO. I live 10 minutes west of Cal Poly.

    • @evelynwaugh4053
      @evelynwaugh4053 4 ปีที่แล้ว

      @@DCBabos The similarities are : all victims are college students and all victims of opportunity. All were kidnapped, i.e. there is no known crime scene, they were removed to another location. And all bodies were hidden. Most sex crimes do not involve kidnapping, it is much riskier. If there is a murder, generally the victim's body is located at the crime scene, usually the street or victim's home. Body disposal often indicates a more sophisticated and experienced perpetrator. So these 3 crimes are actually quite similar. If Krebs wasn't in custody at the time, he would have been looked at for this one.

    In my experience “Campus Police Departments” suffers a conflict of interest. They are in service to the University Administration first and foremost before the public and their main prerogative is to cultivate a show of security, when needed quickly quell situations that might make the school look unfavorably but most of the time traffic and parking enforcement. IMHO University Police should be allowed to focus on the latter and be absolved of any investigatory powers because their situation is inherently biased.
