Hello Sir.. I’m Cathrine Gomes from Bangladesh and I always try to watch your all videos. These are really helpful and the way you teach seems very interesting to me. I’m really grateful for your efforts Sir. Hope that I will be able to know so many things from you.. Stay good and healthy Sir 😊
Sir, under O21, R-3: if the land is situated within the jurisdiction of two courts, then each court is entitled to attach Or sell the only that part which is within the jurisdiction of that court Or sell or attach the whole property.
Mujhe unless before the determination of such attachment the decree has been transferred to the Court by which the attachment has been made and the decree-holder has applied for an Order for the sale of such property. Eska mtlb ni smjh lga
Thank you sir for this lecture. ❤️🙏 Sir Rule 3 me any court likha hai eg agar 2 acre land A court ke jurisdiction me hai aur 5 acre land B Court me. Yaha par likha h anyone of such court may attach and sell the entire estate and tenure hai to kya ab A court 5 acre land ko attach ya sell kar sakta hai kya plz reply sir
sir agar judgement debtor decree holder to aadha paisa deta hai aur aadhe paise pe interest agar baad me decree holder ne aadha paisa lene se mana kiya, toh kya remaining half money par interest pay karna hoga & payment is made according to rule 1 of order 21? please bataiyen and sir rule 2-A ke clause c mein judgement on admission ho sakta hai or order 14 ke according issue frame hokar trial ke liye jayega? please clarify this also
Ssa sir, rule 9 m words 'ordinary original civil jurisdiction' par thoda discuss kar lete. 2(4)District ki definition m words bhi khudme confusing h. (principal cc of original jurisdiction, ordinary original cj of hc, local limits of jurisdiction)
Sir i have doubt in rule 9...why is it mentioned specially separate rule for high court..as in other case it shall de deemed for executing court as if this decree is passed by same court then why it is not supposed to be included in previous rules.
It's about the power given to executing Court that whenever a decree is sent to him for execution it must consider that the decree is passed by him, and by presuming so CPC gives wide power to courts. Moreover it's not about high court only this concept is same for all courts
sir if there is a dispute regarding the amount to be paid in execution, can a court hold inquiry, if so under what provision? would such inquiry be barred under section 47? please reply

is that mean high court can't transfer decree for execution to its subordinate court?(RULE9)
Sir, under O21, R-3: if the land is situated within the jurisdiction of two courts, then each court is entitled to attach Or sell the only that part which is within the jurisdiction of that court Or sell or attach the whole property.
Only the property falling under his jurisdiction can be attached otherwise they have to send it to others jurisdiction for it's attachment
@@harpreetsinghkahlon2827 thnks guru ji
But it says...any one of such courts may attach and sell the entire estate or tenure.
No, if the property falls under the jurisdiction of other district then there is a procedure to be followed by court,
In general it can't
Thankuuu sir 🙏
