Sir I have a question : A sues B for a declaration of title to land and obtains a decree. A then sues C for possession. C's Contention is that B is the real owner and C is in Possession as a tenant of B. Discuss the validity or otherwise of the defence.

Hi, Sir Can execution proceedings be stayed by third party if during the pendency of suit plaintiff signed an MoU cum agreement to sell with third party. Or can third party can be made necessary party in the execution proceedings .if yes please help.
Sir cost of appeals means ?? Nd rule 9 mai it is mentioned .. court from whose decree an appeal lie shall...means trail court which has passed decree will register or the court to whom appeals lies will regester? ...i have confused with bare act language in rule 9
If court do not reject the application and wants the reply of respondent on the application for condonation of delay, then court give notice to respondent and after taking the reply first adjudicate it and then proceed with suit
Rule 9 : there is a misprint in our bare act Starting words " The court from whose decree an appeal lies " Are not right.. As it means the court decree passing decree.........Rightly it goes " Appellate court Or proper officer " .... As I found on net
Sir my mother appealed (for her mother property case) in district court, after partition how the property distributed among 6 siblings. 1) one small home 2) 4 acre land Questions: 1) how home will distributed for judgement 1/6 th each 2) how land will distributed for judgement 1/6th each I mean to ask how or who will decide which portion of land belongs to whom. (Upper, middle, lower) on what basis distribution takes place please reply sir. Waiting for your response Thank you

Sir for stay of execution proceeding the application is to be filled at appellate Court or decree court or executing Court?
Sir what is the difference between furnish security and deposit security?
Furnish security is a word used in the legal term whereas deposit security is a normal word even used for the transaction outside the Court
