Sir... Sec. 42(4)(a) में जहाँ तक मैंने समझा है की transferee decree का execution नहीं करा सकता लेकिन Order 21-Rule 16 में बोला गया है कि transferee application move कर सकता है execution के लिए! Please clear it!
When there is a transfer of a decree either by operation of law or by mutual private arrangement such decree can be executed by transferee after permission is granted under order 21 rule 16 of CPC. ... Under such circumstances notice has to go not only to the transferor decree holder but also to all the judgment debtors. Word after permission is written which means in a general transferre is not to execute the decree. So transferre court can't execute the decree unless transferre obtain the permission from the transferor court.
Execution me time to lagta hi he, but if the opposite party is willing to pay then it's ok, otherwise if the party is willing to take objections then it takes time, but in the end it's the discretion of the judge
